Within the class of indexicals, a distinction is often made between “pure” or “automatic” indexicals on one hand, and demonstratives or “discretionary” indexicals on the other. The idea is supposed to be that certain indexicals refer automatically and invariably to a particular feature of the utterance context: ‘I’ refers to the speaker, ‘now’ to the time of utterance, ‘here’ to the place of utterance, etc. Against this view, I present cases where reference shifts from the (...) speaker, time, or place of utterance to some other object, time, or place. I consider and reject the claim that these counterexamples to the automatic indexical theory all involve non-literal uses of indexicals and argue that they cannot be explained away on the grounds that they involve conversational implicature or pretense. [EN] In this paper, I offer a content–pluralistic account of the meaning of the first–person plural pronoun «we», building upon John Perry’s view on indexicals and demonstratives. I argue that unlike «I», «we» is not a pure or automatic indexical: i.e., it is an indexical whose referents are partly determined by the speaker’s intention; and that it’s not wholly discretionary either, since its character or meaning does require that the speaker be part of its referent. In this sense, (...) «we» is not just the plural counterpart of «I», but is closer to «now» and «here». I consider an alternative approach defended by Vallée that takes the meaning of «we» as reducible to the meaning of «I» plus the different combinations of «you» singular, «he/she», «you» plural, and «they». I argue that, other things being equal, a basic economy principle of meaning favors my approach, and that the cases of co–reference and anaphora posed by Vallée himself and Nunberg are better explained by it. Besides, I discuss seemingly non referential uses of «we», as in Nunberg’s cases of «we [the condemned prisoners]», in which besides referring to herself the speaker does not seem to have any other particular individual in mind to whom she intends to refer. I contend that my approach provides a natural account of these cases. Defiendo que a diferencia de «yo», «nosotros» no es un indéxico puro o automático, puesto que su referencia se determina en parte mediante la intención de la hablante; y no es enteramente discrecional, ya que su carácter o significado requiere que la hablante sea parte de su referencia. En este sentido, “nosotros” no constituye la mera contrapartida plural de «yo», y está más cercano a «aquí» y «ahora». Además, discuto una teoría alternativa propuesta por Vallée, que reduce el significado de «nosotros» al de «yo» más las distintas combinaciones de «tú», «ella», «él», «vosotras/vosotros» y «ellas/ellos», para concluir que principios básicos de economía y simplicidad teórica hablan a favor de mi propuesta, y que los casos de co-referencia y anáfora aducidos por el propio Vallée y Nunberg también se explican mejor mediante ella. Finalmente, considero supuestos casos de usos no referenciales de «nosotros», como los que presenta Nunberg, en los que la hablante no parece tener la intención de referirse a ningún individuo en particular aparte de sí misma. We investigate whether air pollution harms business ethics from the perspective of earnings manipulation, which exerts a real effect on the economy and social welfare. Using a large sample and a comprehensive air quality index in China, we find that firms located in cities with more severe air pollution exhibit higher levels of discretionary accruals and are more likely to restate their financial statements, consistent with exposure to air pollution leading to more earnings manipulation. We further provide causal evidence (...) using propensity score matching and a discontinuity regression design exploiting the Qinling Mountain–Huai River Heating Policy Line, which exogenously leads to more air pollution to cities located immediately north of the Line but not those in the south. Our findings are robust to controlling for weather conditions and alternative samples and measures of air pollution and earnings manipulation. Overall, this study unveils how the ecological environment shapes business ethics. (shrink)

It is widely though not universally accepted what speakers refer to in using demonstratives or “discretionary” (as opposed to “automatic”) indexicals depends on their intentions. Even so, people tend not to appreciate the consequences of this claim for the view that demonstratives and most indexicals refer as a function of context: these expressions suffer from a “character deficiency.” No wonder I am asked from time to time why I resist the temptation to include speaker intentions as a (...) parameter of context. So I thought it would be a good idea to compile some of the scattered statements of my main reasons for this evidently radical view. (shrink)

