This book is about the use of legal scholarship by judges. It discusses the possibility that legal scholarship may function as a genuine source of law in modern municipal legal systems. The book advances a number of claims, some conceptual, some empirical, some normative. The major conceptual claims are found in Chapters 2 and 3, where a general account of the notion of a source of law is provided. Roughly, sources of law are documents or practices (e.g. statutes, judicial decisions, (...) official customs) from which norms can be derived that function as sources of content-independent reasons for judges to decide legal cases one way or another. The relevant notion of content-independence is derived (with qualifications) from H.L.A. Hart's jurisprudence. Indeed, the book's analysis of the concept of a source of law relies at various points on Hartian insights about law and legal reasoning. Chapter 4 argues that legal scholarship - or, more precisely, a particular type of legal scholarship that might be described as standard or doctrinal - can be, and indeed is, used as a source of law in modern legal systems. The conclusion that legal scholarship is used as a source of law (and thus as a source of content-independent reasons for action) may come as a surprise to those who associate judicial recourse to legal scholarship with judicial activism. This association is discussed and criticized in Chapters 5 and 6. It is argued that, in spite of a relatively common opinion to the contrary, legal scholarship can be used to mitigate discretion. In fact, it is precisely because it can be used in this way that judges sometimes refer to scholarship deceptively and suggest that it limits discretion in situations in which it really does not. However, in the quiet that returns after the last student rushes out the classroom door, we may feel an uneasy (...) ambivalence. Perhaps we admonish ourselves that serious science is substantial, enduring, and intellectual. We wonder whether our "cool" class was merely superficial, fleeting, and mindless.In this article I examine the cool—this idea we love and hate—and assert its importance in science education. I acknowledge that some experiences can be engaging but are superficial and unimportant—this is the "merely cool." By contrast, some experiences are deeply moving because we feel a growing capacity to perceive meaning and value in the world—this is the "sublimely cool." I draw from philosophy, literature, psychology, and aesthetics to build connections between cool and sublime experiences. By highlighting the surprisingly substantial connection between the cool and sublime, I hope to bring greater depth to the meaning of "cool," this imprecise, but honest, term. I also take care to define sublimely cool experiences in science as having a direct relationship with subject-matter understanding. It is true that the full meaning of aesthetic experiences extends beyond the grasp of words and conceptualization; however, it is equally true that knowledge and reason are central to all worthwhile experiences. The expansion of meaning and perception, not just intense sensation or emotion, is the heart of the sublimely cool experience. Nobel laureate physicist Richard Feynman provides a personal example of how his knowledge of science enhances his sublimely cool experience of Nature: "Poets say science takes away from the beauty of the stars—mere globs of gas atoms. Nothing is 'mere.' I too can see the stars on a desert night, and feel them. But do I see less or more? On the one hand, "cool" is a colloquial term used by people of all ages and backgrounds in many contexts to describe many things. So wide and informal is its use that "cool" may seem trite and banal. "Cool" is rarely chosen carefully when used: indeed, it is more often an unintentional, reflexive utterance.Thus, the more one thinks before speaking, the less likely "cool" will be used. Nonetheless, because it is an impulsive expression, "cool" may be all the more honest. Dewey made a similar point in his observation of the word "beauty": "Beauty... is properly an emotional term, though one denoting a characteristic emotion. In the presence of a landscape, a poem or a picture that lays hold of us with immediate poignancy, we are moved to murmur or to exclaim 'How beautiful.' By "admiration that approaches worship," Dewey reminds us that the spontaneous uttering of "beautiful" is a sign that a powerful experience has been had. For lyric poetry does not appear an attractive target for censorship. Its subject matter and formalism remove it far enough from the experience of most readers that Gustave Flaubert, fresh from his troubles with the court over Madame Bovary, could express his surprise at the government’s attack: “This is new,” he wrote to Baudelaire, “this pursuit of a volume of verse.” While Flaubert’s comment was in point of fact inaccurate, he puts his finger on a problem worth considering. 2 Here we have a work that must seem naturally exempt from state intervention, by virtue of a deliberate retreat from risky political subjects, and it nonetheless did get censored by the state. This paper addresses the cultural impact of genomics and the Human Genome Project on human self-understanding. Notably, it addresses the claim made by Francis Collins that the genome is the language of God and the claim made by Max Delbrück that Aristotle must be credited with having predicted DNA as the soul that organises bio-matter. From a continental philosophical perspective I will argue that human existence results from a dialectical interaction between two types of texts: the language of molecular biology (...) and the language of civilisation; the language of the genome and the language of our socio-cultural, symbolic ambiance. Whereas the former ultimately builds on the alphabets of genes and nucleotides, the latter is informed by primordial texts such as the Bible and the Quran. For many, the study of literature is still an aesthetic beauty pageant in which “great books” like Laurence Sterne’s Tristram Shandy (1767) or Marie de la Vergne de La Fayette’s La princesse de Clèves (1678) are paraded across the stage in a contest to seduce the Western intelligentsia. 1 The postmodern student of literature may not have much concern for this age-old territorial contest, but she might be interested to learn that the fallout from Hispanism’s quest for the “first modern novel” has involved so much attention to, indeed complication of, Don Quixote, that the book now resembles more a postmodern text than an early modern one. At the turn of the century, we have been left with what Jorge Luis Borges would recognize as an “aleph”: an infinite ideological labyrinth that reflects and/or cannibalizes all forms, thereby escaping all attempts [End Page 68] to describe it. 2 Whatever we currently mean by “Cervantes” (an author, a collection of texts, an ideological construction, and so forth) carries with it an impressive range of critical responses. Cervantes has been labeled converso (Castro, Canavaggio), Christian humanist (Castro, Bataillon, Forcione, Herrero, Vilanova), disillusioned secularist (Lukács, Cascardi), precapitalist (Johnson), anti-essentialist (Wilson), anti-Eusebian (Presberg), Menippean (Bakhtin), feminist (El Saffar, Rabin, Cruz), sadist (Nabokov), ethnocentric imperialist (Mariscal), medieval (Gorfkle), homophobic (Martín), non-organicist Aristotelian (Read), and either discursively or actually homosexual (Combet, Rossi, Smith, Arrabal). This list is nowhere near complete, but the reader will grasp the robust effects of the plurality of perspectives on Cervantes.Each of these interpretations is valid to varying degrees within various contexts, but at present I am interested in reading Cervantes as the author of a multicultural manifesto on behalf of the Moriscos of Southern Spain. 