Models developed using machine learning are increasingly prevalent in scientific research. At the same time, these models are notoriously opaque. Explainable AI aims to mitigate the impact of opacity by rendering opaque models transparent. More than being just the solution to a problem, however, Explainable AI can also play an invaluable role in scientific exploration. This paper describes how post-hoc analytic techniques from Explainable AI can be used to refine target phenomena in medical science, to identify starting points for future (...) investigations of causal relationships, and to generate possible explanations of target phenomena in cognitive science. In this way, this paper describes how Explainable AI—over and above machine learning itself—contributes to the efficiency and scope of data-driven scientific research. (shrink)

Epidemiological studies of chronic diseases began around the mid-20th century. Contrary to the infectious disease epidemiology which had prevailed at the beginning of the 20th century and which had focused on single agents causing individual diseases, the chronic disease epidemiology which emerged at the end of Word War II was a much more complex enterprise that investigated a multiplicity of risk factors for each disease. Involved in the development of chronic disease epidemi-ology were therefore fundamental discussions on the notion of (...) causality, especially the question when causal inferences could be justified. In this paper, I shall analyze the implicit normativity of these de-bates. First, I shall give a brief overview of the historical background on which chronic disease epi-demiology emerged and describe how the pioneer studies on smoking and lung cancer became icon of the major challenge that the emerging chronic disease epidemiology was facing: the impossibility of proving that statistical associations reflected causal relations. Next, I shall describe how the develop-ment from the monocausal enterprise of infectious disease epidemiology to the multicausal enterprise of chronic disease epidemiology gave rise to intense discussions of the possible criteria by which to establish causal relationships between a given factor and a particular disease. I shall show how the necessary and sufficient conditions expressed in the so-called Henle-Koch criteria that had proved useful for the 19th century investigations of infectious diseases remained an ideal, although clearly an unobtainable one. Thus, I shall show how 20th century chronic disease epidemiologists on the one hand were searching for a new set of general principles which would provide a logical framework for their investigations, but on the other hand admitted that they would have to accept something more "pragmatic". I shall analyze the various positions in this debate, arguing that the implacability of the debate was due to unrecognized normative issues. I shall argue that many insisted on a distinction between science and application that was untenable, but that due to this distinction the values in-volved in deciding whether or not to act on the basis of a hypothesis were rarely explicitly discussed and the decision therefore continued to appear as a matter of taste rather than the result of a cogent normative analysis. A frequently advanced claim in contemporary science policy is that interdisciplinarity is especially well suited for being ‘transformative’ and for bringing about ‘major breakthroughs’. Thus, it is expected that, in contemporary science, major progress will come primarily from interdisciplinary research (IDR). Often in this dis-course, interdisciplinarity is also expected to integrate the involved disciplines or specialties. This chapter will provide a philosophical qualification of this political discourse by examining how interdisciplinary progress can be characterised. I shall argue that in addition (...) to the categories of incremental and transformative progress that are well known from mono-disciplinary science, IDR can sometimes also offer another category of progress that I shall call quasi-transformative. In examining these three kinds of interdisciplinary progresses I shall argue, first, that interdisciplinary progress does not necessarily require a specific type of integration between the involved disciplines or specialties, second, that social relations between scientists with different areas of expertise may play a crucial role in especially transformative progress, and third, that different disciplinary perspectives on what constitutes progress can draw wedges between scientists from different disciplines. One of the fundamental problems of epistemology is to say when the evidence in an agent’s possession justifies the beliefs she holds. In this paper and its prequel, we defend the Bayesian solution to this problem by appealing to the following fundamental norm: Accuracy An epistemic agent ought to minimize the inaccuracy of her partial beliefs. In the prequel, we made this norm mathematically precise; in this paper, we derive its consequences. We show that the two core tenets of Bayesianism (...) follow from the norm, while the characteristic claim of the Objectivist Bayesian follows from the norm along with an extra assumption. Finally, we consider Richard Jeffrey’s proposed generalization of conditionalization. We show not only that his rule cannot be derived from the norm, unless the requirement of Rigidity is imposed from the start, but further that the norm reveals it to be illegitimate. We end by deriving an alternative updating rule for those cases in which Jeffrey’s is usually supposed to apply. (shrink)

