Nelson Goodman’s work is universally regarded as pioneering and fundamental, and his attempts to clarify the nature of induction, symbol systems, art, theorizing and understanding have received and continue to receive great attention. Central to that work is a view Goodman describes as “radically relativist.” Goodman’s unusual brand of relativism, however, while basic to the entire Goodman corpus, has yet to be carefully delineated and studied. I hope in this paper to begin such a study. I will first briefly review (...) the development of Goodmanian relativism through his earlier books and articles. Then I will develop a more detailed and elaborate account of the relativist position Goodman develops in his most recent book, Ways of Worldmaking. Because Goodman’s relativism is significantly different from more traditional accounts of relativism, I will attempt to shed light on Goodmanian relativism by contrasting it with those more traditional accounts. Finally, I will argue that there is a crucial ambiguity in Goodman’s portrayal and defense of relativism, having to do with the role of “criteria of rightness” in Goodman’s system, and that this ambiguity licenses two quite distinct versions of Goodmanian relativism. I will argue that the weak version of relativism is defensible, and important, but that the strong, or “radical,” relativist position suffers from a fatal flaw. My hope is that the paper will serve to clarify not only Goodman’s position, but epistemological relativism more generally. (shrink)

Courts reviewing gun laws that burden Second Amendment rights ask how effectively the laws serve public safety — yet typically discuss public safety narrowly, without considering the many dimensions of that interest gun laws serve. “Public safety” is a social good: it includes the public's interest in physical safety as a good in itself, and as a foundation for community and for the exercise of constitutional liberties. Gun laws protect bodies from bullets — and Americans' freedom and confidence to participate (...) in every domain of our shared life, whether to attend school, to shop, to listen to a concert, to gather for prayer, or to assemble in peaceable debate. Courts must enforce the Second Amendment in ways that respect the public health and constitutional reasons a democracy seeks to protect public safety. Lawyers and citizen advocates can help, by creating a richer record of their reasons in seeking to enact laws regulating guns.This inquiry is urgent at a time when the Supreme Court's new conservative majority may expand restrictions on gun laws beyond the right to keep arms for self-defense in the home first recognized inDistrict of Columbia v. Measuring outcomes using quantitative analytic methods is the hallmark of scientific research in healthcare. For clinical ethics support services (CESS), tangible outcome metrics are lacking and literature examining CESS quality is limited to evaluation of single cases or the influence on individual healthcare professional’s perceptions or behaviour. This represents an enormous barrier to implementing and evaluating ethics initiatives to improve quality. In this context, Kok _et al_ propose a theoretical framework for how moral case deliberation (MCD) can drive quality at (...) an organisational-level, termed _morisprudence_ 1. By offering mechanistic insights into how MCD can lead to organisational learning and quality improvement (QI), they provide a roadmap for actionable items to measure quality. As conceptualised, _morisprudence_ follows accumulation of organisational practical wisdom from a repertoire of ‘paradigmatic’ MCDs, aiding identification of patterns of morally important features. We motivate the desire for self-driving and explain its potential and limitations, and explore the need for—and potential implementation of—morals, ethics, and other value systems as complementary “capabilities” to the Deep Technologies behind self-driving. We consider how the incorporation of such systems may drive or slow adoption of high automation within vehicles. First, we explore the role for morals, ethics, and other value systems in self-driving through a representative hypothetical dilemma faced by a self-driving car. Through the lens of engineering, (...) we explain in simple terms common moral and ethical frameworks including utilitarianism, deontology, and virtue ethics before characterizing their relationship to the fundamental algorithms enabling self-driving. The concepts of behavior cloning, state-based modeling, and reinforcement learning are introduced, with some algorithms being more suitable for the implementation of value systems than others. We touch upon the contemporary cross-disciplinary landscape of morals and ethics in self-driving systems from a joint philosophical and technical perspective, and close with considerations for practitioners and the public, particularly as individuals may not appreciate the nuance and complexity of using imperfect information to navigate diverse scenarios and tough-to-quantify value systems, while “typical” software development reduces complex problems to black and white decision-making. What does it mean to look? How does looking relate to damage? These are the fundamental questions addressed in Overlooking Damage. From the Roman triumph to the iconoclasm of ISIS and the Taliban to the aerial views of looted landscapes and destroyed temples visible on Google, the relationship between beauty and violence is far more intimate than we sometimes acknowledge. Jonah Siegel makes the daring argument that a thoughtful reaction to images of damage need not stop at melancholy, but (...) can lead us to a new reckoning. Would the objects we admire be more beautiful if they were not injured or displaced, if they did not remind us of unbearable violence? Siegel takes up writers from the time of the French Revolution to today who have reacted to the depredations of revolutionary iconoclasm, colonial looting, and industrial capitalism, and proposes that in these authors we may find resources with which to navigate our contemporary situation. Deftly bringing the methods of literary studies to bear on important debates in the study of heritage, archaeology, and visual culture, Overlooking Damage reflects on the ways in which concepts of beauty intersect with periods of epochal violence in an attempt to resist the separation of broken things from the worlds in which they have come to be embedded. How should we think about the interrelationships that obtain among Philosophy, Education, and Culture? In this paper I explore the contours of one such interrelationship: namely, the way in which educational and (other) philosophical ideals transcend individual cultures. I do so by considering the contemporary educational and philosophical commitment to multiculturalism. Consideration of multiculturalism, I argue, reveals important aspects of the character of both educational and philosophical ideals. Specifically, I advance the following claims: i) We are obliged to embrace the (...) moral and political directives of multiculturalism. ii) This obligation is a moral one: that is, multiculturalism is justified on moral grounds. iii) Far from entailing any philosophically problematic form of cultural relativism, multiculturalism is itself a ‘universal’ or ‘transcultural’ ideal. iv) Moreover, the advocacy of multiculturalism presupposes another kind of universality, dubbed below ‘transcultural normative reach.’ v) Consequently, multiculturalism should not be understood as entailing the demise of ‘universalistic’ dimensions of either philosophy or education. Rather, the two dimensions are linked in some kind of causal relationship for which continuing conceptual and empirical research is desirable. Is 'education' a thick epistemic concept? The answer depends, of course, on the viability of the 'thick/thin' distinction, as well as the degree to which education is an epistemic concept at all. I will concentrate mainly on the latter, and will argue that epistemological matters are central to education and our philosophical thinking about it; and that, insofar, education is indeed rightly thought of as an epistemic concept. In laying out education's epistemological dimensions, I hope to clarify the degree to (...) which it makes sense to regard the concept as 'thick'. I also discuss the relationship between philosophy of education and virtue epistemology and the sense in which being educated might itself be thought to be an epistemic virtue. Finally, I urge virtue epistemologists in particular and epistemologists generally to turn their attention to questions of education, to further both the philosophy of education and epistemology itself. In this paper I argue that it's possible that the contents of some visual experiences are influenced by the subject's prior beliefs, hopes, suspicions, desires, fears or other mental states, and that this possibility places constraints on the theory of perceptual justification that 'dogmatism' or 'phenomenal conservativism' cannot respect.

