Among the most enduring taboos, those related to the human body are the most enduring, throughout history. Be it its re/presentation of exploration, it constituted for most cultures and epochs a very sensitive subject, ever evolving and changing, but perennially raw and open to debate and discussion. With the advent of new technologies sustaining and infiltrating society, the body is seen, explored and represented in new ways that can be, simultaneously, interpreted either as transgressive or respectful of taboos, depending on (...) the point of view or the current social norms. The question is: are we able to transcend transgression of taboos through our work or are we still far from achieving it? Our tools are computer-generated simulations based on patient-collected data. Building our arguments on Foucault’s Birth of the Clinic (1973) analysis, we approach the evolution of our own research as a ‘case study’. In the age of the life-support, stem-cell therapy and 3D organ printing, is computer simulation mimicking or mirroring organic life and phenomena, or is it creating a debatable simulacrum? From reducing the human body to a series of equations that lead to depersonalization and loss of self, to tailored modelling based on patient-collected biological data, the computer simulations took a variety of guises. At each point of the way, confronting the taboos, conventions and through controlled transgressions of established rules, we strived to transcend all historic limitations and update, adjust and fine-tune the technology and its uses to better suit the clinicians’ pursuits. In this article, we explore the tension between truth telling and the demands of civic life, with an emphasis on the tension between serving one's country and reporting the truth as completely and independently as possible. We argue that the principle of truth telling in journalism takes priority over the promotion of civic values, including a narrow patriotism. Even in times of war, responsible journalism must not allow a narrow patriotism to undermine its commitment to truth telling. Journalists best fulfill (...) their civic role by adopting the perspective of a democratic patriotism. We conclude that if news organizations accept the primacy of truth telling and democratic patriotism, they should not embed reporters with military units, or if they do, they have an ethical obligation to implement special editorial precautions. This article argues that the formally similar conceptions of political authority provided in Oliver O’Donovan’s Resurrection and Moral Order and The Desire of the Nations appear to assume different ontologies of political authority. The former account conceives political authority as a special use of natural authorities found in the created order, where ‘authority’ is defined as what it is that evokes free and intelligible human action. The latter account, however, appears to attribute the existence of political authority exclusively to (...) divine providence. I contend that these two accounts of political authority are ostensibly in tension. I also argue that O’Donovan’s subsequent ‘providentialist’ account of political authority is unable to explain how political authority can evoke free and intelligible action in political communities. I maintain that O’Donovan can remove this apparent tension by returning the essence of political authority to creation, as he did in Resurrection and Moral Order, and then regard the Christ-event as redeeming political authority rather than merely restricting its historical function to judgment, as he argues in The Desire of the Nations. The emergence of O’Donovan’s ‘Christian liberalism’ could then be regarded as the ‘work of divine providence in history’ facilitated by the redemption of the natural authorities in the created order. In this essay I suggest that Heidegger’s Being and Time provides a ground for ethics in the notion of Dasein’s ‘Being-guilty.’ Being-guilty is not a ground for ethics in the sense of a demonstration of the moral ‘ought’ or a refutation of moral skepticism. Rather, Being-guilty serves as a foundation for ethical life in a way uniquely suited to a phenomenological form of ethics, a way that clarifies, from a phenomenological point of view, why the traditional approach to ethics is (...) misguided. The traditional attempt to ground ethics through demonstration or refutation depends upon a misunderstanding of obligation as an imposition that is distinct from, and inflicted upon, the subject in a way that is in need of justification. Heidegger’s conception of Being-guilty, on the contrary, identifies the basis of moral obligation in a form of primary selfobligation that is constitutive of human nature, rather than an imposition upon it. Although primordial guilt or self-obligation does not justify ethical obligation, it does ‘ground’ ethics. For it is the primary source and support of our ethical activity in two distinct senses. First, it serves as the condition for the possibility of our indebtedness to others—it enables us to be morally obligated. It enables moral obligation towards others by determining Dasein as ontologically indebted to care for its own being—a being which is, in turn, ontologically determined as care for others. Second, Being-guilty provides a criterion for distinguishing what we call ethical and unethical behavior. Ethical behavior is distinguished according to the appropriateness of one’s care for the other according to proper recognition of the nature of the Other’s Being as Dasein. (shrink)

