The 2010 Nagoya Protocol is an international framework for access and benefit sharing (ABS) of the use of genetic and biological resources, with particular focus on indigenous communities. This is especially important in Africa, where local communities have a close reliance on environmental resources and ecosystems. However, national legislation and policies commonly lag behind international agreements, and this poses challenges for legal compliance as well as practical applications. This study reviews the academic literature on the Nagoya Protocol and ABS applications, (...) and then considers the implications of this analysis for research in Africa. Results show that there is uneven engagement with the principles of the Nagoya Protocol across different academic disciplines; local communities are sometimes sidelined in these studies; and only 8% of researchers in the literature analysed are located in Africa. Future developments should focus on ensuring national compliance with the Nagoya Protocol, and that researchers and industry work in partnership with local African communities on ABS issues. La littérature du XXe siècle est trop souvent réduite à quelques mouvements littéraires, généralement contestataires. Nous avons voulu rendre hommage à ces chercheurs de l'absolu qui ont profondément marqué leur époque et dont nous voulons montrer l'actualité. Ce recueil d'articles a pour ambition de sonder les nouvelles modalités d'expression d'une parole enthousiaste au moment où l'immanence semble s'imposer. Il s'agit de rendre compte des stratégies employées par les écrivains pour effectuer la transcription langagière d'une forme de transcendance. Au-delà de la (...) thématique générale, nous avons voulu également mettre en lumière des écrivains méconnus qui permettent de porter un regard nouveau sur l'écriture poétique du XXe siècle. J'examine plusieurs sources selon lesquelles Swyneshed (malgré les prétentions d'Angel D'Ors dans ses articles récents) donne une nova responsio en partie sous forme de la règle « On peut nier une proposition conjonctive après avoir concédé ses deux parties. » Je montre que cette nova responsio est liée à un rejet de la règle « Chaque proposition qui suit de l'ensemble de propositions déjà concédées doit être concédée », et j'attribue ce rejet à une théorie selon laquelle une inférence se (...) base sur le rapport logique entre seulement deux propositions. I examine a number of sources according to which Swyneshed (despite the claims made by Angel D'Ors in his recent articles) does give a nova responsio partly in the form of the rule « One can deny a conjunction whose conjuncts have already been granted. » I show that this nova responsio is linked to a rejection of the rule « Every proposition following from a set of propositions which have already been granted must be granted », and I attribute this rejection to a theory whereby an inference is based on the logical relations between just two propositions. It is a working assumption in much of the literature on the meta-problem that problem intuitions are (fairly) universal, and they are (fairly) universally treated as being psychological or rationally significant. I argue that variation in the universality and psychological or rational significance of problem intuitions is worth taking seriously, and that doing so places significant and challenging constraints on what an answer to the meta-problem might look like. In particular, it raises a potential challenge for (full-blown) realists on how (...) solutions to the meta-problem link to the hard problem. (shrink)

Quality and service improvement (QSI) research employs a broad range of methods to enhance the efficiency of healthcare delivery. QSI research differs from traditional healthcare research and poses unique ethical questions. Since QSI research aims to generate knowledge to enhance quality improvement efforts, should it be considered research for regulatory purposes? Is review by a research ethics committee required? Should healthcare providers be considered research participants? If participation in QSI research entails no more than minimal risk, is consent required? The (...) lack of consensus on answers to these questions highlights the need for ethical guidance. Three distinct approaches to classifying QSI research in accordance with existing ethical principles and regulations can be found in the literature. In the first approach, QSI research is viewed as distinct from other types of healthcare research and does not require regulation. In the second approach, QSI research falls within regulatory guidelines but is exempt from research ethics committee review. In the third approach, QSI research is deemed to be part of the learning healthcare system and, as such, is subject to a different set of ethical principles entirely. In this paper, we critically assess each of these views. While none of these approaches is entirely satisfactory, we argue that use of the ethical principles governing research provides the best means of addressing the numerous questions posed by QSI research. In “The Nature of the Atonement”, Eleonore Stump explores the problem of human sin that the atonement is meant to solve, helpfully uncovering important adequacy conditions for theories of atonement. She then uses those conditions to critically evaluate Anselmian and Thomistic theories of atonement, arguing (among many other interesting things) that the Thomist has a leg up on the Anselmian when it comes to the atonement-motivating problem of human sin (pp.11-12 of ms.). I argue for two claims in what follows. (...) First, Stump’s two seemingly independent “further problems” for theorists of atonement (discussed in the penultimate section of her paper) in fact reduce to a single challenge, which suggests a strategy for future theorizing about the atonement. Second, Stump’s case that the Thomist outperforms the Anselmian on the problem of human sin is weaker than it initially appears. As we’ll see, Stump’s own account of shame implies that the Anselmian’s difficulties on this front are less serious than she thinks. (shrink)

Open peer commentary on the article “Social Autopoiesis?” by Hugo Urrestarazu. Upshot: We agree on the need to explore a concept of social autopoiesis that goes beyond a strictly human-centered concept of social systems as autopoietic communicative systems. But both Hugo Urrestarazu and Niklas Luhmann neglect the importance of semiosis in understanding communication, and this has important implications for the question of a more general approach to social systems.