Philosophical/epistemic theories of rationality differ over the role of judgment in rational argumentation. According to the “classical model” of rationality, rational justification is a matter of conformity with explicit rules or principles. Critics of the classical model, such as Harold Brown and Trudy Govier, argue that the model is subject to insuperable difficulties. They propose, instead, that rationality be understood, ultimately, in terms of judgment rather than rules. In this article I respond to Brown's and Govier's criticisms of the classical (...) model, and to the “judgment model” they propose in its place. I argue that that model is unable both to distinguish between rational and irrational judgment and to avoid recourse to rules, and is therefore inadequate as an account of rationality, critical thinking, or argument appraisal. More positively, I argue that an adequate account of rationality must include a place for both rules and judgment. (shrink)

Es ist daher kein Zufall, dass ›Ordnung‹ zum Schlüsselbegriff des humanistischen Enzyklopädismus aufgestiegen und zum Gegenstand hartnäckiger Auseinandersetzungen unter den Gelehrten geworden ist. Das Tafelwerk steht daher im Mittelpunkt der Untersuchungen zu den Figuren enzyklopädischer Wissensordnungen. Jahrhunderts äußerst repräsentative Werk hier vollständig und in einer farbigen Reproduktion wieder zum Druck gebracht. Die komplexen Strategien, mit Hilfe von Bildern, Diagrammen und Texten für eine bestimmte Wissensordnung zu argumentieren, lassen sich auf diese Weise an einer bedeutenden Quelle der vormodernen Gelehrtengeschichte minutiös nachvollziehen. Educating Reason: Critical Thinking, Informal logic, and the Philosophy of Education.

Gerald Doppelt's recent ?Kuhn's Epistemological Relativism: An Interpretation and Defense? (Inquiry, Vol. 21 [1978], pp. 33?86) offers a reconstruction of Thomas Kuhn's views concerning theory choice in science in which Kuhn's ?incommensurability thesis?, and his epistemological relativism, are defended. It is argued that Doppelt's reconstruction fails to provide an adequate defense, and that both Kuhn's incommensurability thesis, and his epistemological relativism, as reconstructed by Doppelt, remain philosophically unacceptable.

In his (1988), Brian Baigrie criticizes my earlier discussion of the rationality of science (Siegel 1985). In this response, I argue that (1) Baigrie misses the point of my tripartite distinction between different questions one can ask about science's rationality, (2) Baigrie's argument that the history of the development of methodological principles is crucial to philosophical discussion of the rationality of science is flawed, and (3) Baigrie's charge that my view is "anemic" rests on a failure to appreciate the (...) point of my tripartite distinction. For over two decades, something akin to a scientific revolution in philosophy of science has been taking place. So, at any rate, claims Harold I. Brown, in his book Perception, Theory and Commitment: The New Philosophy of Science, in which he chronicles and defends the demise of logical empiricism and offers a new philosophy of science in its stead. The new philosophy of science, drawing on the work of Kuhn, Toulmin, Hanson, Lakatos, Polanyi, and others, but effectively structured, enhanced, and (...) defended by Brown, replaces logical empiricism's fundamental presuppositions of Principia logic and observation-based empiricism with a new approach which emphasizes the theory-ladenness of perception, the unavoidability of paradigmatic presuppositions, conceptual change and scientific revolutions, dialectic (as opposed to algorithmic) reasoning as the model of rational thinking in science, and a sharp rejection of the discovery/justification distinction. Brown develops a new epistemology of science to complement and underlie the new philosophy of science, including alternative conceptions of rationality, scientific knowledge, truth, objectivity, and relativism. Later in this essay I will attempt to recount, and bring to light some flaws in, both the new philosophy and the new epistemology of science Brown defends. First, however, it will be helpful to follow Brown's account of the nature and failings of the logical empiricist research program. (shrink)