We empirically analyze the impact of economic uncertainty due to the COVID-19 pandemic on the trading volume of each sector in the S&P 500 index. Wavelet coherence analysis is carried out using economic policy uncertainty data and the trading volume of each sector in the S&P 500 index from July 2004 to September 2020. Furthermore, we apply multifractal detrended fluctuation analysis to the trading volume series of all sectors. The wavelet coherence analysis shows that the COVID-19 pandemic has substantially influenced (...) trading volume in all sectors. However, the impact of the pandemic is different from that during the global financial crisis in some sectors, such as information technology, consumer discretionary, and communication services. Because of the lockdown taken to suppress COVID-19, increased remote working and remote learning are the main reasons for these results. Additionally, according to the MF-DFA analysis, the trading volume of all the sectors has clear multifractal characteristics, and they are all nonpersistent. Specifically, trading volumes of the real estate and materials sector are highly correlated, whereas the trading volumes of industry and information technology sectors are comparatively less correlated. A healthy work-life balance has become increasingly important to people trying to cope with the pressures of contemporary society. This trend highlights the fallacy of assessing well-being in terms of finance alone; how much time we have matters just as much as how much money. The authors of this book have developed a novel way to measure 'discretionary time': time which is free to spend as one pleases. Exploring data from the US, Australia, Germany, France, Sweden and Finland, they (...) show that temporal autonomy varies substantially across different countries and under different living conditions. By calibrating how much control people have over their time, and how much they could have under alternative welfare, gender or household arrangements, this book offers a new perspective for comparative cross-national enquiries into the temporal aspects of human welfare. This paper advances the thesis that sensory concepts have as a semantic component the first-person indexical. It is argued that the private nature of our access to our own sensations forces, in our talking about them, an indexical reference to the inner states of the speaker in lieu of publicly accessible properties by which reference is usually fixed. Indexicals, such as ‘here’, can be understood despite ignorance of their referent. Such is the case with sensory terms. Furthermore, the thesis (...) that sensory terms are indexical has considerable explanatory power. I give two examples: firstly, I argue that clashes of intuition over Block's ‘inverted spectrum’ thought experiment can be explained by appeal to semantic properties of indexicals. Secondly, I argue that multiple realisability intuitions can be shown to be consistent with the view that sensations are type-identical with brain states. (shrink)

This paper is about time preferences, the phenomenon that the very same things are usually considered the less valuable the farther in the future they are obtained. The utilities of those things are discounted at a certain rate. The paper presents a novel normative argument for exponential discount rates, whatever their empirical adequacy. It proposes to take indexical utility seriously, i.e. utilities referring to indexical propositions (that speak of ‘I’, ‘now’, etc.) as opposed to non-indexical propositions. Economic focus is only (...) on the latter, while the former are neglected. The potential ignorance of when is now generates a difference between indexical and non-indexical utility that can be exploited for a novel argument in favour of exponential discount rates. (shrink)

