In order to build on the information that was obtained in the course of the first study, a follow-up survey was conducted first by phone and subsequently in a written form between August and October 2014. We contacted 1.858 hospitals in all of Germany for the follow-up survey by phone. In cases where a hospital had not participated in the first study, the willingness to participate in the follow-up survey was established in advance. The survey’s dispatch was ensured in the (...) case of acceptance. The same structured survey was used as a research tool. The data of the first study and the follow-up survey were merged and evaluated. 654 surveys could be evaluated altogether. Our survey by phone revealed that 912 hospitals in all of Germany have at least one form of clinical ethics consultation available. The health care ethics committee is the most frequently implemented structure of clinical ethics consultation. The implementation of clinical ethics consultation is dependent on sponsorship and hospital size. Recommendations to deliver structures of clinical ethics consultations have a smaller influence on the implementation compared to the certification by KTQ respectively proCum Cert. The rate of implementation in regard to the structures of clinical ethics consultation has steadily increased for years. The establishment of clinical ethics consultation in German hospitals should be further promoted. It would be desirable further to develop suitable juridical regulations in order to implement clinical ethics consultation as well as structural parameters. (shrink)

The goal of achieving Universal Health Coverage (UHC) can generally be realized only in stages. Moreover, resource, capacity and political constraints mean governments often face difficult trade-offs on the path to UHC. In a 2014 report, Making fair choices on the path to UHC, the WHO Consultative Group on Equity and Universal Health Coverage articulated principles for making such trade-offs in an equitable manner. We present three case studies which illustrate how these principles can guide practical decision-making. These case studies (...) show how progressive realization of the right to health can be effectively guided by priority-setting principles, including generating the greatest total health gain, priority for the worse off, and financial risk protection. The parameters governing our behavior are in constant flux. Accurately capturing these dynamics in cognitive models poses a challenge to modelers. Here, we demonstrate a mapping of ACT-R's declarative memory onto the linear ballistic accumulator (LBA), a mathematical model describing a competition between evidence accumulation processes. We show that this mapping provides a method for inferring individual ACT-R parameters without requiring the modeler to build and fit an entire ACT-R model. Existing parameter estimation methods for the LBA can be used, (...) instead of the computationally expensive parameter sweeps that are traditionally done. We conduct a parameter recovery study to confirm that the LBA can recover ACT-R parameters from simulated data. Then, as a proof of concept, we use the LBA to estimate ACT-R parameters from an empirical dataset. The resulting parameter estimates provide a cognitively meaningful explanation for observed differences in behavior over time and between individuals. In addition, we find that the mapping between ACT-R and LBA lends a more concrete interpretation to ACT-R's latency factor parameter, namely as a measure of response caution. This work contributes to a growing movement towards integrating formal modeling approaches in cognitive science. (shrink)

Vaccination complacency occurs when perceived risks of vaccine-preventable diseases are sufficiently low so that vaccination is no longer perceived as a necessary precaution. Disease outbreaks can once again increase perceptions of risk, thereby decrease vaccine complacency, and in turn decrease vaccine hesitancy. In the past 20 years, experimental philosophers have investigated folk intuitions about free will and moral responsibility, and their compatibility with determinism. To determine whether laypeople are “natural compatibilists” or “natural incompatibilists”, they have used vignettes describing agents living in deterministic universes. However, later research has suggested that participants’ answers to these studies are plagued with comprehension errors: either people fail to really accept that these universes are deterministic, or they confuse determinism with something else. This had led certain experimenters (...) to conclude that maybe folk intuitions about the compatibility of free will with determinism could not be empirically investigated. Here, we propose that we should refrain from embracing this pessimistic conclusion, as scenarios involving time loops might allow experiments to bypass most of these methodological issues. Indeed, scenarios involving time loops belong both to the philosophical literature on free will and to popular culture. As such, they might constitute a bridge between the two worlds. We present the results of five studies using time loops to investigate people’s intuitions about determinism, free will and moral responsibility. The results of these studies allow us to reach two conclusions. The first is that, when people are introduced to determinism through time loops, they do seem to understand what determinism entails. The second is that, at least in the context of time loops, people do not seem to consider determinism to be incompatible with free will and moral responsibility. (shrink)

