The purpose of this paper is to demonstrate how condom manufacturers and their marketers have failed to adequately promote their product to the male homosexual population (gays). Inasmuch as the AIDS syndrome constitutes a major life-threatening danger and that gays appear to be particularly vulnerable, failure to aggressively promote a known preventive such as condoms to gays constitutes negligent homicide.The method used here defines what is traditionally viewed as a viable target market, analyzes the major elements of marketing with regard (...) to gays, and examines the neglect of condom promotion by their manufacturers. Objectives To conduct an independent evaluation of the first phase of the Health Foundation’s Safer Patients Initiative (SPI), and to identify the net additional effect of SPI and any differences in changes in participating and non-participating NHS hospitals. Design Mixed method evaluation involving five substudies, before and after design. Setting NHS hospitals in the United Kingdom. Participants Four hospitals (one in each country in the UK) participating in the first phase of the SPI (SPI1); 18 control hospitals. Intervention The SPI1 (...) was a compound (multi-component) organisational intervention delivered over 18 months that focused on improving the reliability of specific frontline care processes in designated clinical specialties and promoting organisational and cultural change. Results Senior staff members were knowledgeable and enthusiastic about SPI1. There was a small (0.08 points on a 5 point scale) but significant (P<0.01) effect in favour of the SPI1 hospitals in one of 11 dimensions of the staff questionnaire (organisational climate). Qualitative evidence showed only modest penetration of SPI1 at medical ward level. Although SPI1 was designed to engage staff from the bottom up, it did not usually feel like this to those working on the wards, and questions about legitimacy of some aspects of SPI1 were raised. Of the five components to identify patients at risk of deterioration—monitoring of vital signs (14 items); routine tests (three items); evidence based standards specific to certain diseases (three items); prescribing errors (multiple items from the British National Formulary); and medical history taking (11 items)—there was little net difference between control and SPI1 hospitals, except in relation to quality of monitoring of acute medical patients, which improved on average over time across all hospitals. Recording of respiratory rate increased to a greater degree in SPI1 than in control hospitals; in the second six hours after admission recording increased from 40% (93) to 69% (165) in control hospitals and from 37% (141) to 78% (296) in SPI1 hospitals (odds ratio for “difference in difference” 2.1, 99% confidence interval 1.0 to 4.3; P=0.008). Use of a formal scoring system for patients with pneumonia also increased over time (from 2% (102) to 23% (111) in control hospitals and from 2% (170) to 9% (189) in SPI1 hospitals), which favoured controls and was not significant (0.3, 0.02 to 3.4; P=0.173). There were no improvements in the proportion of prescription errors and no effects that could be attributed to SPI1 in non-targeted generic areas (such as enhanced safety culture). On some measures, the lack of effect could be because compliance was already high at baseline (such as use of steroids in over 85% of cases where indicated), but even when there was more room for improvement (such as in quality of medical history taking), there was no significant additional net effect of SPI1. There were no changes over time or between control and SPI1 hospitals in errors or rates of adverse events in patients in medical wards. Mortality increased from 11% (27) to 16% (39) among controls and decreased from 17% (63) to 13% (49) among SPI1 hospitals, but the risk adjusted difference was not significant (0.5, 0.2 to 1.4; P=0.085). Poor care was a contributing factor in four of the 178 deaths identified by review of case notes. The survey of patients showed no significant differences apart from an increase in perception of cleanliness in favour of SPI1 hospitals. Conclusions The introduction of SPI1 was associated with improvements in one of the types of clinical process studied (monitoring of vital signs) and one measure of staff perceptions of organisational climate. There was no additional effect of SPI1 on other targeted issues nor on other measures of generic organisational strengthening. (shrink)

Conscious events interact with memory systems in learning, rehearsal and retrieval (Ebbinghaus 1885/1964; Tulving 1985). Here we present hypotheses that arise from the IDA computional model (Franklin,Kelemen and McCauley 1998; Franklin 2001b) of global workspace theory (Baars 1988, 2002). Our primary tool for this exploration is a flexible cognitive cycle employed by the IDA computational model and hypothesized to be a basic element of human cognitive processing. Since cognitive cycles are hypothesized to occur five to tentimes a second (...) and include interaction between conscious contents and several of the memory systems, they provide the means for an exceptionally fine-grained analysis of various cognitive tasks. We apply this tool to the small effect size of subliminal learning compared to supraliminal learning, to process dissociation, to implicit learning, to recognition vs. recall, and to the availability heuristic in recall. The IDA model elucidates the role of consciousness in the updating of perceptual memory, transient episodic memory, and procedural memory. In most cases, memory is hypothesized to interact with conscious events for its normal functioning. The methodology of the paper is unusual in that the hypotheses and explanations presented are derived from an empirically based, but broad and qualitative computational model of human cognition. Recent discussions of emergence in physics have focussed on the use of limiting relations, and often particularly on singular or asymptotic limits. We discuss a putative example of emergence that does not fit into this narrative: the case of phonons. These quasi-particles have some claim to be emergent, not least because the way in which they relate to the underlying crystal is almost precisely analogous to the way in which quantum particles relate to the underlying quantum field theory. But there (...) is no need to take a limit when moving from a crystal lattice based description to the phonon description. Not only does this demonstrate that we can have emergence without limits, but also provides a way of understanding cases that do involve limits. (shrink)

