Much of the legal and social interest in new neuroimaging techniques stems from the belief that they can deliver on the materialist understanding of the relationship between (...) the brain and the mind. This article looks at predictions about the future both of scientific advances and of social reactions to those predictions. It looks at the likely technical limits on neuroscience-based mindreading, then at the likely limits in how the law might use such technologies. It describes three kinds of technical barriers to detailed and useful mindreading: the likely impossibility of making a complete and accurate model of a human brain in light of its incredible complexity, the problems of interpersonal and intrapersonal plasticity, and the problem of trying to read, now, someone's past mental state. The potential changes to the operation of the law, through the use of mindreading as evidence of pain, deception, or bias, among other things, could be extremely important. (shrink)
Background Informed consent is a requirement for all research. It is not, however, clear how much information is sufficient to make an informed decision about participation in (...) research. Information on an online questionnaire about childhood development was provided through an unfolding electronic participant sheet in three levels of information. Methods 552 participants, who completed the web-based survey, accessed and spent time reading the participant information sheet (PIS) between July 2008 and November 2009. The information behaviour of the participants was investigated. The first level contained less information than might be found on a standard PIS, the second level corresponded to a standard PIS, and the third contained more information than on a standard PIS. The actual time spent on reading the information provided in three incremental levels and the participants' evaluation of the information were calculated. Results 77% of the participants chose to access the first level of information, whereas 12% accessed the first two levels, 6% accessed all three levels of information and 23% participated without accessing information. The most accessed levels of information were those that corresponded to the average reading times. Conclusion The brief information provided in the first level was sufficient for participants to make informed decisions, while a sizeable minority of the participants chose not to access any information at all. This study adds to the debate about how much information is required to make a decision about participation in research and the results may help inform the future development of information sheets by providing data on participants' actual needs when deciding about questionnaire surveys. The title essay was originally presented as two lectures inaugurating the John Dewey lectures at Columbia. It is an important essay for understanding Quine's work for (...) class='Hi'>it brings together many themes at the center of his thinking since Word and Object. Quine quotes with approval Dewey's statement "meaning is primarily a property of behavior" and then goes on to consider a thesis which, according to Quine, is a consequence of such a behavioral theory of meaning, i.e., the thesis of the indeterminacy of meaning and translation. Quine relates this indeterminacy thesis, which he has been defending for some time, to language learning, the foundations of mathematics, and to a general view of ontological relativity. Other essays in the volume concern natural kinds and the various paradoxes of confirmation, propositional objects, quantification and existence and the empirical basis of science. All the essays are post-1965 except the introductory essay which was Quine's Presidential Address to the Eastern Division of the American Philosophical Association in 1956. This address was something of an introduction to the ideas to appear in Word and Object and is placed at the beginning of this collection to emphasize that all the essays collected here expand on and defend some of the positions of Word and Object. This article explores the possibility that some of the advantages of prospective overruling can be achieved by deploying the weaker prospective lawmaking technique of ‘not following’ which (...) the author claims is a well‐established feature of the common law as is illustrated most recently by Hall v Simons [2000] 3 All E R 673. On the analysis presented, that case abolished the barristerial immunity for the future only. Some of the problems of time can been seen at their most acute in R v Governor of Brockhill Prison, ex parte Evans [2000] 4 All ER 15 and the author ventures to suggest that had sufficient attention been paid to the distinction between ‘authoritatively overruling’ and ‘not following’ the extreme and nonsensical (but legally correct) outcome in that case might have been avoided. The unsatisfactory outcome is traced to the influence of the declaratory theory of the common law which holds that judicial decisions, especially those changing or correcting earlier decisions, are ‘inevitably retrospective’. The author therefore considers time as a problem not only for practice but also for legal theory and is concerned to challenge the descriptive and normative claims of the declaratory theory of the common law, even in the reinterpreted and diluted form which emerged from judicial opinion in, and academic comment on, Kleinwort Benson v Lincoln City Council [1999] 2 AC 349. Background To describe the preferences for disclosure of individual biomarker results among mothers participating in a longitudinal birth cohort. Methods We surveyed 343 mothers that participated in (...) the Health Outcomes and Measures of the Environment Study about their biomarker disclosure preferences. Participants were told that the study was measuring pesticide metabolites in their biological specimens, and that the health effects of these low levels of exposure are unknown. Participants were asked whether they wanted to receive their results and their child's results. In addition, they were asked about their preferred method (letter vs in person) and format (more complex vs less complex) for disclosure of results. Results Almost all of the study participants wanted to receive their individual results (340/343) as well as their child's results (342/343). However, preferences for receiving results differed by education level. Mothers with less than a college degree preferred in-person disclosure of results more often than mothers with some college education or a college degree (34.3% vs 17.4% vs 7.9%, p<0.001). Similarly, mothers with less than a college education preferred a less complex disclosure format than mothers with some college education or a college degree (59.7% vs 79.1% vs 86.3%, p<0.0001). Conclusion While almost all study participants preferred to receive results of their individual biomarker tests, level of education was a key factor in predicting preferences for disclosure of biomarker results. To ensure effective communication of this information, disclosure of biomarker results should be tailored to the education level of the study participants. (shrink)
