This paper deals with phenomenological distinctions concerning empathy with real persons and empathy with fictional characters. We will introduce both contemporary accounts of our perception of others and Edith Stein’s account of empathy. These theories will turn out to be fruitful in defending our main thesis, i.e. that the differences between empathy with real people and empathy with fictional characters are not structural but just qualitative. We will argue that in both cases empathy is a direct act of perceiving others (...) and their lived experience. However, stemming from Stein’s work, we will underline that empathy with real persons is in principio more vivid and intense than empathy with fictional characters. In order to identify similarities and differences between empathy de vivo and empathy in fiction, we will focus on the following issues: the quality of perception; the motivational context and the “life-world context”; the ontological status of persons vs. characters. In this paper, I will argue in favor of a direct perception account of social cognition, focusing on the idea that we can directly grasp at least some mental states of others through their bodily expressions. I will investigate the way we should consider expressions and their relations to mental phenomena in order to defend DP. In order to do so, I will present Krueger and Overgaard’s idea of expressions as constitutive proper parts of the mental phenomena expressed and I (...) will show how this position can support DP. Then, I will present the way in which the authors seem to construe the relation of parthood between expressions and mental states – that is in terms of components of integral wholes, and I will introduce the possible issues that derive from this strategy. I will propose a different way to understand this parthood relation, referring to Husserl’s notion of moments as distinct from that of pieces. I will narrow my analysis to expressions of feelings, and I will try to argue that they can be described more aptly as moments of the feelings expressed. In this paper, I will focus on the process of constitution of oneself as an embodied being and, more precisely, on the specific way in which one can experience oneself not just as an embodied self, but rather as the actual embodied person he/she is. I will start by describing the most basic way in which our embodied self is constituted, that is as a felt-feeling body and as the zero-point of orientation of all our sensations and perceptions. Then, I (...) will show how our body can be constituted for us also as an instrument for action, leading to the experience of what Husserl called “I-can”. I will argue that, even though in this latter form of body awareness we can experience some traits of our own personality, a further dimension of our embodied life – that is, the expressive one – allows us to have a more defined experience of the specific embodied persons we are. I will describe what “person” specifically means in my framework and, on this basis, I will show how the expressive dimension of our body can account for my experience of myself not just as an embodied self, but as the embodied person I am. In this paper I shall attempt to give an enactive account of the dynamic qualities of music. Starting from Krueger’s account of musical experience, I will highlight how music’s qualities of movement are constituted in the horizon of an embodied consciousness – that is, an embodied subject who can virtually or actually bodily entrain with music and then follow the musical profile. I will argue that the common rythmòs-structure of both music and movement makes such an enactive constitution possible. In (...) this sense, the perception of music’s rythmòs – that is, the perception of its teleological tendency – will turn out to be the condition of possibility for the enaction of music dynamic qualities. But if so, music’s quality of being teleologically-structured will remain unexplained by the discussed enactive account and will need another description of how it is constituted in the horizon of consciousness. When it comes to the debate about the constitutive, supervenience basis for cognition and cognitive processes, two theoretical positions are often opposed to each other. The first is the intracranialist one, exemplified by Adams and Aizawa’s idea that cognition has its supervenience basis just within the boundaries of the brain. The second is the transcranialist one, exemplified by Noë’s and Clark and Chalmers’s theses that the constitutive basis of cognition and the mind can span the brain, the body and the (...) environment. In this paper I want to maintain that Adams and Aizawa’s main intracranialist argument against transcranialism does not hold. In particular, I will try to argue that such an argument does not allow them neither to establish intracranialism nor to defeat transcranialism. (shrink)

