Biobanking can promote valuable health research that may lead to significant societal benefits. However, collecting, storing and sharing human samples and data for research purposes present numerous ethical challenges. These challenges are exacerbated when the biobanking efforts aim to facilitate research on public health emergencies and include the sharing of samples and data between low/middle-income countries (LMICs) and high-income countries (HICs). In this article, we explore ethical challenges for COVID-19 biobanking, offering examples from two past infectious disease outbreaks in LMICs (...) where biobanking activities contributed to the perpetuation of global inequities. We focus on how the ethical imperative to promote the common good during public health emergencies can conflict with protecting the interests of biobank participants. We discuss how conducting biobank research under a waiver of informed consent during public health emergencies is ethically permissible, provided guidance is in place to prevent biopiracy and exploitation of vulnerable communities. We also highlight the need for biobank collaborations between LMICs and HICs to promote capacity building and benefit sharing. Finally, we offer guidance to promote the ethical oversight of biobanks and biobank research during the COVID-19 pandemic or other future public health emergencies. (shrink)

This paper analyses the activities of five organizations shaping the debate over the global governance of genome editing in order to assess current approaches to public engagement (PE). We compare the recommendations of each group with its own practices. All recommend broad engagement with the general public, but their practices vary from expert-driven models dominated by scientists, experts, and civil society groups to citizen deliberation-driven models that feature bidirectional consultation with local citizens, as well as hybrid models that combine elements (...) of both approaches. Only one group practices PE that seeks community perspectives to advance equity. In most cases, PE does little more than record already well-known views held by the most vocal groups, and thus is unlikely to produce more just or equitable processes or policy outcomes. Our exploration of the strengths, weaknesses, and possibilities of current forms of PE suggests a need to rethink both “public” and “engagement.”. (shrink)

Though antiretroviral therapy is the standard of care for people living with HIV, its treatment limitations, burdens, stigma and costs lead to continued interest in HIV cure research. Early-phase cure trials, particularly those that include analytic treatment interruption, involve uncertain and potentially high risk, with minimal chance of clinical benefit. Some question whether such trials should be offered, given the risk/benefit imbalance, and whether those who choose to participate are acting rationally. We address these questions through a longitudinal decision-making study (...) nested in a Thai acute HIV research cohort. In-depth interviews revealed central themes about decisions to join. Participants felt they possessed an important identity as members of the acute cohort, viewing their bodies as uniquely suited to both testing and potentially benefiting from HIV cure approaches. While acknowledging risks of ATI, most perceived they were given an opportunity to interrupt treatment, to test their own bodies and increase normalcy in a safe, highly monitored circumstance. They were motivated by potential benefits to themselves, the investigators and larger acute cohort, and others with HIV. They believed their own trial experiences and being able to give back to the community were sufficient to offset participation risks. These decisions were driven by the specific circumstances experienced by our participants. Judging risk/benefit ratios without appreciating these lived experiences can lead to false determinations of irrational decision- making. While this does not minimise vital oversight considerations about risk reduction and protection from harm, it argues for inclusion of a more participant-centered approach. (shrink)

Today’s medical training environment exposes medical trainees to many aspects of what has been called “the hidden curriculum.” In this article, we examine the relationship between two aspects of the hidden curriculum, the performance of emotional labor and the characterization of patients and proxies as “bad,” by analyzing clinical ethics discussions with resident trainees at an academic medical center. We argue that clinicians’ characterization of certain patients and proxies as “bad,” when they are not, can take an unnecessary toll on (...) trainees’ emotions. We conclude with a discussion of how training in ethics may help uncover and examine these aspects of the hidden curriculum. (shrink)

Some recent genomic research studies — enrolling patients as participants — boldly (...) address the question with protocols dictating that researchers place research results directly into study participants’ existing medical records, without participant consent. Such privileging of researcher judgment over participant choice may be motivated by a desire to discharge a duty that researchers perceive themselves as owing to participants. The current ethical norms of genomic biobanking creating and maintaining large repositories of human DNA and/or associated data for biomedical research have generated criticism from every angle, at both the practical and theoretical levels. The traditional research model has involved investigators seeking biospecimens for specific purposes that they can describe and disclose to prospective subjects, from whom they can then seek informed consent. In the case of many biobanks, however, the institution that collects and maintains the biospecimens may not itself (...) be directly involved in research, instead banking the biospecimens and associated data for other researchers. Moreover, the future uses of biospecimens may be unknown, if not unknowable, at the time of collection. Biobanking may thus stretch the meanings of inform and consent to their breaking point: if you cannot inform subjects about what their biospecimens will be used for, what can they consent to? Given that informed consent by individual subjects is the ethical gold standard, the seeming dilution of the concept in the context of biobanking is a profound problem. (shrink)

