Hymenoplasty is a practice that must be judged from within its cultural confines and not only from outside. It offers women who have grown up within the sexual norms of a Western society the chance to return to their parental culture, with its female-specific virginity expectations. Hymenoplasty allows women to be sexually active prior to marriage, which equalizes the discrepancy between gender norms on premarital sexual experience. Caution is needed when comparing hymenoplasty to female genital mutilation. However, comparing hymenoplasty to (...) other cosmetic genital modification procedures raises unique ethical, social, and medical quandaries that highlight the importance of patient’s autonomy. In this paper, I examine whether the use of artificial intelligence (AI) and automated decision-making (ADM) aggravates issues of discrimination as has been argued by several authors. For this purpose, I first take up the lively philosophical debate on discrimination and present my own definition of the concept. Equipped with this account, I subsequently review some of the recent literature on the use AI/ADM and discrimination. I explain how my account of discrimination helps to understand that the general claim in (...) view of the aggravation of discrimination is unwarranted. Finally, I argue that the use of AI/ADM can, in fact, increase issues of discrimination, but in a different way than most critics assume: it is due to its epistemic opacity that AI/ADM threatens to undermine our moral deliberation which is essential for reaching a common understanding of what should count as discrimination. As a consequence, it turns out that algorithms may actually help to detect hidden forms of discrimination. (shrink)

Although dominated by consequentialist and deontological thinking, the debate about human enhancement has been enriched by several arguments from virtue theory and from virtue ethics. This article provides an overview of the virtue ethical arguments in the debate and identifies several topics in the ethics of human enhancement where the argumentative resources of virtue ethics have not yet been sufficiently considered.

It is important to be able to offer an account of which activities count as scientific research, given our current interest in promoting research as a means to benefit humankind and in ethically regulating it. We attempt to offer such an account, arguing that we need to consider both the procedural and functional dimensions of an activity before we can establish whether it is a genuine instance of scientific research. By placing research in a broader schema of activities, the similarities (...) and differences between research activities and other activities become visible. It is also easier to show why some activities that do not count as research can sometimes be confused with research and why some other activities can be regarded only partially as research. Although the concept of research is important to delimit a class of activities which we might be morally obliged to promote, we observe that the class of activities which are regarded as subject to ethical regulation is not exhausted by research activities. We argue that, whether they be research or not, all the activities that are likely to affect the rights and interests of the individuals involved and impact on the rights and interests of other individuals raise ethical issues and might be in need of ethical regulation. In the debate about actions in virtual environments two interdependent types of question have been pondered: What is a person doing who acts in a virtual environment? Second, can virtual actions be evaluated morally? These questions have been discussed using examples from morally dubious computer games, which seem to revel in atrocities. The examples were introduced using the terminology of “virtual murder” “virtual rape” and “virtual pedophilia”. The terminological choice had a lasting impact on the debate, on the way action (...) types are assigned and on how moral evaluation is supposed to be conducted. However, this terminology and its theoretical consequences, while sometimes resulting in correct results, lead to absurd results when applied across the board. It will be suggested that these absurd consequences can be avoided by a different answer to the question what people in virtual worlds are doing. Alleged virtual actions are first and foremost the creation and modification of data-structures and the resulting output in computer hardware. Such modifications of data structure and imagery can be performed with different intentions, purposes and styles, which will influence the type and moral evaluation of a user’s actions. This reinterpretation allows for a more complex analysis of the moral reasons for praiseworthiness or blameworthiness of actions in virtual environments. This analysis takes not just harm and effects on character into account but the peculiar ways in which speech acts can be morally wrong: e.g. agitatory, deceptive, bullshitting. (shrink)