The article analyzes the system of legal regulation of the higher education in Lithuania with the purpose to determine the boundaries of exercising the discretionary powers of the executive institutions in the field of higher education. The article is made of two parts. Discretionary powers of the executive institutions in legislative field are discussed in the first part. The power of legislative discretion is described as a right to set the legal regulation by way of a subject who (...) is granted such discretionary power. Problems may arise in cases when the law granting such discretionary powers is too abstract or declarative. The main criteria in determining the boundaries of exercise of discretionary powers are the provisions of Constitution and laws, and constitutional law principles. The system of delegation of legislative powers in the field of regulation of the higher education in Lithuania is analyzed in the second part of the article. The permanent changes in administrative legal regulation of higher education and studies determined by a vast amount of subjects issuing post-legislative legal acts in this field, as well as rather tedious legal regulation which, in turn, calls for frequent changes in legal acts, raises doubts regarding a possibility to implement main principles of the studies, such as freedom of creation and scientific research or academic freedom and autonomy. Being able to ask others to do things, and thereby giving them reasons to do those things, is a prominent feature of our interpersonal lives. In this paper, I discuss the distinctive normative status of requests – what makes them different from commands and demands. I argue for a theory of this normative phenomenon which explains the sense in which the reasons presented in requests are a matter of discretion. This discretionary quality, I argue, is something that other theories (...) cannot accommodate, though it is a significant aspect of the relations that people stand in to one another, and the kinds of practical reasons that flow from those relations. This paper explores the relationship between the bonds of practitioner/patient trust and the notion of a justified lie. The intersection of moral theories on lying which prioritize right action with institutional discretionary power allows practitioners to dismiss, or at least not take seriously enough, the harm done when a patient's trust is betrayed. Even when a lie can be shown to be justified, the trustworthiness of the practitioner may be called into question in ways that neither theories of right (...) action nor contemporary discourse in health care attends to adequately. Indexicals are linguistic expressions whose reference shifts from context to context: some paradigm examples are ‘I’, ‘here’, ‘now’, ‘today’,‘he’, ‘she’, and ‘that’. Two speakers who utter a single sentence that contains an indexical may say different things. For instance, Fred and Wilma say different things when they utter the sentence ‘I am female’. Many philosophers (following David Kaplan 1989a) hold that indexicals have two sorts of meaning. The first sort of meaning is often called ‘character’ or ‘linguistic meaning’; (...) the second sort is often called ‘content’. The administrative practices of officials who process the admission of immigrants show severe variations in the ways in which migration policy is enforced on the ground. For the author, inequality of treatment lies in the very hierarchy of tasks and services of what he dubs, following Pierre Bourdieu, the immigration "field". According to the author, the governments’ securitizing priorities favour the sort of suspicion towards foreigners that the media then reproduces, thus authorizing so-called street-level bureaucrats to act with great leeway (...) with regard to immigrants. Under pressure, governments implement what the author calls a "trompe-l’oeil policy" that explores the ambivalence between international and domestic law: while the state enforces repressive laws that apparently comply with fundamental human rights, it leaves to low-ranking civil servants enough discretion to make those rights ineffective. This point is the author’s central contention. The arbitrariness of these officials is neither contingent nor accidental: it actually constitutes a purposive "front-line policy" to enlarge the discretionary power of street-level bureaucrats in charge of regulating admissions. Unequal treatment comes in three flavours in this context. First, officials are asked to ensure that each right granted to a foreigner will not threaten the national order, which means the economic, social and political order. They are therefore in a position to judge the suitability of each application in view of their own arbitrary interpretation of what such "threats" consist of. The question of discretionary power is in this way intimately linked to the problem of equality before the law. Second, the scarcity of material and human resources allocated to services in charge of welcoming migrants starkly contrasts with the expenditure incurred to deport foreigners. Inequality also arises from how agents perceive users and the leeway they have to implement the law. Third, inequality is related to foreigners’ abilities and means to challenge discretionary power, especially through the legal tools they use or through legal intermediaries. The author thus concludes that such "front-line policy" has increasingly been used as a weapon against migrants, especially since the early 2000s, when immigration and detention policies were generalized in France. More broadly, in Europe as well as in United States, immigration reforms have made greater use of detention and focused on enforcement rather than on hosting programs and services for asylum seekers. But they have also strengthened the role of legal intermediaries. Hence the need to investigate how discretionary power is challenged as it sheds light on the power relations between states and migrants. This paper offers a theory of spatial indexicals like _here_ and _there_ on which such expressions are variables associated with presuppositional constraints on their values. I show how this view handles both referential and bound uses of these indexicals, and I propose an account of what counts as the location of the context on a given occasion. The latter is seen to explain a wide range of facts about what the spatial indexicals can refer to.