3 Within the contexts of French Marxist philosopher Louis Althusser and Palestinian postcolonial literary critic Edward Said, materialist, postcolonial, and multicultural critiques of various forms of power and their ideologies can be seen as the fundamental propositions of Cervantes’s Don Quixote. 4 Cervantes’s ultimate orientation may perhaps be inescapably Eurocentric, but his responses to the European experience of the rise and expansion of an ethnocentric militaristic nation state are relatively centrifugal when compared to the attitudes of many of his contemporaries.In surveying some of the antihegemonic details of Cervantes’s novel, I am also interested in dispelling the popular myth of Don Quixote. Purpose: The paper intends to investigate possible affinities between Husserlian phenomenology, mainly on the basis of Zur Phänomenologie der Intersubjektivität, and radical constructivism, essentially in its version according to Maturana and Varela. Findings: Although the two thoughts appear to be delivered in terms that can be philosophically quite abstract for the Husserlian phenomenology and that are empirical-concrete for radical constructivism in Maturana's thought, there is actually an obvious closeness between the two theories of knowledge, so that the epistemological approach used (...) on both sides can be said to be idealistic. This idealistic orientation in epistemology certainly has its basis in the links seen on both sides between the organic and the cognitive dimension of the subject, although those links are taken as a theme in a kinesthetic approach by Husserl and in a bio-physiological one by Maturana. Neurophenomenology is nowadays one of the fields where this organic--cognitive link -- which is crucial for an idealistic approach to knowledge -- is being expressed. Research implications: Talking about idealism should not be a source of fear, especially when what is meant is an epistemological idealism and when it is clearly and simply understood as the philosophical and epistemological orientation that interprets the subject as determining the way the object is known in the cognitive process. Also idealism does not mean necessarily subjective idealism. Some very "balanced" authors developed a theory of knowledge that is usually seen as idealistic without ignoring the role played by the object in the cognitive process. It is therefore worth investigating further the fact that the ultimate meaning of idealistic epistemologies acknowledging intersubjectivity as a defining dimension of knowledge, is not to ignore the object but to rigorously reestablish the genesis of the object in the cognitive process. IntroductionPlato's solution to the problem of falsehood carries a notorious reputation which sometimes overshadows a variety of interesting developments in Plato's philosophy. One of the less-noted developments in the Sophist is a nascent conception of truth which casts truth as a particular relation between language and the world. F. M. Cornford, for one, in his translation and commentary on (...) the Sophist takes Plato's account of truth to involve something like correspondence: "The [true] statement as a whole is complex and its structure corresponds to the structure of the fact. Truth means this correspondence."1 In more general contexts, we find A. N. Prior claiming in his Encyclopedia of Philosophy entry on the correspondence theory of truth: "Aristotle did not originate the correspondence theory but took it over from Plato's Sophist."2However, all this assumes a lot about Plato, much less Aristotle. For one, it assumes that to claim that the statement 'Theaetetus is sitting' is true is to claim that it is true because it corresponds with the fact that Theaetetus is sitting. Other scholars, for a wide variety of interpretational reasons, have been reluctant to accept Cornford's view, but few offer any explanation of what sort of account of truth we might ascribe to Plato by the end of the Sophist. Michael Frede claims [End Page 1] that Plato thinks a true statement is true precisely if a form is something that is with reference to a subject. Frede is quiet about whether this expresses a particular conception of truth, but if he's right, truth involves something other than correspondence. Alfred Tarski has argued at length that truth is a simpler notion than that of correspondence or coherence or whatever. In fact, one claim he emphasizes about his own "conception" of truth is that it is similar to the classical conception of truth we find in places like Aristotle's Metaphysics—a conception of truth which is formulated in Greek in very much the same way Plato formulates it in the Sophist. Unfortunately, Tarski never sufficiently explains exactly what it is about the classical conception that makes it closer to his own.I shall argue that in a very general sense Tarski is right about the ancient conception of truth, but this is not to claim that Tarski's own conception of truth can be found in Plato. By interpreting in a certain way Plato's solution to the paradox of not being and his solution to the problem of falsehood, I argue that the account of true and false statement that emerges within the discussion of not being and falsehood generally neither entails nor outwardly suggests any of the traditional characterizations of a correspondence "theory" of truth.3 On the contrary, what emerges from the Sophist is a very minimalistic "conception" of truth which requires neither positing the existence of facts or states of affairs nor formulating a precise, explanatory definition of truth. Aristotle's discussion of truth in the Categories and De Interpretatione is in many respects remarkably similar to Plato's; and I argue that although some, including W. D. Ross and J. L. Ackrill, have found forms of the correspondence theory in these early works, Aristotle's conception of truth makes no radical departures from Plato's and in fact stands as an obvious extension of the ideas about truth Plato presents in the Sophist. In the final section, I offer a few reasons why one should not expect to find the emergence of a "theory" of truth in the Sophist. If my general interpretation of Plato is correct, we should revise at least one historically significant footnote to Plato accordingly: Plato did not father the correspondence theory of truth and those claiming otherwise risk anachronistically attributing a problem-laden theory to Plato and/or missing one of Plato's points about the fundamental nature of truth.2. But philosophers have had almost nothing to say about problems of responsibility in these cases—in particular, the question: In what respect(s) and to what extent should a multiple be held responsible for the actions of his/her alternate personalities (or alters)?Unlike questions about personhood and identity, this question is not simply an abstract matter that we may ponder at our leisure. Clinicians treating multiples must decide whether it is appropriate—or even just therapeutically beneficial—to hold their patients (or specific alters) responsible for behaviors which they seem unable to control or remember. Similarly, and