This essay develops a joint theory of rational (all-or-nothing) belief and degrees of belief. The theory is based on three assumptions: the logical closure of rational belief; the axioms of probability for rational degrees of belief; and the so-called Lockean thesis, in which the concepts of rational belief and rational degree of belief figure simultaneously. In spite of what is commonly believed, this essay will show that this combination of principles is satisfiable (and indeed nontrivially so) and that the principles (...) are jointly satisfied if and only if rational belief is equivalent to the assignment of a stably high rational degree of belief. Although the logical closure of belief and the Lockean thesis are attractive postulates in themselves, initially this may seem like a formal “curiosity”; however, as will be argued in the rest of the essay, a very reasonable theory of rational belief can be built around these principles that is not ad hoc and that has various philosophical features that are plausible independently. In particular, this essay shows that the theory allows for a solution to the Lottery Paradox, and it has nice applications to formal epistemology. The price that is to be paid for this theory is a strong dependency of belief on the context, where a context involves both the agent's degree of belief function and the partitioning or individuation of the underlying possibilities. But as this essay argues, that price seems to be affordable. (shrink)

Wodurch zeichnet sich menschliches intelligentes Handeln aus und in welcher Beziehung steht dieses Handeln zum Wissen der handelnden Personen? Diesen Fragen wird im vorliegenden Buch nachgegangen. Praktische Intelligenz wird als Fähigkeit verstanden, im Denken, Handeln und Fühlen durch Standards und Normen geleitet zu werden. Aufbauend auf eine Interpretation von Überlegungen Gilbert Ryles entwickelt Hannes Worthmann einen neuartigen Ansatz, praktische Intelligenz und die Unterscheidung zwischen Wissen-wie und Wissen-dass jenseits verbreiteter intellektualistischer und anti-intellektualistischer Auffassungen verständlich zu machen.

In everyday life we either express our beliefs in all-or-nothing terms or we resort to numerical probabilities: I believe it's going to rain or my chance of winning is one in a million. The Stability of Belief develops a theory of rational belief that allows us to reason with all-or-nothing belief and numerical belief simultaneously.

The contemporary debate about the ontology of sounds appears stuck. Two main contestants—the medial view and the located event view—each have a number of arguments on their side, while each needs to either accommodate or downplay the arguments speaking for the competing approach. In this paper, I want to argue that the two views are in fact not at odds with each other, but may, with some amendments, be combined in a two‐step model of sound perception inspired by Thomas Reid's (...) theory of vision: Reid argues that we perceive bodies in virtue of perceiving visibles, two‐dimensional occupants of the visual field, best understood as relational properties. My suggestion is that we perceive sounds, understood as located events in virtue of perceiving audibles which have much in common with sounds as understood by medial theorists. (shrink)

The so-called paradoxes of material implication have motivated the development of many non-classical logics over the years, such as relevance logics, paraconsistent logics, fuzzy logics and so on. In this note, we investigate some of these paradoxes and classify them, over minimal logic. We provide proofs of equivalence and semantic models separating the paradoxes where appropriate. A number of equivalent groups arise, all of which collapse with unrestricted use of double negation elimination. Interestingly, the principle ex falso quodlibet, and several (...) weaker principles, turn out to be distinguishable, giving perhaps supporting motivation for adopting minimal logic as the ambient logic for reasoning in the possible presence of inconsistency. The natural history of our moral stance told here in this commentary reveals the close nexus of morality and basic social-cognitive capacities. Big mysteries about morality thus transform into smaller and more manageable ones. Here, I raise questions regarding the conceptual, ontogenetic, and evolutionary relations of the moral stance to the intentional and group stances and to shared intentionality.

