The concept of representation in public law is attracting more and more interest; specially gives many problems in the Parliament how representation, so as a representative institution. In this place is plained a principal problem: the new function of Parliament and the roll of parliamentary's Government control. We assist to the end of the dogma of the separation of powers. So we need to distinguish between control by the Parliament and control in the Parliament; the first are less effective because (...) significate the Government control of his own majority; the second is the critical capacity of minorities against the Government; this last are a effective control who's should create public opinion. This does not imply the suppression of public representation idea. By suggesting a revision of these idea does not mean that they should disappear. It seems wise to conserve the concept of representation providing it refer to the particular situation of the autoritas and his decision, whenever he appers as a victim of the procers in which take part the after side of problem: the souveragnity. En Carl Schmitt en la Segunda República Española Gabriel Guillén Kalle analiza aspectos particulares de Carl Schmitt en ese periodo de nuestra nación en entreguerras. El autor reconoce que la recepción republicana fue primordialmente jurídica, mas esta perspectiva conlleva observar ese concepto de lo polítíco que atraviesa su obra entera. Guillén propone una estrategia para la relectura de Schmitt en ese periodo y para ello analiza a los principales autores que se ocuparon de él, sin desdeñar a (...) algunos menos conocidos como puede ser Zozaya. Un tema importante para nuestra nación es el control de constitucionalidad que Schmitt, siguiendo a Constant con la teoría del poder moderador, encuentra en el Presidente del Reich, y que en la segunda República española se dejó en un organismo, el Tribunal de Garantías Constitucionales que pretendía colocarse por encima de las pasiones, aunque por su composición -poco jurídica- condujo al fracaso. También es de interés cómo Medina sitúa el pensamiento schmittiano de los órdenes concretos en el idealismo objetivo necesitando de dualismos para su existencia. (shrink)

In recent years, a great deal of evidence has accumulated on the health risks and environmental impacts of some herbicides. Both conventional agriculture and agroecology are searching for alternatives to address the challenges posed by the consequences of herbicide use. In this search, peasant and indigenous agroecosystems have much to contribute since their crops evolved thousands of years ago together with diverse communities of weeds, and farmers have carried out sophisticated strategies to manage them. Through participant observation, semi-structured interviews, free (...) lists, and botanical collection, we document a milpa design that integrates and manages spontaneous vegetation to take advantage of its presence and minimize risks of crop loss. The objective of this article is to critically contrast agroecological mechanisms in this milpa design which matches the prevention principle with a set of recommendations recognized as preventive in conventional weed science. Localization Wireless Sensor Networks (WSN) represent a research topic with increasing interest due to their numerous applications. However, the viability of these systems is compromised by the attained localization uncertainties once implemented, since the network performance is highly dependent on the sensors location. The Node Location Problem (NLP) aims to obtain the optimal distribution of sensors for a particular environment, a problem already categorized as NP-Hard. Furthermore, localization WSN usually perform a sensor selection for determining which nodes are to be (...) utilized for maximizing the achieved accuracy. This problem, defined as the Sensor Selection Problem (SSP), has also been categorized as NP-Hard. While different metaheuristics have been proposed for attaining a near optimal solution in both problems, no approach has considered the two problems simultaneously, thus resulting in suboptimal solutions since the SSP is biased by the actual node distribution once deployed. In this paper, a combined approach of both problems simultaneously is proposed, thus considering the SSP within the NLP. Furthermore, a novel metaheuristic combining the Black Widow Optimization (BWO) algorithm and the Variable Neighbourhood Descent Chains (VND-Chains) local search, denominated as BWO-VND-Chains, is particularly devised for the first time in the author’s best knowledge for the NLP, resulting in a more efficient and robust optimization technique. Finally, a comparison of different metaheuristic algorithms is proposed over an actual urban scenario, considering different sensor selection criteria in order to attain the best methodology and selection technique. Results show that the newly devised algorithm with the SSP criteria optimization achieves mean localization uncertainties up to 19.66 % lower than traditional methodologies. (shrink)