with increasing frequency, our courts must decide whether a defendant claiming to be a multiple may be held guilty for the actions of one or more alters. In fact, the legal issues can be quite dramatic, and even bizarre. Consider: What sort of individual is standing trial? An alter or the multiple as a whole? Should courts accept the claim that the subject being questioned on the stand is not the same as the subject who committed the crime? If so, other questions come immediately to mind. For example, would it be appropriate for each alter of a criminal defendant to have separate legal council?Undoubtedly, some will have trouble taking that last question seriously. When people are bad storytellers we tend (...) not to pay as close attention to their stories; our minds drift, and we hope for a swift conclusion. We tend not to remember those stories as well as the ones that were carefully constructed and skillfully delivered. Storytelling is one of our primary forms of communication with other people. Narrativity is the principle way that human beings order their experience in time. It is also one of the primary ways that humans make coherent sense out of seemingly unrelated sequences of events. Thus, an account of how this ordering works is essential to understanding one of the many ways of knowing used by humans, one that has been widely unaccounted for, I believe. What I will argue in this article is that reading, telling, and hearing well-constructed narratives are not just idle pastimes that we have created for entertainment purposes or even as a mere means of communication. Rather, there are epistemological benefits to reading, hearing, and telling well-constructed narratives. In particular, by practicing what I call narrative reasoning, we develop this skill, just as by practicing discursive reasoning we develop discursive reasoning skills. In turn, we develop an enhanced reasoning ability that arises from narrative reasoning and narrative meaning construction. Ultimately, I will argue that those who are able to develop the capacity to reason narratively will be able to have a more comprehensive understanding of the human experience. [End Page 42]Defining NarrativeTo begin, I will go into some detail about what I mean when I talk about narratives since the reasoning skills that will ultimately come from engaging with narratives will be related to the way that we come to understand and make sense of them. Since I do not intend to posit a theory of narrative, I will talk about what constitutes narrativity and what sort of features contribute to increasing the narrativity of a story. To begin, narrative is generally the representation of an event or sequence of events. It is closely tied to description, but it goes beyond description. "My cat has fleas" is a description of a state of affairs. "My cat was bitten by a flea" is a narrative about my cat, which includes a description. Some theorists (such as Barthes and Rimmon-Kenan) argue that a narrative must consist of more than one event or state of affairs in order to be minimally considered a narrative. For my purposes, the change in states of affairs from one to another will be essential for understanding the cognitive aspects that can be gained from engaging with narrative. Although I do not advocate a minimal requirement for something to be considered a narrative, at least two, if not multiple, states of affairs increase narrativity significantly. Narratives also have a unified subject and some relatively easily understood temporal structure. Although many narratives do not order all of their events sequentially, good narratives will have a temporal order that can be gleaned by its reader.1An annal might be something that is temporally ordered and likely have more than two events or states of affairs, and for this reason it might be put into a category of "story form." First, we are not repudiating the natural and social facts of pathologic brain degeneration and the physical and cognitive impairments (...) that manifest in people affected by dementia disorders. We are, however, questioning the epistemology, politics, and persistence by some to harden the construct of mild cognitive impairment (MCI) prematurely as a "natural" precursor to dementia. We suggested insufficiencies in viewing MCI as prodromal to Alzheimer's disease (AD; Graham and Ritchie 2006, 36), and pointed to evidence for the prognostic irrelevance of some MCI subcategories (35). The commentators have read our manuscript as suggesting that AD and MCI are different kinds, and that a diagnosis of AD is more "real" than that of MCI. But AD is also fraught with classification issues, as we describe in the section of our paper that deals with consensus committees, published practice guidelines, and the determination of treatment efficacy. Like MCI, AD is a heterogeneous condition, but unlike MCI, AD is a constructed practical kind that does some "work" beyond essentialist (neural degeneration, brain atrophy) claims. Its criteria identify people with well-defined dementia symptoms and multiple cognitive and functional impairments who are in need of, and benefit from, support. Even with these criteria, however, there have been great attempts to achieve definitional accuracy in dementia diagnoses. Practical refinements to the differential diagnosis of dementia based on solid research evidence have made way for more specific recognitions of vascular dementias, dementia of the Lewy body type, and other subtypes beyond AD. So AD too has been subject to more careful, more cautious operationalization in recent years, with research supporting multiple factors and the comorbidity of several types (kinds) of dementia in any one individual.Our paper takes up concerns that are not resolved for dementia and suggests that the nascent category of MCI is still so insufficiently defined as to be ambiguous, and as such, is in danger of identifying individuals with what will be, and has [End Page 57] already been, linked to a debilitating and deeply stigmatizing and fatal disorder (AD). It is doubtful Kant took a dog along on his constitutional; nevertheless, at the moment in the Critique of Pure Reason that he determines the possibility of the conceptualization of sense perception, which Heidegger considered the very heart of Kant's critical project and which ultimately turns on the regulation of the synthesis of time,2 Kant trots out man's best friend. Although he needs this dog in order to demonstrate the trick of temporal synthesis that makes any sensible conceptuality possible, it is also clear that he needs to keep this dog on a tight leash; he cannot afford to let it run off or go astray. On one reading, then, the Critique of Pure Reason institutes a sort of philosophical leash law. Indeed, Kant holds the dog so tightly that it is always already a dead dog—philosophical roadkill.In literature there is perhaps no more memorable instance of the problem of conceptuality than Jorge Luis Borges's "Funes el memorioso." Some scholars have tried to distinguish between historical fact and legend in the biographical information about al-Fārābī that can be gleaned from medieval Arabic sources; by reinterpreting accounts in the bio-bibliographical literature and by presenting new evidence from a contemporaneous medical source; this article argues that such a distinction is problematic. In the eyes of some of his contemporaries, al-Fārābī exemplified the character type of the melancholic thinker, who