An overview of the epistemology of perception, covering the nature of justification, immediate justification, the relationship between the metaphysics of perceptual experience and its rational role, the rational role of attention, and cognitive penetrability. In this paper I offer a theory of what makes certain influences on visual experiences by prior mental states (including desires, beliefs, moods, and fears) reduce the justificatory force of those experiences. The main idea is that experiences, like beliefs, can have rationally assessable etiologies, and when those etiologies are irrational, the experiences are epistemically downgraded.

In Biro and Siegel we argued that a theory of argumentation mustfully engage the normativity of judgments about arguments, and we developedsuch a theory. In this paper we further develop and defend our theory.

In this volume, a well-known psychoanalyst, dance therapist, and educational consultant chronicles her clinical work with deeply troubled children who fall between the cracks of our diagnostic and educational systems. These children, who frequently turn out to have been sexually or punitively abused, have no real emotional home despite the fact that they live in materially comfortable circumstances. In spite of their apparent brightness and precocity, they do not thrive in the classroom, where their disruptive behavior, tendency to act out, (...) and fragmented learning bring them to the attention of teachers, counselors, and school psychologists. Standard diagnoses do not explain their plight; such children are neither retarded nor learning disabled nor neurotic. Through poignant case studies, Siegel reviews the developmental circumstances that bring these middle-class waifs to a critical impasse with both their parents and the educational establishment. Time and again she discovers that the children's expectable developmental course has been derailed by their accommodation to parental abuse and deformed parental expectations. Psychodynamic treatment invariably uncovers the maladaptive solutions that fueled the children's behavioral and learning disturbances. This volume speaks to a broad clinical and non-clinical readership: psychoanalytic clinicians; psychologists; counselors; social workers; art, dance, and music therapists; special education teachers; child therapists; and child care workers. They will all join in admiration of Siegel's treatment approach which focuses on what is healthy in deeply traumatized children and, in so doing, helps debunk the myth of the untreatable child. This essay focuses on the repeated rhetorical moves through which the third wave autobiographical subject seeks to be real and to speak as part of a collective voice from the next feminist generation. Given that postmodernist, postructuralist, and multiculturalist critiques have shaped the form and the content of third wave expressions of the personal, the study is ultimately concerned with the possibilities and limitations of such theoretical analysis for a third wave of feminist praxis.

Evolutionary psychology is a science in the making, working toward the goal of showing how psychological adaptation underlies much human behavior. The knee-jerk reaction that sociobiology is unscientific because it tells just-so stories has become a common charge against evolutionary psychology as well. My main positive thesis is that inference to the best explanation is a proper method for evolutionary analyses, and it supplies a new perspective on the issues raised in Schlinger's (1996) just-so story critique. My main negative thesis (...) is that, like many nonevolutionist critics, Schlinger's objections arise from misunderstandings of the evolutionary approach.Evolutionary psychology has progressed beyond telling just-so stories. It has found a host of ingenious special techniques to test hypotheses about the adaptive significance and proximate mechanisms of behavior. Naturalistic data using the comparative method combined with controlled tests using statistical analyses of data provide good evidence for a variety of hypotheses about behavioral control mechanisms — whether in nonhumans or in humans. For instance, the work of Gangestad and Thornhill on evolved mate preferences and fluctuating asymmetry of body type (FA) is a model of success. As the quantity and quality of evidence increase, we are entitled not just to regard such evolutionary hypotheses as preferable, but also as true. Such studies combine to show that the best explanation of the psychic unity of humankind — common patterns across societies, history, and cultures exposed by evolutionists — is the gendered, adapted, evolved species-typical design of the mind. In this paper, I argue that certain perceptual relations are represented in visual experience.

Decision making capacity (DMC) is a fundamental concept grounding the principle of respect for autonomy and the practice of obtaining informed consent. DMC must be determined and documented every time a patient undergoes a hospital procedure and for routine care when there is reason to believe decision making ability is compromised. In this paper we explore a path toward ethically informed development and implementation of a hospital policy related to DMC assessment. We begin with a review of the context of (...) DMC assessment before discussing some considerations relevant to policy creation by healthcare ethics committees. The discussion concludes in a presentation of a typology of capacity assessment policies, which draws upon a sampling of currently used hospital policies to illustrate relevant ethical considerations.