In discussions about whether the Principle of the Identity of Indiscernibles is compatible with structuralist ontologies of mathematics, it is usually assumed that individual objects are subject to criteria of identity which somehow account for the identity of the individuals. Much of this debate concerns structures that admit of non-trivial automorphisms. We consider cases from graph theory that violate even weak formulations of PII. We argue that (i) the identity or difference of places in a structure is not to be (...) accounted for by anything other than the structure itself and that (ii) mathematical practice provides evidence for this view. This article investigates the role of historical references and arguments in the current policy debate on non‐invasive prenatal testing (NIPT) in Germany. It analyses major documents and opinion statements, including the recent parliamentary debate (2019). The implementation of NIPT is accompanied by concerns and strong criticism, particularly in Germany. Many perceive the new test to be a problematic step that facilitates selective practices and is reminiscent of eugenics. Analysis of the German policy discourse shows that ‘eugenics’, and even more strongly, (...) ‘selection’, are pivotal terms for rejecting NIPT and its coverage by public health insurance. They touch on a historical dimension in public deliberation, namely the fundamental distancing from the inhuman practices of the National Socialist period and anything that resembles them. However, using these terms to criticize prenatal genetic testing is controversial, and recent discourse demonstrates their avoidance as well, with many supporters of a limited coverage by public health insurance contrasting their approach with more widespread screening. Here, ‘screening’ has a negative connotation, and functions to demarcate the debate in a way that may reflect distance from certain modes of historical reasoning, but still expresses a special need to reconcile prenatal testing with the principles of dignity, inclusion and diversity. This article aims to elucidate the concerns involved in the national debates on prenatal testing and to increase awareness of the historical dimensions of the language and reasoning with which such methods are negotiated today and in future. The article explores the early Marx’s vision of communal relationships, which is centered on the idea that in producing for others individuals can be concerned with satisfying the needs of others, and may reciprocally value their interdependence in producing for one another. It is argued that if the ideal of communal reciprocity is to be realized in a viable and desirable form, it must be compatible with some forms of self-interest, social indifference and instrumental action, typically realized through the institution (...) of the market. The article shows that communal reciprocity may go together with market reciprocity as long as market relations are structured such that exploitative motives are not systematically promoted. The article examines various economic institutions that could meet the non-exploitation requirement, either by transforming the constitutive rules of the market, in contrast to its regulative rules, or by regulating the market internally, in contrast to its external regulation. Thomas Kuhn's Structure of Scientific Revolutions became the most widely read book about science in the twentieth century. His terms 'paradigm' and 'scientific revolution' entered everyday speech, but they remain controversial. In the second half of the twentieth century, the new field of cognitive science combined empirical psychology, computer science, and neuroscience. In this book, the theories of concepts developed by cognitive scientists are used to evaluate and extend Kuhn's most influential ideas. Based on case studies of the Copernican revolution, (...) the discovery of nuclear fission, and an elaboration of Kuhn's famous 'ducks and geese' example of concept learning, this volume, first published in 2006, offers accounts of the nature of normal and revolutionary science, the function of anomalies, and the nature of incommensurability. Formålet med nærværende oversigtsartikel er at undersøge den stigende digitalisering og deling af personlige informationer i sundhedsvæsenet, samt hvilke etiske udfordringer denne udvikling har for den enkelte borger. Mere præcis vil vi rammesætte denne diskussion i en dansk kontekst eksemplificeret ved Det Fælles Medicinkort. Det Fælles Medicinkort er en obligatorisk database for danske borgere indeholdende informationer om patienters medicinske historie to år tilbage. Denne database kan tilgås af en bred vifte af sundhedsprofessionelle i Danmark.På trods af lovede sundhedsmæssige fordele, såsom (...) en højere grad af sikkerhed i forbindelse med medicinering, en øget effektivisering af sundhedsvæsenet og dermed besparelser på de offentlige budgetter, plæderer vi i artiklen for, at implementeringen af Det Fælles Medicinkort kompromitterer den enkeltes privathed. Den enkelte borger er ikke i tilstrækkelig grad informeret om brugen af Det Fælles Medicinkort. Ydermere finder vi ikke, at borgerens autonomi i forhold til indholdet af personlige oplysninger i Det Fælles Medicinkort er opretholdt på en tilfredsstillende måde.Artiklens primære perspektiv er deontologisk, men for at nuancere vores diskussion inddrages lejlighedsvist også utilitaristiske argumenter. Endvidere inddrages i artiklen Helen Nissenbaum, Tom L. Beauchamp og James F. Childress samt John Rawls. Specifically the paper discusses the right to privacy in a Danish context, namely in relation to the use of The Shared Medical Record. The Shared Medical Record is a default digital health record consisting of every patient’s medical history for the previous two years, accessible to a broad range of health professionals in Denmark.In this paper we discuss three aspects of The Shared Medical Record, primarily from a normative point of view: 1) Are the personal data shared by The Shared Medical Record relevant and appropriate? 2) Is the distribution of this information to the current array of health professionals appropriate? And 3) Does The Shared Medical Record adequately support and account for the quorum and autonomy of the individual citizen with regards to personal information?We argue that, advantages such as heightened security, efficiency and convenience aside, the citizens’ right to privacy is to some extent compromised by the terms and use of this record. The citizen is not extensively informed on the use of the record, and does not hold a sufficient degree of autonomy over the content and distribution of their personal data. The primary ethical perspective of the paper is deontological, but in order to properly nuance our stance we have chosen to include traditionally utilitarian points of view throughout our discussions.In the paper we introduce Helen Nissenbaum’s notion of contextual integrity in order to thoroughly assess the service’s ethical implications for Danish citizens and their future privacy, as well as points from John Rawls, Tom L. Zusammenfassung Der Sport ist ein körperzentriertes Sozialsystem, das als machtvolle Ausdrucks- und Inszenierungsstätte beschrieben wird, in der verschiedene soziale Gruppen um Prestige und symbolische Macht konkurrieren. In diesem Wettbewerb können Vorurteile der Abgrenzung zwischen Gruppen auf der Grundlage von ethnischen, sozialen und kulturellen Kategorisierungen dienen. Die vorliegende Studie befasst sich mit der Ideologie der Ungleichwertigkeit im vereinsorganisierten Sport. Es wird den Fragen nachgegangen, ob und wie Vorurteile im Sport miteinander zusammenhängen und welche Faktoren ausgewählte Abwertungen beeinflussen. Es zeigt sich, dass (...) Vorurteile im Sport eng miteinander verbunden sind, und es wird diskutiert, weshalb Diversität im Sport eine stärkere Rolle bei Integrationsprozessen spielen sollte. (shrink)