succumbs to the disease because of excessive study. Arguing that the poetry (...) attributed to al-Fārābī fits well with the picture that the new medical source paints of him, the article also underscores that the topics of literature are the topics of life, and that it is therefore doubtful whether we will ever be able to disentangle myth from reality in the biographical information about al-Fārābī. Chaos, once considered antithetical to scientific law and order, is presently the subject of a vigorous and progressive scientific research program. "Chaos" as it is used in current scientific literature is a technical term: it refers to stochastic behavior generated by deterministic systems. This behavior has appeared in models of a wide range of phenomena including atmospheric patterns, population dynamics, celestial motion, heartbeat rhythms, turbulent fluids, chemical reactions and social structures. In general, chaos arises in the nonlinear dynamics of complex (...) systems. Grebogi, Ott and Yorke reflect the sentiment of the scientific community when they state that chaotic nonlinear dynamics has "fundamental implications." This dissertation explores these results in a philosophic context. ;The research is organized as follows: The Context of Science. Scientific results are achieved in and make sense in the practical context of research which includes both experiment and theory. Drawing on the work of Dyke, Galison, Garfinkel and Hacking, a philosophic context is described which more accurately reflects the significance of scientific results than do the contexts of discovery and justification. Models. Chaos theory is constituted by a family of numerical models. In this chapter, Giere's account of modeling is extended to both bio-medical and numerical models. Chaos in Scientific Models. This is a rather lengthy primer of chaos theory that is, although technically accurate, accessible to nonspecialists. It constitutes a road map for the primary literature on chaos. Chaos and Prediction. Chaos theory shows a limit of our science, namely, chaotic systems are deterministic yet unpredictable in the long run. The chapter includes a discussion of scientific determinism following Popper and, it concludes by providing evidence against the laplacian claim that deterministic systems are predictable. Chaos and Complexity. This shows what contribution chaos theory makes toward answering the challenge of organized complexity articulated by Weaver. It discusses attempts to characterize complexity and shows how the results of chaos theory can help. Both as an interpretive principle in textual criticism and literary theory and as a critical framework for the analysis of social and political structures and cultural formations, sexual difference provided a (...) fertile conceptual ground from which the disinterested universalism claimed by patriarchal and phallocentric knowledges could be put into question. However, in the past decade, the primacy of sexual difference as a critical principle has itself been called into question for eliding other collective forms of difference such as race, class, and sexuality.In a sense, this fracturing or fissuring of the conceptual ground of feminist theory can be seen as a logical outcome of the concept of “difference” itself, which endlessly proliferates into a multiplicity of sometimes conflictual forms. Nevertheless, it is important to stress that the fissuring of “sexual difference” within academic discourse also reflects and expresses (albeit a little belatedly) broader sociological and political events: the rise in the 1970s of what the sociologist Immanuel Wallerstein has described as new antisystemic movements or “new social movements.”By the 1970s one began to speak in the plural of the “new social movements.” The shift from the grammatical singular to the plural provides a crucial clue to the nature of the process. For the “movement,” if it was ever organizationally singular, soon became multiple, if not necessarily fractionated. That is to say, there emerged a whole series of movements, each organized around a specific theme or focus—movements of “ethnic minorities” or “immigrants,” womens’ movements, ecology movements, antiwar movements, gay and lesbian movements, movements of the handicapped and of the aged (or pensioners).... Bio-heteronormative conceptions of the family have long reinforced a nuclear ideal of the family as a heterosexual marriage, with children who are the genetic progeny of that union. This ideal, however, has also long been resisted in light of recent social developments, exhibited through the increased incidence and acceptance of step-families, donor-conceived families, and so forth. Although to this end some might claim that the bio-heteronormative ideal is not necessary for a social unit to count as a family, a more (...) systematic conceptualization of the family—the kind of family that matters morally—is relatively underexplored in the philosophical literature. This paper makes a start at developing and defending an account of the family that is normatively attractive and in line with the growing prevalence of non-conventional families and methods of family-formation. Our account, which we call a constitutive-affirmative model of the family, takes the family to be constituted by an ongoing process of relevant affective and affirmative relations between the putative family members. In support of Mencius, this article develops additional metaphysical and bio-social-evolutionary grounds, both of which parallel each other. The metaphysical analysis suggests that, in the spirit of Spinoza, an entity’s nature must necessarily include the drive toward its preservation. Likewise, the multi-faceted bio-social-evolutionary argument locates the fundamental telos of humanity in the preservation of social ties and (...) species preservation, leading to a life-affirming philosophy and bio-psychological deduction of human emotions based on the primary emotion of love. Within feminist commentary, there has been increasing disillusionment with the radical feminist thesis commonly associated with the work of Catharine MacKinnon. Set against the backdrop of this disillusionment, this article traces the development of an emerging genre of contemporary feminist critique, which has been heavily influenced by the writings of French genealogist Michel Foucault. The work of Foucault, despite focusing upon issues of power and sexuality that have long since been central to the radical feminist project, appears to offer a (...) stark alternative to the accompanying radical feminist emphasis upon grand-scale theories of domination and gender-based victimization. Highlighting the points of divergence between Foucault and radical feminism, this article joins with much contemporary feminist commentary in heralding the Foucaultian position as a worthy alternative, capable of remedying the problems of essentialism and determinism that have plagued MacKinnon's arguments. Unlike much contemporary feminist commentary, however, this article also seeks to highlight the similarities between the theoretical positions of MacKinnon and Foucault. With a particular focus upon Foucault's work on domination, this article charts the reinsertion of asymmetrical power relationships within the Foucaultian landscape, and highlights the impact of that development upon popular understandings of his thesis on micro-politics, bio-power and resistance. Locating the centrality of domination