This article responds to the papers by O’Donovan, Rizvi and Heck by identifying four convergent themes emerging from their accounts of Christian and Islamic political thought: the denial of salvific efficacy to the state; the claim that political authority is legitimated and limited by law; the attribution of a normative purpose to the state; and the ascription of a positive role for the people in the legitimation and scrutiny of political authority. James Joyce’s Ulysses can be read through the prism of the New Materialist School of contemporary critical thought to shed light on ongoing questions in the humanities about the relationship between language and embodiment. Specifically, Ulysses resonates with three thematic concerns of New Materialisms: the nature of matter, the correspondence between human and animal, and the role of affect. Contra some calls for the humanities to retrench in a conservative posture that reaffirms the special status of human reason and “consciousness” (...) – corresponding to Catholic readings of Ulysses that find in Joyce a metaphysical philosopher of transcendence – New Materialisms take human continuity with animals and matter seriously. Joyce’s Ulysses, by developing robust accounts of the interactions between matter, language, and thinking bodies, offers a template for exploring this convergence, demonstrating that the human “ghost” must be understood as radically inextricable from its material body and the material formations of its world. This paper draws on Friedrich Nietzsche’s work to defend the (admittedly non-Nietzschean) conclusion that a non-liberal egalitarian society is superior in two ways: first, as a moral ideal, it does not rest on questionable claims about essential human equality and, second, such a society would provide the optimal psychological and political conditions for individual wellbeing, social stability, and cultural achievement. I first explain Nietzsche’s distinction between forms of egalitarianism: noble and slavish. The slavish form promotes equality, defined negatively as the (...) elimination of privilege. It is non-liberal in its prioritization of equality over the interests of the advantaged. Nietzsche rejects both slavish egalitarianism and liberalism for the same reasons: they questionably assume the equal value of all persons, and they harm cultural achievement, sacrificing the potential of those who are most valuable to cultural development to the interests of the majority. Noble egalitarianism, in contrast, exemplifies Nietzsche’s conception of justice as ‘equality among equals’. It demands that individuals of equal worth or power (such as members of an artistic or political elite) treat each other as what they, in fact, are: equals. It avoids asserting essential equality, demanding instead—against both slavish and liberal forms—respect on the basis of shared superiority. And it escapes the charge of harm to cultural development, commanding respect only where equality already exists. Although Nietzsche quickly assumes that ‘noble egalitarianism’ requires the rejection of all forms of universal egalitarianism, concluding that we should ‘never make equal what is unequal’, in fact it only entails the rejection of slavish methods: equalization through harm to the advantaged. However, non-liberal forms of egalitarianism can be ‘noble’, promoting equality without harm to the advantaged—through, for example, unequal distribution of resources, the equalization of economic opportunities, and economic regulation to prevent the creation of substantial wealth disparities. If egalitarianism can ‘make equal’ without slavish methods, then Nietzsche’s demand for ‘equality for equals’ applies to the newly equal, too. More importantly, his moral psychology of power—the view that our source of happiness and incentive to self-development is the feeling of power in relation to equal resistance or ‘opponents who are our equals’ —supports the superiority of a nobly-achieved, non-liberal egalitarian society. For achieved, practical equality of wealth and opportunity would optimize conditions for the feeling of power: a balance of equal, oppositional powers serving as mutual limitation and resistance. Such a society is superior in three ways. First, it maximizes social happiness by promoting and maintaining the feeling of power in all. Liberal and aristocratic societies, in contrast, allow radical inequalities that not only diminish the power of the disadvantaged, but diminish the opportunities of the advantaged to encounter equal resistance, thus undermining the happiness of all. Second, it promotes social stability by preserving a balance of powers that prevents domination and exploitation, in contrast to the inevitable class conflicts of aristocratic and liberal societies. Finally, it promotes cultural achievement, since the feeling of power in relation to proportional resistance is the psychological incentive for self-development and cultural achievement. (shrink)

In recent years, much discussion has taken place regarding the social role of firms and their responsibilities to society. In this context, the role of universities is crucial, as it may shape management students’ attitudes and provide them with the necessary knowledge, skills and critical analysis to make decisions as consumers and future professionals. We emphasise that universities are multi-level learning environments, so there is a need to look beyond formal curricular content and pay more attention to implicit dimensions of (...) the learning process in order to create significant learning. With this in mind, we propose an integrative and holistic approach to guide the integration of ethics, corporate social responsibility and sustainability in management education that aims to improve students’ knowledge and attitudes. In this model, we consider three interdependent levels of analysis–the institutional level, the curricular level and the instrumental level–which together produce a leverage effect on student learning. For each level, we identify the main issues and aspects that need to be considered, based on an extensive literature review in this field. (shrink)

