  1. Voluntary Obligations and the Scope of the Law of Contract.J. E. Penner - 1996 - Legal Theory 2 (4):325-357.
By building upon Raz's analysis of the spectrum of voluntary obligations, the author produces a typology of agreements, and then assesses the extent to which these different kinds of agreements underpin the common law of contract. While recognizing that the law of contract purports to deal with a broad range of voluntarily undertaken obligations, the typology of agreements suggests that the present law is primarily suited to dealing only with bargains. This suggests that there are situations in which agreements should (...)

Property, Community, and the Problem of Distributive Justice.J. E. Penner - 2009 - Theoretical Inquiries in Law 10 (1):193-216.
While it is often taken for granted that the concepts of property and of distributive justice are capable of working together to generate norms which can enhance positive social and political relations, in particular the value of community, this Article argues otherwise. Relying on critical tools deriving from Hegel’s Philosophy of Right and Marx’s notion of fetishism, the author claims that the Rawlsian conception of distributive justice fetishizes the institution of property, and claims to "distribute" participation in society amongst its (...)

    Hispanic Philosophy: Its Beginning and Golden Age.Jorge J. E. Gracia - 1993 - Review of Metaphysics 46 (3):475 - 502.
HISPANIC PHILOSOPHY. The notion of Hispanic philosophy is a useful one for trying to understand certain historical phenomena related to the philosophy developed in the Iberian peninsula, the Iberian colonies in the New World, and the countries that those colonies eventually came to form. It is useful for two reasons. First, it focuses attention on the close relations among the philosophers in these geographical areas; and second, other historical denominations and categorizations do not do justice to such relations. This becomes (...)

Hume and Nietzsche.Peter J. E. Kail - 2016 - In Paul Russell (ed.), The Oxford Handbook of David Hume. Oxford: Oxford University Press.
In his contribution, the author discusses the deep and surprising similarities between the philosophies of David Hume and Friedrich Nietzsche. The author argues that these stem from their shared conception of naturalism. Their naturalism is primarily an explanatory one and primarily aimed at explaining human thought and practice. In Nietzsche, this form of naturalism is expressed in his adoption of a genealogical approach to various topics, most famously that of morality. The author shows that Hume’s naturalism is similarly genealogical. The (...)

I am extremely grateful to all my commentators for their very careful engagement with my book.1 Some disagreements, I think, may stem from my failure to be sufficiently clear and so are only apparent. Other objections are not and seem to be spot on. I will not be able to give fully adequate answers to all the objections, since some require sustained discussion of some very fundamental issues that is simply impossible in this forum.Schliesser's comments concern my discussion of philosophical (...)

The primary function of a book review is to articulate and present an understanding of the book's thesis and argument, and to make a judgment as to its value, so that readers will themselves understand and be guided by the understanding and judgment of the reviewer. Reviews are supposed to be interpretations created for the sake of a potential audience for a book. Unfortunately, most reviews fail to fulfill this function insofar as they merely paraphrase the text they are supposed (...)

Life Stories and Cross-Cultural Marriages: A Discussion of Betty de Hart, `Not Without My Daughter: On Parental Abduction, Orientalism and Maternal Melodrama'.Ellettha J. E. Schoustra-van Beukering - 2002 - European Journal of Women's Studies 9 (1):69-78.
In the footsteps of Betty Mahmoody's book Not Without My Daughter, a raft of other western women wrote books about their mixed marriages with men from other continents. The men are mainly orientals. All these women have seen their marriages fail. Although most of them admit they made a wrong choice, they do not necessarily portray their former husbands as unreliable characters and themselves as heroines. The life stories cannot be read from such a narrow perspective. These authors should take (...)

Although much of the literature in this field focuses on employee rights, this volume considers the issue from the perspective of both employees and employers. Considers the rights of both employees and employers. Discusses the moral and legal landscape and traditional assumptions about right in employment. Investigates arguments for guaranteeing rights, particularly for employees, which are derived from relational, developmental, and economic bases. Explores new dimensions of employment including (...)