to Foucault's thesis on power, the article will re-establish the relevance of related aspects of that analysis for the purposes of contemporary feminist critique. Other articles in this issue address the rich content of the project’s work, that is, the artworks themselves, their contextual grounding, and the development of skills that maximize learning. This article looks at the creation of a learning space as a home for the development of the project. It explores issues related to learning spaces and features some of the technologies that can be used within them.The Rembrandt Project will not be a Web site that merely flattens images on a computer screen or conveys facts about Rembrandt and his oeuvre. Rather, it is a portal to a learning place with online features and opportunities for learners to have transformative experiences. Learning may occur online in electronic conversations, in opportunities to view and respond to reproductions in collections that cannot be visited in person, and in the creation and display of learners’ products. Learning is facilitated by access to a range of resources and people. Numerous announcements of activities, events, and products will be posted on the site. Some individuals will work in the space of the works themselves while others might undertake learning activities in museums, galleries, and private homes. In some cases special programs will highlight certain works and relate them to the project. Images of places in the Netherlands will also be presented with accompanying learning opportunities for those who may wish to see the paintings in person or simply ponder their influence from afar. All participants will be encouraged to share creations and reflections on the site. Perhaps you returned to the work many times, experiencing it more deeply and differently upon each visit. What is it, specifically, about the encounter that resulted in a satisfying experience? In pursuing its purposes, the Rembrandt Project explores ways multiple skills can help maximize the experience of a wide range of works both online and off. ObjectiveFatigue after burns is often attributed to the hyperinflammatory and hypermetabolic response, while it may be best understood from a bio-psychological perspective, also involving the neuro-endocrine system. This longitudinal multi-center study examined the course of fatigue up to 18 months postburn. The contribution of bio-psychological factors, including burn severity, pain, and acute PTSD symptoms, to the course and persistence of fatigue was studied in a multifactorial model.MethodsParticipants were 247 adult burn survivors. Fatigue symptoms were assessed with the Multidimensional Fatigue Inventory (...) during the acute phase and subsequently at 3, 6, 12, and 18 months postburn, and were compared to population norms. Age, gender, burn severity, acute PTSD symptoms and pain were assessed as potential predictors of fatigue over time in a latent growth model.ResultsAt 18 months postburn, 46% of the burn survivors reported fatigue, including 18% with severe fatigue. In the acute phase, higher levels of fatigue were related to multiple surgeries, presence of pain, and higher levels of acute PTSD symptoms. Fatigue gradually decreased over time with minor individual differences in rate of decrease. At 18 months, pain and acute PTSD symptoms remained significant predictors of fatigue levels.ConclusionsProtracted fatigue after burns was found in almost one out of five burn survivors and was associated with both pain and acute PTSD symptoms. Early detection of PTSD symptoms and early psychological interventions aimed at reducing PTSD symptoms and pain may be warranted to reduce later fatigue symptoms. (shrink)

Fenner (bio)IntroductionIn my experience—with students, colleagues, friends, myself—I find that most people view aesthetic objects and art objects (which sometimes overlap but not always) through a variety of "lenses": subjectively located, psychologically based perspectives or "contexts" through which the object is viewed, considered, appreciated, and many times even criticized. I believe that many times the depth and richness of aesthetic reward (...) depends on the perspective through which the subject attends to an object or event. While a part of aesthetic perspectival context is objective—such as the physical conditions surrounding and history concerning the aesthetic object—the majority of it is subjective, and I want to take another step and say that the majority is psychological.1 Aesthetic attenders bring to aesthetic experiences thick sets of background beliefs, personal associations, taste preferences, attitudes, and values—and this is not to mention the more temporal items like how they feel on the day or whether they are attending alongside friends, relatives, or colleagues. Hundreds of psychological factors result in differences in aesthetic experience; this is most likely true of all experiences, but it is even more the case in aesthetic experience and those kinds of experiences that set the occasions for attenders to think, feel, consider, spend time with, introspect, and be in a relationship—subject and object—that is distinct from the ordinary and the routine.Attenders can employ a single lens or multiple ones. It is entirely possible to attend in the absence of the employment of any lens—a purely disinterested or purely formalist perspective would be such a thing—but the vast majority of aesthetic attenders bring with them layers of lenses through which they naturally, nontheoretically (which is not to say noncognitively) view objects. On different occasions, given particular objects and particular subjects, the subject may view an aesthetic object from an art historical [End Page 109] perspective (whether or not the object is an art object); a moral perspective; a cultural, political, or national perspective; a social, class, race, ethnic, or gender perspective; a religious or spiritual point of view; an emotional point of view; a point of view colored by personal associations, personal history, personal identification, personal preference; and on and on.2 Sometimes the employment of lenses is distracting, and sometimes the experience is less than positive given such employment. But (1) many times—I want to say most times—the employment of such lenses results in a richer and more meaningful experience, and (2) it is the natural stance. Adopting a noncontextualized perspective requires conscious volitional effort. Seeing through particular psychological lenses is the default.I want to focus in this paper on a kind of perspective, a kind of psychological context, that has not been much discussed: I will call it aesthetic engagement preparation. Essentially, this has to do with the level of readiness that the subject possesses for engaging with particular objects aesthetically. To engage in a way that will provide a good return on her investment of attention, the subject must be open to the object, must be comfortable with the objective context, must be ready to enter into a relationship with the object—a relationship that may be psychologically associational in all sorts of ways (affectively, cognitively, and so forth)—and must be ready to employ a range of lenses, like the ones described above, to get the most out of her experience. Again, those who advocate noncontextualized (disinterested or formalist) approaches—Shaftesbury, Hutcheson, Addison, Kant, Schopenhauer, Wilde, Whistler, Wimsatt, Greenberg, Brooks, Wolfflin, Bell, Moore, Bullough, Hanslick, Ortega