Laura Odwazny and Benjamin Berkman have raised several challenges regarding the new reasonable person standard in the revised Common Rule, which states that in‐ formed consent requires potential research subjects be provided with information a reasonable person would want to know to make an informed decision on whether to participate in a study. Our aim is to offer a response to the challenges Odwazny and Berkman raise, which include the need for a reasonable person standard that can be applied consistently (...) across institutional review boards and that does not stigmatize marginal groups. In response, we argue that the standard ought to be based in an ordinary rather than ideal person conception of reasonable person and that the standard ought to employ what we call a liberal constraint: the reasonability standard must be malleable enough such that a wide variety of individuals with different, unique value systems would endorse it. We conclude by suggesting some of the likely consequences our view would have, if adopted. (shrink)

Intentionality is the power of minds to be about, to represent, or to stand for, things, properties and states of affairs. The puzzles of intentionality lie at the interface between the philosophy of mind and the philosophy of language. This article argues that we can improve the way we teach early modern political philosophy if we introduce students to alternative views about the development of the state. First, it summarizes the work of contemporary philosophers and historians who are critical of the modern state. Second, it points out ways in which early social contract theorists take the state for granted. Third, it argues that alternative views about the development of the state can help students take a more critical perspective (...) on standard works of early modern political philosophy. This article discusses recent legal conflicts between state universities and conservative religious students in the United States, focusing on Christian Legal Society v. Martinez. In recent years, several universities have denied recognition to religious student organizations that discriminate on the basis of religion or sexual orientation. I argue that scholars on both sides of the issue have failed to recognize the full scope of the privilege that the universities demand. If the courts accept the universities' demands, then the courts dangerously (...) expand the government's authority to suppress dissenters. No proponent of civil liberties should welcome this change. What are the prospects for meaningful reform of U.S. health care? To answer this question requires understanding why previous reform efforts failed—the combination of deep structural biases against large-scale public provision and the inherited constraints posed by the rise of employment-based insurance. Generally, the context is more favorable today than it was fifteen years ago. But the prospects for change hinge on learning the right lesson of history: Politics comes first. Putting politics first means avoiding the overarching mistake of the (...) Clinton reformers: envisioning a grand policy compromise rather than hammering out a real political compromise. It also means addressing the inevitable fears of those who believe they are well protected by our eroding employment-based framework. And it means premising political strategies on the contemporary realities of hyperpolarized politics, rather than wistfully recalled images of the bipartisan politics of old. (shrink)

I argue that the internal evidence of the Republic supports a conjecture first advanced by the historian Mark Munn: Glaucon was an accomplice of the so-called Thirty Tyrants who most likely died at the side of his relatives Critias and Charmides in the Battle of Munychia. If Munn is right, the Republic must be read as a poignant philosophical drama, the tragedy of Socrates’ unsuccessful struggle to save Plato’s brother from the corrupting influence of his family and his city. Alva Noë’s version of the enactive conception in _Action in Perception_ is an important contribution to the study of visual perception. First, I argue, however, that it is unclear (at best) whether, as the enactivists claim, work on change blindness supports the denial of the existence of detailed visual representations. Second, I elaborate on what Noë calls the ‘puzzle of perceptual presence’. Thirdly, I question the enactivist account of perceptual constancy. Finally, I draw attention to the tensions between enactivism and (...) two trends in cognitive neuroscience: the two-visual systems model of human vision and the theory of internal forward models of action. ZusammenfassungDer Begriff „Ethik“ wurde vor kurzem sowohl in die zahnmedizinische Musterberufsordnung 2014 als auch in den aktuellen „Nationalen Kompetenzbasierten Lernzielkatalog Zahnmedizin“ aufgenommen. Die hier vorgelegte Studie widmet sich der Frage, welche Bedeutung dies für die zahnmedizinische Profession und die Gesellschaft hat. Zu diesem Zweck werden die gesellschaftlichen Prozesse erörtert, die durch den autonom handhabbaren Handlungsspielraum der zahnmedizinischen Profession bedingt sind. Die sozialwissenschaftlichen Diskursfelder Profession, Vertrauen, Bildung, Expertise, Handlungspraxis und Sanktion werden hierzu in ihrer Anschlussfähigkeit zueinander und als struktureller Bedeutungsrahmen professionsethisch (...) reflektierten Handelns aufgearbeitet. Basis des professionellen Handlungsspielraums ist ein gesellschaftlicher Vertrauensvorschuss, der dem professionell Handelnden seitens der Gesellschaft und seitens des einzelnen Patienten entgegengebracht wird. Die Studie kommt zu dem Ergebnis, dass das jahrzehntelange Fehlen einer institutionell etablierten Vermittlung der ethischen Grundlagen des zahnmedizinischen Handelns ein schweres Versäumnis darstellt, da junge Zahnärzte nicht angeleitet werden, ihre fachliche Expertise in Bezug auf die zu lösenden Problemstellungen permanent zu reflektieren. Dieses Defizit ist nunmehr benannt worden. Eine institutionell getragene Struktur zur Bearbeitung ethischer Fragen im Rahmen der Zahnheilkunde ist hiernach zu fordern und sollte nunmehr dringend implementiert und umgesetzt werden. (shrink)

