Mainstream economics evaluates capitalism primarily from the perspective of efficiency. Social philosophy typically applies other or additional normative criteria, such as equality, democracy, and community. This essay examines the implications of these contrasting sets of criteria in the evaluation of capitalism. Its first two sections consider the criteria themselves, assuming that a trade-off exists between them. The last three sections question whether such a trade-off necessarily occurs, and explore the claim that improvements in nonefficiency dimensions of capitalist society may enhance, (...) rather than conflict with, efficiency. Federal guidelines require that informed consent be obtained from participants when they are enrolled in a research study. When conducting research with children, the guidelines utilize the term permission to describe parents' agreement to enroll their children in a study. The basic components of consent and permission are well described and identical, with the exception of the person for whom the decision to participate is being made. Beyond permission, when enrolling minor participants in research, affirmative agreement to participate in research (...) or assent must be obtained from the child participants themselves. The concept of children's assent to research, however, is poorly defined, resulting in inconsistency in its pursuit and, consequently, in its utility. The interface between cognitive development, emotional, and social development must be examined as it pertains to this special situation of decision making. For this process to meaningfully protect minors, the assent process must be clarified, decisions regarding parental veto power must be more convincingly justified, and researchers must be better educated and held accountable for the valid execution of this process. Strategies for implementing the assent process more effectively are presented. (shrink)
In this paper I will deal with two questions. One is the relatively specific issue of whether mandatory retirement is unjust discrimination against the aged. The position taken is that it is not. But in the development of this argument a principle is advanced which appears to have the consequence that nothing, or at least very few of the practices that we are intuitively inclined to regard as unfair discrimination, are discriminatory with respect to age.

Pharmaceutical advertising is one of the most important kinds of advertising that can have a direct impact on the health of a consumer. Hence, this necessitates the fact that it is essential for advertisers of such products to take special care and additional responsibility when devising the promotional strategies of these products. In reality, it has been observed that pharmaceutical product advertisers often promoted their products to achieve their own goals at the potential risk of having an adverse effect on (...) the consumerÕs health. This type of advertising is most often seen in over-the-counter drug product advertisements, and not as often in the case of prescription drug advertisements, which is relatively new. This article analyzes various purposes of advertising pharmaceutical products and also the potential problems that arise from the way pharmaceutical products have quite frequently been promoted. What is sin? Is it simply wrongdoing? Why do its effects linger over time? In his recent article Should Trees Have Standing? Revisited" Christopher D. Stone has effectively withdrawn his proposal that natural objects be granted legal rights, in response to criticism from the Feinberg/McCloskey camp. Stone now favors a weaker proposal that natural objects be granted what he calls legal "considerateness". I argue that Stone's retreat is both unnecessary and undesirable. I develop the notion of a "de facto" legal right and argue that species already have de facto legal rights as statutory beneficiaries (...) of the "Endangered Species Act of 1973." I conclude that granting certain nonhuman natural entities legal rights is both more important and less costly that Stone and his critics have realized, and that it is not Stone's original proposal which needs rethinking, but the concept of interests at work in the Feinberg/McCloskey position. This book offers a close reading of Adorno’s more explicitly political writings and his work on fascist and anti-Semitic propaganda, and argues for the continuing relevance of these works for contemporary political practice. Adorno’s criticism of political violence and mass movements has, surprisingly, yet to be brought to bear upon contemporary developments in critical theory in the vein of Slavoj Žižek and Alan Badiou. In the subsequent pages, I want to develop a distinction between wanting and valuing which will enable the familiar view of freedom to make sense of the notion of an unfree action. The contention will be that, in the case of actions that are unfree, the agent is unable to get what he most wants, or values, and this inability is due to his own "motivational system." In this case the obstruction to the action that he most wants to do (...) is his own will. It is in this respect that the action is unfree: the agent is obstructed in and by the very performance of the action. (shrink)