Bishop's Lemma is a centrepiece in the development of constructive analysis. We show that its proof requires some form of the axiom of choice; and that the completeness requirement in Bishop's Lemma can be weakened and that there is a vast class of non‐complete spaces that Bishop's Lemma applies to.

Zusammenfassung In diesem Beitrag geht es vor dem Hintergrund verschiedener Neokapitaltheorien um Bestimmungsmöglichkeiten eines spirituellen bzw. religiösen Kapitals und die solchen Kapitalformen zugrunde liegenden Begriffe von Religion und Spiritualität. Ein eigener Ansatz wird in die Diskussion gebracht, der eine Ausdifferenzierung in spiritualisierendes und spirituelles, exoterisches religiöses und esoterisches religiöses Kapital vorschlägt. Die vorgeschlagenen Begriffe werden anhand aktueller Entwicklungen in der afrobrasilianischen Candomblé-Religion erörtert.

This article introduces, studies, and applies a new system of logic which is called ‘HYPE’. In HYPE, formulas are evaluated at states that may exhibit truth value gaps and truth value gluts. Simple and natural semantic rules for negation and the conditional operator are formulated based on an incompatibility relation and a partial fusion operation on states. The semantics is worked out in formal and philosophical detail, and a sound and complete axiomatization is provided both for the propositional and the (...) predicate logic of the system. The propositional logic of HYPE is shown to contain first-degree entailment, to have the Finite Model Property, to be decidable, to have the Disjunction Property, and to extend intuitionistic propositional logic conservatively when intuitionistic negation is defined appropriately by HYPE’s logical connectives. Furthermore, HYPE’s first-order logic is a conservative extension of intuitionistic logic with the Constant Domain Axiom, when intuitionistic negation is again defined appropriately. The system allows for simple model constructions and intuitive Euler-Venn-like diagrams, and its logical structure matches structures well-known from ordinary mathematics, such as from optimization theory, combinatorics, and graph theory. HYPE may also be used as a general logical framework in which different systems of logic can be studied, compared, and combined. In particular, HYPE is found to relate in interesting ways to classical logic and various systems of relevance and paraconsistent logic, many-valued logic, and truthmaker semantics. On the philosophical side, if used as a logic for theories of type-free truth, HYPE is shown to address semantic paradoxes such as the Liar Paradox by extending non-classical fixed-point interpretations of truth by a conditional as well-behaved as that of intuitionistic logic. Finally, HYPE may be used as a background system for modal operators that create hyperintensional contexts, though the details of this application need to be left to follow-up work. (shrink)