The ‘Knobe effect’ is the name given to the empirical finding that judgments about whether an action is intentional or not seems to depend on the moral valence of this action. To account for this phenomenon, Scaife and Webber have recently advanced the ‘Consideration Hypothesis’, according to which people’s ascriptions of intentionality are driven by whether they think the agent took the outcome in consideration when taking his decision. In this paper, I examine Scaife and Webber’s hypothesis and conclude that (...) it is supported neither by the existing literature nor by their own experiments, whose results I did not replicate, and that the ‘Consideration Hypothesis’ is not the best available account of the ‘Knobe Effect’. We classify a sharp phase transition threshold for Friedman’s finite adjacent Ramsey theorem. We extend the method for showing this result to two previous classifications involving Ramsey theorem variants: the Paris–Harrington theorem and the Kanamori–McAloon theorem. We also provide tools to remove ad hoc arguments from the proofs of phase transition results as much as currently possible.

Salomon Maïmon argues that the formal determination of experience in Kant’s first Kritik insufficiently answers the question ‘quid juris?’. As an alternative to Kant’s theory, he develops a genetic transcendentalism in which experience is completely determined a priori. Discussing this genetic approach, I focus on how the spatiotemporal determinations of conscious experience are traced back to pure ideal relations. Relying on Leibniz and his theory of space and time, I explain how the extensive magnitudes of consciousness are founded in intensive (...) magnitudes of what Maïmon calls ‘pure thought’. As the latter is the transcendental ground for both sensibility and the understanding, Maïmon’s theory contains a radical form of immanence, much like the philosophy of Spinoza and Gilles Deleuze. Responding to recent concerns about the reliability of the published literature in psychology and other disciplines, we formed the X-Phi Replicability Project to estimate the reproducibility of experimental philosophy. Drawing on a representative sample of 40 x-phi studies published between 2003 and 2015, we enlisted 20 research teams across 8 countries to conduct a high-quality replication of each study in order to compare the results to the original published findings. We found that x-phi studies – as represented in our sample (...) – successfully replicated about 70% of the time. We discuss possible reasons for this relatively high replication rate in the field of experimental philosophy and offer suggestions for best research practices going forward. (shrink)

'Identity' as a concept has many faces, and its very versatility in different contexts can make it hard to define. Florian Coulmas discusses the many meanings of this slippery concept, considering why individual and collective identities are important to us, and discussing the problems asserting individual identities can create.

