Feminism is going to ruin your life--in the best way possible--because society screams numerous messages every moment about how women must look, act, and speak in order to earn their right to be seen and heard. The only thing any human needs to do in order to earn their right to exist, however, is to exist. Break free of the insidious narratives that hold you back from being your most authentic self.

In conversation with Hortense Gallois’ recent essay on the importance of bioethicists participating in public discourse, I suggest that speaking up is as fraught as it is important. Focusing on the anti-trans movement’s misuse of expertise, I highlight the fine line between correcting misinformation and inadvertently causing harm through ill-timed speech. Drawing on the work of Eva Feder Kittay, I suggest that knowing when to speak up and when to stay silent starts with understanding the communities we speak about and (...) the consequences that our words can have on them. Although informed consent models for prescribing hormone replacement therapy are becoming increasingly prevalent, many physicians continue to require an assessment and referral letter from a mental health professional prior to prescription. Drawing on personal and communal experience, the author argues that assessment and referral requirements are dehumanising and unethical, foregrounding the ways in which these requirements evidence a mistrust of trans people, suppress the diversity of their experiences and sustain an unjustified double standard in contrast to other forms of clinical (...) care. The best I could write would never be more than philosophical remarks." The fragmented character of Investigations is matched by its other formal oddities and difficulties: (...) its metaphors, its cryptic evocative obscurity about some things and its linguistic precision about others, its dramatization of philosophical positions in stories, in hypothetical worlds, and in the role of the interlocutor(s). Our initial and continual problem in reading Investigations is to understand the reason for its form, and to justify this form relative to its philosophical concerns and methods. I will argue that the justification of the form of Investigations comes down to a single question: how do we take up Wittgenstein's example—in thinking and in confusion—without mimicking him?IThe justification pursued in the preface bears affinities with theological justification, defined as our becoming righteous relative to God, as Calvin characterizes it, "an acceptation, whereby God receiving us into [End Page 428] favour, taketh us for righteous" (Institutes III. xi. §2).1 Righteousness as a mark of acceptation, the very tone of "righteousness" and God's power of acceptation, have no direct counterparts in Wittgenstein's philosophy. Philosophical justification does not have a doctrinal foundation that would establish any particular content nor any special relation between the pursuit of that justification (through philosophy) and its fulfillment, even hypothetically, in some possible acknowledgment of righteousness. The seriousness betrayed by Investigations need for justification, however, is expressed in the moral fervor of Wittgenstein's philosophizing. It is also his philosophical goal to encourage a kind of acceptation that the ground of our involvement in the world, in what constrains and confuses us, is no more than how we live and what we are: "Instead of the unanalyzsable, specific, indefinable; the fact that we act in such-and-such ways, e.g. punish certain actions, establish the state of affairs thus and so, give orders, render accounts, describe colours, take an interest in other's feelings. What has to be accepted, the given—it might be said—are facts of living" (Remarks on the Philosophy of Psychology, §630; c.f. PI, p. 226d).2 The translators comment in a footnote that a variant for "facts of living" in Wittgenstein's manuscript is "forms of life." What has to be accepted are forms of life.The form of Investigations is justified as part of a discovery, with or without a supporting theology, of how to move ourselves toward some greater form of perfection (although not to reach it). The Protestant cast of this justification, in Wittgenstein's case, is just (and I wouldn't want to extend it further) that while this justification is achieved by virtue of our effort, it is not effort towards the world, but towards our intransigent will, and that the grace that might enable our work is less a gift, than a condition within which we can struggle.3 Thus, "what has to be overcome," in philosophy, "is not the difficulty of the understanding but of the will" (CV, p.17).4 Philosophy for Wittgenstein is a form of self-education. One works on the will in order to see differently: but the will is neither a thing nor a faculty. Working on the will is not a psychological project of self-reform, but a reconstitution of our attitude toward what we take as necessary. We can describe such attitudes with the vocabulary of the passions by which express or curb our will: devotion, derision, hope, fear, confidence, indignation, pride, repentance, emulation, gratitude, consternation, daring, timidity, and so on. And thus "philosophy is a work on the will" is kind of maxim to help us remember a kind of attitude, purpose, and justification.I will derive an agnostic notion of justification from its Protestant [End Page 429] theological form, retaining its moral force and claim on our person, but without psychologizing it, with minimal doctrinal content, and without God. By attending to how people speak about their gender, we can find diverse answers to the question of what it is like to have a gender identity. To some, it is little more than having a body whereas others may report it as more attitudinal or dispositional—seemingly contradictory views. In this paper, I seek to reconcile these disparate answers by developing a theory of how individual gender identity comes about. In the simplest possible terms, I propose that gender identity is (...) how we make sense of our gender subjectivity, the totality of our gendered experiences of ourselves. Gender identity is constituted by gender subjectivity, but this constitutive relationship is underdetermined. While gender subjectivity may narrow the range of inhabitable gender identities, it is always compatible with more than one. To arrive at a gender identity, we arrange gender subjectivity like building materials. My theory helps us understand how different people offer seemingly incompatible accounts of their gender identity without questioning their authenticity or validity. Drawing on the principle of subsidiarity, this article develops a framework for allocating medical decision-making authority in the absence of capacity to consent and argues that decisional authority in paediatric transgender healthcare should generally lie in the patient. Regardless of patients’ capacity, there is usually nobody better positioned to make medical decisions that go to the heart of a patient’s identity than the patients themselves. Under the principle of subsidiarity, decisional authority should only be held by a higher level decision-maker, (...) such as parents or judges, if lower level decision-makers are incapable of satisfactorily addressing the issue even with support and the higher level decision-maker is better positioned to satisfactorily address the issue than all lower level decision-makers. Because gender uniquely pertains to personal identity and self-realisation, parents and judges are rarely better positioned to make complex medical decisions. Instead of taking away trans youth’s authority over their healthcare decisions, we should focus on supporting their ability to take the best possible decision for themselves. (shrink)

