Data sharing – broadly defined as the exchange of health-related data among multiple controllers and processors – has gained increased relevance in the health sciences over recent years as the need and demand for collaboration has increased. This includes data obtained through healthcare provisions, clinical trials, observational studies, public health surveillance programs, and other data collection methods. The practice of data sharing presents several notable challenges, however. Compliance with a complex and dynamic regulatory framework is essential, with the General Data (...) Protection Regulation being a prominent example in a European context. Recent regulatory developments related to clinical trial transparency, trade secrecy, data access, AI training data, and health data spaces further contribute to the difficulties. Simultaneously, government initiatives often encourage scientists to embrace principles of “open data” and “open innovation.” The variety of regulations in this domain has the potential to impede widespread data sharing and hinder innovation. This edited volume, therefore, compiles comparative case studies authored by leading scholars from diverse disciplines and jurisdictions. The book aims to outline the legal complexities of data sharing. By examining real-world scenarios from diverse disciplines and a global perspective, it explores the normative, policy, and ethical dilemmas that surround data sharing in the health sciences today. Notwithstanding the potential danger to security and privacy, sharing and publishing data has become usual in Data Science. To preserve privacy, de-identification methodologies guided by risk estimation have been designed. Two issues associated with classical risk metrics are, on the one hand, the adequacy of the metric and, on the other hand, its static nature. In this paper, we present metrics for estimating risk based on the emerging semantics provided by Formal Concept Analysis. The metrics are designed to estimate the (...) a priori risk of compromised data deletion. Furthermore, by applying specialized variable forgetting methods for association rules, it is shown how to reflect the effect of deleting attributes belonging to potentially dangerous quasi-identifier sets. Additionally, a study of the role of the risk metric in confidence-based reasoning for re-identification is presented. (shrink)

There is a broad consensus amongst law firms and in-house legal departments that next generation "Legal Tech" - particularly in the form of Blockchain-based technologies and Smart Contracts - will have a profound impact on the future operations of all legal service providers. Legal Tech startups are already revolutionizing the legal industry by increasing the speed and efficiency of traditional legal services or replacing them altogether with new technologies. This on-going process of disruption within the legal profession offers significant opportunities (...) for all business. However, it also poses a number of challenges for practitioners, trade associations, technology vendors, and regulators who often struggle to keep up with the technologies, resulting in a widening regulatory "gap." Many uncertainties remain regarding the scope, direction, and effects of these new technologies and their integration with existing practices and legacy systems. Adding to the challenges is the growing need for easy-to-use contracting solutions, on the one hand, and for protecting the users of such solutions, on the other. To respond to the challenges and to provide better legal communications, systems, and services Legal Tech scholars and practitioners have found allies in the emerging field of Legal Design. Con las agrupaciones musicales escolares se requiere previamente activar las técnicas de audición e interpretación de forma individual para lograr en el grupo, aptitudes motoras, perceptivas, cognitivas y activar procesos afectivos y de socialización. De esta forma, la atención a la diversidad no quedaría excluida. La música, en definitiva, favorece el desarrollo de la persona en todas sus dimensiones, lo cual redunda en (...) una mejora de la calidad de vida y es un gran avance a nivel personal, familiar, escolar, clínico y social. Artificial intelligence and related technologies are changing both the law and the legal profession. In particular, technological advances in fields ranging from machine learning to more advanced robots, including sensors, virtual realities, algorithms, bots, drones, self-driving cars, and more sophisticated "human-like" robots are creating new and previously unimagined challenges for regulators. These advances also give rise to new opportunities for legal professionals to make efficiency gains in the delivery of legal services. With the exponential growth of such technologies, radical disruption (...) seems likely to accelerate in the near future. This collection brings together a series of contributions by leading scholars in the newly emerging field of artificial intelligence, robotics, and the law. The aim of the book is to enrich legal debates on the social meaning and impact of this type of technology. The distinctive feature of the contributions presented in this edition is that they address the impact of these technological developments in a number of different fields of law and from the perspective of diverse jurisdictions. Moreover, the authors utilize insights from multiple related