In this paper, we use some elements of the philosophical theories of Wilfrid Sellars and Robert Brandom for examining the interactions between humans and machines. In particular, we adopt the concept of the space of reasons for analyzing the status of artificial intelligent agents. One could argue that AIAs, like the widely used recommendation systems, have already entered the space of reasons, since they seem to make knowledge claims that we use as premises for further claims. This, in turn, can (...) lead to a sense of alienation because AIAs do not quite play by the rules of the space of the reason. We, therefore, ask somewhat pointedly whether aliens have entered the space of reasons. A closer look reveals that it is a misconception to consider AIAs as being in the space of reasons. In fact, they should be seen as very sophisticated tools. Since these tools affect our own acting in the space of reasons, special regulations are required for their proper use. (shrink)

Current debates in neuroethics engage with extremely diverse technologies, for some of which it is a point of contention whether they should be a topic for neuroethics at all. In this article, I will evaluate extended mind theory’s claim of being able to define the scope of neuroethics’ domain as well as determining the extension of an individual’s mind via its so-called trust and glue criteria. I argue that a) extending the domain of neuroethics by this manoeuvre endangers the theoretical (...) consistency of neuroethics and b) the current state of the trust and glue criteria can introduce a bias towards overstating the relevance which representational devices have in characterising the field of neuroethics as compared to other technologies which are clearly of neuroethical relevance. As a remedy, I suggest a modification of the trust and glue criteria and a broader conception of cognition. (shrink)

Although the principle of informed consent is well established and its importance widely acknowledged, it has met with criticism for decades. Doubts have been raised for a number of different reasons. In particular, empirical data show that people regularly fail to reproduce the information provided to them. Many critics agree, therefore, that the received concept of informed consent is no more than a myth. Strategies to overcome this problem often rest on a flawed concept of informed consent. In this paper, (...) it is suggested that informed consent is a communicative act between two persons. The challenge is to elucidate the norms and constraints for successfully performing such a communicative act. In this paper I propose to examine the concept of discrimination from an ethical viewpoint. In a preliminary part, I will point out which aspects of the subject matter I will focus on and which I will leave aside (II). On the basis of the Aristotelian principle “treat like cases alike”, I will continue with a very formal definition, according to which discrimination can be understood as acting in a way that implies that like cases are not treated alike. This (...) leads to the difficult question of which cases are to be considered as “alike”, or which traits can serve as morally valid reasons for identifying cases as “unlike” (III). I will argue that this question cannot be answered independently from the specific circumstances and the normative premises referred to for describing these circumstances. My conclusion is that the concept of discrimination derives its “moral strength” solely from these normative premises. As a consequence, the use of the con- cept of discrimination can often be misleading since it falsely presupposes that there is agreement about the underlying normative premises (IV). A series of dialogues with the most exciting and controversial German philosopher writing today. Peter Sloterdijk first became known in this country for his late 1980s Critique of Cynical Reason, which confronted headlong the “enlightened false consciousness” of Habermasian critical theory. Two decades later, after spending seven years in India studying Eastern philosophy, he is now attracting renewed interest for his writings on politics and globalization and for his magnum opus Spheres, a three-volume archaeology of the human attempt to dwell (...) within spaces, from womb to globe: Bubbles, 1998; Globes, 1999; Foam, 2004, all forthcoming from Semiotext. In Neither Sun nor Death, Sloterdijk answers questions posed by German writer Hans-Jürgen Heinrichs, commenting on such issues as technological mutation, development media, communication technologies, and his own intellectual itinerary. Iconoclastic and provocative, alternatively sparkling and bombastic, a child of '68 and a libertarian, Sloterdijk is the most exciting and controversial German philosopher to appear on the world scene since Nietzsche and Heidegger. Like Nietzsche, Sloterdijk remains convinced that contemporary philosophers have to think dangerously and let themselves be “kidnapped” by contemporary “hypercomplexities”; they must forsake our present humanist and nationalist world for a wider horizon at once ecological and global. Neither Sun nor Death is the best introduction available to Sloterdijk's philosophical theory of globalization. It reveals a philosophe extraordinaire, encyclopedic and provocative, as much at ease with current French Theory as with Heidegger and Indian mystic Osho Rajneesh. (shrink)