La conception fodorienne de la psychologie scientifique soulève les trois problèmes suivants qui peuvent, je crois, être résolus. La condition de formalité est-elle compatible avec l'existence de lois psychologiques intentionnelles ? L'atomisme sémantique est-il compatible avec le fonctionnalisme? L'atomisme sémantique est-il compatible avec la systématicité des pensées humaines? Dans les trois premières sections du présent article, j'essaie de résorber ces tensions. Dans la quatrième et dernière section, j'examine la conception des attributions de croyance développée par Fodor dans « Substitution Arguments (...) and the Individuation of Beliefs » selon laquelle la relation de croyance est une relation à quatre places entre une personne, un symbole , un rôle fonctionnel et un contenu propositionnel. Je fais valoir que Fodor est confronté à un dilemme : soit le rôle fonctionnel est un déterminant du contenu propositionnel, et Fodor doit rejeter l'atomisme sémantique; soit le rôle fonctionnel est un déterminant de l'efficacité causale d'un symbole, et il doit amender la condition de formalité.Fodor's views about scientific psychology raise three puzzles : Is the Formality Condition compatible with there being intentional psychological laws ? Is Content Atomism consistent with Fonctionalism? Can Content Atomism be reconciled with the claim that human thoughts are systematic? In the first three sections of this paper, I try and show how to solve the three puzzles. Finally, in the fourth section, I examine Fodor's recent view of belief-ascriptions in "Substitution Arguments and the Individuation of Beliefs" according to which the belief relation is a four place relation between a believer, a symbol token , a functional role and a propositional content. I argue that Fodor faces a dilemma : either the functional role is a determinant of content, in which case Fodor must reject Content Atomism; or it is a determinant of the causal efficacy of the vehicle, in which case he must amend his Formality Condition. Résumé Jules Vuillemin était un philosophe érudit et savant ; il entretenait avec la philosophie analytique de son temps une relation étroite, mais rendue énigmatique par sa fidélité au principe de l’inséparabilité entre la philosophie et l’histoire de la philosophie hérité de l’historien de la philosophie, Martial Gueroult. La question principale que je me pose ici est de savoir quelle était l’attitude exacte de Vuillemin à l’égard de la triple controverse entre Quine et Carnap provoquée par les critiques dirigées par (...) Quine contre la tripartition de Carnap entre les propositions analytiques (de la logique et des mathématiques), les propositions synthétiques (des sciences expérimentales) et les choix ontologiques purement pragmatiques. Tout en souscrivant à la tripartition carnapienne, Vuillemin réprouvait l’idée positiviste de l’irrésolubilité des controverses ontologiques et défendait, au nom de la liberté de la raison spéculative, l’idée de la pluralité des solutions. What makes one individual’s experience vicarious is that it is both similar to, and caused by, another’s psychological state. Vicarious responses are mediated by the observation of another’s goal-directed or expressive action. While the evidence from cognitive neuroscience suggests the ubiquity of vicarious responses to others’ goals, intentions, sensations and emotions, the question is: is the general function of vicarious responses to understand another’s mind?