Il est courant de déplorer la perte d’un horizon politique fédérateur apte à mobiliser les membres de nos sociétés dans la poursuite de l’intérêt général. Entre autres responsables de la dissolution du lien politique et de l’affaiblissement du devoir civique, est convoquée la philosophie libérale dont la portée individualiste aurait rendu inconcevable le sacrifice des intérêts particuliers au nom de l’intérêt général. Il s’agit d’éclaircir cette critique en montrant que la reformulation moderne du bien commun par le libéralisme a surtout (...) introduit une indétermination qui rend compte de la difficulté pour ses membres à s’y rapporter. En vertu du droit de chacun à poursuivre ses propres buts, l’intérêt général peut aussi bien désigner la protection des droits que la satisfaction des intérêts particuliers. Or ces deux finalités sont non seulement distinctes mais peuvent également entrer en conflit, comme le révèlent aujourd’hui les débats autour des objectifs de l’Union européenne ou ceux entourant la protection des Biens Publics Mondiaux. Cet ouvrage se propose de montrer que cette tension est déjà présente chez les auteurs fondateurs du libéralisme qui oscillent entre la consécration d’un droit déterminant la sphère des intérêts légitimes et la préservation des intérêts dont découle le régime des droits. Cette thèse de doctorat se propose de reprendre l'ensemble de la philosophie pratique de Kant en aval, c'est-à-dire à partir de l'ouvrage chronologiquement tardif dans le corpus kantien, "La religion dans les limites de la simple raison" (1793), dont la première partie assigne à la volonté un défi : le "mal radical". Le "mal radical" n'est pas le mal absolu ou diabolique, mais il consiste en une inversion (Verkehrtheit) de l'ordre des principes au sein du vouloir, et ne peut être (...) déraciné que par l'entière conversion du coeur. Avec le mal, s'ouvre l'antinomie du judaïsme, considéré par le philosophe comme le contre-modèle de la foi par excellence, et du christianisme, criterium unique et anhistorique de la religion, seul à même de résoudre le problème de l'homme nouveau. Si, selon Kant, le judaïsme est nouménalement nul parce qu'incapable de véhiculer le contenu de la religion rationnelle, le philosophe, qui considère l'interdit biblique de l'idolâtrie comme "le commandement le plus sublime du Livre de loi des Juifs", lui reconnaît néanmoins le mérite de mettre l'accent sur le respect. Although it has been recognized that employees regularly engage in non-green behaviors, little research has been conducted to explain how these behaviors may be avoided. Using data from a three-wave study, this study tested a moderated-mediation model in which trust in the immediate manager was expected to increase the indirect effect of supervisory support for the environment on non-green behaviors through employee environmental commitment. While the findings showed, as predicted, that exchange relationships with the immediate manager reduce the tendency of (...) employees to engage in non-green behaviors, the indirect effect of supervisory support on non-green behaviors through employee environmental commitment was moderated at a low level of trust in the manager, contrary to predictions. Though unexpected, this result seems less surprising when discussed in the light of negotiated exchange, suggesting that employee efforts to avoid non-green behaviors need to be seen as the result of a deal between managers and subordinates. The findings of this study contribute to the emerging literature on social exchange in an environmental context and have implications for organizations seeking to achieve environmental sustainability. During the last two decades there has been an enormous development in treatment possibilities in the field of neonatology, particularly for (extremely) premature infants. Although there are cross-cultural differences in treatment strategy, an overview of the literature suggests that every country is confronted with moral dilemmas in this area. These concern decisions to initiate or withhold treatment directly at birth and, later on, decisions to withdraw treatment with the possible consequence that the child will die. Given that the neonate cannot (...) express his or her own will, who will decide? And on the basis of what information, values and norms? We explored some of these issues in daily practice by interviewing a small sample of health care practitioners in a Dutch university Neonatal Intensive Care Unit (NICU). It turned out that experiencing moral dilemmas is part of their daily functioning. Nurses underline the suffering of the newborn, whereas physicians stress uncertainty in treatment outcome. To make the best of it, nurses focus on their caring task, whereas physicians hope that future follow-up research will lead to more predictable outcomes. As for their own offspring, part of these professionals would hesitate to bring their own extremely premature newborn to a NICU. For the most oppressing dilemma reported – terminating an already initiated treatment – we propose the concept of ‘evidence shift’ to clarify the ambiguous position of uncertainty in decision making. The academic dominance of cultural studies and the increasing interest and significance of cultural conflict in our world has encouraged various theories of culture, the most pervasive being theories of transculture and hybrid cultural forms and entities. In this guest column, Bourbon argues that all such trans theories are fundamentally flawed and distort the very idea of culture. His essay analyzes the concept of transobjects and transcultures, looking both at the assumptions supporting such objects and ideas and at their (...) explanatory uses. This discussion leads to one on the relationship between texts and contexts. Most cultural theories, and all transcultural theories, confuse the relationship between texts and contexts, specifically misusing the idea of the conditions of possibility, while relying on various forms of personification. Bourbon both criticizes these ideas and also offers a more modest idea of culture, along with specific suggestions on how to study and understand what we call “products of culture,” including fictions and ourselves. As global warming continues to attract growing levels of attention, various stakeholders have put climate change on corporate agendas and expect firms to disclose relevant greenhouse gas information. In this paper, we investigate the consistency of the GHG information voluntarily disclosed by French listed firms through two different communication channels: corporate reports and the Carbon Disclosure Project. More precisely, we contrast the amounts of GHG emissions reported and the methodological explanations provided in each channel. Consistent with a stakeholder theory perspective, (...) we find that GHG amounts are significantly lower in the CR than in the CDP. We also find that firms increase the CR figures’ traceability when there is a discrepancy between disclosures in the two channels. We suggest that the aim of this greater traceability is to enhance information credibility across the different channels used. (shrink)