Recent work on ecological accounts of moral responsibility and agency have argued for the importance of social environments for moral reasons responsiveness. Moral audiences can scaffold individual agents’ sensitivity to moral reasons and their motivation to act on them, but they can also undermine it. In this paper, we look at two case studies of ‘scaffolding bad’, where moral agency is undermined by social environments: street gangs and online incel communities. In discussing these case studies, we draw both on recent (...) situated cognition literature and on scaffolded responsibility theory. We show that the way individuals are embedded into a specific social environment changes the moral considerations they are sensitive to in systematic ways because of the way these environments scaffold affective and cognitive processes, specifically those that concern the perception and treatment of ingroups and outgroups. We argue that gangs undermine reasons responsiveness to a greater extent than incel communities because gang members are more thoroughly immersed in the gang environment. (shrink)

Bert Heinrichs unternimmt es, die Ethik der Forschung am Menschen grundlegend und systematisch zu erschließen. Seine ethische Rahmentheorie wird im Hinblick auf drei kontrovers diskutierte Problemkomplexe ausgewertet, nämlich die Forschung mit Minderjährigen, randomisierte klinische Studien und Forschung in Entwicklungsländern. Sie soll helfen, wesentliche Orientierung bei der konkreten Problemlösung zu geben.

Non-invasive brain stimulation promises innovative experimental possibilities for psychology and neurosci- ence as well as new therapeutic and palliative measures in medicine. Because of its good risk–benefit ratio, non-invasiveness and reversibility as well as its low effort and cost it has good chances of becoming a wide- spread tool in science, medicine and even in lay use. While most issues in medical and research ethics such as informed consent, safety, and potential for misuse can be handled with manageable effort, the (...) real promise of brain stimulation does raise one prominent moral worry: it may lay the foundation of reliable, precise and stable manipulations of the mind. This article addresses this worry and concludes that it is not the possibility of manipulation, but the shift in our understanding of our mind which stands in need of careful consideration. (shrink)

BackgroundAdvance research directives (ARD) have been suggested as a means by which to facilitate research with incapacitated subjects, in particular in the context of dementia research. However, established disclosure requirements for study participation raise an ethical problem for the application of ARDs: While regular consent procedures call for detailed information on a specific study (“token disclosure”), ARDs can typically only include generic information (“type disclosure”). The introduction of ARDs could thus establish a double standard in the sense that within the (...) context of ARDs, type disclosure would be considered sufficient, while beyond this context, token disclosure would remain necessary.Main bodyThis paper provides an ethical analysis of ARDs, taking into account the results of numerous empirical studies that have been performed so far. It will be argued that a revised understanding of informed consent can allow for context-sensitive disclosure standards. As a consequence, ARDs that include type disclosure can be acceptable under suitable circumstances. Such an approach raises a number of objections. A thorough examination shows, however, that they are not sufficient to justify a rejection of the approach.ConclusionThe approach presented in this paper avoids introducing a double standard. It is, therefore, more suitable for the implementation of ARDs than established approaches. (shrink)

