Desde la separación estricta de ética y derecho, la Rechtslehre kantiana sostiene que es la ética la que exige al sujeto que haga suya la máxima de actuar conforme al derecho. En la misma línea defiende J. F. Kervégan que los sujetos habríamos de reconocer como un deber ético el respeto a las normas jurídicas, sin que esto quiera decir que el derecho dependa de la ética, pues en estricto derecho no podría tenerse a la intención de conciencia como móvil (...) de la acción justa. Lo que el derecho regula y juzga son las acciones exteriores, y también el móvil tiene que es el poder coercitivo, que el derecho, a diferencia de la ética, tiene la facultad de imponer a la sociedad a fin de que cada miembro de ella en su acción externa evite por su propio interés perjudicar la libertad de cualquier otro. Por esta unicidad del móvil sostiene Kant que derecho y facultad de coaccionar significan una y la misma cosa. El formalismo de su planteamiento impide a Kant entrar en la complejidad del entramado de derechos y deberes, de bienes y cargas, que hace de la justicia distributiva el verdadero objeto del arte jurídico. Y por su externalización estricta del derecho reduce al jurista a la observancia de los textos, ignora el procedimiento de la controversia judicial, excluye la equidad como ajena al derecho, y convierte al derecho en el gendarme de la moral . En cuanto a la intención interior, una cosa es que las leyes no puedan motivar el albedrío por la conciencia de la obligación, y otra que si derecho y coacción significaran lo mismo no habría diferencia entre cumplir la ley para evitar el castigo o eludir el castigo burlando la ley -opción ésta que a muchos resultaría más provechosa, dado que el poder del Estado es incapaz de vigilar en cada momento a cada sujeto, y que los vigilantes mismos necesitan ser vigilados, ad infinitum. Tras una breve alusión a los conocidos argumentos de Platón, Hobbes y Montesquieu sobre la obediencia voluntaria como el otro móvil del derecho, no menos necesario que la coerción, se recuerda que también el profesor Kervégan ha defendido en otro contexto que un orden jurídico cualquiera tiene dos componentes irreductibles entre sí: el sistema de normas que define lo que debe ser y la decisión que conforma el ser al deber-ser. Finalmente, en el derecho interestatal no puede Kant invocar la facultad de coaccionar, que deja de significar lo mismo que "derecho" porque, al no haber ninguna fuerza superior a la soberanía de los Estados, el pacto durará hasta que alguno de ellos lo incumpla por su libre y soberana decisión. From a firm distinction between ethics and right, the Kantian Rechtslehre holds that the demand to adopt the maxim to act according to the right is an ethical demand. Also J.F. Kervégan defends that individuals should recognize the ethical obligation to respect juridical rules, but this does not mean that right depends on ethics, because, in strict right, internal disposition or intention could not be considered as motive for the rightful action. Law regulates and judges the external actions and also the motive has to be external as it is external the coercion that right -but not ethics- can impose on society so that each member of it, for his own interest, does not damage in his external agency any other member's freedom. Because of this only one motive, Kant declares that right and coercion's capacity signify the same thing. His formalist position stops him to go into the complex network of rights and duties, of advantages and burdens, which makes distributive justice the true subject of juridical art. Moreover, because of the strict externals of the law Kant is unaware of the juridical controversy, reduces the jurist to the observance of texts, ejects the equity as not right's own, and risks to transform the right in the gendarme of morals . With regard to intention, one thing is that in strict law the internal disposition can not be deemed as the motive, and other thing is that if law and coercion's capacity signify the same thing, there is no difference between obeing the law to avoide the punishment, or avoiding the punishment in breaking the law; then, the last option would be profitable for too many people, since the coercion power is not able to survey in every moment each individual, and the watchmen themselves need to be watched over and so on. After a short mention of the well known Plato, Hobbes and Montesquieu's arguments about the voluntary obedience as the other motive of the strict right, not less necessary than coercion, we remember that J. F. Kervégan also defended in another context that any juridical order has two irreducible le système des normes générales qui définissent ce qui doit être, et la décision qui conforme l'être au devoir-être. Finally, in the interstates right, Kant can not maintain that right and capacity of coercion mean the same thing, because there is not any force over the sovereignty of the States, and therefore the contract will last till one of them breaks it by its free and sovereign decision. Tarski's theory of truth brings out the question of whether he intended his theory to be a correspondence theory of truth and whether, whatever his intentions, his theory is, in fact, a correspondence theory. The aim of this paper is to answer both questions. The answer to the first question depends on Tarski's relevant assertions on semantics and his conception of truth. In order to answer the second question Popper's and Davidson's interpretations of Tarski's truth theory are examined; to this (...) end both Tarski's definition of truth in terms of satisfaction and the T-sentences are taken into account. Our society is being shaped in a non-negligible way by the technological advances of recent years, especially