Patients have received experimental pharmaceuticals outside of clinical trials for decades. There are no industry-wide best practices, and many companies that have granted compassionate use, or ‘preapproval’, access to their investigational products have done so without fanfare and without divulging the process or grounds on which decisions were made. The number of compassionate use requests has increased over time. Driving the demand are new treatments for serious unmet medical needs; patient advocacy groups pressing for access to emerging treatments; internet platforms (...) enabling broad awareness of compelling cases or novel drugs and a lack of trust among some that the pharmaceutical industry and/or the FDA have patients’ best interests in mind. High-profile cases in the media have highlighted the gap between patient expectations for compassionate use and company utilisation of fair processes to adjudicate requests. With many pharmaceutical manufacturers, patient groups, healthcare providers and policy analysts unhappy with the inequities of the status quo, fairer and more ethical management of compassionate use requests was needed. This paper reports on a novel collaboration between a pharmaceutical company and an academic medical ethics department that led to the formation of the Compassionate Use Advisory Committee. Comprising medical experts, bioethicists and patient representatives, CompAC established an ethical framework for the allocation of a scarce investigational oncology agent to single patients requesting non-trial access. This is the first account of how the committee was formed and how it built an ethical framework and put it into practice. (shrink)

The controversy regarding the unit of selection is fundamentally a dispute about what is the correct causal structure of the process of evolution by natural selection and its ontological commitments. By characterizing the process as consisting of two essential steps--interaction and transmission--a singular answer to the unit question becomes ambiguous. With such an account on hand, two recent defenses of competing units of selection are considered. Richard Dawkins maintains that the gene is the appropriate unit of selection and Robert Brandon, (...) in response, argues that the individual organism is better suited to the role. This paper argues that by making explicit the underlying questions that each of these views addresses, the apparent conflict can be resolved. Furthermore, such a resolution allows for a more complete and realistic understanding of the process of evolution by natural selection. (shrink)

The Covid-19 pandemic has led to severe shortages of many essential goods and services, from hand sanitizers and N-95 masks to ICU beds and ventilators. Although rationing is not unprecedented, never before has the American public been faced with the prospect of having to ration medical goods and services on this scale.

Drawing together researchers from diverse theoretical positions, the aim of this book is to work towards a coherent and unified account of how we develop an understanding of one's and others' mental states.

One of the most fundamental questions in general jurisprudence concerns what makes it the case that the law has the content that it does. It is the job of theories of legal content to provide answers. This article offers a novel positivist theory of legal content. According to the theory it calls “principled positivism,” legal practices ground legal principles, and legal principles determine legal rules. This two-level account of the determination of legal content differs from Hart’s celebrated theory in two (...) essential respects: in relaxing Hart’s requirement that fundamental legal notions depend on judicial consensus; and in assigning weighted contributory legal norms—“principles”—an essential role in the determination of legal rights, duties, powers, and permissions. Drawing on concrete examples from American statutory and constitutional law, the article shows how the version of positivism that it introduces and defends betters Hart’s in meeting the most formidable challenges to positivism that Dworkin marshaled. The article also explains why the revisions it advances matter, legally as well as philosophically. (shrink)

In this paper I focus on the central role faith plays in the thought of Polanyi and Voegelin. I begin by indicating how both find the modern conception of scientific knowing seriously wanting. What Polanyi terms "objectivism" and Voegelin calls "scientism" is the modern tendency to reduce knowledge to only that which can be scientifically demonstrated. This errant view of knowledge does not occur in a vacuum, though, and both men draw a connection between this and the political pathologies of (...) the twentieth century. I then show the complementary ways in which these two thinkers believe recovery is possible: an epistemological solution encompassed in Polanyi's personal knowledge and an ontological reorientation that is the core of Voegelin's insistence that we must recover an awareness of human participation in transcendent reality. In the Statesman , Plato brings together--only to challenge and displace--his own crowning contributions to philosophical method, political theory, and drama. In his 1980 study, reprinted here, Mitchell Miller employs literary theory and conceptual analysis to expose the philosophical, political, and pedagogical conflict that is the underlying context of the dialogue, revealing that its chaotic variety of movements is actually a carefully harmonized act of realizing the mean. The original study left one question outstanding: what specifically, in the metaphysical (...) order of things, motivated the nameless Visitor from Elea to abandon bifurcation for his consummating non-bifurcatory division of fifteen kinds at the end of the dialogue? Miller addressed in a separate essay, first published in 1999 and reprinted here. In it, he opens the horizon of interpretation to include the new metaphysics of the Parmenides , the Philebus , and the "unwritten teachings." This study empirically examines the association between certain director characteristics and the extent of voluntary audit committee disclosure in annual reports. Results suggest that Singapore's publicly traded firms are more likely to voluntarily disclose audit committee related information as: the number of board members increases; different individuals occupy the roles of CEO and board chairperson; and the proportion of independent directors serving on the board increases. Findings, however, fail to show any association between the amount of voluntary audit committee disclosure (...) and the percentage of executive directors' ownership. Documented findings are of interest and benefit to various parties including regulators, corporate governance reformists, and corporate management. For instance, findings imply that a positive by-product of implementing major corporate governance reforms currently championed by corporate governance reformists will be an increase in audit committee disclosures. As a result, there will be less pressure on regulators to develop, introduce, and enforce mandatory audit committee disclosures that may be potentially intrusive to a firm's management. (shrink)