In this paper, we address the question of whether AI should be used for suicide prevention on social media data. We focus on algorithms that can identify persons with suicidal ideation based on their postings on social media platforms and investigate whether private companies like Facebook are justified in using these. To find out if that is the case, we start with providing two examples for AI-based means of suicide prevention in social media. Subsequently, we frame suicide prevention as an (...) issue of beneficence, develop two fictional cases to explore the scope of the principle of beneficence and apply the lessons learned to Facebook’s employment of AI for suicide prevention. We show that Facebook is neither acting under an obligation of beneficence nor acting meritoriously. This insight leads us to the general question of who is entitled to help. We conclude that private companies like Facebook can play an important role in suicide prevention, if they comply with specific rules which we derive from beneficence and autonomy as core principles of biomedical ethics. At the same time, public bodies have an obligation to create appropriate framework conditions for AI-based tools of suicide prevention. As an outlook we depict how cooperation between public and private institutions can make an important contribution to combating suicide and, in this way, put the principle of beneficence into practice. Artificial intelligence (AI) is a powerful tool for several healthcare tasks. AI tools are suited to optimize predictive models in medicine. Ethical debates about AI’s extension of the predictive power of medical models suggest a need to adapt core principles of medical ethics. This article demonstrates that a popular interpretation of the principle of justice in healthcare needs amendment given the effect of AI on decision-making. The procedural approach to justice, exemplified with Norman Daniels and James Sabin’s accountability for reasonableness (...) conception, needs amendment because, as research into algorithmic fairness shows, it is insufficiently sensitive to differential effects of seemingly just principles on different groups of people. The same line of research generates methods to quantify differential effects and make them amenable for correction. Thus, what is needed to improve the principle of justice is a combination of procedures for selecting just criteria and principles and the use of algorithmic tools to measure the real impact these criteria and principles have. In this article, the author shows that algorithmic tools do not merely raise issues of justice but can also be used in their mitigation by informing us about the real effects certain distributional principles and criteria would create. Scientific policy advice is usually perceived as a formalized advisory process within political institutions. Politics has benefited from this arrangement because the science-based rationalization of policy has contributed to its legitimacy. However, in Western democratic societies, scientific expertise that is routinely mobilized to legitimate political positions has increasingly lost its power due to controversial expertise in the public sphere in particular within the mass media. As a consequence of the medialization of science, political decision makers are increasingly confronted with mass-mediated (...) expertise. Empirical results of a qualitative survey among decision makers in the German political and administrative system, presented in this article, support the hypothesis that mass-mediated expertise has a significant impact on policy processes. Five functions of media coverage on science-based issues for policy making were identified. Mass-mediated expertise has therefore altered the established relations between scientific policy advisors and political decision makers and can be seen as informal policy advice complementing institutionalized advisory arrangements. Brain age prediction is a relatively new tool in neuro-medicine and the neurosciences. In research and clinical practice, it finds multiple use as a marker for biological age, for general health status of the brain and as an indicator for several brain-based disorders. Its utility in all these tasks depends on detecting outliers and thus failing to correctly predict chronological age. The indicative value of brain age prediction is generated by the gap between a brain’s chronological age and the predicted (...) age, the brain age gap (BAG). This article shows how the clinical and research use of brain age prediction tacitly pathologizes the states that it is sensitive to. It will be argued that the tacit character of this transformation conceals the need for its explicit justification. (shrink)

Die Frage nach der Gerechtigkeit im Gesundheitswesen wird aus der Perspektive einer allgemeinen Theorie der Gerechtigkeit betrachtet. Diese Theorie ist ein Befähigungsansatz, der zwischen 1) der Grundversorgung aller Bürger mit Grundbefähigungen, 2) einem gerechten Anteil an den Früchten gesellschaftlicher Kooperation und 3) individuell erstrebten Gütern und Leistungen differenziert. Die Anwendung dieser Theorie reagiert auf charakteristische Probleme der Allokation im Gesundheitssektor: den prinzipiell ungedeckten Bedarf, die mangelnde Zurechenbarkeit des Bedarfes und die asymmetrische Informationsstruktur zwischen Patienten und Leistungserbringern.