in information and communications technologies. The pervasiveness and democratization of ICTs have allowed people from all backgrounds to access and use them, which has resulted in new information-based assets. At the same time, this phenomenon has brought a new class of problems, in the form of activists, criminals and state actors that target the new assets to achieve their goals, legitimate or not. Cybersecurity (...) includes the research, tools and techniques to protect information assets. However, some cybersecurity measures may clash with the ethical values of citizens. We analyze the synergies and tensions between some of these values, namely security, privacy, fairness and autonomy. From this analysis, we derive a value graph, and then we set out to identify those paths in the graph that lead to satisfying all four aforementioned values in the cybersecurity setting, by taking advantage of their synergies and avoiding their tensions. We illustrate our conceptual discussion with examples of enabling technologies. We also sketch how our methodology can be generalized to any setting where several potentially conflicting values have to be satisfied. (shrink)

Gundisalvo desempeñó su papel principal como filósofo, y como tal, fue el primero en acoger críticamente las doctrinas avicenianas, farabianas, gabirolianas y aristotélicas. En este sentido, Gundisalvo nos proporciona un panorama donde el platonismo timaico típico de la Escuela de Chartres y de Hermann de Carintia estaba en crisis y que, en varias décadas, llegó a ser superado por la revolución aristotélica del siglo XIII. En sus escritos, Gundisalvo parece quedarse entre las dos orillas de este caudal especulativo, acogiendo el (...) aristotelismo neoplatónico árabe y rechazando fundamentos doctrinales timaicos, sin renegar de su formación platónica y boeciana. The received view on the nature of legal authority contains the idea that a sound account of legitimate authority will explain how a legal authority has a right to command and the addressee a duty to obey. The received view fails to explain, however, how legal authority truly operates upon human beings as rational creatures with specific psychological makeups. This book takes a bottom-up approach, beginning at the microscopic level of agency and practical reason and leading to the justificatory framework (...) of authority. The book argues that an understanding of the nature of legal normativity involves an understanding of the nature and structure of practical reason in the context of the law, and advances the idea that legal authority and normativity are intertwined. This point can be summarised thus: if we are able to understand both how the agent exercises his or her practical reason under legal directives and commands and how the agent engages his or her practical reason by following legal rules grounded on reasons for actions as good-making characteristics, then we can fully grasp the nature of legal authority and legal normativity. Using the philosophies of action enshrined in the works of Elisabeth Anscombe, Aristotle and Thomas Aquinas, the study explains practical reason as diachronic future-directed intention in action and argues that this conception illuminates the structure of practical reason of the legal rules' addressees. The account is comprehensive and enables us to distinguish authoritative and normative legal rules in just and good legal systems from 'apparent' authoritative and normative legal rules of evil legal systems. At the heart of the book is the methodological view of a 'practical turn' to elucidate the nature of legal normativity and authority. (shrink)

When we perform an action because we are complying with the legal command or directive, are we still active, self-governed autonomous agents? In what sense are we still autonomous agents? The task of this study is to explain what legal authority is and the premise of the study is that this question can only be answered through understanding of how legal authority operates upon the (...) agent: if we recognize that legal commands or directives intervene upon, affect and change the agent’s practical reasoning, then we need to understand and explain how this happens. The current study analyzed the relationship between Coronavirus Awareness, mental health, and willingness to seek professional psychological help. This was made through a quantitative approach, using online questionnaires to collect data from 855 subjects. The questionnaires included the Brief Symptom Inventory to measure mental health indicators, the Attitudes Toward Seeking Professional Psychological Help Scale–Short Form, and the Coronavirus Awareness Scale-10. An Exploratory Factor Analysis suggests that three factors underlie the CAS-10: Coronavirus Concern, Exaggerated Perception, and Immunity Perception. Results indicate a (...) significant positive correlation between Coronavirus Concern and both general anxiety and phobic anxiety symptoms. Immunity Perception is positively related to paranoid ideation and psychotic symptoms. A Mediation Analysis determined that Coronavirus Concern has a significant positive direct effect on Openness to Seeking Psychological Treatment, while Exaggerated Perception and Immunity Perception scores have significant direct negative effects on the Value and Need in Seeking Treatment scores. Indirectly, the relationship between Coronavirus Concern and OPST is significantly mediated by anxiety symptoms. Similar results were found for the VNST subscale. There is a negative significant effect of Immunity Perception over OSPT mediated by Paranoid Ideation. However, the overall model only achieved small r2 coefficients for the OSPT and VNST scores. Comparisons in Coronavirus Awareness between sex, age, and the presence of children and older adults at home were also made. These results are discussed regarding their practical implications for mental health providers and policymakers. (shrink)