According to tradition, the Laozi 老子 or Daodejing 道德經 was written in the mid-sixth century bce, but there has been little trace of it or its impact, until the third century bce. Recent archaeological discoveries of bamboo texts from the Warring States Period have begun to fill in this space. Several cosmogonic texts have been discovered, all buried around 300 bce, providing some insight into the broader context in which the Laozi was written and took form. The most important discovery (...) is the three sets of bamboo strips found at Guodian, known as Laozi A, B and C. The purpose of this chapter is to introduce these Guodian Laozi materials, with a particular focus on their philosophical significance. The first section provides an overview of the materials and the ways they differ from other versions of the text. Section 2 offers an interpretation of the content of the materials, showing that they share a coherent philosophical position. The third section discusses the nature of the materials as a text, and the fourth section considers their relationship to the complete Laozi. (shrink)

I’m writing to underscore one point, which should be obvious, but which all too often has been neglected in the literature on medical futility. The futility of an action or an intervention is always relative to some goal. Consider the classical example of futility: carrying water in a sieve. If your goal is to transport a quantity of water without spilling some or all of it, then it is futile to do so by placing it in a sieve. But we (...) can readily imagine children carrying water in the backyard in a sieve, enjoying the water spilling out on the grass and trickling down their legs. The results of the first randomized controlled trial of a medical treatment were reported in 1947. The antibiotic streptomycin was demonstrated to be dramatically superior to bed rest alone in treating tuberculosis. Looking back on this trial in 1990, A. B. Hill, the distinguished medical statistician who played a prominent role in the use of randomization in this study, made a telling statement about the moral climate of clinical research at the time: "Of course, there were no ethical problems in (...) those days: we did not ask the patient’s permission or anybody’s permission. First, that Aristotle's considered view of time is intrinsically tied to a language of temporal passage heavily dependent on the A-series.1 As such Aristotle's understanding of time is plagued with the perplexities that the A-series generates.2 Second, that the series of puzzles that Aristotle treats (...) in IV. 10, leading to the conclusion that time is non-existent, are left unanswered by Aristotle.3 [End Page 169] Instead, after presenting the puzzles having to do with whether time is, Aristotle cannot move fast enough to his treatment of what time is, leaving the puzzles unresolved.4 In this paper we would like to look at these two issues together. Our thesis is that the puzzles about the existence of time discussed by Aristotle at IV.10 are generated by a particularly naïve version of the A-theory. Further, although Aristotle's answer to what time is incorporates elements of an A-theory of time, it manages to avoid just those particular puzzles discussed in IV. 10 leading to the conclusion of time's non-existence.Our discussion is divided into three parts. First we provide an analysis of the puzzles raised by means of the commonplace ideas () mentioned by Aristotle at 217 b 31. This analysis will reveal that the puzzles are the consequence of a hypostatization of time, that is, the naïve notion that time has metaphysical status in its own right, in the way that a substance has, for instance. The hypostatization of time is what results when we ask questions concerning when the now exists and when the now ceases to be. We argue that these are questions that arise when the present is thought of as something that becomes, that is, that surges forward through history. Moreover, the problems brought to light by these puzzles are not left unresolved by Aristotle. Rather, Aristotle's considered view of time, piggybacking as it does on substances and their changes, would clearly avoid such a reification of time and hence the problems generated by it. In the second part of the paper we discuss Aristotle's view of the substrate of time, namely change, and show why Aristotle argues that change must be thought of as following a magnitude. Using our discussion in section 2 as our basis, in the third and final section we discuss the [End Page 170] significance of Aristotle's theory of time as that which results when we measure one change by another. Our discussion in sections 2 and 3 is geared towards an exploration of how Aristotle's own theory avoids a commitment to pure temporal becoming as real, that is, the idea that the now moves through a fixed continuum along which events are arranged in chronological order. The fact that this denial is an implication of his theory is closely linked to Aristotle's solution of the aporias in IV.10.1. TheThe arguments presented in IV.10 concern difficulties arising from common sense views of time. We will argue that these puzzles are the result of a reification of time. Resulting from naïve conceptions of time, they dissolve once these have been replaced by Aristotle's ensuing demystified account of the nature of time. Single-handedly and without the blessing or approval of the academic community, Williams had called attention to the importance of including Afro-Americans in any acceptable and comprehensive history of the nation long before the historians of various groups of European-Americans or Asian-Americans had begun to advocate a similar treatment for their groups. And if Williams did not impress the white professional historians, he gave heart and encouragement (...) to future Afro-American historians. When the History of the Negro Troops appeared in 1887, nineteen-year-old W. E. B. Du Bois was a college senior at Fisk University and editor-in-chief of the student magazine, The Fisk Herald. In the columns of the Herald Du Bois wrote, "At last we have a historian; not merely a Negro historian, but a man who judged by his merits alone has written a splendid narrative. The Herald congratulates George W. Williams, and the race, which may justly be . . . [proud] of him."1 Many years later, Carter G. The aim of this work is to demarcate, develop, and defend the commitments and consequences of metaethical minimalism. Very roughly, this is the position that a commitment to objective moral truths does not require any accompanying ontological commitments. While there are few, if any, who call themselves “metaethical minimalists”, I endeavor to uncover existing articulations of metaethical minimalism which have been presented under different names, attempting to identify the common ground between them. As I interpret the position, all metaethical minimalists (...) are committed to the same positive pair of claims (what I call the Objectivity Thesis): “a) Moral truths are strongly mind-independent; b) there are moral truths.” Taken by itself, however, this pair of claims is not sufficient for differentiating their view from the moral realist’s. Consequently, the minimalist must also articulate that which they are denying about the non-minimalist approach, or what I call the “negative ontological thesis”. I offer my own version of this negative thesis and argue for its dialectical advantages. -/- In Chapters 3 and 4, I focus my attention on attacks on the viability of metaethical minimalism in the form of two “challenges” that aim to problematize a commitment to objective moral truths absent any accompanying ontological commitment. The big-picture takeaway from these chapters is that minimalism can defend itself by playing to the dialectical advantage I find for it in Chapter 2 as well as by being creative about minimalist constructions/reworkings of plausible principles/lines of reasoning that seem to contradict it. -/- The temptation to embrace quietism is strong among minimalists, but in Chapters 5, 6, and 7 I aim to show that there is a positive alternative available for the minimalist interested in developing a full picture of their position. Chapter 5 is aimed at providing an adequate understanding of the distinction between the objects of purely normative thoughts and objects of thoughts about reality. Building on this are Chapters 6 and 7, which argue in favor of an account of the relationship between emotion and evaluative knowledge that is consistent with metaethical minimalism. (shrink)