This article investigates how human life is conceptualized in the design and use of digital assistants and how this conceptualization feeds back into the life really lived. It suggests that a specific way of conceptualizing human life — namely as a set of tasks to be optimized — is responsible for the much-criticized information hunger of these digital assistants. The data collection of digital assistants raises not just several issues of privacy, but also the potential for improving people’s degree of (...) self-determination, because the optimization model of daily activity is genuinely suited to a certain mode of self-determination, namely the explicit and reflective setting, pursuing, and monitoring of goals. Furthermore, optimization systems’ need for generation and analysis of data overcomes one of the core weaknesses in human capacities for self-determination, namely problems with objective and quantitative self-assessment. It will be argued that critiques according to which digital assistants threaten to reduce their users’ autonomy tend to ignore that the risks to autonomy are derivative to potential gains in autonomy. These critiques are based on an overemphasis of a success conception of autonomy. Counter to this conception, being autonomous does not require a choice environment that exclusively supports a person’s “true” preferences, but the opportunity to engage with external influences, supportive as well as adverse. In conclusion, it will be argued that ethical evaluations of digital assistants should consider potential gains as well as potential risks for autonomy caused by the use of digital assistants. Research with psychiatric patients raises frequently discussed, ethical questions, one of which is: Can psychiatric patients give consent to participation in research at all? To answer this and similar questions adequately, it is - according to our thesis - necessary to analyze first, which theoretical assumptions are made in established practice. -/- To solve the question after the possibility of consent, compatible understandings of ‘disease’, ‘illness’ and ‘autonomy’ are crucial, but there is no consensual use of these terms in philosophy. (...) Therefore we first are going to explain different concepts of ‘autonomy’ and ‘disease’. Subsequent to this we will test how the different conceptualizations of ‘autonomy’ and ‘disease’ can be related to each other and how the reasonable combinations shape possible answers to the opening question. It will become apparent that an adequate analysis of ‘autonomy’ and ‘disease’ raises ethical dilemma in psychiatry, for which we shall suggest possible solutions. (shrink)

Enhancement, the improvement of mental capacities with psychoactive substances and technologies has stimulated one of the largest debates in contemporary bioethics. Surprisingly few participants in this debate take note of the tendentious legal status of psychoactive pharmaceuticals as the primary means of enhancement. -/- Enhancement technologies and substances have measurable effects on specific measurable cognitive functions. A major issue of contention in the debate is how to evaluate these effects, i. e. which theory of value to use. It is contested (...) whether the pleasures and achievements resulting from the use of enhancement can be counted as such or can be ignored or devaluate by calling them fraudulent or inauthentic. -/- The alleged and real benefits of enhancement are not expected to be evenly distributed, nor is it always clear whether enhancement is a zero-sum game or has benefits even for the non-users. This results in a complex structure of risks and benefits for individuals and groups, which needs to be broken down in detail. (shrink)

Darunter fällt Forschung, die für militärische, geheimdienstliche, terroristische oder kriminelle Zwecke verwendet werden kann. _Dual Use_ stellt seit über einem Jahrzehnt ein sich beständig verschärfendes Problem für viele Bereiche der Lebenswissenschaften und der Medizin dar, weil viele von deren Ergebnissen geeignet sind aufzuzeigen, wie Menschen, aber auch (Nutz‑)Tiere und Pflanzen manipuliert und attackiert werden (...) können und welche Werkzeuge dafür besonders geeignet sind. Die Digitalisierung in den Lebenswissenschaften hat im Hinblick auf das _Dual-Use-_Problem zwei voneinander unterscheidbare Einflüsse, nämlich einen verschärfenden und einen erweiternden. Dadurch, dass die Digitalisierung schnellere und umfangreichere Forschungs- und Entwicklungsprozesse ermöglicht, verschärft sie das bestehende _Dual-Use_-Problem, weil zugleich das Tempo steigt, in dem die Ergebnisse dieser Forschung für sicherheitsrelevante Zwecke nutzbar gemacht werden können. Zudem erweitert die Digitalisierung der Lebenswissenschaften das _Dual-Use-_Problem, denn einige der digitalen Werkzeuge, die in den Lebenswissenschaften entwickelt und gebraucht werden, können selbst militärische oder sicherheitsrelevante Verwendung finden. Deshalb bedarf es einer breit angelegten Governance inklusive einer breiten Beteiligung der Stakeholder im Forschungsprozess und eines Informationsangebots zu _Dual Use_ in der Ausbildung in guter wissenschaftlicher Praxis über Institutionen, Karrierestufen und Disziplinen hinweg. The volume focusses on the ethical dimensions of the technological scaffold embedding human thought and action, which has been brought to attention of the cognitive sciences by situated cognition theories. There is a broad spectrum of technologies co-realising or enabling and enhancing human cognition and action, which vary in the degree of bodily integration, interactivity, adaptation processes, of reliance and indispensability etc. This technological scaffold of human cognition and action evolves rapidly. Some changes are continuous, some are eruptive. Technologies that (...) use machine learning e.g. could represent a qualitative leap in the technological scaffolding of human cognition and actions. The ethical consequences of applying situated cognition theories to practical cases had yet to find adequate attention and are elucidated in this volume. (shrink)

