This article seeks to reveal, conceptualize, and analyze a trend in the development of the retributive theory of punishment since the beginning of the 21st century. We term this trend “retributarianism.” It is reflected in the emergence of retributive approaches that through expanding the concepts of censure and culpability extend the relevant time-frame for assessing the deserved punishment beyond the sentencing moment. These retributarian approaches are characterized by the individualization of retributivism. On one hand, retributarianism shares with classic retributivism the (...) rhetoric of justice, a focus on the moral evaluation of the severity of the offense, and the primary importance ascribed to maintaining proportionality. On the other hand, it shares with utilitarianism the possibility of taking into account, in addition to the severity of the offense, the offender’s personal circumstances, with a future-oriented perspective that also considers developments subsequent to the commission of the offense. This article analyzes the emergence of retributarianism, suggests possible explanations for its development, and assesses its possible implications for penal theory and policy. (shrink)

Crowdfunding has created new opportunities for poor microentrepreneurs. One crucial question is the impact that the purpose of a loan—either business investment or basic necessities—may have on the success of a campaign. Investigating a prosocial crowdfunding platform, we find that loans taken out to meet basic needs are funded faster than business-related loans, especially for small amounts, which can be explained by the prosocial motivation of microlenders. Moreover, female microborrowers are funded faster than men, especially for basic needs loans. Our (...) results therefore suggest an ethical blind spot, since prosocially motivated crowdlenders may unintentionally end up producing adverse effects, replicating gender role by supporting women to a lesser extent when they apply for business loans. Don Ihde is one of the world's foremost thinkers on the place of technologies in our lives. Over the course of a long career, he has built a unique and useful perspective by expanding on phenomenological and American pragmatist philosophy and has developed wide-ranging insights and conceptual tools for describing the details of our experience across the various areas of human activity, including scientific practice, anthropological history, computer interface, design, art history, and the technologies of everyday life. The F-twist is giving way to the methodology of scientific research programs. Milton Friedman's “Methodology for Economics” is being supplanted as the orthodox rationale for neoclassical economics by Imre Lakatos' account of scientific respectability. Friedman's instrumentalist thesis that theories are to be judged by the confirmation of their consequences and not the realism of their assumptions has long been widely endorsed by economists, under Paul Samuelson's catchy rubric “the F-twist.” It retains its popularity among economists who want no truck with (...) methodology, but among the increasing number of able economists who are writing on methodology the F-twist has been surrendered, not so much because these writers have decided it is false, as because something better has finally come along. This paper provides insights into the pedagogy in practice of non-mainstream education through a qualitative case study of an alternative school in the context of the Israeli school system. The school’s alternative agenda is based on being isolated from mainstream education. We explore the negotiations between the school’s pedagogy and mainstream educational standards. We point to the tensions stemming from the intersections between the school’s ideals and the external context. This issue is significant for understanding the voices that affect alternative (...) education, in relation to its aspiration for autonomous practices, and the ways in which secluded practices are permeated by mainstream influences. Our findings reveal that these negotiations centre on issues relating to learning, knowledge, and assessment. Mainstream standards pass into the alternative educational schemes, creating challenges leading not to a rejection of mainstream demands but to a need to balance between the different educational approaches. The act of balancing does not negate the significance of the alternative school. On the contrary, the ability to suspend educational isolation by interacting with the surrounding educational context enables this type of alternative education to stay in touch with its radical educational agenda. One of the most fundamental concepts within Martin Buber’s philosophy concerns two modes of being: I–it, which reflects an egocentric instrumental existence, and I–thou, which reflects dialogical encounter and interrelatedness. At the face of it, technology seems to be the ultimate example of that which engenders and I–it consciousness. Indeed, a recurrent concern in contemporary times suggests that the increase in our technology use is slowly but surely depriving us of meaningful encounters with the other. In this paper we propose (...) that technology can in fact be applied as an antidote to this predicament. To make this point we describe the teaching of mindfulness practice in higher education. We focus particularly on the use of cell phones to cultivate mindful attention as a precondition and characteristic of I–thou relationships. These cell phones, which have somewhat become extensions of our bodies, remind us to become present and hence more likely to acknowledge interrelatedness. Brief excerpts from student projects in these courses will be applied to demonstrate these transitions. (shrink)

This article aims to raise education researchers’ self-reflection about their treatment of teachers as workers through introducing the term “creative work ethic.” At its core, the creative work ethic is the belief that good work entails innovation. Additional features of this ethic are the prizing self-motivation, work done individually, and a flexible schedule that mixes labor with leisure activities. The danger of the creative work ethic is a tendency for self-exploitation and devaluing workers who do not fit into the ethic. (...) After defining the features of the creative work ethic and describing its drawback, the paper reads closely three education papers in order to show how this ethic colors their analysis of teachers’ work or their prescription for better teaching. We introduce a novel experimental paradigm for eliciting metaphoric expressions in spontaneous speech, under controlled conditions. Participants were presented with a pair of words on a PC monitor and were asked to provide a verbal response describing a conceptual relation between the stimuli. The proportion of metaphoric responses depended on the stimuli in a predictable manner. A large proportion of metaphoric responses was obtained for stimuli that were derived from existing metaphors. The chronometric study of metaphor production in this paradigm (...) produced 3 major findings: (a) a figurative-literal difference: responses that included metaphorical expressions showed greater reaction times (RTs) than responses with only literal expressions; (b) familiarity effect: responses that included more-familiar metaphorical expressions showed smaller RTs than responses that included less-familiar metaphorical expressions; (c) degree of metaphoricity effect: responses that included highly metaphorical expressions showed greater RTs than responses that included less metaphorical expressions. This article explores the relationship between psychotherapy and sound reproduction technologies from the early 20th century to the present. Subscribing to a media genealogy approach, it traces the changing status of the recorded voice in therapy as set against broader transformations in the field of mental health. Delving into the recorded voice’s diverse applications across psychotherapeutic approaches, it demonstrates how technology worked to unravel the temporal and spatial formations of the therapeutic setting, thereby unsettling established hierarchies, terminologies, and techniques while (...) at the same time supporting the integrity of the therapeutic situation. The article points to sound media’s capacity to bifurcate the voice into somatic and expressive elements and reassemble them in various configurations, thereby producing the ‘psyche’ through alternative access points. The story of the recorded voice in therapy provides a glimpse into the way technological affordances inform therapeutic concepts and practices, which in turn implement technology in study, training, and treatment. This paper considers whether the available evidence from archeology, biological anthropology, primatology, and comparative gene-sequencing, can test evolutionary game theory models of cooperation as historical hypotheses about the actual course of human prehistory. The examination proceeds on the assumption that cooperation is the product of cultural selection and is not a genetically encoded trait. Nevertheless, we conclude that gene sequence data may yet shed signi cant light on the evolution of cooperation.