L’article présente une reconstruction d’analyse husserlienne de l’éveil et démontre que, selon Husserl, seule une phénoménologie de l’attention est en mesure d’élucider les véritables caractéristiques de l’état d’éveil. Plus précisément, l’article démontre que, d’un point de vue husserlien, l’attention introduit une distinction entre thème et arrière-plan dans notre expérience et que cette différence est ce qui nous permettra de déterminer dans quelle mesure nous ne sommes jamais pleinement éveillés lorsque nous sommes éveillés (section 1 et 2), comment le sommeil au (...) sein de l’état d’éveil diffère du sommeil véritable (section 3), et, enfin, comment l’intentionnalité survenant lors du sommeil véritable, à l’instar des rêves, diffère radicalement de toute forme de conscience intentionnelle survenant lors de l’état d’éveil (section 4). It is a commonly raised argument against the family resemblance account of concepts that there is no limit to a concept's extension. An account of family resemblance which attempts to provide a solution to this problem by including both similarity among instances and dissimilarity to non-instances has been developed by the philosopher of science Thomas Kuhn. Similar solutions have been hinted at in the literature on family resemblance concepts, but the solution has never received a detailed investigation. I shall provide (...) a reconstruction of Kuhn's theory and argue that his solution necessitates a developmental perspective wchich builds on both the transmission of taxonomies between generations and a progressive development through history. Thomas Kuhn's The Structure of Scientific Revolutions was published at the beginning of what has come to be known as “the cognitive revolution.” With hindsight one can construct significant parallels between the problems of knowledge, perception, and learning with which Kuhn and cognitive scientists were grappling and between the accounts developed by each. However, by and large Kuhn never utilized the research in cognitive science—especially in cognitive psychology—that we believe would have furthered his own paradigm. This is puzzling since he (...) did not have the traditional philosophical aversion to “psychologizing” and in fact drew on insights from psychology to support the most radical claims in Structure, such as the “Gestalt switch” nature of conceptual change. Indeed, the research program outlined there seems intrinsically historical, philosophical, and psychological and Kuhn's work has had considerable influence on research in cognitive science. (shrink)

In the sequel, we derive the main tenets of Bayesianism from the relevant mathematical versions of Accuracy to which this characterization of the legitimate inaccuracy measures gives rise, but we also show that Jeffrey conditionalization has to be replaced by a different method of update in order for Accuracy to be satisfied. With the main work The Revolutions of Science, Thomas S. Kuhn became one of the most read and influential science theorists of the 20th century, and today Kuhn's mindset is part of the majority of science theory courses mandatory at any university course. Kuhn's concepts of paradigms, scientific revolutions and incommensurability have not only changed our view of science but have almost become part of the everyday language and are used far outside the world of science. The legacy of Kuhn (...) paints a picture of the importance Kuhn's thoughts have had to our understanding of the sciences. The authors begin with an introduction to Kuhn's life and work and to the many philosophical discussions that his work has spawned. Next follows a series of chapters outlining Kuhn's influence on the history of science and philosophy of science and his importance in sociology, physics, biology, geography, anthropology, psychology, linguistics and aesthetic sciences. The book is aimed at anyone studying or engaged in one of these subjects, or who wants to understand the debate about the sciences and their evolution over the last half-century. (shrink)

Within recent years, scientific misconduct has become an increasingly important topic, not only in the scientific community, but in the general public as well. Spectacular cases have been extensively covered in the news media, such as the cases of the Korean stem cell researcher Hwang, the German nanoscientist Schön, or the Norwegian cancer researcher Sudbø. In Science's latest annual "breakthrough of the year" report from December 2006, the descriptions of the year's hottest breakthroughs were accompanied by a similar description of (...) "the breakdown of the year: scientific fraud". Official guidelines for dealing with scientific misconduct were introduced in the 1990s. At this time, research agencies, universities and other research institutions around the world developed guidelines for good scientific practice and formed committees to handle cases of scientific misconduct. In this process it was widely debated how to define scientific misconduct. Most definitions centered on falsification, fabrication, and plagiarism (the so-called FFP definition), but suggestions were also made for definitions that were broader and more open-ended, such as the 1995 suggestion from the US Commission of Research Integrity to replace FFP with misappropriation, interference and misrepresentation (the so-called MIM definition). The MIM definition was not adopted in the US, but MIM-like definitions have been adopted in several other countries. In this paper, I shall describe these MIM-related definitions of scientific misconduct and analyze the arguments that have been advanced in their favor. I shall discuss some of the difficulties inherent in the MIM-related definitions, such as the distinction between misrepresentation and mistake, and the demarcation of misrepresentation in areas characterized by uncertainty or by diverging research paradigms. I shall illustrate the problems inherent in the MIM-definition through a particular case: the ruling of the Danish Committee on Scientific Dishonesty (DCSD) about Bjørn Lomborg's best-selling book The Skeptical Environmentalist in which he argued that contrary to what was claimed in the “litany” of the environmentalists, the state of the environment is getting better rather than worse. Lomborg was reported to the DCSD by several environmental scientists, and this controversial case from 2003 ended with a verdict that characterized Lomborg’s conclusions as misrepresentations, but acquitted Lomborg of misconduct due to his ignorance. I shall analyze this verdict and the problems it reveals with respect to the MIM-related definitions of misconduct. (shrink)