ABSTRACT This article examines Bergson’s critique of intensive magnitude in Time and Free Will. I demonstrate how his rejection of a different kind of quantity that is ordinal and does not allow measurement, and the underlying strict dualism of quantity and quality, is inconsistent with both the letter and the spirit of his later philosophy. I dismantle two main strategies for explaining these inconsistencies. Furthermore, I argue that Bergson’s simplistic conception of quantity in terms of homogeneous multiplicity, which is operative (...) in his rejection of an alternative conception of quantity, lacks justification in the face of the transformations that the concept of quantity underwent in the history of mathematics and physics. Large scale experiments at CERN’s Large Hadron Collider rely heavily on computer simulations, a fact that has recently caught philosophers’ attention. CSs obviously require appropriate modeling, and it is a common assumption among philosophers that the relevant models can be ordered into hierarchical structures. Focusing on LHC’s ATLAS experiment, we will establish three central results here: with some distinct modifications, individual components of ATLAS’ overall simulation infrastructure can be ordered into hierarchical structures. Hence, to a good degree of approximation, hierarchical (...) accounts remain valid at least as descriptive accounts of initial modeling steps. In order to perform the epistemic function Winsberg Model-based reasoning in scientific discovery. Kluwer Academic/plenum Publishers, New York, pp 255–269, 1999) assigns to models in simulation—generate knowledge through a sequence of skillful but non-deductive transformations—ATLAS’ simulation models have to be considered part of a network rather than a hierarchy, in turn making the associated simulation modeling messy rather than motley. Deriving knowledge-claims from this ‘mess’ requires two sources of justification: holistic validation :253–262, 2010; in Carrier M, Nordmann A Science in the context of application. Springer, Berlin, pp 115–130, 2011), and model coherence. As it turns out, the degree of model coherence sets HEP apart from other messy, simulation-intensive disciplines such as climate science, and the reasons for this are to be sought in the historical, empirical and theoretical foundations of the respective discipline. Despite remarkable efforts, it remains notoriously difficult to equip quantum theory with a coherent ontology. Hence, Healey (2017, 12) has recently suggested that ‘‘quantum theory has no physical ontology and states no facts about physical objects or events’’, and Fuchs et al. (2014, 752) similarly hold that ‘‘quantum mechanics itself does not deal directly with the objective world’’. While intriguing, these positions either raise the question of how talk of ‘physical reality’ can even remain meaningful, or they must ultimately embrace (...) a hidden variables-view, in tension with their original project. I here offer a neo-Kantian alternative. In particular, I will show how constitutive elements in the sense of Reichenbach (1920) and Friedman (1999, 2001) can be identified within quantum theory, through considerations of symmetries that allow the constitution of a ‘quantum reality’, without invoking any notion of a radically mind-independent reality. The resulting conception will inherit elements from pragmatist and ‘QBist’ approaches, but also differ from them in crucial respects. Furthermore, going beyond the Friedmanian program, I will show how non-fundamental and approximate symmetries can be relevant for identifying constitutive principles. (shrink)