Electoral control refers to attempts by an election's organizer to influence the outcome by adding/deleting/partitioning voters or candidates. The important paper of Bartholdi, Tovey, and Trick [1] that introduces control proposes computational complexity as a means of resisting control attempts: Look for election systems where the chair's task in seeking control is itself computationally infeasible.We introduce and study a method of combining two or more candidate-anonymous election schemes in such a way that the combined scheme possesses all the resistances to (...) control possessed by any of its constituents: It combines their strengths. From this and new resistance constructions, we prove for the first time that there exists a neutral, anonymous election scheme that is resistant to all twenty standard types of electoral control. Preston Greene (2020) argues that we should not conduct simulation investigations because of the risk that we might be terminated if our world is a simulation designed to research various counterfactuals about the world of the simulators. In response, we propose a sequence of arguments, most of which have the form of an "even if” response to anyone unmoved by our previous arguments. It runs thus: (i) if simulation is possible, then simulators are as likely to care about simulating simulations (...) as they are likely to care about simulating basement (i.e. non-simulated) worlds. But (ii) even if simulations are interested only in simulating basement worlds the discovery that we are in a simulation will have little or no impact on the evolution of ordinary events. But (iii) even if discovering that we are in a simulation impacts the evolution of ordinary events, the effects of seeming to do so could also happen in a basement world, and might be the subject of interesting counterfactuals in the basement world Finally, (iv) there is little reason to think that there is a catastrophic effect from successful simulation probes, and no argument from the precautionary principle can be used to leverage the negligible credence one ought have in this. Thus, if we do develop a simulation probe, then let’s do it. (shrink)

Many apps request access to users’ contacts or photos and many consumers agree to these requests. However, agreeing is ethically questionable as it also gives apps access to others’ data. People thus regularly infringe each other’s information privacy. This behavior is at odds with offline practices and still poorly understood. Introducing a novel application of the theory of neutralization, we explore how people justify the giving away of others’ data and the emerging norms surrounding this behavior. To obtain a deeper (...) understanding of the potentially ambiguous norms surrounding the behavior, we investigate how people justify, i.e., neutralize, the behavior from both offender and victim perspectives. Across four studies, offenders appear more likely to admit to moral wrongdoing than victims assume. This suggests moral disagreement between offenders and victims. The discrepancy appears to be reasonably robust across different samples, apps and whether the other is identified, but diminishes when people learn how easily others’ data could be protected. These insights offer suggestions for businesses, consumers and public policy. (shrink)