Modern society is characterised by rapid technological development that is often socially controversial and plagued by extensive scientific uncertainty concerning its socio-ecological impacts. Within this context, the concept of ‘responsible research and innovation’ is currently rising to prominence in international discourse concerning science and technology governance. As this emerging concept of RRI begins to be enacted through instruments, approaches, and initiatives, it is valuable to explore what it is coming to mean for and in practice. In this paper we draw (...) attention to a realm that is often backgrounded in the current discussions of RRI but which has a highly significant impact on scientific research, innovation and policy—namely, the interstitial space of international standardization. Drawing on the case of nanoscale sciences and technologies to make our argument, we present examples of how international standards are already entangled in the development of RRI and yet, how the process of international standardization itself largely fails to embody the norms proposed as characterizing RRI. We suggest that although current models for RRI provide a promising attempt to make research and innovation more responsive to societal needs, ethical values and environmental challenges, such approaches will need to encompass and address a greater diversity of innovation system agents and spaces if they are to prove successful in their aims. The Svalbard Global Seed Vault provides a backup of seed collections from genebanks around the world. It’s unique character has made it iconic in the public imagination as a ‘Noah’s Ark’ for crop plants. Its remote location and strict controls on access have, however, also lent it an air of mystery, swirling with conspiracy theories. In this paper, I first clarify the aims of the Vault, the history of its development and the policies and practices of its current operation. Given (...) concerns around its potential links to the biotechnology industry, I go on to ask whether GM crops are currently stored in the Vault. Presenting several reasons for why GM crops are formally excluded, while indicating the potential for both change and unintentional contamination, I am compelled to question whether GM crops should be excluded. Answering this requires an interrogation of their potential conservation value as modern contributors to crop biodiversity. In exploring this issue, I suggest that there has been surprisingly little discussion of the moral status and conservation value of bio-technological crop plants and indeed, of how we care for all the techno-lifeforms we are currently engaged in co-creating. I suggest that these are becoming important issues as biotechnological techniques and applications begin to rapidly evolve and diversify. Emphasizing the scope for a refreshed interdisciplinary research agenda exploring the interface between biotechnology and biodiversity conservation, I conclude the article by proposing new concepts of synbiodiversity and symbiodiversity to encourage further debate. El blanco y el negro son más que colores, son claves de un contraste simbólico en islas que montaron su estructura social –desde los tiempos coloniales– sobre la esclavitud que racializó las relaciones sociales y generó con ellas modos diversos de discriminación que llegan hasta nuestros días. Uno de los importantes aportes del negro a las artes plásticas del Caribe, es su color, un signo visual en el universo de las tensiones raciales, nacidas en el seno mismo de la (...) sociedad moderno–colonial. Este trabajo se propone distinguir esa trayectoria de significaciones visuales, a través de una selección de obras que emplean el blanco y el negro a partir del soporte físico del cuerpo con todas sus capacidades expresivas. Uno de los textos más significativos del siglo XX sobre la cuestión, Piel negra, máscaras blancas (1952) de Frantz Fanon, será asumido como un recurso de interpretación crítica para el estudio de la selección de obras y autores del Caribe insular que se inscriben en los conflictos de la racialización e inferiorización de las corporalidades, para explorar formas de un humanismo decolonizador, devolver el hombre a su lugar, resituar su “yo” y revalorizar su sitio en la historia. My aim in this paper is to critically assess Plantinga’s modal ontological argument for existence of God, such as it is presented in the book “The Nature of Necessity”. Plantinga tries to show that this argument is valid and it is rational to believe in his main premise, namely “there is a possible world in which maximal greatness is instantiated”. On the one hand, I want to show that this argument is logically valid in both systems B and S5 of (...) modal logic. On the other hand, I think that this argument is not a good argument to show that God exists or that it is rational to believe in God. (shrink)

If we reconstruct the history of Late Scholasticism in this second sense, we can appraise the contribution of Domingo de Soto, who organized the entire scholastic matter in a clear system and introduced with his treatise On justice and law a successful literary form of discussion. In this sense, Soto deserves to be considered a founder of Late Scholasticism (...) together with Francisco de Vitoria. Relevant is the scheme he adopted in the topological distribution, as he joined the notions of law and of justice through a doctrine of freedom and dominion, which figured as a true starting point for a theory of law, especially for a theory of natural law.
