    Property rights: a re-examination: by J. E. Penner, Oxford, Oxford University Press, 2020, 233 pp., £80.00, ISBN: 9780198830122.Ira K. Lindsay - 2021 - Jurisprudence 12 (3):439-446.
James Penner has probably done more than anyone else in legal philosophy to set the terms of debate in property theory for the past two decades. His 1997 book, The Idea of Property in Law initiated...

Voluntary Obligations and the Scope of the Law of Contract.J. E. Penner - 1996 - Legal Theory 2 (4):325-357.
By building upon Raz's analysis of the spectrum of voluntary obligations, the author produces a typology of agreements, and then assesses the extent to which these different kinds of agreements underpin the common law of contract. While recognizing that the law of contract purports to deal with a broad range of voluntarily undertaken obligations, the typology of agreements suggests that the present law is primarily suited to dealing only with bargains. This suggests that there are situations in which agreements should (...)

Property, Community, and the Problem of Distributive Justice.J. E. Penner - 2009 - Theoretical Inquiries in Law 10 (1):193-216.
While it is often taken for granted that the concepts of property and of distributive justice are capable of working together to generate norms which can enhance positive social and political relations, in particular the value of community, this Article argues otherwise. Relying on critical tools deriving from Hegel’s Philosophy of Right and Marx’s notion of fetishism, the author claims that the Rawlsian conception of distributive justice fetishizes the institution of property, and claims to "distribute" participation in society amongst its (...)

Theodicy and the Free Will Defence: Response to Plantinga and Flew: J. E. BARNHART.J. E. Barnhart - 1977 - Religious Studies 13 (4):439-453.
Although Professor of Philosophy at Calvin College, Alvin Plantinga has developed a theodicy that is fundamentally Arminian rather than Calvinistic. Anthony Flew, although the son of an Arminian Christian minister, regards the Arminian view of ‘free will’ to be both unacceptable on its own terms and incompatible with classical Christian theism. In this paper I hope to disentangle some of the involved controversy regarding theodicy which has developed between Plantinga and Flew, and between Flew and myself. The major portion of (...)

Limits to Action, the Allocation of Individual Behavior.J. E. R. Staddon (ed.) - 1980 - Academic Press.
Limits to Action: The Allocation of Individual Behavior presents the ideas and methods in the study of how individual organisms allocate their limited time and energy and the consequences of such allocation. The book is a survey of individual resource allocation, emphasizing the relationships of the concepts of utility, reinforcement, and Darwinian fitness. The chapters are arranged beginning with plants and general evolutionary considerations, through animal behavior in nature and laboratory, and ending with human behavior in suburb and institution. Topics (...)

    The Epistemology of G. E. Moore. [REVIEW]J. E. J. - 1970 - Review of Metaphysics 23 (3):558-558.
This book evaluates Moore's contribution to the discussion of a number of epistemological problems, and arrives at the conclusion that Moore's contribution is not considerable. The author maintains that Moore was able to succeed philosophically in the refutation of Idealism, in the establishment of analytical techniques, and in his recognition of the role of common sense; but in those technical areas which were most interesting to Moore, the author finds little accomplishment, and even some confusion. For example, in considering the (...)

The Metaphysics of Quantities.J. E. Wolff - 2020 - Oxford: Oxford University Press.
What are physical quantities, and in particular, what makes them quantitative? This book presents an original answer to this question through the novel position of substantival structuralism, arguing that quantitativeness is an irreducible feature of attributes, and quantitative attributes are best understood as substantival structured spaces.

    Asymmetrical Analogical Arguments.J. E. Adler - 2007 - Argumentation 21 (1):83-92.
Analogies must be symmetric. If a is like b, then b is like a. So if a has property R, and if R is within the scope of the analogy, then b (probably) has R. However, analogical arguments generally single out, or depend upon, only one of a or b to serve as the basis for the inference. In this respect, analogical arguments are directed by an asymmetry. I defend the importance of this neglected – even when explicitly mentioned – (...)