The massive expansion of US higher education after World War II is a sociological puzzle: a spectacular feat of state capacity-building in a highly federated polity. Prior scholarship names academic leaders as key drivers of this expansion, yet the conditions for the possibility and fate of their activity remain under-specified. We fill this gap by theorizing what Randall Collins first callededucational entrepreneurshipas a special kind of strategic action in the US polity. We argue that the cultural authority and organizational centrality (...) of universities in the US national context combine with historical contingency to episodically produce conditions under which academic credentials can be made viable solutions to social problems. We put our theorization to the test by revisiting and extending a paradigmatic case: the expansion of engineering education at Stanford University between 1945 and 1969. Invoking several contemporaneous and subsequent cases, we demonstrate the promise of theorizing educational expansion as an outcome of strategic action by specifically located actors over time. Catholic health care is often viewed as antithetical to secular conceptions of autonomy. This view can engender calls to protect “choice” in Catholic facilities. However, this view is built on a fundamental misunderstanding of the Ethical and Religious Directives for Catholic Health Care Services (ERDs). This commentary, which responds to “Principled Conscientious Provision: Referral Symmetry and Its Implications for Protecting Secular Conscience,” by Abram Brummett et al., seeks to demonstrate the nuance of the ERDs as well as to address some (...) of the challenges various Catholic identities have when interpreting and living out the ERDs so that all patients receive high-quality, compassionate care. By highlighting the Church's desire to protect all people at every stage, I hope to dispel the caricatures that often result from misunderstandings by Catholics and non-Catholics alike. (shrink)

In this paper, we investigate the link between audit committees and earnings management providing a more comprehensive simultaneous analysis of the influence of audit committee features using a sample of 485 firm-years from Singapore's publicly traded firms during the 2000 2001 calendar period. Empirical findings indicate firms with a higher proportion of independent audit committee members are more effective at constraining earnings management. Firms with audit committees that are more diligent and/or lack the presence of independent directors serving simultaneously on (...) a substantial number of boards and committees are more effective at constraining earnings management. These findings are robust to alternative income-incentives facing corporate management. Overall, our findings have implications for stakeholders, regulators, and corporate governance. For example, our findings infer policymakers may need to focus on other audit committee characteristics to strengthen the committee's ability to constrain earnings management rather than continue the present fixation with independence. It is a pity that the question about the proper purpose of law has so often been formulated in terms of ‘the enforcement of morals’. Not only is that issue highly charged with emotion, but the sense of the expression is unclear and, taken in any ordinary sense, its importance is marginal. What Lord Devlin seems chiefly to be arguing, when he supports the enforcement of morals, is that there are in any society certain central institutions which receive and deserve (...) protection by law and that without such protection the society in question would disintegrate. His examples in our own society are monogamy and private property. It is true that these institutions are closely bound up with parts of our morality in two different ways: certain moral prohibitions are defined in terms of them, e.g. adultery and theft; a host of obligations is associated with them upon whose general acceptance and discharge their continuance depends. But it is only in an extended sense that one could describe the institutions themselves as parts of the common morality. It is possible, therefore, to hold that the law may properly be used to protect such institutions without necessarily taking the further step of maintaining that their protection requires and justifies legal prohibition of acts which offend against the associated morality. Professor Hart states this position clearly : ‘What is essential and to be preserved is the essential core. On this footing it would be an open and empirical question whether any particular moral rule or veto, e.g. on homosexuality, adultery or fornication, is so organically connected with the central core that its maintenance and preservation is required as a vital outwork or bastion.’. Scholars, theologians and lay people are in the midst of a wave of vital conversations about the nature of Christian supersessionism and the possibility of a post-supersessionist theology. This paper seeks to contribute to these conversations by drawing out the presuppositions about evental relationship that underly supersessionistic habits of thought and their alternatives. This effort will proceed primarily through a critique of Alain Badiou’s supersessionistic reading of the Jewish/Christian evental relationship while attempting to salvage his formal concept of evental recurrence (...) as a potential resource for post-supersessionist theology. The bulk of the paper is dedicated to this critique and salvage project. However, it will close with a series of brief reflections on how a non-teleogical metaphysics of evental recurrence might displace some of the teleological thought patterns that drive the dilemmas of supersessionism. I might as well say at the outset that, although I can return Christensen’s compliment, and call his response “thoughtful,” I am most interested in those places where the fullness of his thought, and particularly of his own language, has paralyzed his thought in compulsively repetitious patterns, and led him into interpretive maneuvers that he would surely be skeptical about in the reading of a literary text. Even more interesting is the way Christensen’s antipathy to the film, and the violence (...) of the language in which eh expresses the antipathy, has prevented him from registering the plainest sensory and perceptual elements of the film text. In a rather straightforward and literal sense, Christensen has neither seen nor heard Do the Right Thing, but has screened a fantasy film of his own projection. To say Christensen has projected a fantasy, however, is not to say that his response is eccentric or merely private. On the contrary, it is a shared and shareable response, a reflex in the public imaginary of American culture at the present time. As such, it deserves patient and detailed examination. W. J. T.