Advances in DNA technology and the discovery of DNA polymorphisms have permitted the creation of DNA databases of individuals for the purpose of criminal investigation.Many ethical and legal problems arise in the preparation of a DNA database, and these problems are especially important when one analyses the legal regulations on the subject.In this paper three main groups of possibilities, three systems, are analysed in relation to databases. The first system is based on a general analysis of the population; the second (...) one is based on the taking of samples for a particular list of crimes, and a third is based only on the specific analysis of each case. The advantages and disadvantages of each system are compared and controversial issues are then examined. We found the second system to be the best choice for Spain and other European countries with a similar tradition when we weighed the rights of an individual against the public's interest in the prosecution of a crime. In two often neglected passages of the Critique of Pure Reason, Kant submits that the Critique is a 'treatise' or a 'doctrine of method'. These passages are puzzling because the Critique is only cursorily concerned with identifying adequate procedures of argument for philosophy. In this book, Gabriele Gava argues that these passages point out that the Critique is the doctrine of method of metaphysics. Doctrines of method have the task of showing that a given science is indeed a science because (...) it possesses 'architectonic unity' – which happens when it realizes the 'idea' of a science. According to Gava's novel approach, the Critique establishes that metaphysics is capable of this unity, and his reading of the Critique from this perspective not only illuminates the central role of the Transcendental Doctrine of Method within it, but also clarifies the relationship between the different parts of the work. En estas páginas se reúnen tres trabajos elaborados en diferentes fechas, pero estrechamente interrelacionados bajo la intención global de aportar algunos elementos a la evaluación de las opciones metodológicas y epistemológicas en el campo de la investigación en Ciencias Sociales. Esos tres escritos nacen de la preocupación por los riesgos a que se ven expuestos los procesos de producción de conocimientos en el área social, sobre todo si consideramos que, dadas ciertas circunstancias del debate epistemológico actual, casi a diario aparecen (...) ofertas bajo la con?signa del nuevo paradigma o del paradigma emergente. Ante estas ofertas suele ocurrir que unos se muestran entusiasmados y otros incrédulos, pero muy pocos, relativamente, se dedican a evaluarlas. Así, sin evaluar las distintas opciones, la investigación social podría llegar a extremos de li?bertinaje académico, inoperancia y descrédito, incumpliendo de ese modo con el delicado compromiso que tienen los investigadores -tesistas, tuto?res y profesores- con respecto a las necesidades de la sociedad actual. En general, el supuesto inicial más importante aquí es que no pode?mos asumir ciegamente una determinada oferta metodológica y epistemo?lógica, por atractiva que parezca, si previamente no la sometemos a una crítica dura, desinteresada y honesta. Bajo esos términos, tomando en cuenta el predominio y la creciente influencia que han llegado a ejercer las propuestas del «paradigma emergente» sobre noveles investigadores sin que éstos dispongan de un cuerpo amplio de contrargumentaciones y señalamientos divergentes, los trabajos aquí presentados se orientan a deslindar aspectos que parecen significativos para una crítica severa y puntual. Esto es aun más urgente si consideramos que, apartando el caso de muchos investigadores respetables y serios que trabajan bajo la óptica del paradigma emergente, recientemente han pululado las posiciones anárqui?cas y descabelladas que también se declaran bajo esa misma óptica. ABSTRACT:Giving without the expectation of reward is difficult to understand in organizational contexts. In opposition to a logic based on self-interest or a sense of duty, a “logic of gift” has been proposed as a way to understand the phenomenon of free, unconditional giving. However, the rationale behind, and effects of, this logic have been under-explored. This paper responds by first clarifying the three logics of action—the logic of exchange, the logic of duty, and the logic of gift—and then explains (...) how their balanced integration promises to enhance organizational life and outcomes. Having explicated the unique character and contributions of the logic of gift, the paper further suggests practical implications for management. Encouraging the logic of gift fosters more humane relationships within organizations and to enable individuals to be generous in ways that inspire trust and promote creativity. (shrink)

El hecho de que el tema carcelario aparezca con frecuencia en sus relatos y novelas, en algunos de los cuales la cárcel deviene un personaje más, obedece precisamente a su interés en dicho problema. Como aquí se muestra, Revueltas no sólo buscaba exponer y analizar la enajenación humana, sino a la vez explorar posibles vías de liberación. De ahí que, mientras (...) que en sus primeros trabajos se centró en el sistema penitenciario, gradualmente pasó a abordar en ellos el encierro en el espacio público y en la propia conciencia. El Misterio de la Trinidad constituye el centro de la fe cristiana. Para la teología es también la verdad fundamental, que ilumina las demás realidades creídas. Esta situación indica que ha quedado atrás el “esplendido aislamiento” de la doctrina trinitaria que denunciaban los grandes teólogos del siglo XX. El presente trabajo pretende mostrar los logros de esta renovación trinitaria de la teología, especialmente en los ámbitos de la antropología teológica, la teología de la familia, la eclesiología y la doctrina social (...) de la Iglesia. Junto con los frutos maduros de esta nueva dimensión trinitaria de la teología, no se ocultan sus límites y riesgos. The purpose of the conference "On Pythagoreanism", held in Brasilia in 2011, was to bring together leading scholars from all over the world to define the status quaestionis for the ever-increasing interest and research on Pythagoreanism in the 21st century. The papers included in this volume exemplify the variety of topics and approaches now being used to understand the polyhedral image of one of the most fascinating and long-lasting intellectual phenomena in Western history. During the oppressive reign of Louis XIV, Gabrielle Suchon (1632–1703) was the most forceful female voice in France, advocating women’s freedom and self-determination, access to knowledge, and assertion of authority. This volume collects Suchon’s writing from two works—Treatise on Ethics and Politics (1693) and On the Celibate Life Freely Chosen; or, Life without Commitments (1700)—and demonstrates her to be an original philosophical and moral thinker and writer. Suchon argues that both women and men have inherently similar intellectual, corporeal, and spiritual (...) capacities, which entitle them equally to essentially human prerogatives, and she displays her breadth of knowledge as she harnesses evidence from biblical, classical, patristic, and contemporary secular sources to bolster her claim. The goal of this paper is to provide an account of the role played by logic in the context of what Husserl names the “crisis of European sciences.” Presupposing the analyses offered in the Krisis, I look at Formale und Transzendentale Logik to demonstrate that the crisis of logic stems from the deviation of its original meaning as a “theory of science” and from its restriction to a mere “theoretical technique.” Through a comparison between Aristotelian syllogistic and modern logic, I (...) show why the modern discovery of the purely formal dimension of knowledge which makes possible such a mathematical technization is a positive achievement that hinders at the same time the disclosure of the truly philosophical nature of logic. The correct appraisal of this ambiguous phenomenon will explain why the rise of modern logic represents a decisive challenge for the success of Husserl’s late phenomenological project. (shrink)

