Droit et morale Sous la direction de Dominique Bureau, France Drummond et Dominique Fenouillet Véritable « pont aux ânes de la pédagogie juridique », la question des relations qu'entretiennent Droit et Morale appelle une réponse doctrinale presque invariable: la séparation de principe n'exclurait pas l'influence réciproque. Le droit contemporain semble pourtant traversé par deux courants a priori antinomiques: ici, la référence morale est invoquée comme une sorte de « tabou » qui justifierait le retrait du droit, alors (...) que, là, elle est appelée en renfort pour justifier telle solution ou fonder telle réforme. C'est de cette étrange coexistence du « retour offensif » et du « tabou » qu'est née l'idée d'organiser un colloque sur le thème « Droit et Morale. Aspects contemporains » en privilégiant une approche interdisciplinaire. Le 4 juin 2010, dans le cadre des journées d'étude qu'il consacre au pluralisme, le Laboratoire de sociologie juridique de l'Université Paris II accueillait donc les réflexions croisées d'Olivier Descamps, Dominique Fenouillet, Michel Germain, Valérie Malabat, Horatia Muir Watt, Cécile Pérès, Marc Pichard, Jean-Emmanuel Ray et Jean-Louis Sourioux. La obra de Hans-Dieter Gondek y László Tengelyi, Neue Phänomenologie in Frankreich (2011) ofrece una relectura de los nuevos desarrollos fenomenológicos provenientes de Francia. Su tesis principal es que a pesar de que estos enfoques son muy diversos, ellos tienen en común el siguiente motivo fundamental: una reformulación del estatuto del fenómeno como «acontecimiento de sentido» (Sinnereignis). El presente trabajo ofrece una traducción al español de la «Introducción» de la obra mencionada, donde se expone un panorama general de la filosofía (...) francesa. En segundo lugar, se aborda la lectura de Dominique Janicaud del supuesto «giro teológico» en cierto sector la fenomenología gala, que juzgan parcial e insuficiente para dar cuenta de la nueva fenomenología en el Hexágono. Finalmente, tratan de probar las limitaciones de la lectura de Janicaud, contraponiendo dos perspectivas fenomenológicas, a su juicio, sumamente distintas, a saber: Jean-Luc Marion y Marc Richir. Aunque estas propuestas tengan metas diferentes, ellas llevan adelante una transformación de los límites de la fenomenicidad, un tópico que también está en el centro mismo de los análisis de los autores. This chapter argues that mental fictionalism can only be a successful account of our ordinary folk-psychological practices if it can in some way preserve its original function, namely its explanatory aspect. A too strong commitment to the explanatory role moves fictionalism unacceptably close to the realist or eliminativist interpretation of folk psychology. To avoid this, fictionalists must degrade or dispense with this explanatory role. This motivation behind the fictionalist movement seems to be rather similar to that of Sellars when he (...) came up with the Myth of Jones, his proto-theory of mental concepts. He was faced with the problem of preserving the explanatory status of mental concepts without turning them into proper theoretical entities. By introducing the Sellarsian proto-theory of concepts related to the mental and outlining its main points, this chapter aims to provide a critique of the two versions of mental fictionalism that are arguably the strongest: Adam Toon’s prop-oriented pretence theory and Tamás Demeter’s expressive storyism. This chapter enters into a debate with the analytic theory of action, especially the version developed by Donald Davidson, who makes it clear that the upsurge of a desire to perform a specific action is a natural event that is causally responsible for the action in question. The narrative interpretation of selfhood was initiated by Hannah Arendt. Selfhood is certainly assured on a passive and affective plane. Edmund Husserl maintains that in the passive sphere, a self is constituted preceding active (...) reflection. As Paul Ricœur clearly determines, the complicity with reality entails a ‘decentred self’ that is strictly opposed to the self-centred, self-controlled, and self-assured ego of modern philosophy. Emmanuel Levinas never accepted Wittgenstein's constraint on philosophy to remain silent with regard to the ‘unsayable’. (shrink)

When we ask whether Infinite is art, we're asking about the experience of playing it. BioShock Infinite is still one of the greatest video game stories and worlds of all time. Authors believe we can reverse humanity's destructive environmental path, positing that a new worldview of a "quantum paradigm" is emerging in society, based on awareness that consciousness is a universal energy field from which we form our reality-and guide civilizations to find solutions combining Western medicine and Eastern wisdom traditions to create better lives for all.

