However, this general characterization overlooks crucial differences among the different contractualist theories. The article analyzes diverse typologies in order to highlight these differences and reach a more precise characterization of contractualism. It concludes that the distinction between hypothetical and ideal consent made by some of these versions makes it impossible to formulate a univocal definition of contractualism. Background Regulations on research ethics in France have evolved considerably over the past four years: the implementation of the Jardé law and of the General Data Protection Regulations have changed the landscape of research ethics for research involving or not involving human persons. In a context of creation of an Institutional Review Board at the University of Bordeaux, France, we sought to explore research ethics practices and perceptions in the medical community of our University Hospital. Methods A short questionnaire was (...) sent to all physicians of the University Hospital of Bordeaux. The questionnaire included closed questions and main topics were: physicians’ education in research ethics, ethics practices concerning researches non implying human persons, and physicians’ perceptions about current regulations. Results 86 questionnaires were sent back. If a majority of physicians have validated Good Clinical Practices trainings, there was a low rate of specific training on fundamental references in research ethics and a high proportion of responders do not consider themselves as educated in research ethics after completion of GCPs. Regulations on research ethics have many implications on medical research, especially by inducing changes in protocols in order to alleviate ethical requirements. Malpractices were acknowledged like false mention of positive opinion from an ethics committee. If If a majority of responders considers regulations as a positive answer to research ethics, a large majority considers it as a constraint and a complexification of research process. For 58%, regulations in research ethics are perceived as a hindrance for research initiatives. Conclusion Because of their impact on research process, regulations seem to constitute a scarecrow for physicians. Lack of training, bad representations and questionable practices highlight the need to improve education and to propose concrete guidance for medical researchers. (shrink)

Il s’appuie sur la documentation épigraphique et plus particulièrement sur les décrets honorifiques – des textes gravés sur pierre souvent affichés dans l’espace public – qui honoraient une personne pour ses actions en faveur de la cité. Les femmes étaient honorées dans ces documents notamment lorsqu’elles exerçaient une charge religieuse, comme (...) celle de prêtresse. Cette étude, en partant d’un décret athénien honorant une prêtresse du nom de Timokritè, se demande où se joue le genre, en s’intéressant à la manière dont les prêtresses étaient désignées et en observant ce que la façon de les nommer indiquait sur leur statut et leur fonction. Il s’agit de montrer comment certaines femmes, en tant que prêtresses, occupaient grâce à leur statut de citoyennes des fonctions politiques de magistrates. (shrink)

RESUMEN: El presente trabajo examina Anarquía, Estado y utopía de Robert Nozick a la luz de los mitos y ficciones sobre los cuales se construye. En este sentido, se sostendrá que es posible identificar dos mitos principales: el estado de naturaleza lockeano, cuyo principio se deja resumir en la máxima volenti non fit iniuria; y la meta-utopía libertaria, que se deja explicar como una aplicación de la teoría evolutiva de Hayek y de la epistemología de Popper a la construcción de (...) una utopía. Se sostendrá además que existe una continuidad entre ambos mitos y que dicha continuidad viene dada por una intuición moral que Nozick formula al principio de la obra y que sirve también de inspiración al mito libertario: que la vida solo puede tener sentido cuando se deja a cada persona vivir la suya del modo en que estime conveniente. Dicha intuición, se concluirá, se traduce en el campo de la política y del derecho en el principio de que cada persona es dueña de sí misma y que, por consiguiente, esta forma particular de propiedad constituye el secreto hilo conductor de toda la obra. ABSTRACT: This paper examines Robert Nozick's Anarchy, State, and Utopia in the light of the myths and fictions upon which it is built. I hold that it is possible to identify two main myths: the Lockean state of nature, whose principle can be summarized by the maxim volenti non fit injuria, and the libertarian meta-utopia, that can be explained as an application of Hayek evolutive theory and of Popper's epistemology in order to construct an utopia. I also claim that there is a continuity between both myths, and that this continuity is granted by a moral intuition that Nozick presents at the beginning of this work, and that also inspires the libertarian myth: that life can only have sense when each person is allowed to live her own in the way she deems convenient. I will conclude that this intuition finds an expression, in the field of politics and law, in the principle that each person owns herself and, hence, that this peculiar form of ownership is the secret thread of the whole book. El presente trabajo explora la posibilidad de obtener y defender una concepción particular de los derechos sociales a partir de la teoría del título válido de Robert Nozick. Se sostendrá que dicha teoría ofrece varios caminos hacia un Estado más que mínimo. Aquí nos detendremos en uno de ellos, que se desarrolla a partir del concepto de “voluntariedad”. Para ello, después de impugnar el concepto estrecho de voluntariedad adoptado normalmente por los filósofos libertarios, se introduce la noción de “acto mixto” (...) de Aristóteles, que refleja las condiciones bajo las cuales los agentes de hecho contratan. Se sostendrá que la celebración de acuerdos con voluntad mixta plantea una serie de problemas a la teoría del título válido, problemas que sólo pueden ser remediados introduciendo pautas distributivas. Estas pautas deberían conducir a un Estado subsidiario y a combinar la teoría de Nozick con criterios suficientaristas de distribución en favor de los necesitados. (shrink)