Who is responsible for the events and consequences caused by using artificially intelligent tools, and is there a gap between what human agents can be responsible for and what is being done using artificial intelligence? Both questions presuppose that the term ‘responsibility’ is a good tool for analysing the moral issues surrounding artificial intelligence. This article will draw this presupposition into doubt and show how reference to responsibility obscures the complexity of moral situations and moral agency, which can be analysed (...) with a more differentiated toolset of moral terminology. It suggests that the impression of responsibility gaps only occurs if we gloss over the complexity of the moral situation in which artificial intelligent tools are employed and if—counterfactually—we ascribe them some kind of pseudo-agential status. Unter Off-Label-Use versteht man den zulassungsüberschreitenden Einsatz eines Arzneimittels außerhalb der von Zulassungsbehörden genehmigten Anwendungsgebiete. Er ist in der medizinischen Praxis weit verbreitet und fächerübergreifend zu beobachten. Der Beitrag gibt eine Einschätzung der Off-Label-Anwendung aus ethischer Sicht. Dazu wird die Off- Label-Anwendung zunächst von anderen, sachlich verwandten Anwendungsweisen abgegrenzt. Danach wird über die aktuelle Verbreitung des Off-Label- Use informiert. Sodann wird gezeigt, dass sich bekannte Problemlagen aus der Medizinethik bei der Off-Label-Anwendung in spezifischer Weise verschärfen. Schließlich wird diskutiert, wie eine (...) ethisch akzeptable Off-Label-Anwendung von Arzneimitteln ausgestaltet werden könnte und auf welchen Ebenen sie ansetzen müsste. (shrink)

In this paper, I will suggest an unorthodox hybrid theory of ethical justification that combines, on an ontological level, a realist approach with constructivist elements. On an epistemological level, the realist part of the theory will be squared with an intuitionist account. Eventually, the suggested hybrid theory will take the form of an intuitionist ethics of persons. I will start with briefly sketching the ontological shape of the relevant concept of person whereby I will extensively draw on Kant and endorse (...) a realist reading of his ethical theory (2.). Subsequently, I will explain why and how constructivist elements must complement the picture (3.). Then, I will focus on the epistemological shape of the theory. In particular, I will suggest an intuitionist reading of Kant’s doctrine of “the fact of reason” (4.). Next, I will briefly comment on classical intuitionism and on Bernard William’s notion of convergence in ethics (5.). Subsequently, I will compare my approach with Robert Audi’s attempt to refine a Rossian type of intuitionism (6.). Finally, I will revisit the charge of dogmatism that has traditionally been raised against intuitionism (7.). (shrink)