Deux ques t ions impor tantes sont rarement posées à propos de l’introduction possible de Quotas Individuels Transférables dans les pêcheries : Pourquoi n’y a-t-il que deux pays dans le monde, l’Islande et la Nouvelle Zélande, qui ont introduit un système compréhensible de QIT dans leurs pêcheries? et : qui s’occupe de la privatisation des biens d’accès libre? L’expérience de l’Islande peut donner quelques réponses. Dans une première partie, l’évolution du système de QIT en Islande entre 1975 et 2000 est (...) décrite comme un processus difficile de marchandage. D’une part les coûts de marchandage furent abaissés par la crainte répandue de la disparition des stocks de poisson, et par la relative homogénéité dans les pêcheries pélagiques. D’autre part ces coûts furent augmentés, par l’hétérogénéité dans les pêcheries démersales, avec des différences immenses entre les propriétaires de petits bateaux et ceux de grands chalutiers, ainsi que des différences entre les régions. Dans la seconde partie, est décrite la nature du système de QIT: alors que ceux qui détiennent des QIT jouissent de droits d’extraction plutôt que de la propriété, l’introduction du système de QIT équivaut à clôturer partiellement les stocks de poisson dans les eaux d’Islande, résolvant ainsi la plupart des problèmes associés à la “tragédie des communs”. Le système a plutôt bien opéré mis à part quelques problèmes subsistants, en particulier le statut légal incertain des QIT et les prises de premier choix. La troisième partie décrit les controverses actuelles au sujet du système des QIT. Nous démontrons que le seul moyen de rendre l’introduction de ce système acceptable pour les propriétaires d’un capital de pêche était d’allouer des quotas sur la base de l’histoire des prises, et qu’une taxe spéciale sur la location des ressources serait injuste car elle frapperait ceux qui ont choisi de rester dans les pêcheries et non ceux qui ont été mis à l’écart.Two important questions are rarely asked about the possible introduction of ITQs in fisheries: Why are there only two countries in the world, Iceland and New Zealand, which have introduced a comprehensive ITQ system into their fisheries? and: Who cares whether the commons is privatized? The experience in Iceland may provide some answers. In Part 1, the evolution of the ITQ system in Iceland in 1975-2000 is described as a difficult process of bargaining. Costs of bargaining were lowered by the widespread fear of the collapse of the fish stocks, and by the relative homogeneity in the pelagic fisheries. Those costs were increased, on the other hand, by the heterogeneity in the demersal fisheries, with vast differences between owners of small boats and large trawlers, and also between regions. In Part II, the nature of the ITQ system is described: while those who hold ITQs enjoy rights of extraction rather than property, the introduction of the ITQ system amounts to the partial enclosure of the fish stocks in Icelandic waters, solving most of the problems associated with the “tragedy of the commons”. The system has performed quite well although some problems remain, in particular the uncertain legal status of the ITQs and high-grading. In Part III, current controversies about the ITQ system are described. It is argued that the only way to make the introduction of the system acceptable to owners of fishing capital was to allocate quotas on the basis of catch history, and that a special resource rent tax would be unjust, since it would hit those who chose to remain in the fisheries, not those who were bought out. The work of T.H. Green provides a justificatory argument for human rights which is a powerful alternative to the still prevailing account of rights, which sees them as somehow tied to human nature and argues that humans have rights qua humans, and independent of society. Green's account of rights turns on the process of social recognition. However, the precise mechanism for recognition is left slightly ambiguous. This paper argues that recognition in Green can be usefully divided into two stages, 'recognition (...) of persons' and 'recognition of rights'. It will be argued that the two are separate and that the first is a necessary prerequisite for the second. Recognition of persons is the recognition of moral action based on the use of language; recognition of rights occurs in societies of persons and is the dialogical recognition of certain rights claims.