This paper focuses on the materialistic account of the blending and the way it shapes an original organism model. I aim to shed light on the threads of connections we can gather between the Presocratic and the Stoic views on the physical krasis of the body. The Stoics share with Parmenides and Empedocles the idea of a single material cosmic continuum in which thought and perception depend on the various blendings of the physical constituents of the body. Both of these (...) naturalistic traditions are committed to the view that substance is continuous and undergoes constant and qualitative change. My point is to underline how this view of a sympathetic cosmos presupposes a model of the individuality that is radically open. Thus, by taking off the notion of the krasis, the Stoics take off a problem – namely, that of the organism – that is first fleshed out by the Presocratics – Parmenides and Empedocles in particular – philosophers. In this respect, the Stoic view of relational identity indebts to the Presocratic account, beyond and against the Aristotelian one. (shrink)

A well-established narrative in the history of science has it that the years around 1800 saw the end of a purely descriptive, classificatory and static natural history. The emergence of a temporal understanding of nature and the new developmental-history approach, it is thought, permitted the formation of modern biology. This paper questions that historical narrative by closely analysing the concepts of development, history and time set out in Karl Ernst von Baer’s study of the mammalian egg (1827). I show that (...) Baer’s research on embryogenesis aimed not simply to explain temporal changes, but to inscribe the formation of new individual organisms into a continuous, unending organic process. I confront Baer’s views with other explanations of embryogenesis arising in the 1820s and 1830s, especially those of Jean-Baptiste Dumas and Jean-Louis Prévost and of Theodor Schwann. By highlighting divergences between these scientists, especially as to their view of the role of gender differences in reproduction, I argue that biology evolved not from a homogeneous concept of developmental history but out of various, even opposing, views and research programmes. Thus, the birth of biology did not imply the end of all natural history’s thought models. (shrink)

This paper analyzes resource utilization of the Sundarbans in terms of the contradictory issues and pressures generated by foreign assistance and commercial interests in Bangladesh. In the paper, the historical legacy of resource definition and use that shaped the development of forest policy under the British is considered. In addition, the critical role of the state and the interests and pressures on the Government are explored as these shape the larger context in which current natural resource policy is generated and (...) maintained. Three areas of potential conflict between current devlopment policy and resource management control are noted. They are 1) the privatization of production and resource exploitation in contrast to common property resource use, 2) the need to meet foreign exchange requirements versus local user interests, and 3) commercial versus local user interests.The paper argues that national and international fiscal and economic constraints operate to favor commercial interests and natural resource exports at the cost of policies that emphasize an active approach to the generation and preservation of renewable resources such as the Sundarbans.