How does the term ‘free will’ refer? This question seems to lie at the center of debates about whether the attitudes and practices that depend on our successful attributions of basic-desert-entailing moral responsibility ought to be preserved or eliminated. In this paper I tackle questions about the way that different reference-fixing conventions might inform disagreement between preservationists and eliminativists about free will and moral responsibility, and argue that even recent elimination-friendly work on reference fails to offer much real support for (...) eliminativism. In fact, making explicit the role that different motivating concerns play in rendering certain reference-fixing conventions operative for eliminativists and preservationists suggests at least one powerful reference-based argument in favor of preservationism. Reichenbachian approaches to indexicality contend that indexicals are "token-reflexives": semantic rules associated with any given indexical-type determine the truth-conditional import of properly produced tokens of that type relative to certain relational properties of those tokens. Such a view may be understood as sharing the main tenets of Kaplan's well-known theory regarding content, or truth-conditions, but differs from it regarding the nature of the linguistic meaning of indexicals and also regarding the bearers of truth-conditional import and truth-conditions. Kaplan has (...) criticized these approaches on different counts, the most damaging of which is that they make impossible a "logic of demonstratives". The reason for this is that the token-reflexive approach entails that not two tokens of the same sentential type including indexicals are guaranteed to have the same truth-conditions. In this paper I rebut this and other criticisms of the Reichenbachian approach. Additionally, I point out that Kaplan's original theory of "true demonstratives" is empirically inadequate, and claim that any modification capable of accurately handling the linguistic data would have similar problems to those attributed to the Reichenbachian approach. This is intended to show that the difficulties, no matter how real, are not caused by idiosincracies of the "token-reflexive" view, but by deep facts about indexicality. (shrink)

It is widely agreed that the references of indexical expressions are fixed partly by their relations to contextual parameters such as the author, time, and place of the utterance. Because of this, indexicals are sometimes described as token-reflexive or utterance-reflexive in their semantics. But when we inquire into how indexicals help us to identify items within experience, we find that while utterance-reflexivity is essential to an interpretation of indexical tokens, it is not a factor in a speaker's identificatory (...) use of indexicals. Tokens cannot be interpreted unless they are first produced, and obviously the speaker who produces them does not depend upon utterance parameters in order to identify their referents in the way that hearers do. Consequently, the standard reflexive accounts of indexicals are of little use in explaining the speaker's identificatory use of indexicals, and must be either replaced or complemented by a further theory of the role of indexicals in thought. This paper provides an account of indexical identification that is attentive to a speaker's as well as a hearer's identification and reveals how indexicals are inextricably perspectival. (shrink)

When is state coercion for the provision of public goods justified? And how should the social surplus of public goods be distributed? Philosophers approach these questions by distinguishing between essential and discretionary public goods. This article explains the intractability of this distinction, and presents two upshots. First, if governments provide configurations of public goods that simultaneously serve essential and discretionary purposes, the scope for justifiable complaints by honest holdouts is narrower than commonly assumed. What characterizes indexical thinking is the fact that the modes of presentation through which one thinks of objects are context-bound and perspectival. Such modes of presentation, I claim, are mental files presupposing that we stand in certain relations to the reference : the role of the file is to store information one can gain in virtue of standing in that relation to the object. This raises the communication problem, first raised by Frege : if indexical thoughts are context-bound and relation-based, (...) how is it possible to communicate them to those who are not in the same context and do not stand in the right relations to the object? Following Frege, I argue that the solution comes from an important distinction between linguistic and psychological modes of presentation. Psychological modes of presentation are mental files. They are perspectival and context-bound. But linguistic modes of presentation are fixed by the conventions of the language and they are shared by the language users. They are public and serve to coordinate mental files in communication by constraining them to contain the piece of information they encode. In this way communication takes place even though the indexical thoughts entertained by the speaker are, in some sense, private and cannot be shared by the audience. (shrink)

What are the possible profiles of an indexical shifting language, and why do we find these profiles and not various equally conceivable others? Drawing both from the literature (published and unpublished) and from original fieldwork on the language Nez Perce, Amy Rose Deal puts forward several major generalizations about indexical shift crosslinguistically and present a theory that attempts to explain them. Charles Travis influentially argued in “The Silence of the Senses” that the representational theory of perceptual experience is false. According to Travis, the way that things look cannot index the content of experience as the subject of the experience cannot read the content off from the way things look. This looks indexing is a central commitment of representationalism. The main thrust of Travis’ argument is that the way things look is fundamentally comparative, and this prevents the subject from reading a (...) single content off from the way things look. If content were looks indexed, the subject would be able to do this. I argue that Travis’ argument rests on an illicit transition from an argument about the way objects look in themselves—i.e. an argument about the visible properties that they have—to a conclusion about the way that objects look to subjects in experience.