One author stands out for his contributions to the evolving field of organizations and management: James March. He was the co-author of the two books that were particularly influential in initiating the field which is now broadly recognized as behavioural theories of organizations: A Behavioral Theory of the Firm, written with Richard Cyert, and Organisations, written with Herbert Simon. This article outlines part of the evolution of March’s framework that he has developed in order to understand human action in often-complex (...) situations. It also includes some notes on Richard Cyert’s contributions. March’s framework became clear and was shaped by his background at the interdisciplinary environment at Carnegie Mellon in the 1950s and 60s. The non-rational and adaptive aspects of human decision-making and behaviour have figured more prominently in March’s work as time has gone on. (shrink)

: The work of Herbert A. Simon has drawn increasing attention from modern scholars who argue that Simon's work changed during the Cold War. This is due to the fact that Simon seemingly changed the substance of his research in the 1950s. This paper argues that Simon did not change in any significant way, but was lead by his interest in decision making and rationality into areas of economics, political science, sociology, psychology, organization theory, and computer science. He used elements (...) of different disciplines to address his overall interest and there is therefore a considerable continuity in Simon's work. This paper also provides part of a background for the recent increase of interest in Simon's ideas by providing some details of the RAND Corporation and the Ford Foundation's support of scientific research through the post war years in general, and their connections to the behavioral science research at Carnegie Mellon University in particular. Durkheim écrit ce livre avec un but double : d'abord il voulait expliquer ce qui crée une société, ce qui la tient ensemble ; ensuite il voulait éclaircir l'influence qu'a la société sur la pensée logique. Pour Durkheim, la religion est la clé utilisée pour déverrouiller ces deux problématiques.Dans ce livre, Durkheim argumente que les représentations religieuses sont en fait des représentations collectives : l'essence du religieux ne peut être que le sacré. Il est une caractéristique qui se trouve universellement (...) dans toutes les religions. Le sacré, être collectif et impersonnel, représente ainsi la société elle-même. Ensuite il argumente que la société a un impact majeur dans la genèse de la pensée logique. C'est la société qui fournit à l'individu les catégories (le temps, l'espace, le nombre etc.) et les concepts nécessaires pour la pensée logique. (shrink)

There is a long tradition in philosophy and literary theory defending the view that engagement with literature promotes readers’ empathy. Until the last century, few of the empirical claims adduced in that tradition were investigated experimentally. Recent work in psychology and neuropsychology has now shed new light on the interplay of empathy and literature. This article surveys the experimental findings, addressing three central questions: What is it to read empathically? Does reading make us more empathic? What characteristics of literature, if (...) any, affect readers’ empathy? While experimental studies have delivered no conclusive answers to these questions, it has exposed their psychological complexity and constructed a more nuanced picture of the diverse ways in which literature interacts with our empathic capacities. When we perceive an object, we perceive the object from a perspective. As a consequence of the perspectival nature of perception, when we perceive, say, a circular coin from different angles, there is a respect in which the coin looks circular throughout, but also a respect in which the coin's appearance changes. More generally, perception of shape and size properties has both a constant aspect—an aspect that remains stable across changes in perspective—and a perspectival aspect—an aspect that changes depending on (...) one's perspective on the object. How should we account for the perspectival aspect of spatial perception? We present a framework within which to discuss the perspectival aspect of perception and put forward three desiderata that any account of the perspectival aspect of perception should satisfy. We discuss views on which the perspectival aspect of perception is analyzed in terms of constitutively mind-dependent appearance properties as well as views on which the perspectival aspect of perception is analyzed in terms of representations of mind-independent perspectival properties. We argue that the trend toward providing users with feasible and actionable explanations of AI decisions—known as recourse explanations—comes with ethical downsides. Specifically, we argue that recourse explanations face several conceptual pitfalls and can lead to problematic explanation hacking, which undermines their ethical status. As an alternative, we advocate that explanations of AI decisions should aim at understanding.

In his Treatise, Hume confronted the tensions between his project of uncovering the causal operations of the human mind and the extreme skeptical tendencies of his system. Louis Loeb argues that Hume overreaches, and he advances a controversial interpretation of Hume's epistemological framework that shows how Hume could have avoided the more destructive positions in his work.

Hume's claim that a state is a belief is often intertwined—though without his remarking on this fact—with epistemic approval of the state. This requires explanation. Beliefs, in Hume's view, are steady dispositions (not lively ideas), nature's provision for a steady influence on the will and action. Hume's epistemic distinctions call attention to circumstances in which the presence of conflicting beliefs undermine a belief's influence and thereby its natural function. On one version of this interpretation, to say that a belief is (...) justified, ceteris paribus, is to say that for all that has been shown the belief would be steady in its influence under suitable reflection. On a second version, it is to say that prima facie justification is an intrinsic property of the state, in virtue of its steadiness. These versions generate different understandings of the relationship between Parts iii and iv of Book I of the Treatise. (shrink)

Cette question est travaillée selon une triple orientation philologique, épistémologique et historique, en prenant pour fils conducteurs l'auto-énonciation du sujet, la constitution du " nous " communautaire, l'aporie de l'institution judiciaire. L'interprétation défendue pose que les processus opposés du devenir-citoyen du sujet et du devenir-sujet du citoyen en viennent à se recouvrir. C'est aussi le moment où le rapport du commun à l'universel devient un écart politique au sein de l'universel lui-même. Le " jugement des autres (...) " doit être rapporté à un " jugement de soi-même " attestant pour chacun sa propre normalité. Dès lors, l'humain ne peut coïncider avec l'institution du politique qu'à la condition de se retrancher de soi-même, dans la forme des " différences anthropologiques ". Le citoyen-sujet ne peut se comprendre indépendamment de son envers, qui le conteste et le défie. (shrink)
