This paper argues that Cicero develops a new view of the state as a partnership in his work De republica. Like any other partnership, the Roman state is upheld by the agreement of its members and an allocation of rewards that is proportionate to the contributions. Cicero sketches an outline of this view in his definition of this state. By focusing on how Cicero uses the definition in the construction of his argument, the paper attempts to uncover a detailed view (...) of the state as a partnership. The ancestral Roman constitution, Cicero argues, surpasses all other constitutions in offering the best division of contributions and rewards. Although the state is held together by the agreement of the whole people, there is an enormous disparity in the assessment of contributions and rewards among different social groups. (shrink)

This paper starts with the familiar question: how appropriate is Lucretius’ use of poetry to present Epicurus’ prose teachings? I suggest that Lucretius used the term lucida in the phrase lucida carmina (at 1.933) to signify not only clarity of exposition but also the truth of illumination. I develop my proposal in two parts. The first part (“Reception”) views Lucretius, with reference to Stoic theory, as a recipient of Epicurus’ prose writings, seeking to communicate his illumination to the recipients of (...) his poem. The second part (“Conversion”) argues, with reference to initiation rituals, that Lucretius sought to convey his illumination by rearranging Epicurus’ teachings into a journey of conversion. This journey has two main stages: a progression toward initiation; and a course of further instruction, intended to firm up the initiate’s commitment to an Epicurean way of life. Lucretius uses poetry both to charm the hearer and to reflect the sanctity of this journey to enlightenment. (shrink)

If one wants to know what happened in Hellenistic poetic theory, Philodemus' survey of poetic theories in the fifth book of his On Poems is an excellent guide. Even though the survey is well preserved, it has been neglected. Jensen, who published the first complete edition of On Poems 5 in 1923, did not discuss this part of the text; and it has been treated only briefly by others. This is a pity because, as Philodemus shows, the Hellenistic period was (...) an era of great diversity and innovation in literary theory. Philodemus gives evidence of: a refined and highly systematic critical vocabulary; a new concern with verbal form; a new notion of mimesis; and in general, a great proliferation of theories that present alternatives to those of Plato and Aristotle. Hellenistic literary theorists studied Plato and Aristotle critically; some revised or elaborated their views, whereas others opposed them. Ancient poetic theory did not come to a standstill with Aristotle any more than philosophy did. (shrink)

This paper treats the relationship between natural law and Cicero's code of laws, as presented in Cicero's work On Laws. In response to recent interpretations, it argues that Cicero's code is not identical with natural law. Instead, his laws participate imperfectly in the commands and prohibitions of natural law. Just as Cicero uses a Stoic conception of natural law, so he uses a specifically Stoic view of participation in natural law. His laws share imperfectly in the guiding power of natural (...) law by prescribing intermediate duties as a means to the attainment of virtue. Overall, Cicero's code of laws prefigures modern written constitutions in the attempt to found the basic laws of a state on an unchanging moral norm. (shrink)

Pour Durkheim, la religion est la clé utilisée pour déverrouiller ces deux problématiques.Dans ce livre, Durkheim argumente que les représentations religieuses sont en fait des représentations collectives : l'essence du religieux ne peut être que le sacré. Il est une caractéristique qui se trouve universellement (...) dans toutes les religions. Le sacré, être collectif et impersonnel, représente ainsi la société elle-même. Ensuite il argumente que la société a un impact majeur dans la genèse de la pensée logique.
