Al-Shāfiʿī’s works contain reports of numerous debates on the epistemological value of hadith reports, but unfortunately rarely name specific opponents or interlocutors or the groups to which they belong. In Jimāʿ al-ʿilm al-Shāfiʿī summarizes the views of scholars whom he considered opponents of hadith under two broad rubrics: those who reject hadith categorically and those who reject only part of the hadith. There have been speculations regarding their identity but only in 2013 was a concrete advance made, when Ahmed El (...) Shamsy identified one of al-Shāfiʿī’s opponents in debate as Ibn ʿUlayya. This study attempts to identify a group of al-Shāfiʿī’s opponents in Jimāʿ al-ʿilm, drawing on Abū l-Qāsim al-Balkhī’s Kitāb al-Maqālāt and other classical works of Islamic theology. (shrink)

With this study, it is aimed to clarify some ambiguities about the origin of the manuscripts that the edition of Kitāb al-Tahrīsh and Kitāb al-Maqālāt, which we published recently, rest on. Those editions which we expect to open new horizons in terms of the history of Islamic theology and hadith criticism, have reached today via Yemeni libraries, like other Muʿtazila cultural heritage items. Due to the political instability caused by the long-term civil wars in the country, a detailed inventory of (...) private or official libraries in Yemen, which has rich collections of manuscripts on Islamic culture, has not been made until now. Although some of these manuscripts were collected in the Sanaa Library (Maktabat al-Awqāf), most of them are still preserved in mosques’ libraries or private collections under inappropriate conditions. Since there are no reliable records or indexes of these manuscripts, it is not possible to give reliable information about the origin of each item especially the status of those found in private collections or family libraries as called Buyūt alʿilm. Today, most of the Yemeni manuscripts found in the libraries of Europe, America and Islamic countries have been purchased by manuscript collectors, merchants, foreign researchers, or other illegal ways. The ones that have been published so far are either based on these manuscripts or similarly on copies from Yemen. This ambiguity about the origin of the manuscripts can sometimes lead to unjust accusations that target the editors of them, as if they used illegal copies on purpose. In this article, we tried to clarify the ambiguities and controversial points related to those manuscripts which our edition is based on by giving information about the obtaining manuscripts and edition processes. Flückiger’s study of the history of the natural law from the standpoint of evangelical theology and Fuchs’ handling of the natural law in the context of Catholic theology provide a striking contrast to Ross’s book. Fluckiger’s book is the first, and so far the only one to appear, of a three-volume work. Study of ecclesiastical social ethics, and in particular of the theological basis of civil authority and law, convinced the author, so he tells us in his Preface, of (...) the need for a history of the natural law that would explore the neglected relationship of that concept with theology. This standpoint, as the author perfectly well recognises gives only a partial view of the western tradition of the natural law. The book falls into five sections—pre-history, beginnings, late antiquity, the Fathers and the early Middle Ages—but it is only in the fourth, that dealing with the Fathers, that the theological preoccupation becomes prominent. Books about Einstein abound but they sell. Perhaps more than with other subjects, if you want to publish a book about Einstein, you need to delimit your subject matter and target a sizeable audience. Topobiographies, as one might call them, that is, biographies with a focus on a specific location, are a popular way to meet this challenge. You are cutting down your subject matter to manageable proportions and you are addressing a naturally defined readership. With Einstein, topobiographical works almost (...) constitute a genre.Let me mention some examples. Carl Seelig wrote a book about Einstein in Switzerland (Seelig 1952). Max Flückiger (1974) followed his example with a book specifically about “Albert Einstein in Bern.” For Einstein’s Berlin years, not a biography, but a collection of sources was presented in the year of the hundredth anniversary of his birth by Christa Kirsten and Hans-Jürgen Treder (1979). Josef Fuchs’s Droit naturel is a French translation of the German Lex Naturae—Zur Theologie des Naturrechts. The author has taken the opportunity of making some minor alterations and of adding a new chapter on the relation between the natural law and Christian social teaching. Otherwise the work is unchanged. It is divided into two parts. In the first the author studies the natural law in revelation, which, of course, takes him outside the scope of philosophy. What he says is, however, (...) indirectly of interest to philosophy. Christians are sometimes tempted to think of the natural law as, in practice, almost a special preserve of the Catholic Church which has the mission of interpreting it. It is therefore interesting to discover that the term is almost impossible to find in documents of the magisterium before the pontificates of Pius IX and Leo XIII. Fuchs finds only the synod of Aries in 475, echoing St. Paul’s doctrine of Romans. On the other hand Fuchs points out that St. Paul’s reference to the natural law, while by far the most explicit, is not the only one in Sacred Scripture. This is a useful corrective of the view sometimes met with that the natural law is unknown in the Bible; and it is also a corrective of Flückiger’s exegesis of St. Paul. (shrink)