disciplines, in particular social theory and philosophy, in order to better understand and address the legal challenges created by AI. In Platons Dialog Sophistes wird nach der Definition des Sophisten gefragt; das führt zum Begriff des Nichtseienden und schließlich unter dem Stichwort 'Dialektik' auf die Frage nach dem Seienden. Daß Platon dabei von der sophistischen Methode ausgeht, das Seiende als bloße Spitze einer Begriffspyramide zu deuten, haben seine Interpreten seit jeher als irgendwie widersprüchlich empfunden. Dieser Kommentar ist für Leser gedacht, die bereit sind, den Sophistes genau zu studieren, aber dabei einen Begleiter haben möchten, der ihnen in möglichst direkter und (...) knapper Form hilft, den oft schwierigen einzelnen Schritten zu folgen und zugleich die Übersicht über das nicht weniger schwierige Ganze zu behalten. Er will nicht in die kaum noch überschaubare wissenschaftliche Diskussion einführen, sondern nur das dort zunehmend ins Hintertreffen geratende unmittelbare Verständnis des Wortlauts sicherstellen. Er ist "kritisch", weil er zum unbefangenen Lesen anhalten möchte. Damit wendet er sich nicht gegen die idealistische Interpretation von Platons Dialogen, der Platon seinen Ruhm als Philosoph verdankt, sondern will zeigen, daß es falsch wäre, den Platon, der im Sophistes Grundlegendes u. a. über Begriffsbildung und Sprache zu sagen hat, darüber zu vernachlässigen. Reasons are of the wrong kind if, despite appearing of the right kind, are not able to justify nor to motivate the formation of a mental attitude. Initially, this problem was thought to apply only within the theoretical realm of reason, but Kavka's Toxin Puzzle showed that reasons of the wrong kind are also found in the practical realm. The aim of this paper is to analyze the scope of this problem, in order to determine the kind of reasons it (...) affects. I will examine two possible solutions to this problem, and I will argue that the most promising solution, proposed by Hieronymi, is based on a conception of reasons and attitudes that is too narrow. Argumento que los eximentes afectan la relevancia causal del acusado, mientras que las excusas lo justifican total o parcialmente, porque afectan al juicio evaluativo implícito en las atribuciones de responsabilidad. Construction of the trunk/caudal region of the vertebrate embryo involves a set of distinct molecules and processes whose relationships are just coming into focus. In addition to the subdivision of the embryo into head and trunk domains, this “caudalisation” process requires the establishment and maintenance of a stem zone. This sequentially generates caudal tissues over a long period which then undergo differentiation and patterning in the extending body axis. Here we review recent studies that show that changes in the signalling (...) properties of the paraxial mesoderm act as a switch that controls onset of differentiation and pattern in the spinal cord. These findings identify distinct roles for different caudalising factors; in particular, Fibroblast Growth Factor (FGF) inhibits differentiation in the caudal stem zone, while Retinoic acid (RA) provided rostrally by somitic mesoderm is required for neuronal differentiation and establishment of ventral neural pattern. Furthermore, the mutual opposition of FGF and RA pathways controls not only neural differentiation but also mesoderm segmentation and might also underlie the progressive assignment of rostrocaudal identity by regulating Hox gene availability and activation. Se relata la experiencia docente durante 7 años de profesoras especialistas en Ortodoncia, quienes representaron la Facultad de Estomatología de la Universidad de Ciencias Médicas "Carlos J. Finlay" de Camagüey, en la Universidad de Saná en la República de Yemen. El reconocimiento por parte de estudiantes, profesores y evaluadores (...) externos de otras universidades del mundo árabe, sobre la calidad de programas de la especialidad, introducción de formas de organización docentes y la metodología en las evaluaciones frecuentes es una muestra de la utilidad de la colaboración docente cubana en países hermanos. Important events and changes that occurred within the Public Health Ministry, the Higher Education from the 20th century, and the International Collaboration of Cuba after the Triumph of the Revolution are mentioned. The objective of the work is to expose the teaching experiences during the teaching of the undergraduate degree in Stomatology and contribution provided by two medical teachers from the Medical University "Carlos J. Finlay" of Camagüey in Sana'a University, Republic of Yemen during the international collaboration for 7 years. Recognition by students, faculty and external evaluators of other universities in the Arab world on the equality of programs of specialty, introduction of Teaching Organization Forms and the methodology in the frequent evaluations is an example of the usefulness of the Cuban educational collaboration in neighboring countries. Naturalism is the philosophical thesis that holds the following assumptions: the rejection of the supernatural and the transcendent; the acceptance of science as knowledge of high epistemic value, for some philosophers it is the only valid knowledge, and the rejection of all first or a priori philosophy. The problem addressed is that prima facie it seems problematic to explain the theses of naturalism without violating some of its assumptions.