This paper proposes a specific approach to understanding the nature of technology that encompasses the entire field of technological praxis, from the making of primitive tools to using the Internet. In that approach, technology is a specific form of human agency that yields to (an imperfect) realization of human control over a technological situation—that is, a situation not governed to an end by natural constraints but by specific human aims. The components of such technological situations are a given collection of (...) natural or artificial beings, humans, human aims, and situation-bound tools. By performing technological situation analysis, the essential form of tool making, the complex system of relationships between science and technology, technological practices with and without machines, the finiteness or imperfectness of any technology, and engineering (i.e., the possibility of the creation of technological situations) can be considered. For a better characterization of the approach to technology, the paper also presents a comparison of other philosophies of technology. Following Feenberg’s comparative analysis, the so-called fundamental question of the philosophy of technology is formulated, its two sides are identified, and it is applied for clarification of our position within philosophy of technology. In our approach, all human praxis can be considered to be technological; more precisely, every human activity has a technological aspect or dimension. (shrink)

The relationship between humans and non-human animals has received considerable attention recently. Animal advocates insist that non-human animals must be included in the moral community. Consequently, eating meat is, at least in most cases, morally bad. In an article entitled “In Defense of Eating Meat”, Hsiao argued that for the membership in the moral community, the “root capacity for rational agency” is necessary. As non-human animals lack this capacity, so the argument runs, they do not belong to the moral community. (...) Consequently, harming non-human animals for human nutrition can be justified. In this short comment I would like to highlight some of the most important errors of the above argument, primarily from the perspective of a biologist. I conclude that assuming the existence of a mysterious “root capacity for rational agency” is a biological nonsense. It cannot be verified, and it only obscures reality. In my opinion, the greatest problem with Hsiao’s argument is that it tries to defend anthropocentrism, a view that has presumably been the very cause of the spoiled non-human–human relationships. Perhaps adopting a vegan lifestyle is a better solution than quieting one’s conscience. (shrink)

How are ownership relationships distributed in the geographical space? Is physical proximity a significant factor in investment decisions? What is the impact of the capital city? How can the structure of investment patterns characterize the attractiveness and development of economic regions? To explore these issues, we analyze the network of company ownership in Hungary and determine how are connections are distributed in geographical space. Based on the calculation of the internal and external linking probabilities, we propose several measures to evaluate (...) the attractiveness of towns and geographic regions. Community detection based on several null models indicates that modules of the network coincide with administrative regions, in which Budapest is the absolute centre, and where county centres function as hubs. Gravity model-based modularity analysis highlights that, besides the strong attraction of Budapest, geographical distance has a significant influence over the frequency of connections and the target nodes play the most significant role in link formation, which confirms that the analysis of the directed company-ownership network gives a good indication of regional attractiveness. While the formulation of Mihaly Csikszentmihalyi's theory of flow, including the experience dimensions, has remained stable since its introduction in 1975, its dedicated measurement tools, research methodologies, and fields of application, have evolved considerably. Among these, education stands out as one of the most active. In recent years, researchers have examined flow in the context of other theoretical constructs such as motivation. The resulting work in the field of education has led to the development of a new model for understanding (...) flow experience in education, specifically dedicated to adult learning. As a result of both a meticulous analysis of existing models and consideration of more recent developments, a new flow scale has thus been developed. The aim of this study is therefore twofold: to validate the new flow measurement scale dedicated to the educational environment, EduFlow-2, and to test a new theoretical model. Students taking a course, some on-site and others in a MOOC, participated. Several scales were administered online at the end of the participants' course during the 2017 academic year. The factor structure of EduFlow-2 was tested using Exploratory Structural Equation Modeling. Several models were tested. The model with a second-order factor best fit the data. We tested the invariance of the flow scale measure for gender and for the type of training. We were able to show that the flow scale is invariant of the modalities of these two variables. Results revealed good psychometric qualities for the scale, making it suitable for both on-site and distance learning. The analysis also revealed significant relationships with the classic variables of motivation, self-efficacy, learning climate, and life satisfaction. Furthermore, all four dimensions of the model were found to be adequate and consistent with the underlying theoretical arguments. In the end, this new, short flow scale and the theoretical model were demonstrated to be promising for future studies in the field of education. (shrink)

This essay presents an argument, which it calls the Bias Argument, with the dismaying conclusion that (almost) everyone should significantly reduce her confidence in (too many) philosophical beliefs. More precisely, the argument attempts to show that the most precious philosophical beliefs are biased, as the pervasive and permanent disagreement among the leading experts in philosophy cannot be explained by the differences between their evidence bases and competences. After a short introduction, the premises of the Bias Argument are spelled out in (...) the first part. The second part explains why the objections to the Bias Argument are not compelling. Even though the essay does not adopt the conclusion of the Bias Argument, partly because it seems to be self-defeating, the authors know no plausible way to refute its premises. Thus, the primary aim of the essay is to clarify why the aporetic situation of the Bias Argument arises. (shrink)

This chapter, which provides a discussion on the phenomenological foundations of predicative structure, first introduces the different steps in Edmund Husserl's argument. It is noted that not all judgements can be equated with a nexus between a conceptual function and an argument. The predicative structure shows the orientation of consciousness towards one or more objects taken as a theme of interest and utterance. The genetic phenomenological perspective posits the question of the origin of predicative judgement within a much larger context. (...) Husserl's account amounts to granting a paradigmatic character to the theory of experience of ultimate individual substrates and to the theory of perceptual judgement. Levinasian phenomenology implies a radical rethinking of the primacy of the predicative apophansis. It is noted that language can never be taken as an independent and autonomous dimension. (shrink)
