Health technology assessment consists of thesystematic study of the consequences of theintroduction or continued use of the technology in aparticular context, with the explicit objective toarrive at a judgment of the value or merit of thetechnology. Ideally, it is aimed at assessing allaspects of a given technology or group oftechnologies, including non-technical, e.g.socio-ethical, aspects. However, methods for assessingsocio-ethical implications of health technology arerelatively undeveloped and few mechanisms exist totake action based on the results of such evaluations.Still, the examples of cochlear (...) inplants and other cases illustratethat HTA is not a matter of merely collecting thefacts about a technology. The facts must beplausible and relevant from a particular framework,which is not always shared by different groups. It ishere that socio-ethical aspects are encountered. Ifhealth technology assessment aims to enhance theaccountability of the decision making processregarding funding and use of health technology, it isa major challenge to assessors of health technologiesto deal adequately with existing value pluralism. Lewis et al. (2011) attempted to restore the reputation of Samuel George Morton, a 19th century physician who reported on the skull sizes of different folk-races. Whereas Gould (1978) claimed that Morton’s conclusions were invalid because they reflected unconscious bias, Lewis et al. alleged that Morton’s findings were, in fact, supported, and Gould’s analysis biased. We take strong exception to Lewis et al.’s thesis that Morton was “right.” We maintain that Gould was right to reject Morton’s analysis as inappropriate and (...) misleading, but wrong to believe that a more appropriate analysis was available. Lewis et al. fail to recognize that there is, given the dataset available, no appropriate way to answer any of the plausibly interesting questions about the “populations” in question (which in many cases are not populations in any biologically meaningful sense). We challenge the premise shared by both Gould and Lewis et al. that Morton’s confused data can be used to draw any meaningful conclusions. This, we argue, reveals the importance of properly focusing on the questions asked, rather than more narrowly on the data gathered. (shrink)

As new military technologies change the character of war by empowering agents in new ways, it can become more difficult for our ethics of war to achieve the right balance between moral principle and necessity. Indeed, there is an ever-growing literature that seeks to apply, defend and / or update the ethics of war in light of what is often claimed to be an unprecedented period of rapid advancement in military robotics, or warbots. To increase confidence that our approach to (...) this development finds success in appropriately constraining war, this article compares our current discourse to the ethical debate over the rise of air power during the interwar period. As moral norms largely failed to constrain air power in World War II, by highlighting the interrelated processes of technological change, ethical debate, and the eventual reconciliation of war practice and war ethics, this historical case offers insights that can help military ethicists maintain their “critical edge” as remote and autonomous robotic weapons continue to mature and proliferate. The Weather Prediction Task was originally designed to assess probabilistic classification learning. Participants were believed to gradually acquire implicit knowledge about cue–outcome association probabilities and solve the task using a multicue strategy based on the combination of all cue–outcome probabilities. However, the cognitive processes engaged in the resolution of this task have not been firmly established, and despite conflicting results, the WPT is still commonly used to assess striatal or procedural learning capacities in various populations. Here, we tested young adults (...) on a modified version of the WPT and performed novel analyses to decipher the learning strategies and cognitive processes that may support above chance performance. The majority of participants used a hierarchical strategy by assigning different weights to the different cues according to their level of predictability. They primarily based their responses on the presence or absence of highly predictive cues and considered less predictive cues secondarily. However, the influence of the less predictive cues was inconsistent with the use of a multicue strategy, since they did not affect choices when both highly predictive cues associated with opposite outcomes were present simultaneously. Our findings indicate that overall performance is inadequate to draw conclusions about the cognitive processes assessed by the WPT. Instead, detailed analyses of performance for the different patterns of cue–outcome associations are essential to determine the learning strategies used by participants to solve the task. (shrink)

This incisive book deals with the use of the criminal law to enforce morality, in particular sexual morality, a subject of particular interest and importance since the publication of the Wolfenden Report in 1957. Professor Hart first considers John Stuart Mill's famous declaration: "The only purpose for which power can be rightfully exercised over any member of a civilized community is to prevent harm to others." During the last hundred years this doctrine has twice been sharply challenged by two great (...) lawyers: Sir James Fitzjames Stephen, the great Victorian judge and historian of the common law, and Lord Devlin, who both argue that the use of the criminal law to enforce morality is justified. The author examines their arguments in some detail, and sets out to demonstrate that they fail to recognize distinction of vital importance for legal and political theory, and that they espouse a conception of the function of legal punishment that few would now share. The paper defends the position that phenomenological interviews can provide a rich source of knowledge and that they are in no principled way less reliable or less valid than quantitative or experimental methods in general. It responds to several skeptic objections such as those raised against introspection, those targeting the unreliability of episodic memory, and those claiming that interviews cannot address the psychological, cognitive and biological correlates of experience. It argues that the skeptic must either heed the methodological and epistemological (...) justification of the phenomenological interview provided, or embrace a more fundamental skepticism, a “deep mistrust”, in which scientific discourse can have no recourse to conscious processes as explananda, with ensuing dire consequences for our conception of science.