In his book, Simon Franklin investigates various writings attested in Rus. This, however, does not automatically mean “Russian writings.” As the author himself states in the first sentence of his work, “This book is about the origins and early uses of writings in a particular society (Rus), but it may also serve as a case-study for those with a broader interest either in medieval uses of writing or—still more broadly—in the cultural history of information technology” (p. 1).

This essay tells a story. It is a story of the author's experience with community supported agriculture (CSA). It is also a story that depicts the difficulties of academic activism and grass-roots engagement. As an academic and an activist, the author argues that it is important to admit and share experiences that are “less than perfect,” since they are the basis for a more complete knowledge and a more organic existence, individually, collectively, sensually, and intellectually.

Franklin G. Miller and colleagues have stimulated renewed interest in research ethics through their work criticizing clinical equipoise. Over three years and some twenty articles, they have also worked to articulate a positive alternative view on norms governing the conduct of clinical research. Shared presuppositions underlie the positive and critical dimensions of Miller and colleagues' work. However, recognizing that constructive contributions to the field ought to enjoy priority, we presently scrutinize the constructive dimension of their work. Critically analyzes and revitalizes agrarian philosophy by tracing its evolution. Today, most historians, philosophers, political theorists, and scholars of rural America take a dim view of the agrarian ideal that farmers and farming occupy a special moral and political status in society. Agrarian rhetoric is generally seen as special pleading on the part of farmers seeking protection from labor reform and environmental regulation while continuing to receive direct payments and subsidies from the public till. Agrarianism should not be viewed as (...) a set of immutable claims about farming and political order, but as a tradition of moral and political philosophy that has evolved and deepened over the centuries. Agrarian naturalism--the belief that culture and conduct are conditioned by nature because they are of a piece with nature--becomes pragmatic naturalism, giving way to a new set of puzzles about how we are to understand the rural landscape and our responsibilities for its use. The agrarian idea that personality and sociability are integrated with the material transformation of the landscape can serve as the basis for a new, pragmatically grounded ethic of natural resources and rural development. The essays in this volume critically analyze and revitalize agrarian philosophy by tracing its evolution in the classical American philosophy of key figures such as Franklin, Jefferson, Emerson, Thoreau, Dewey, and Royce. Three chapters address the belief that farming peoples develop moral virtue and a taste for democracy as it evolved in the American context, and four examine how a reconstitution of agrarian themes might invigorate our nation's thinking on environment, food, and rural development policy. The Agrarian Roots of Pragmatism will be of broad interest to scholars of American philosophy, rural history, history of ideas, geography, and agricultural or natural resource policy. (shrink)