In this chapter, I investigate a problem for Kant’s claim that metaphysics can reach the status of science. The problem arises when one considers Kant’s account of the “architectonic unity” of metaphysics in the Architectonic of Pure Reason. Attaining architectonic unity is a condition for becoming a science for any body of cognitions that purports to be such. This is achieved when the cognitions belonging to a science are systematically organized according to the “idea of reason” which lies at the (...) basis of that science. However, Kant suggests that nobody can ever legitimately claim to have matched the idea of the philosopher, where this appears to imply that nobody can justifiably claim that she has fully grasped the idea of metaphysics. This generates a problem. I suggest that when Kant claims that the idea of the philosopher must remain an ideal or an archetype, he has a particular conception of philosophy in mind, that is, philosophy as a doctrine of wisdom. According to this understanding, philosophy must provide an example of how one can become virtuous. However, this is only a partial solution to our problem, for reasons that will be illustrated. On September 19th, 2005, an Spanish blogger wrote a post against blog nets. In that post he showed a kierkegaardian interpretation of blogging issue. It was the first time someone was using strictly philosophical categories in the blogosphere. On 2006, February, the 23rd, Rafael Herrera Guillén made a philosophical dramatization about this issue in a game of heteronyms.

This paper takes a close look at the thought that mereological relations on material objects mirror, and are mirrored by, parallel mereological relations on their exact locations. Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

Die Arbeit untersucht dies im Ausgang von Schellings "Philosophie der Mythologie".

O objetivo deste trabalho é investigar a natureza ontológica e epistemológica do conceito de informação, focalizando inicialmente a Filosofia e Ética da Informação (EI), propostas por Floridi (1999; 2002; 2004; 2011; 2016), cujo fundamento teórico servirá de suporte para reflexões acerca da inteligência artificial generativa (IAGen), mais especificamente, o ChatGPT. O conceito de informação será abordado a partir de três vertentes na perspectiva filosófico-interdisciplinar: (1) realismo informacional, (2) ecologia informacional e (3) semântica informacional, segundo Gonzalez, Nascimento & Haselager (2004). A (...) partir dessa abordagem, direcionamos nosso estudo para propostas de Floridi (2004), indicando os seus possíveis problemas. Procuraremos entender a Filosofia da Informação, a partir da perspectiva da Ética da Informação (EI), analisando como a EI pode contribuir para reflexões acerca do uso de IA generativa. In Kant’s Critique of Pure Reason and the Method of Metaphysics (CUP 2023), I argue that the first Critique is not only a ‘propaedeutic’ to metaphysics, but actually already establishes parts of metaphysics. These parts belong to what Kant calls transcendental philosophy. Additionally, I also provide an account of Kant’s critique of dogmatism and Wolff as its main defender. In this paper, I take up Luigi Filieri’s and Davide Dalla Rosa’s invitation to further develop my characterization of transcendental philosophy and (...) Numerous researchers have examined the antecedents of trust between managers and subordinates. Recent studies conclude that their influence varies depending on whether what is being examined is a manager's trust in a subordinate or a subordinate's trust in a manager. However, the reasons given to justify this phenomenon present limitations. This article offers a new theoretical approach that relates the influence of each antecedent to Aristotelian forms of reasoning, ethical, and instrumental. The proposed approach shows that the influence of each (...) antecedent depends on which rationality prevails in the person who trusts. The contribution of this article is to better explain the phenomenon of interpersonal trust formation and its logic, while offering at the same time several practical implications for managers interested in developing an organizational culture based on trust. The article begins with a literature review of more relevant empirical studies analyzing superior–subordinate trust formation and presents some theoretical limitations of the arguments described in these works. Then, it offers a new theorerical approach based on Aristotelian thought to explain the influence of the antecedents of trust in management–subordinate relationships. The theoretical contribution is then confirmed in an empirical study of 163 mid-level managers in Spain. (shrink)

This discussion of pride, shame, and guilt centers on the beliefs involved in the experience of any of these emotions. Through a detailed study, the author demonstrates how these beliefs are alike--in that they are all directed towards the self--and how they differ. The experience of these three emotions are illustrated by examples taken from English literature. These concrete cases supply a context for study and indicate the complexity of the situations in which these emotions usually occur.