y Gassett, Fry, Hampshire, Stolnitz, and Zangwill, just to name a few—will find aesthetic engagement preparation not only unnecessary but counterproductive. Fenner (bio)Two of the most common challenges that teachers of aesthetics have to face in their classrooms today are, first, the presumption that since "beauty is in the eye of the beholder" and "there's no disputing taste," every aesthetic judgment is as good as every other one. The second is that the content from which aesthetics courses (...) commonly draw for examples and for the impetus for contemporary philosophy of art theory — and by this I mean art from Post-Impressionism to the present — is made up of "stuff I could have done when I was four years old." The substance behind these two challenges — that aesthetic judgment is highly or perhaps exclusively subjective and that twentieth-century art does not demonstrate care of technique, or that it is simply ugly1 — are intimately connected. This connection is the focus of this essay. The answer to the question, "why was there so much ugly art in the twentieth century?" may be that the tradition of showing beauty to be a highly or purely subjective phenomenon renders beauty apparently less valuable than if it were objective in character, and so we have, in the twentieth century, a move away from the production in art of beauty to that which is simply "artistic" or "artistically important." I want to come at this thesis not through a discussion about either the location or the reality of aesthetic properties. Instead, I want to focus on the "ugly art."Students in aesthetics courses tend to take one of three positions regarding modern art, and by "modern art," I mean art from Post-Impressionism to the present, including Pop Art, Dada, Surrealism, Abstract Expressionism, and the rest: 1. They deny the value of it, together with claims about their artistic abilities during their kindergarten years. 2. Because they know something of the history and progression of twentieth-century art, or because they have an experiential basis for approaching modern art conceptually, they actually appreciate and value it. 3. They think they ought to value it (the way so many of us feel when buying our very first tickets to the [End Page 13] opera), and they do their level best to act in accord with what they see as their aesthetic obligation. Those of the first camp will probably voice their positions early in aesthetics courses, and at that point the challenge for the teacher is raised.Teachers in aesthetics courses, when faced with this challenge, tend, I think, to take one of three positions in response: 1. They use the authority of their office to stifle the discussion, hoping that students of the first camp will over the course of time and exposure at least move to being students of the third camp. 2. They embrace the complaint, discuss it, give it due regard (after all, those teachers probably read Tom Wolfe's The Painted Word themselves), but leave the final decision about the merit of modern art open and unsettled. I presume this is the majority position, at least in philosophical courses of aesthetics. 3. They seek to impart to students — through exposure, discussion, and the eloquence they can muster of descriptions of their own positive, valuable experiences with modern art — some sense of its merit. Auger (bio)Popular films about the environment and related human and material resource issues, particularly colonialism, tend to enhance the appeal of their subject matter by aesthetically transforming it according to audience preferences and tastes. Such mediating strategies are perhaps too familiar to contemporary artists of all types who would prefer to work beyond the limits of what their readers or (...) viewers are prepared to tolerate as entertainment, but the particular emphases and accommodations made by film artists to convey messages about the environment are little changed from those strategies used by painters over the past three centuries to a similar end. The methods by which environmental issues are aestheticized in late-twentieth-century film is directly and historically related to those established for grand manner painters by Nicholas Poussin (1594-1665) and taught at the French academy from the seventeenth through the nineteenth centuries. That these fundamentals were part of the training of artists who would be willing and able to enhance the glory of Louis XIV's absolutist monarchy seems not to have undermined the popular enthusiasm their association with the "classical" past generated outside of France. Thus, the grand manner ideal was repeated, elaborated, and adapted by subsequent British and American artists, teachers, and aestheticians, both amateur and professional, including Joshua Reynolds (1723-92), president of the British academy; theoretician Edmund Burke (1729-97); and such American painters as Benjamin West (1738-1820), Thomas Cole (1801-48), Frederic Church (1826-1900), and Albert Bierstadt (1830-1902).Examples of filmic adaptations of grand manner aesthetics considered here include English director John Boorman's The Emerald Forest (1985) and Anglo-French director Roland Joffé's The Mission (1986), both British productions; Kevin Costner's Dances with Wolves (1990) and John McTiernan's [End Page 96] Medicine Man (1992), both American productions with American directors; and Australian director Bruce Beresford's Black Robe (1991), a Canadian/Australian production based on Irish-born, Canadian novelist Brian Moore's best-selling novel of the same title (1985). Thus, the interest of this study to educators and students of the visual arts is twofold: first, it demonstrates the continued adaptation and application of aesthetic principles originally developed in the seventeenth century to a technology-based medium; and second, it shows how those aesthetic principles are currently applied in film to direct and modulate public opinion on matters well beyond the domain of pure or theoretical aesthetics.The grand manner aesthetic, first defined with reference to seventeenth-century painting and still apparent in twentieth-century film, is largely attributable to Poussin since he was an artist who wrote—and wrote well—about his understanding of artistic quality and priorities. He was deeply committed to classicism; he thought the elements of a painting should be idealized rather than realistic and particularized, that those elements should be clearly delineated in a linear manner, that exotic subjects and excessive color should be avoided as both appeal too much to the senses and not enough to the mind, and that figures should always predominate over landscape. Poussin's ideals became the model for students training at the French Academy, an institution officially formed in 1648 under the direct control of the government. Aspiring academicians were exhorted to produce images that were usually composites of the better, and sometimes imagined, aspects of the appearance, character, and deeds of the fictional and historical people, events, and locations that were their subjects. Se trata de un establecimiento que, además de formar maestros populares, se halla enrolado en las luchas sociales y políticas. A fines de 2014 fueron reprimidos brutalmente y objeto de desaparición forzosa (...) unos 43 alumnos de esa Escuela, lo cual dio lugar a una ininterrumpida protesta civil con muy diversos ribetes internos y mundiales cuyas múltiples