Pero, ya no en línea con Stumpf, sino con Scheler, se sostiene que además del dolor-sensación, existen sentimientos sensibles, a los que se propone denominar «displacer» y «desagrado». Entre los sentimientos de desagrado hay algunos con intencionalidad (...) trascendente, que son los ligados a las sensaciones exhibitivas. Pero también hay un sentimiento de «desagrado» ligado al dolor-sensación, que tiene una intencionalidad inmanente. This article explores André-Marie Ampère's autobiography in order to analyse the dynamics of science in early 19th century French institutions. According to recent works that have emphasised the value of biographies in the history of science, this study examines Ampère's public self-representation to show the cultural transformations of a life dedicated to science in post-revolutionary French society. With this aim, I have interpreted this manuscript as an outstanding example of the scientific rhetoric flourishing in early 19th century French Romanticism, which (...) celebrated the life and works of men of science by means of biographies. Following this approach, Ampère's account has been analysed in relation to certain commonplaces shared with other autobiographies of that time, such as his traumatic experience linked to the French Revolution. Finally, this article discusses Ampère's autobiography as revealing an emerging model of scientific personae, i.e. a new collective way of thinking, feeling and perceiving, which announced the category of the modern scientist. Biobanking in Europe has made major steps towards harmonization and shared standards for the collection and processing of data and samples stored in biobanks. Still, biobanks and researchers face substantial legal difficulties in the field of data protection and sample management. Data protection law was harmonized almost 15 years ago while rights in samples fall under the competence of the Member States of the EU. Despite the Data Protection Directive the field of data protection shows a substantial degree of deviation (...) as public health was excluded from the harmonization. Biobanks seem to have substantially fewer difficulties to cope with in terms of the legal requirements in the field of sample management. This paper discusses the legal framework, experiences of different biobanks in Europe and potential ways forward. It also highlights the need for a health economic analysis of the costs and benefits of privacy protection in Europe. At the moment, policymakers seem to build their decisions on an insufficient evidence base which underestimates the potential value of biobanks for European public health. Within the past few years little progress has been achieved with regards to the development of a unified legal framework in Europe, The diversity in the legal system is also reflected in the different approaches of ethics committees towards biobanking. To secure the responsible and effective use of data and samples, more efforts are needed to come up with pathways for a solution. (shrink)

Recent scientific policies constrict the design of research grants with the aim of short-term maximization of the monetary value generated by the researcher.

Nietzsche’s psychological theory of the drives calls into question two common assumptions of ideology critique: 1) that ideology is fetishistic, substituting false satisfactions for true ones, and 2) that ideology is falsification; it conceals exploitation. In contrast, a Nietzschean approach begins from the truth of ideology: that capitalism produces an authentic contentment that makes the concealment of exploitation unnecessary. And it critiques ideology from the same standpoint: capitalism produces pleasures too efficiently, an overproduction of desire that is impossible to sustain (...) indefinitely. Nietzsche’s concept of the drives (Trieben) is grounded in his theory of the will to power. In contrast to Freud’s view that drives aim at satiation, pleasure through stimulus reduction, in Nietzsche’s view, they aim primarily at the “feeling of power” and the “happiness of high tension.” Nietzsche sees the desire for satiation as a symptom of weakness, a secondary, contingent aim that is incompatible with the fundamental drive to sustain and heighten the feeling of tension that accompanies strong desire. While the Freudian subject desires satisfaction, the Nietzschean subject is paradoxically frustrated by satisfaction, finding happiness in desire sustained by resistance and tension. If individuals desire desire as such, then exploitation and immiseration are not necessarily incompatible with their happiness. Consequently, we must reject the view that ideology is fetishistic: capitalism does not depend on an ersatz satisfaction in the commodity, a transferal of value from quality to quantity, use value to exchange value. Capitalism authentically satisfies desire precisely through its exploitative economic structure. The independence and unpredictability of the value of commodities and the immiseration of laborers produces discontents that enhance rather than frustrate desire. By continually introducing new, initially inaccessible commodities, then overcoming their inaccessibility through overproduction, capitalism sustains and intensifies desires. It promotes happiness not by satisfying wants but generating them, feeding the desire for desire, for the intensity of feeling that the brief pleasures of satiation would destroy. The commodity is not, then, a fetish, not a false satisfaction or aim, but a means, a prop that supports and sustains satisfaction as continued desire. Consequently, we must also reject the view that ideology is falsification: capitalism’s efficient production of happiness obviates the need to conceal its nature. Individuals tolerate capitalism not out of ignorance of exploitation but indifference to it; they prefer real happiness to a merely possible justice that might come at its expense. The critique of ideology must begin by acknowledging its truth. Rather than deny the real satisfactions of capitalism, it must demonstrate that they are unsustainable. (shrink)

