The United Nations Convention on the Rights of Persons with Disabilities, adopted on December 13, 2006, and entered into force on May 3, 2008, constitutes a key landmark in the emerging field of global health law and a critical milestone in the development of international law on the rights of persons with disabilities. At the time of its adoption, the U.N. High Commissioner for Human Rights heralded the CRPD as a rejection of the understanding of persons with disabilities “as objects (...) of charity, medical treatment and social protection” and an embrace of disabled people as “subjects of rights.”The text of the Convention itself, and the highly participatory process by which it was negotiated, signal a definitive break from previous international approaches that focused on disability within a medical model framework. In contrast to traditional approaches, the CRPD embraces a social model of disability, concentrating the disability experience not in individual deficiency, but in the socially constructed environment and the barriers that impede the participation of persons with disabilities in society. This article reviews the contributions of the UN Convention on the Rights of Persons with Disabilities to the progressive development of both international human rights law and global health law and governance. It provides a summary of the global situation of persons with disabilities and outlines the progressive development of international disability standards, noting the salience of the shift from a medical model of disability to a rights-based social model reflected in the CRPD. Thereafter, the article considers the Convention's structure (...) and substantive content, and then analyzes in specific detail the particular contributions of the Convention to health and human rights law and global health governance. It concludes with an exploration of the potential implications of the CRPD's innovations for some of the most pressing issues in global health governance, including the Convention's contributions to the principle of participation in decision-making. The close friendship between Charlotte Bronte and Mary Taylor began in boarding school and lasted for the rest of their lives. It was Mary Taylor, in fact, who inspired Bronte to leave her oppressive parsonage home and go to Brussels, the eventual setting for her novel, Villette. Mary herself led a much less restricted life, especially in her later years as a feminist essayist who strongly urged women to consider their "first duty" to be working to support themselves. (...) In Miss Miles, her only novel, Taylor breaks with tradition by creating a profoundly feminist and morally intense work which depicts women's friendships as sustaining life and sanity through all of the vicissitudes of Victorian womanhood. She also introduces an innovative narrative form which Janet Murray (who has written an introduction for this edition) calls a "feminist bildungsroman": the story of the education of several heroines which emphasizes their friendship and economic and mental well-being rather than their love lives. Set in the small Yorkshire village of Repton against the backdrop of starvation in the wool districts and the rise of Chartism in the 1830s, this recovered feminist classic chronicles the lives of four disparate and individually ambitious women as they learn to find their own voices and support one another. The novel's emphasis on the healing power of women's friendships echoes the relationship between Bronte and Taylor herself. Originally published in 1890, Miss Miles has been unavailable for decades. This paper approaches the question of awareness outside of attention through a broader psychological examination of human consciousness. Questions regarding the boundaries of conscious awareness, as well as the possibility of 'subconscious' or 'unconscious' mental processes, were widely discussed 100 years and more ago when they played a central role in the thinking of turn-of-thecentury theorists such as William James, F.W.H. Myers, Jean-Martin Charcot, and Pierre Janet, all of whom were interested in dissociative phenomena suggestive of consciousness, or awareness, (...) beyond the margins of attention. Such phenomena included hypnosis, hysteria, trance states, and motor automatisms, and for many scholars also sleep related conditions such as dreaming and hypnogogic states. (shrink)
This is an excellent article, probably the best there is in defence of prohibiting the sale of organs, and it deserves a much fuller discussion of detail than there is space for here.1 My concerns, however, are with generalities rather than detail. Although some such argument might justify prohibition of organ selling in particular places and at particular times, it is difficult to see how it could support the kind of general, universal policy currently accepted by most advocates of prohibition.Whenever (...) the subject of organ selling is discussed, it is useful to keep in mind the natural history of the debate. Prohibition was instituted by most governments and professional bodies just about as quickly as possible after it was discovered that payment for kidneys was going on, and was a direct response to feelings of moral outrage. It all happened without time for debate. It was only later, as challenges appeared, that justifications began to be produced; and when they did they followed a pattern long familiar to philosophers, and more recently recognised by moral psychologists, of determined efforts to find a justification for the initial intuition that organ selling must be wrong. New arguments kept appearing in the cause as earlier attempts were shown to fail, and many were so weak that they could not have seemed plausible unless their advocates had already been committed to their conclusion. This instructional case explores ethical and leadership issues within the context of public accounting. The case examines one senior manager in a public accounting firm who failed to receive an anticipated promotion to partner and the resulting discussions and actions that follow. The primary objectives of the case are to increase students’ awareness of select ethical issues commonly faced by auditors as they attempt to serve the public trust, their clients, and their firms, and to consider their own value system (...) in relation to the issues identified in this case. The secondary learning objectives are to increase students’ knowledge of the AICPA Code of Professional Conduct / IESBA Code of Ethics, encourage consideration of the impact of ethical and unethical behaviors by auditors on others within the profession, and illustrate how leadership within an organization influences the behaviors of others. This interview with Charles Taylor explores a central concern throughout his work, namely, his concern to ‘reenchant’ self and world through a careful examination of value as emanating from the world rather than from ourselves. It focuses especially on the status of his central doctrine of ‘strong evaluation’ against the background of mainstream meta-ethical theories, such as neo-Kantian constructivism and robust realist non-naturalism. Additionally, the relationship between Taylor’s theism and his moral–political philosophy is discussed. A key issue that (...) is examined is what ontological background picture can make sense of the strong evaluative experience of higher worth. We thank the commentators for their thoughtful engagement with our paper.1 In different ways, they make the same substantial point: our suggested interventions are not enough to solve the problems of organisational failure. On this we wholeheartedly agree. Organisational failure in healthcare is complex and multifaceted, it cannot be solved by one intervention in medical education. We did not intend to imply that our proposals alone would solve organisational failure, and this positioning misconstrues the aims of our paper. We had (...) more modest ambitions, we wanted to shift the analytical emphasis away from the individual and explore the implications raised by our analysis for our piece of the jigsaw—medical education. Having stepped away from such grand claims, the commentators make some valid points to which we would like to respond more specifically. Jesudason makes the distinction that normalisation of deviance (NoD) is well suited to understand institutional misfeasance but not malfeasance.2 We are inclined to agree; NoD can do some things but not all. Janet is known almost exclusively for his left-step periodic table (LSPT). A study of his writings shows him to have been a highly creative thinker and a brilliant draftsman. His approach was primarily arithmetic-geometric, but it led him to anticipate the discovery of deuterium, helium-3, transuranian elements, antimatter and energy from nuclear fusion. He recognized the (n + ℓ) rule well before Madelung and correctly placed the actinides. 'Most of us are still groping for answers about what makes life worth living, or what confers meaning on individual lives', writes Charles Taylor in Sources of the Self. 'This is an essentially modern predicament.' Charles Taylor's latest book sets out to define the modern identity by tracing its genesis, analysing the writings of such thinkers as Augustine, Descartes, Montaigne, Luther, and many others. This then serves as a starting point for a renewed understanding of modernity. Taylor (...) argues that modern subjectivity has its roots in ideas of human good, and is in fact the result of our long efforts to define and attain the good. The modern turn inwards is far from being a disastrous rejection of rationality, as its critics contend, but has at its heart what Taylor calls the affirmation of ordinary life. He concludes that the modern identity, and its attendant rejection of an objective order of reason, is far richer in moral sources that its detractors allow.