expresiones procuran explicitarse en el trabajo. Por otra parte, se incursiona en el trasfondo ideológico que viene acompañando el devenir institucional mexicano bajo el manto del neoliberalismo -al cual el autor ha optado por reconceptuar como neuroliberalismo en distintos ensayos suyos y en colaboración. Conjuntamente, se enfoca la problemática en cuestión desde un ángulo doctrinario y existencial específico: el del necropoder y el pensamiento crítico. It relies upon thermodynamics and information theory and is, therefore, applicable to all kinds of systems, which makes it most suitable for cross-disciplinary investigations and innovation. SD is complex and cross-disciplinary by its very nature and, therefore, the ISA is the best way (...) to investigate its different subsystems. Out of all the feminist theorists you both interrogate, she seems to emerge as a kind of touchstone of the feminist ethical, political, and intellectual concerns to which you seem (...) to aspire. Could each of you briefly outline how she figures in your work, whether your relations to her have changed, and if so, how?JB:I think that probably early on, when I started working on French feminism as a graduate student in the early ‘80s, I was not interested in her at all because she seemed to me to be an essentialist and that was a term we used quite easily then, when we thought we knew what it meant. In the late ‘80s, I started to rethink my objections to her on that basis and found that she was, among the feminist theorists I had read, perhaps the most versed in philosophy and that her engagement with philosophy was a curious mixture of both loyalty and aggression. And it became very interesting to me when I started thinking about her whole practice of critical mimesis—what she was doing when she was reading Freud, what was she doing when she was reading Plato—and I read Speculum again and again, frightened by its anger, compelled by the closeness of the reading, confused by the mimetism of the text. Was she enslaved to these texts, was she displacing them radically, was she perhaps in the bind of being in both positions at the same time? And I realized that whatever the feminine was for her, it was not a substance, not a spiritual reality that might be isolated, but it had something to do with this strange practice of reading, one in which she was reading texts that she was not authorized to read, texts from which she was as a woman explicitly excluded or explicitly demeaned, and that she would read them anyway. And then the question is: what would it mean to read from a position of radical deauthorization in order to expose the contingent authority of the text? That struck me as a feminist critical practice, a critical reading practice that I could learn from, and from that point on, highly influenced by both Drucilla’s work and Naomi Schor’s work [see Schor], I started to read her quite thoroughly.PC:Is this kind of relationship that she has with the philosophers she reads a sexual relationship? I am thinking of some of the sexualized terms you just used: loyalty and aggression.JB:Yes, there is no doubt that there is an eros of a certain kind, usually the kind that frightens me, quite frankly. This report analyses the relationship between RRI-like practices and competitive advantage. RRI frameworks have traditionally been less oriented towards their application in competitive environments; hence resulting in limitations to the applicability of some of its main tenets in industry and in the context of the development of a national competitive advantage. Aiming to close this gap and identify how a competitive advantage based on engagement in RRI-like practices across world regions may be developed, a systematic literature review, a survey and (...) case studies were carried out. Five main drivers of competitive advantage through RRI-like practices were identified: avoiding uncompetitive regulation, increasing social acceptance, incorporating stakeholder needs and tapping into new markets, increasing the efficiency of the innovation process, and reputational effects. On the other hand, four barriers were identified: obstacles during the research and innovation process, protecting intellectual property, lack of consumer awareness, and barriers derived from the institutional environment. The survey revealed that, while there are some differences in terms of attitudes and engagement in RRI-like practices across regions, both procedural and outcome dimensions were relevant. However, the application of particular practices in exercising such dimensions showed more variations across regions, reflecting adaption to local environments. In relation to competitive advantage, outcome dimensions and open and transparent innovation processes showed a clear relationship with performance, in particular with customer performance. The reason for this might lie in the increased visibility of such practices to the consumer. Two cases studies were carried out focusing on the management of socio-ethical concerns through RRI-like practices and their relationship with competitive advantage. The case on the bio-economy domain, identified different responses depending on local regulations and the focus placed on the development of competitive advantages at the micro and macro levels, and showcased the importance of domain specific considerations in RRI-like responses. The ICT case highlighted the importance of network approaches and second-order reflexivity, and the need to adapt RRI-like practices to local contexts to maximise their benefits for competitive advantage. Lastly, the analysis of the two cases concentrating on transversal issues made notable how strategic approaches to RRI and their proper integration in strategy showed an improved relation with competitive advantage. This study makes a significant contribution to existing research on RRI-like practices and competitive advantage and adds to the literature on business involvement in RRI that has been flourishing despite the tradition of overlooking RRI by actors in competitive environments. Moreover, it provides a set of practical recommendations for industry, policymakers, research performing organizations, research funding organizations, investors, civil society and NGOs and association bodies. These recommendations are oriented towards developing and sustaining a competitive advantage based on RRI-like practices by research and innovation actors, while supported by other stakeholders in the system. The advice is informed by the research study and proposes the need to tailor and adopt bottom-up approaches in the implementation of RRI-practices, integrating RRI-like logics and competitive advantage logics into organizational dynamic, and the need for collaboration among different actors, apart from recommendations particular to each stakeholder. The INBIOSA project brings together a group of experts across many disciplines who believe that science requires a revolutionary transformative step in order to address many of the vexing challenges presented by the world. It is INBIOSA’s purpose to enable the focused collaboration of an interdisciplinary community of original thinkers. This paper sets out the case for support for this effort. The focus of the transformative research program proposal is biology-centric. We admit that biology to date has been more fact-oriented (...) and less theoretical than physics. However, the key leverageable idea is that careful extension of the