The principles regulating our linguistic practices can then be grouped into two broad categories (Dummett 1973: 396, 1991: 211). We might state them as follows: I-principles: state the circumstances under which an assertion of a sentence containing the expression in question is warranted. E-principles: state the consequences of asserting a sentence containing the expression. The philosophy of G.W.F. Hegel emphasises the importance of understanding consciousness and, even more so, self-consciousness. His lectures on aesthetics contain aesthetic theories for all forms of art (viz. architecture, painting, music or poetry), but critics use them only in significantly altered versions. The present paper attempts to give an in-depth analysis of a poem following one interpretation of Hegel's philosophy of self-consciousness. The poem analysed is not a German Romantic poem, but an Indian poem from the mid-20th century. Whereas the importance of authenticity in relation to educational contexts has been highlighted, educational authenticity has mainly referred to a real-life/world convergence or the notion of teacher authenticity, implying that authenticity can be taught and learnt. This view, however, has largely overlooked philosophical considerations so that the semantic and ontological vagueness surrounding authenticity has generated an uneven dialectic between the term’s potential significance and its actual relevance for the educational field. This article aims to move closer towards an understanding of (...) philosophically grounded EA as a normative ideal for education. It discusses three contemporary philosophical models of authenticity and how they relate to the multicultural dimension of the International Baccalaureate’s Primary Years Programme. I will argue that by extrapolating common features of these theories, EA bears significant potential for contemporary education as it combines the importance of civic engagement, preparation for political involvement, and co-construction of knowledge and offers a fresh rationale for student involvement in curriculum planning. Ce travail opère une relecture de deux textes de jeunesse de Th. W. Adorno dans l’optique d’une réévaluation de leur importance pour son œuvre ultérieure, en particulier pour sa philosophie de l’histoire. Ces deux textes, dans lesquels est défini le concept d’interprétation philosophique de l’histoire, ou Deutung, seront abordés à partir d’une question issue des philosophies de l’histoire classiques du xixe siècle, celle du lien entre cette interprétation philosophique et une expérience commune de l’histoire. Nous montrerons que, loin de pouvoir (...) constituer un programme univoque pour la suite de la philosophie adornienne, ces textes de jeunesse sont au contraire travaillés par une ambiguïté. Fondamentale pour toute la philosophie adornienne de l’histoire, cette ambiguïté prend place entre un fondement méthodologique de la Deutung et la tentative de l’originer au contraire dans une expérience dialectique de la réalité historique. Recent evidence confirming that the administration of antiretroviral drugs (ARVs) to HIV-infected persons may effectively reduce their risk of transmission has revived the discussion about priority setting in the fight against HIV/AIDS. The fact that the very same drugs can be used both for treatment purposes and for preventive purposes (Treatment as Prevention) has been seen as paradigm-shifting and taken to spark a new controversy: In a context of scarce resources, should the allocation of ARVs be prioritized based on the (...) goal of providing treatment, or on the goal of preventing the spread of the HIV epidemic? Contributions to this discussion tend to assume that treatment and prevention constitute two divergent goals that entail conflicting priorities. We challenge that assumption on the basis of both conceptual and empirical examination. We argue that, as far as the provision of ARVs to HIV-infected persons is concerned, the goals of treatment and prevention do not entail conflicting priorities; to the contrary, they dictate converging strategies for the optimal allocation of ARVs. In light of the current evidence, the concept of Treatment as Prevention can indeed be seen as paradigm-shifting, yet in a novel way: Rather than extending the tension between the goals of treatment and prevention to the level of drug-allocation, it dissolves this tension by providing a rationale for a unified strategy for allocating ARVs. One of the goals of computerized tutoring systems is to optimize the learning of facts. Over a hundred years of declarative memory research have identified two robust effects that can improve such systems: the spacing and the testing effect. By making optimal use of both and adjusting the system to the individual learner using cognitive models based on declarative memory theories, such systems consistently outperform traditional methods. This adjustment process is driven by a continuously updated estimate of the rate of (...) forgetting for each item and learner on the basis of the learner's accuracy and response time. In this study, we investigated to what extent these estimates of individual rates of forgetting are stable over time and across different materials. We demonstrate that they are stable over time but not across materials. Even though most theories of human declarative memory assume a single underlying rate of forgetting, we show that, in practice, it makes sense to assume different materials are forgotten at different rates. If a computerized, adaptive fact-learning system allowed different rates of forgetting for different materials, it could adapt to individual learners more readily. (shrink)

In this paper, I provide a general introduction to the trolley problem. I describe its birth as a philosophical thought experiment, then its successful career in moral psychology. I explain the different reasons behind its popularity and success but argue that, despite its popularity and widespread utilization in psychological research, few researchers have actually tried to directly solve it and that we are still ignorant of the real factors guiding our responses to trolley cases. Against the idea that trolley problems (...) were just a fad, I insist on the importance of seriously studying them and put forward a new hypothesis about the psychological mechanisms underlying our responses to trolley cases. According to tradition, logic is normative for reasoning. Gilbert Harman challenged the view that there is any straightforward connection between logical consequence and norms of reasoning. Authors including John MacFarlane and Hartry Field have sought to rehabilitate the traditional view. I argue that the debate is marred by a failure to distinguish three types of normative assessment, and hence three ways to understand the question of the normativity of logic. Logical principles might be thought to provide the reasoning agent with (...) first-personal directives; they might be thought to serve as third-personal evaluative standards; or they might underwrite our third-personal appraisals of others whereby we attribute praise and blame. I characterize the three normative functions in general terms and show how a failure to appreciate this threefold distinction has led disputants to talk past one another. I further show how the distinction encourages fruitful engagement with and, ultimately, resolution of the question. (shrink)