Background There is broad international agreement from clinicians and academics that healthcare rationing should be undertaken as explicitly as possible, and the BMA have publicly supported the call for more accountable priority setting for some time. However, studies in the UK and elsewhere suggest that clinicians experience a number of barriers to rationing openly, and the information needs of patients at the point of provision are largely unknown. Methodology In-depth interviews were undertaken with NHS professionals working at the community level (...) of provision, and with patients and professionals receiving or providing treatment for morbid obesity and breast cancer (n=52). Results Nearly all patients wanted to know about healthcare rationing and had high expectations of their clinical professionals to provide all relevant information about treatment options. However, professionals did not always understand these information requirements, and cases of implicit rationing were common. The existence of relevant national guidance was not always known about, meaning that patients were often reliant on other sources of information about treatment options, which included the popular media, the internet, patient advocacy groups and informal networks of support. Discussion Clinical professionals need to understand patients' need for detailed information when it comes to rationing, and to understand that they are the main gateway for this to be provided. However, disclosure could be distressing for both patients and professionals, and thus the most sensitive and acceptable ways to make this information available requires further investigation. This book completes the project, begun in Nietzsche’s Immoralism: Politics as First Philosophy, of critically reconstructing a Nietzschean left politics. Nietzsche's incompatibilist ideal of amor fati requires reconceiving legitimacy as the breeding of a people whose material conditions enable it to affirm its social order. Justice is founded in a future, higher type’s right to exist against present individuals who internalize the contradictions of past societies. In opposition to Nietzsche’s self-undermining aristocratism, this right can only be realized through a universal (...) promotion of the pluralistic unity of the manifold soul, secured by an equally manifold form of democracy. Against the covert aristocratism of liberal proceduralism, authentic democracy produces a true people grounded in shared, concrete happiness, requiring a comprehensive egalitarianism maintained by a permanent socialist state and achievable only through a populist, coalitional politics across identities that radically transforms the material conditions of our shared social life. In this paper, I directly oppose Nietzsche ’s endorsement of a morality of breeding to all forms of comparative, positive eugenics: the use of genetic selection to introduce positive improvement in individuals or the species, based on negatively or comparatively defined traits. I begin by explaining Nietzsche ’s contrast between two broad categories of morality: breeding and taming. I argue that the ethical dangers of positive eugenics are grounded in their status as forms of taming, which preserves positively evaluated character (...) traits and types through the active de-selection of negatively evaluated ones. The morality of taming is not a form of selection, but de-selection: the production of counter or anti-traits and types. Consequently, in its attempt to improve humanity, it tends necessarily toward violence as the elimination of de-selected forms of human life. In contrast, Nietzsche ’s morality of breeding selects traits and types by protecting them from de-selection—specifically, by attacking moral ideas, values, and practices designed to eliminate them. It tends not towards the destruction but preservation of types; its negativity targets not life but the ideas that disable, disempower, and eradicate forms of life. I argue, further, that the fundamental ethical difference between breeding and taming, and so between Nietzschean morality and eugenics, is found in their attitudes toward the natural world. The violence of eugenics as taming is grounded in its status as anti-natural, while Nietzsche ’s morality of breeding resists violence through its foundational affirmation of the conditions and limitations of the natural world: its resolute moral naturalism. Finally, I apply my interpretation of breeding and taming to two cases of comparative, positive eugenics: the historical case of racial eugenics and the so-called “designer baby” case in contemporary liberal eugenics. The anthropological and religious interest for the raven is present in Buddhism, in biblical stories, in North and Greek mythologies, in Arthurian legend and in Spanish epic. The occultism attributed to the raven the mission of guidance of dead human souls after death. This article tracks how the raven transfers its occult connotations to the poetic symbol analyzing the poem«The Raven» by EdgarAlan Poe in its cultural and aesthetic context. Charles Baudelaire and the French symbolists dignified the intertextual evolution of (...) Poe’s symbol and transferred it to LatinAmerican and Spanish modernists. These poets used the raven not only as a symbol but mainly as a recurrent motif or poetic topos. Even though the occultist influence appears ‘scattered’ in the process of the creative experience of this symbol, it does not take away its existence. The occultist influence of the raven explains the ultimatemeaning of some verses and clarifies the exceptions and contradictions that appear in many poems. (shrink)