science of living systems can be more effectively applied to some of our most vexing modern problems than the prevailing scheme, derived from abstractions in physics. While these have some universal application and demonstrate computational advantages, they are not theoretically mandated for the living. A new set of mathematical abstractions derived from biology can now be similarly extended. This is made possible by leveraging new formal tools to understand abstraction and enable computability. [The latter has a much expanded meaning in our context from the one known and used in computer science and biology today, that is "by rote algorithmic means", since it is not known if a living system is computable in this sense (Mossio et al., 2009).] Two major challenges constitute the effort. The first challenge is to design an original general system of abstractions within the biological domain. The initial issue is descriptive leading to the explanatory. There has not yet been a serious formal examination of the abstractions of the biological domain. What is used today is an amalgam; much is inherited from physics (via the bridging abstractions of chemistry) and there are many new abstractions from advances in mathematics (incentivized by the need for more capable computational analyses). Interspersed are abstractions, concepts and underlying assumptions “native” to biology and distinct from the mechanical language of physics and computation as we know them. A pressing agenda should be to single out the most concrete and at the same time the most fundamental process-units in biology and to recruit them into the descriptive domain. Therefore, the first challenge is to build a coherent formal system of abstractions and operations that is truly native to living systems. Nothing will be thrown away, but many common methods will be philosophically recast, just as in physics relativity subsumed and reinterpreted Newtonian mechanics. -/- This step is required because we need a comprehensible, formal system to apply in many domains. Emphasis should be placed on the distinction between multi-perspective analysis and synthesis and on what could be the basic terms or tools needed. The second challenge is relatively simple: the actual application of this set of biology-centric ways and means to cross-disciplinary problems. In its early stages, this will seem to be a “new science”. This White Paper sets out the case of continuing support of Information and Communication Technology (ICT) for transformative research in biology and information processing centered on paradigm changes in the epistemological, ontological, mathematical and computational bases of the science of living systems. Today, curiously, living systems cannot be said to be anything more than dissipative structures organized internally by genetic information. There is not anything substantially different from abiotic systems other than the empirical nature of their robustness. We believe that there are other new and unique properties and patterns comprehensible at this bio-logical level. The report lays out a fundamental set of approaches to articulate these properties and patterns, and is composed as follows. -/- Sections 1 through 4 (preamble, introduction, motivation and major biomathematical problems) are incipient. Section 5 describes the issues affecting Integral Biomathics and Section 6 -- the aspects of the Grand Challenge we face with this project. Section 7 contemplates the effort to formalize a General Theory of Living Systems (GTLS) from what we have today. The goal is to have a formal system, equivalent to that which exists in the physics community. Here we define how to perceive the role of time in biology. Section 8 describes the initial efforts to apply this general theory of living systems in many domains, with special emphasis on crossdisciplinary problems and multiple domains spanning both “hard” and “soft” sciences. The expected result is a coherent collection of integrated mathematical techniques. Section 9 discusses the first two test cases, project proposals, of our approach. They are designed to demonstrate the ability of our approach to address “wicked problems” which span across physics, chemistry, biology, societies and societal dynamics. The solutions require integrated measurable results at multiple levels known as “grand challenges” to existing methods. Finally, Section 10 adheres to an appeal for action, advocating the necessity for further long-term support of the INBIOSA program. -/- The report is concluded with preliminary non-exclusive list of challenging research themes to address, as well as required administrative actions. Due to the potential ethical and psychological implications of screening, and especially inregard of screening on children without available and acceptable therapeutic measures, there is a common view that such procedures are not advisable. As part of an independent research- and bioethical case study, our aim was therefore to explore and describe bioethical issues among a representative sample of participant families (n = 17,055 children) in the ABIS (All Babies In South-east Sweden) research screening for Type 1 diabetes (IDDM).The primary (...) aim is the identification of risk factors important for the development of diabetes and other multifactorial immune-mediated diseases. Four hundred, randomly chosen, participant mothers were asked to complete a questionnaire exploring issues of information, informed consent, bio-material, confidentiality and autonomy, and of prevention/intervention. 293 completed the questionnaire, resulting in a response rate of 73.3%. The majority of questions had the form of 6-point Likert-type response scales (1–6).We found that the majority of respondents felt calm in regard of samples and written material, and also concerning the possibility of their child in the future being identified as having high risk of developing Type 1 diabetes. An important finding concerning access and control of mainly biological data was indicated, with the respondents expressing concern for potential future use. We believe our findings indicate that this kind of empirical studies can substantially contribute to our understanding of bioethical issues of medical research involving genetics. Issues, such as safeguards ensuring theethical criteria of autonomy and respect, were emphasised by our respondents. We believe theissues brought up may promote further discussion, and do suggest issues for consideration by, among others, researchers, bioethicists and Institutional Review Boards. (shrink)

Therefore, it is necessary to note the importance of taking into account the principle of I2K2+SH, ie: Intellectualization, Integration, Convergence, Coevolution and Socio- humanitarian technologies. It is important and necessary to take into account modern principles of designing a su- stainable and secure AIS and solving the problem of Harmonization between 2 worlds: Real and Virtual, especially in their hybridization. Our immediate future is a hybrid nonlinear world. Note that digitalization, artificial intelligence and robotics will be the main drivers of global economic growth by 2030E. An important paradigm and platform is the Integrated System: for Industry 4.0, DE and AI, taking into account the complex principle of I2K2+SH. If the transition of the Ukrainian economy to an innovative one does not take place in the next 3-5 years, Ukraine will remain in the backyard of civilization. (shrink)