In this paper, we argue that, barring a few important exceptions, the phenomenon we refer to using the expression “being moved” is a distinct type of emotion. In this paper’s first section, we motivate this hypothesis by reflecting on our linguistic use of this expression. In section two, pursuing a methodology that is both conceptual and empirical, we try to show that the phenomenon satisfies the five most commonly used criteria in philosophy and psychology for thinking that some affective episode (...) is a distinct emotion. Indeed, being moved, we claim, is the experience of a positive core value (particular object) perceived by the moved subject as standing out (formal object) in the circumstances triggering the emotion. Drawing on numerous examples, we describe the distinctively rich phenomenology characteristic of the experience as well as the far-reaching action-tendencies and functions associated with it. Having thus shown that the candidate emotion seem to satisfy the five criteria, we go on, in section three, to compare it with sadness and joy, arguing that it should not be confused with either. Finally, in section four, we illustrate the explanatory power of our account of “being moved” by showing how it can shed light on, and maybe even justify, the widespread distrust we feel towards the exhibition of ‘sentimentality’. On the whole and if we are right, we have uncovered an emotion which, though never or rarely talked about, is of great interest and no small importance. (shrink)

We challenge an argument that aims to support Aesthetic Realism by claiming, first, that common sense is realist about aesthetic judgments because it considers that aesthetic judgments can be right or wrong, and, second, that becauseAesthetic Realism comes from and accounts for “folk aesthetics,” it is the best aesthetic theory available.We empirically evaluate this argument by probing whether ordinary people with no training whatsoever in the subtle debates of aesthetic philosophy consider their aesthetic judgments as right or wrong. To operate in an unpredictable environment, a vehicle with advanced driving assistance systems, such as a robot or a drone, not only needs to register its surroundings but also to combine data from different sensors into a world model, for which it employs filter algorithms. Such world models, as this article argues with reference to the SLAM problem in robotics, consist of nothing other than probabilities about states and events arising in the environment. The model, thus, contains a virtuality of (...) possible worlds that are the basis for adaptive behavior. The article shows that the current development of these technologies requires new concepts because their complex adaptive behaviors cannot be explained by referring them to mere algorithmic processes. Instead, it proposes the heuristic instrument of microdecisions to designate the temporality of decisions between alternatives that are created by probabilistic procedures of world modeling. Microdecisions are more than the implementation of deterministic processes—they decide between possibilities and, thus, always open up the potential of their otherness. By describing autonomous adaptive technologies with this heuristic, the question of sovereignty inevitably arises. It forces us to re-think what autonomy means when decisions can be automated. Deep neural networks have become increasingly successful in applications from biology to cosmology to social science. Trained DNNs, moreover, correspond to models that ideally allow the prediction of new phenomena. Building in part on the literature on ‘eXplainable AI’, I here argue that these models are instrumental in a sense that makes them non-explanatory, and that their automated generation is opaque in a unique way. This combination implies the possibility of an unprecedented gap between discovery and explanation: When unsupervised models (...) are successfully used in exploratory contexts, scientists face a whole new challenge in forming the concepts required for understanding underlying mechanisms. Nach einer originiellen Lesart des Autors gebietet der kategorische Imperativ, das eigene Glück stets nur als Bestandteil allgemeinen Glücks zu verfolgen. Das höchste Gut ist nun derjenige Zustand der Welt, der erreicht würde, wenn alle Menschen diesem Prinzip gemäß handeln würden und ihrem gemeinsamen Streben nach allgemeiner Glückseligkeit auch Erfolg beschieden wäre. Dieser Zustand ist ein notwendiges Ziel vernünftigen Handelns, das (...) sich aus dem kategorischen Imperativ ergibt, dessen Verfolgung aber trotzdem über das bloße Handeln nach verallgemeinerbaren Maximen hinausgeht. Durch eine Neuinterpretation von Kants These, im höchsten Gut sei das Glück stets proportional zur Tugend, gelingt es dem Autor, nicht nur diese These, sondern auch Kants Aussagen über Gerechtigkeit, Glückswürdigkeit und Hoffnung argumentativ an den kategorischen Imperativ zu binden und damit im Kontext des höchsten Guts zu rechtfertigen. Dem Autor zufolge hat das höchste Gut somit eine wichtige eigenständige Funktion in der kantischen Ethik, ohne ihren deontologischen Charakter in Frage zu stellen. (shrink)