Case studies, both with a view to didactical and argumentative purposes, are widely used in applied ethics. However, case studies are often used without methodological considerations concerning the premises and limitations of these kind of studies as methodological tools within ethics. The present paper critically examines the recourse to – real or fictitious – case studies. Important suggestions will be taken from Kant’s philosophy. Kant himself occasionally uses case studies in his ethical writings. Yet, he also discusses the relevance as (...) well as the limitations of case studies in ethics. Against the background of this analysis, the opinion that ethics can be taught or developed in concreto, or that ethics might eventually be resolved into compilations of case studies must be rejected. For a couple of years, “Aristotelian Naturalism” has been the subject of intensive debates. Among the most prominent proponents of this type of ethical theory are Philippa Foot and John McDowell. At first sight, these approaches are quite attractive for they seem to combine a number of advantages. The central thesis of the present paper is, however, that they do not succeed in developing a convincing ethical theory. To substantiate this claim, Foot’s approach will be presented in a first step. (...) In a second step, McDowell’s critique on Foot will be out- lined. Foot’s attempt to provide an external foundation for morality takes centre stage here. In a third step, McDowell’s own version of Aristotelian Naturalism, which has an explicitly anti-foundational shape, will be delineated. Although McDowell’s critique on Foot proves to be valid, it leads him to the wrong con- clusions. He ignores that a reason-internal foundation of morality is available which resists his legitimate critique while being superior to his own anti-foun- dational theory. At the core of such an approach lies a non-reductive concept of person, which stands in clear contrast to Foot’s concept of “life form” as well as to McDowell’s concept of “second nature”. (shrink)

Recent advances in genomic research have led to the development of new diagnostic tools, including tests which make it possible to predict the future occurrence of monogenetic diseases (e.g. Chorea Huntington) or to determine increased susceptibilities to the future development of more complex diseases (e.g. breast cancer). The use of such tests raises a number of ethical, legal and social issues which are usually discussed in terms of rights. However, in the context of predictive genetic tests a key question arises (...) which lies beyond the concept of rights, namely, What should we want to know about our future? In the following I shall discuss this question against the background of Kant’s Doctrine of Virtue. It will be demonstrated that the system of duties of virtue that Kant elaborates in the second part of his Metaphysics of Morals offers a theoretical framework for addressing the question of a proper scope of future knowledge as provided by genetic tests. This approach can serve as a source of moral guidance complementary to a justice perspective. It does, however, not rest on the – rather problematic – claim to be able to define what the “good life” is. (shrink)

Zu den Grenzfragen des Lebens. Bioethik als Feld intensiver Auseinandersetzung im fachwissenschaftlichen Diskurs und kontroverser Diskussionen in der breiten Öffentlichkeit. Das Handbuch erläutert die Grundlagen und gibt einen Überblick über Bereiche, in denen bioethische Fragen relevant sind, wie Menschenwürde, Leben, Tod und Krankheit. Daneben widmet es sich den speziellen bioethischen Problemen wie etwa Zulässigkeit von Sterbehilfe, Präimplantationsdiagnostik oder embryonaler Stammzellenforschung und zeigt die Schnittstellen der Bioethik zu anderen Disziplinen und gesellschaftlichen Bereichen auf (Bioethik in der Lehre, Biopolitik, Biorecht und Ethikkommissionen).

Background: Informed consent is a legal as well as ethical prerequisite in clinical research. For dementia research, informed consent can be a problem if subjects with dementia, whose capacity for understanding and thus also decision making might be limited, are to be exam- ined. This might result in exclusion of dementia patients from research, as capacity for understanding and decision making are often equated with the ability for rational decision making. However, this valuation has been criticized at times for attaching (...) too much impor- tance to the cognitive aspect of decision making. -/- Methods: This qualitative study investigates the actual consent procedure of a clini- cal research study in Germany with regard to dementia patients’ subjective and objective understanding of informed consent information. Research participants were ten dementia patients, who volunteered in two clinical research studies, as well as their caregivers. Data were collected by use of semi-structured interviews. -/- Results: It was determined that the patients’ comprehension of informed consent infor- mation was rather limited. However, a number of patients were quite aware of this. In con- trast, all caregivers claimed to have fully understood the provided information, while their objective comprehension was also incomplete. Several participants indicated that they did not attach much importance to the information given in the consent procedure and that their consent did not primarily depend on this information. Rather, participation in the research study for them seemed to be more of a problem-focused coping strategy for dealing with their diagnosis of dementia. -/- Conclusion: For research ethics these results raise the question whether the currently prevailing emphasis on the cognitive aspect of autonomous decision making, i.e., compre- hension, may be too one-sided, and to what extent the “volitional” aspect in giving consent should be given greater consideration.