In this paper I focus on possible boosting factors for the sense of we-agency in joint actions. My aim is to shed light on a factor that, until now, has received little or no consideration at all, and that I call vitality attunement. I argue that vitality attunement stands between two other boosting factors for the sense of we-agency—i.e., rhythmic alignment and emotional attunement. Investigating two examples of joint action, i.e., dancing and joint musical performances, I show that vitality attunement (...) is not reducible to either of the other two boosting factors and that it deserves to be studied on its own as a distinctive boosting factor for the sense of we-agency. In order to argue for my thesis, I first introduce some of the most crucial aspects of the sense of we-agency in joint actions, then I analyze how rhythmic alignment and emotional attunement have been argued to foster such an experience, and finally I introduce vitality attunement, describing how it too can be a boosting factor for the sense of we and of we-agency. In this special issue, our aim is to analyse the role of emotions with particular attention to shaping political actions in the face of present challenges to justice. The relationship between the widespread rise of collective emotions and the experience of injustice in our societies is a pressing issue, both in our everyday practice of ethical and political discourse and in philosophical reflection and discussion. Some negative emotions—such as fear, resentment, greed, distrust towards institutions, and disrespect for basic human rights—are (...) often manipulated and amplified. Other, more positive, emotions, such as respect, hope, solidarity, and affinity, often seem to be not enough to give rise to alternative policies. This worldwide problem reflects a deep economic, social, and existential crisis. In this framework, philosophical reflection on emotions can be put fruitfully in dialogue with the contemporary philosophical analysis of collective intentionality and collective agency, which aims at investigating the nature of different types of groups and their main features as well as phenomena such as sense of group membership and group agency. Indeed, it is often argued that collective emotions boost the sense of group belonging in individual members and act to reduce uncertainty in joint actions. In normative terms, feelings such as the rejection of cruelty have been proposed as the foundation of moral equality, and even rationalistic approaches tend to focus on respect first of all as a feeling, as Kant maintained. The global spread of severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) or coronavirus disease 19 (COVID-19) has led to the imposition of severely restrictive measures by governments in the Western hemisphere. We feel a contrast between these measures and our freedom. This contrast, we argue, is a false perception. It only appears to us because we look at the issue through our contemporary moral philosophy of utilitarianism and an understanding of freedom as absence of constraints. Both these views can be (...) substituted with more sophisticated alternatives, namely an ethics of virtue and a notion of freedom of the will. These offer a fuller picture of morality and enable us to cooperate with the current restrictions by consciously choosing to adhere to them instead of perceiving them as draconian and immoral. We ask whether we should collaborate with the restrictions and argue that considerations of virtue will lead to an affirmative answer. More broadly, virtue ethics permits to deal with the practical concerns about how an individual should behave during this pandemic, given the current lockdown measures or lack thereof. -/- In section 1, we present how utilitarianism and a notion of freedom as negative liberty support the opposition to restrictive measures. In section 2, we outline an alternative based on an ethics of virtue and a more elaborated notion of free will. At Columbia University in 1906, William James gave a highly confrontational speech to the American Philosophical Association (APA). He ignored the technical philosophical questions the audience had gathered to discuss and instead addressed the topic of human energy. Tramping on the rules of academic decorum, James invoked the work of amateurs, read testimonials on the benefits of yoga and alcohol, and concluded by urging his listeners to take up this psychological and physiological problem. What was the goal of this unusual (...) speech? Rather than an oddity, Francesca Bordogna asserts that the APA address was emblematic—it was just one of many gestures that James employed as he plowed through the barriers between academic, popular, and pseudoscience, as well as the newly emergent borders between the study of philosophy, psychology, and the “science of man.” Bordogna reveals that James’s trespassing of boundaries was an essential element of a broader intellectual and social project. By crisscrossing divides, she argues, James imagined a new social configuration of knowledge, a better society, and a new vision of the human self. The aim of this paper is to investigate Nishida Kitarō’s way of philosophizing in the light of the concept of “transition” in order to deepen our understanding of both Nishida’s philosophy and our thinking about and in transitions, using the concept of “boundary” or “border” (Grenze) as a catalyst. For that purpose, we focus on Nishida’s essay “Place” (「場所」), passing through different parts of the text as if through successive gates on a path of transition between one place and the (...) next, until we reach the final place of “absolute nothingness.” Dwelling on this place, we turn our attention to its internal structure and try to depict it along the outlines of a boundary, following the movements taking place in Nishida’s essay. The second part proposes an interpretation of the place of nothingness as an interminable practice of boundary-crossing that doesn’t come to a halt in a final, all-encompassing place, but dynamically situates itself on countless intersecting planes. After a more or less abstract analysis of the concept of “boundary,” we will apply and concretize this approach by using the example of the skin. To this end, we expose five main features of the skin as boundary: permeability, enclosure, excessiveness, interstitiality and reciprocal self-formation. (shrink)

Criminal liability for acts committed by AI systems has recently become a hot legal topic. This paper includes three different contributions. The first contribution is an analysis of the extent to which an AI system can satisfy the requirements for criminal liability: accomplishing an actus reus, having the corresponding mens rea, possessing the cognitive capacities needed for responsibility. The second contribution is a discussion of criminal activity accomplished by an AI entity, with reference to a recent case involving an online (...) bot, the Random Darknet Shopper. This discussion will provide the context for the analysis of commonalities and differences between criminal activities by humans and by artificial systems. The third contribution concerns the evaluation of different ways of addressing criminal activities by AI systems in a regulatory perspective. (shrink)

Francesca Y. Albertini (1974‐2011) compares Maimonides’ idea of peace, as developed in MT Sefer shofetim (Book of Judges), with Kant’s work on the notion of “eternal peace” ( Zum ewigen Frieden ). Both authors develop a historical vision pointed against the use of force and war in light of a framework not limited by historical time (messianic age, eternity). Despite all differences in method and historical context, the authors agree on the notion that universal ethics provides the basis of (...) a determination of right grounded in the will. Maimonides’ universal messianism as well as Kant’s universal history emphasize the pivotal role and decisive responsibility of the human being in realizing, through reason, the reign of peace and prosperity on earth first envisioned by the biblical prophets. These utopias continue to challenge us, especially in this day and age. (shrink)

Francesca Ervas 7 Journal of Language & Translation 9-2September 2008, 7-29 Davidson’s Notions of TranslationEquivalence Francesca Ervas Università Roma Tre Abstract The paper analyses the relationship of semantic equivalence as described by Donald Davidson in his theory of meaning, showing its limits above all in respect to language use in the contextual situation.The notion of equivalence used by the “first” Davidson does not successfully explain why some biconditionals are simply true and why others, besides being true, offer the (...) real translation of the source sentence. The paper argues that the main limits of the Davidsonian proposal, which lie in the very attempt to apply Tarskian theory of truth to natural languages, are partially overcome later by Davidson himself. Above all in his paper A NiceDerangement of Epitaphs (1986), Davidson rejects the very idea of an “invariance of meaning” and proposes a “second” notion of equivalence, described as the research of momentary and always changing points of convergence of interpreter and speaker,depending on contextual information. This convergence is possible because of a “deeper equivalence,” a common cognitive apparatus that allows communication to take place. At any rate, as the paper aims to demonstrate, this solution seems to simply shift the problem on to another level of explanation. Once this level of “deeper equivalence” is reached, there is too no explanation of exactly how a translator can understand contextual implications in order to graspfunctional equivalence. (shrink)