ABSTRACT:Do corporations have a duty to promote just institutions? Agreeing with Hsieh’s recent contribution, this article argues that they do. However, contrary to Hsieh, it holds that such a claim cannot be advanced convincingly only by reference to the negative duty to do no harm. Instead, such a duty necessarily must be grounded in positive obligation. In the search of a foundation for a positive duty for corporations to further just institutions, Stephen Kobrin’s notion of “private political authority” offers a (...) promising connecting point. Political authority implies political responsibility; Political obligation, however, includes more than merely not doing any harm—it is essentially positive obligation. The implications of the new political responsibilities of multinational corporations may even go far beyond the particular duty to promote just institutions; they may be symptomatic for a much more profound shift from an individual to a collective age. Chapter 1 serves as an introduction to the vast topic of laws of nature. Thus, it first outlines the alleged characteristics of the laws of nature, namely truth, objectivity, contingency, necessity, universality, grounding counterfactuals and their role in science. Among these aspects, the peculiar modal status of laws of nature will be identified as the ‘holy grail’ of the debate. The second part of this chapter is concerned with the three main families of theories of laws of nature – neo-humean, (...) ADT and dispositional theories – which are introduced and evaluated in regard to the aforementioned characteristics. It will then be argued that among those theories, the dispositional ones show the greatest promise of being able to account for the natural necessity of the laws of nature. -/- Before a dispositional account of laws of nature can be given, dispositions themselves need to be understood. Consequently, Chapter 2 introduces various analyses of dispositions. As dispositions are pre-theoretically close to conditionals, a lot of analyses try to reduce dispositions to conditionals. This chapter critically assesses some chosen accounts: the simple conditional analysis, Carnap’s reduction sentences, the simple counterfactual conditional analysis, Lewis’ reformed conditional analysis, Malzkorn’s sophisticated con- ditional analysis, Choi and Gundersen’s context-dependent analysis, Manley and Wasserman’s gradable dispostion ascriptions, and Fara’s habituals. The prevention problem, which poses a threat to any account of dispositions, is depicted. It is argued that, ultimately, none of the conditionalising attempts is able to convince since they all exclude the problem cases which leads to explanation gaps and outlaw areas. -/- Chapter 3 contains the synchronic part of my preferred solution to the prevention problem. The notion of ‘component causes’ is introduced, and the ontological status of components discussed. Millikan’s oil drop experiment is depicted en detail. In a first step, making a distinction between dispositions and the resulting behaviour is advocated. Via the symmetry argument, mani- festations and masks are shown to be ontologically on a par. In a second step, a triadic account consisting of dispositions, wirkungen and resultant behaviour, is established. Finally, the ontological interpretation of the trias is given. It is in the nature of the dispositions to bring about the wirkungen. These interact via combinations rules like the functions f and fa or vector addition, which are built-in into to dispositions. -/- The diachronic part of my favourite interpretation, the triadic process picture of dispositions (TPD), is presented in chapter 4. The dynamics of dispo- sition manifestation are discussed and it is argued that fiddling with the trigger works only up to a certain point. Diachronic masking cases turn out to be no- torious. An excursus to action theory shows that the ontology needs to include processes, as understanding disposition manifestations as processes solves the diachronic prevention problem. The (TPD) can account for all counterexamples by taking the stimulus as the beginning of the manifestation process. -/- Chapter 5 applies the (TPD) to the debate about laws of nature. In order to judge its adequacy, the characteristics of laws of nature given in chapter 1 are consulted. As a first step, the criteria truth, objectivity, universality, grounding counterfactuals and their role in science are covered. It is sketched how the (TPD) can account for these. The second part of the chapter deals with the modal status of the laws of nature. The dispositional essentialist’s view that laws of nature are metaphysical necessary is depicted and then criticised. It is argued that metaphysical necessity is not the appropriate modal status of the laws of nature. Finally, the (TPD) account of the necessity of the laws of nature is presented: laws of nature are naturally necessary and metaphysically contingent. (shrink)