Russell Goodman tells the story of the development of philosophy in America from the mid-18th century to the late 19th century. The key figures in this story, Jonathan Edwards, Benjamin Franklin, Thomas Jefferson, the writers of The Federalist, and the romantics Emerson and Thoreau, were not professors but men of the world, whose deep formative influence on American thought brought philosophy together with religion, politics, and literature.

The essays in this volume critically analyze and revitalize agrarian philosophy by tracing its evolution in the classical American philosophy of key figures such as Franklin, Jefferson, Emerson, Thoreau, Dewey, and Royce.

A total of 944 expressed sequence tags generated 2212 EST loci mapped to homoeologous group 1 chromosomes in hexaploid wheat. EST deletion maps and the consensus map of group 1 chromosomes were constructed to show EST distribution. EST loci were unevenly distributed among chromosomes 1A, 1B, and ID with 660, 826, and 726, respectively. The number of EST loci was greater on the long arms than on the short arms for all three chromosomes. The distribution of ESTs along chromosome arms (...) was nonrandom with EST clusters occurring in the distal regions of short arms and middle regions of long arms. Duplications of group 1 ESTs in other homoeologous groups occurred at a rate of 35.5%. Seventy-five percent of wheat chromosome 1 ESTs had significant matches with rice sequences, where large regions of conservation occurred between wheat consensus chromosome 1 and rice chromosome 5 and between the proximal portion of the long arm of wheat consensus chromosome 1 and rice chromosome 10. Only 9.5% of group 1 ESTs showed significant matches to Arabidopsis genome sequences. The results presented are useful for gene mapping and evolutionary and comparative genomics of grasses. (shrink)

Few will, I think, doubt that the Trio from the Minuetto movement of Mozart's G Minor Symphony seems simple, direct, and lucid—even guileless. Its melodies are based upon common figures such as triads and conjunct diatonic motion. No hemiola pattern, often encountered in triple meter, disturbs metric regularity. With the exception of a subtle ambiguity..., rhythmic structure is in no way anomalous. There are no irregular or surprising chord progressions; indeed, secondary dominants and chromatic alterations occur very frequently. The instrumentation (...) is quite conventional, and no unusual registers are employed. In this essay, Leonard B. Meyer, Benjamin Franklin Professor of music and humanities at the University of Pennsylvania, further explores and details the significance of theories advanced in his book, Explaining Music: Essays and Explorations. With this work, the author terminates his trilogy on nationally prominent philosophers in Germany, France, and the United States, respectively. In all three works a deliberate attempt is made to counter the current trend towards linguistic analysis and deal with philosophy in its classical meaning as a body of general truths about the universe as a whole, which the author believes leads to some important consequences of present day relevance. The style of the work, to say the least, is unusual (...) in that it is cast in the form of a series of letters, fourteen in number, of a father to his daughter. Since he admits there are no German, French, or American "philosophies," properly speaking, each letter deals with a particular North American philosopher, beginning with Jonathan Edwards, Benjamin Franklin, and Thomas Paine in Revolutionary days, continuing with Ralph Waldo Emerson, William James, Charles Sanders Peirce, Josiah Royce, John Dewey, and George Herbert Mead as 19th century representatives, and Whitehead, Santayana, and Carnap for the first half of the twentieth. The work concludes with Hans Kelsen and Marcuse, who like Carnap, came to the United States as the result of Hitler’s antisemitism. The tenor of the work lays stress on problems of cultural and political life and, thereby, on the ties of this sort that bind the United States and Europe. The work reads well, and although its tone is more biographical than philosophical, more expository than critical, it could well serve as supplementary reading for a seminar on American philosophy.—A.B.W.
