A review, with reflections, of Michael S. Gazzaniga's (2011) book, Who's in Charge? Free Will and the Science of the Brain. Gazzaniga, a distinguished neuroscientist, wishes to connect contemporary understandings of the functioning of the human brain to the proper functioning of the American courtroom. What effect, if any, should these current understandings (and current technologies) have on legal conceptions of personal responsibility, guilt, and punishment? If, as many neuroscientists hold, the functioning of the brain wholly determines the (...) functioning of the mind, can people rightly be held responsible for their actions? Psychology is dead. The self is a fiction invented by the brain. Brain plasticity isn?t all it?s cracked up to be. Our conscious learning is an observation post factum, a recollection of something already accomplished by the brain. We don?t learn to speak; speech is generated when the brain is ready to say something. False memories are more prevalent than one might think, and they aren?t all that bad. We think we?re in charge of our lives, but actually we are (...) not. On top of all this, the common belief that reading to a young child will make her brain more attuned to reading is simply untrue. : Michael Gazzaniga, a prominent cognitive neuroscientist, has argued against reductionist accounts of cognition. Instead, Gazzaniga defends a form of non-reductive physicalism: epistemological neuro-cognitive non-reductionism and ontological monist physicalism. His position is motivated by the theses that: cognitive phenomena can be realized by multiple neural systems; many outcomes of these systems are unpredictable; and multi-level explanations are required. Epistemological neuro-cognitive non-reductionism is presented as the most appropriate stance to account for the way in which phenomena should be explained (...) in cognitive neuroscience. In this paper, I argue, however, that a recent form of neuro-cognitive reductionism, namely neo-mechanistic reductionism accounts for the arguments presented by Gazzaniga. Thus, the theory offers a more consistent and well-articulated view of the relationship between cognitive and neural phenomena that is specifically compatible with the explanatory strategies and aims of contemporary cognitive neuroscience. Al contrario Gazzaniga difende una forma di fisicalismo non-riduzionistico che risulta dalla combinazione, sul piano epistemologico, di un anti-riduzionismo cognitivo e, sul piano ontologico, di un monismo fisicalista. La sua posizione è motivata dalla tesi per cui i fenomeni cognitivi possono essere realizzati da molteplici sistemi neurali; molti esiti di tali sistemi non si possono prevedere; e sono pertanto necessarie spiegazioni a livelli plurimi. La concezione presentata come più adeguata per dare conto sul piano epistemologico di come i fenomeni dovrebbero essere spiegati all’interno delle neuroscienze cognitive è una forma di anti-riduzionismo neuro-cognitivo. In questo articolo si sostiene tuttavia che una recente forma di riduzionismo neuro-cognitivo può dare conto degli argomenti presentati da Gazzaniga. Si tratta di una teoria che offre una interpretazione maggiormente coerente ed articolata della relazione fra fenomeni cognitivi e neurali e che offre un modello di spiegazione compatibile con gli scopi esplicativi delle neuroscienze cognitive contemporanee. Michael S. Gazzaniga, a pioneer and world leader in cognitive neuroscience, has made an initial attempt to develop neuroethics into a brain-based philosophy of life that he hopes will replace the irrational religious and political belief-systems that still partly govern modern societies. This article critically examines Gazzaniga’s proposal and shows that his actual moral arguments have little to do with neuroscience. Instead, they are based on unexamined political, cultural and moral conceptions, narratives and values. A more promising way (...) of interpreting the belief-forming system of the brain is to say that we cannot avoid thinking in terms of wider frameworks and narratives that are socially embedded and historically developed; consequently, any moral discussion has to be in terms of these frameworks and narratives. Michael S. Gazzaniga is a renowned cognitive neuroscientist. He was Editor-in-Chief of the 1447 page book The Cognitive Neurosciences, which, for the past decade, has been the fattest book in my library, apart from the ‘unabridged’. His recent book The Ethical Brain has a Part III entitled “Free Will, Personal Responsibility, and the Law”. This Part addresses, from the perspective of cognitive neuroscience, some of the moral issues that have been dealt with in the present book. The aim of (...) this Part III is to reconcile the materialist idea that brain activity is determined with the notion of moral responsibility, which normally depends upon the idea that we human agents possess free will. In this paper, our goal is to survey some of the legal contexts within which violence risk assessment already plays a prominent role, explore whether developments in neuroscience could potentially be used to improve our ability to predict violence, and discuss whether neuropredictive models of violence create any unique legal or moral problems above and beyond the well worn problems already associated with prediction more generally. In Violence Risk Assessment and the Law, we briefly examine the role currently played by (...) predictions of violence in three high stakes legal contexts: capital sentencing, civil commitment hearings, and sexual predator statutes. In Clinical vs. Actuarial Violence Risk Assessment, we briefly examine the distinction between traditional clinical methods of predicting violence and more recently developed actuarial methods, exemplified by the Classification of Violence Risk software created by John Monahan and colleagues as part of the MacArthur Study of Mental Disorder and Violence [1]. In The Neural Correlates of Psychopathy, we explore what neuroscience currently tells us about the neural correlates of violence, using the recent neuroscientific research on psychopathy as our focus. We also discuss some recent advances in both data collection and data analysis that we believe will play an important role when it comes to future neuroscientific research on violence. In The Potential Promise of Neuroprediction, we discuss whether neuroscience could potentially be used to improve our ability to predict future violence. Finally, in The Potential Perils of Neuroprediction, we explore some potential evidentiary, constitutional, and moral issues that may arise in the context of the neuroprediction of violence. (shrink)
Christology seems to fall fairly clearly into two divisions. The first is concerned with the truth of the two propositions: ‘Christ is God’ and ‘Christ is a man’. The second is concerned with the mutual compatibility of these propositions. The first part of Christology tends to confine itself to what is sometimes called ‘positive theology’: that is to say, it is largely given over to examining the Jons revelationis —let us not prejudge currently burning issues by asking what this is—to (...) see what evidence can be found for the truth of these propositions. Clearly, the methods used will be above all those of New Testament exegesis. The second part of Christology will necessarily consist entirely of that speculative theology which is contrasted with positive theology. Even if the earliest speculation on this topic is to be found in the New Testament itself and thus becomes fair game for the exegetes, any attempt to relate the primary truths, ‘Christ is God’ and ‘Christ is a man’, to eachother is a work of reflection, and in the terminology I am using speculative. One dark and rainy night, Yuso sexually assaults and tortures Zelan. In escaping from the scene of his crime, he falls heavily and becomes an impotent paraplegic. Instead of treating his fate as divine retribution for his wicked acts, Yuso sees it as sheer bad luck. He shows no remorse for what he has done, and vainly hopes that he will recover his powers, which he now treats as involuntarily hoarded resources to be used on less rainy days. In the (...) presence of others, he pretends that he has turned over a new leaf. He asks for religious and educational books, hoping to make up for his poor education and deprived social background. But he immediately discards them when he is alone in favor of the pornographic magazines which he has bribed a nurse to smuggle in for him. His deception and various obscene acts committed in the hospital are exposed; by the time he comes up for trial, everyone knows that he is still a lustful, sadistic, and unrepentant man. Most retributivists have a sufficient justification for punishing Yuso independently of the social consequences of his punishment. Two features of the case might cause some difficulties. First, Yuso has already experienced considerable suffering and deprivation both before and after his crime, and retributivists might disagree about the relevance of the suffering to his punishment. Secondly, Yuso is unrepentant, and it is unlikely that punishment will change him. This might, as we shall see, create a problem for those who think that the justifying aim of punishment is the moral reform of the offender. (shrink)
