In this article, I propose to see the emotion of anger in the ‘Antapodosis’ by Liudprand of Cremona as an important means of assessing characters. By depicting the anger of the Ottonian kings as just and predictable, Liudprand shows how the ideal ruler should behave. He uses various examples from the Old Testament and especially the Deuterocanonical books of the Maccabees to present the anger of the Ottonian kings in the same fashion. In his vision, the negative counterpart to the (...) Ottonians is played by the Italic kings, who show their unworthiness precisely through the inept and tyrannical use of anger. In addition to this, Liudprand writes about aristocratic anger-management as well as the anger of women. Although a man of the church, Liudprand shows himself to understand and to use the code of honour which applied to noblemen in conflicts. Women do not, on the contrary, show unmediated anger. Law search is fundamental to legal reasoning and its articulation is an important challenge and open problem in the ongoing efforts to investigate legal reasoning as a formal process. This Article formulates a mathematical model that frames the behavioral and cognitive framework of law search as a sequential decision process. The model has two components: first, a model of the legal corpus as a search space and second, a model of the search process that is compatible with that environment. The (...) search space has the structure of a “multi-network”—an interleaved structure of distinct networks—developed in earlier work. In this Article, we develop and formally describe three related models of the search process. We then implement these models on a subset of the corpus of U.S. Supreme Court opinions and assess their performance against two benchmark prediction tasks. The first is to predict the citations in a document from its semantic content. The second is to predict the search results generated by human users. For both benchmarks, all search models outperform a null model with the learning-based model outperforming the other approaches. Our results indicate that through additional work and refinement, there may be the potential for machine law search to achieve human or near-human levels of performance. (shrink)

Ernst Cassirer occupies a unique space in Twentieth-century philosophy. A great liberal humanist, his multi-faceted work spans the history of philosophy, the philosophy of science, intellectual history, aesthetics, epistemology, the study of language and myth, and more. The following lecture on Monism is an informal address delivered extemporaneously on October 9, 1892, at Altenburg, on the seventy-fifth anniversary of the "Naturforschende Gesellschaft des Osterlandes." The immediate occasion of it was a previous address delivered by Professor Schlesinger of Vienna on "Scientific Articles of Faith." This philosophical discourse contained, with reference to the weightiest and most important problems of scientific investigation, much that was indisputable; but it also contained some assertions that challenged immediate rejoinder and a statement of (...) the opposite view.