Background: A growing literature has raised—skeptically—the question of whether cutting-edge scientific research can identify and address broader ethical and policy considerations in real time. In genomics, the question is: Can ELSI contribute to genomics in real time, or will it be relegated to its historical role of after-the-fact outsider critique? We address this question against the background of a genomic screening project where we participated as embedded, real-time ELSI researchers and observers, from its initial design through its conclusion.Methods: As part (...) of the ELSI study design, the project included an ongoing reflexive ethnography in which the authors studied the process of its design and implementation. The authors were true participant observers, serving as members of various task-oriented groups while recording meetings and other events for ongoing qualitative analysis. We also conducted and analyzed interviews of multiple participants at the conclusion of the project.Results: Our real-time ELSI initiative had a mixed record of successes and challenges. If we define success as ELSI researchers having had an opportunity to participate fully in the project and to make the ELSI perspective heard, then our assessment is largely positive. If, however, we define successes as instances where real-time ELSI contributions changed the direction of the genomic or public health aspects of the GeneScreen project or, after careful deliberation, confirmed the appropriateness of the status quo, then we can identify only a few examples. While we had a seat at the table, we were, for the most part, tolerated guests.Conclusions: We conclude that there are significant barriers to real-time ELSI influence. The difficulty does not reside in any intended exclusion of an ELSI perspective, but in factors endemic to genomic research, including knowledge disparities, epistemological biases, and the pressures of time and money. Genomic biobanks present ethical challenges that are qualitatively unique and quantitatively unprecedented. Many critics have questioned whether the current system of informed consent can be meaningfully applied to genomic biobanking. Proposals for reform have come from many directions, but have tended to involve incremental change in current informed consent practice. This paper reports on our efforts to seek new ideas and approaches from those whom informed consent is designed to protect: research subjects. Our model emerged from semi-structured interviews with healthy (...) volunteers who had been recruited to join either of two biobanks , and whom we encouraged to explain their concerns and how they understood the relationship between specimen contributors and biobanks. These subjects spoke about their DNA and the information it contains in ways that were strikingly evocative of the legal concept of the trade secret. They then described the terms and conditions under which they might let others study their DNA, and there was a compelling analogy to the commonplace practice of trade secret licensing. We propose a novel biobanking model based on this trade secret concept, and argue that it would be a practical, legal, and ethical improvement on the status quo. (shrink)

According to a well-known view in the philosophy of mind, intentional attitudes by their very nature satisfy requirements of rationality (e.g. Davidson 1980; Dennett 1987; Millar 2004). This view (which I shall call Constitutivism) features prominently as the ‘principle of minimal rationality’ in de Sousa’s monograph The Rationality of Emotion (1987). By explicating this principle in terms of the notion of the formal object of an attitude, de Sousa articulates an interesting and original version of Constitutivism, which differs in important (...) respects from other extant versions. In this paper, I explore this version of Constitutivism against the background of recent developments in the theory of rationality and make explicit its ramifications for the long-standing dispute over whether the mind is essentially normative. My focus will be on how to conceive of the form of the rationality requirements that attitudes as such must satisfy according to this principle. I argue that, although de Sousa seems officially to endorse a structuralist conception of rationality, according to which these requirements are requirements of coherence, his considerations on formal objects suggest that they are more aptly conceived in terms of a reasons-responsive conception of rationality. I further argue that which of these two readings we choose makes a significant difference to the prospect of vindicating the essential normativity of mind by invoking the principle of minimal rationality. In this wide-ranging historical introduction to philosophical hermeneutics, Jean Grondin discusses the major figures from Philo to Habermas, analyzes conflicts between various interpretive schools, and provides a persuasive critique of Gadamer's view of hermeneutic history, though in other ways Gadamer's Truth and Method serves as a model for Grondin's approach. Grondin begins with brief overviews of the pre-nineteenth-century thinkers Philo, Origen, Augustine, Luther, Flacius, Dannhauer, Chladenius, Meier, Rambach, Ast, and Schlegel. Next he provides more extensive treatments of such major (...) nineteenth-century figures as Schleiermacher, Böckh, Droysen, and Dilthey. There are full chapters devoted to Heidegger and Gadamer as well as shorter discussions of Betti, Habermas, and Derrida. Because he is the first to pay close attention to pre-Romantic figures, Grondin is able to show that the history of hermeneutics cannot be viewed as a gradual, steady progression in the direction of complete universalization. His book makes it clear that even in the early period, hermeneutic thinkers acknowledged a universal aspect in interpretation--that long before Schleiermacher, hermeneutics was philosophical and not merely practical. In revising and correcting the standard account, Grondin's book is not merely introductory but revisionary, suitable for beginners as well as advanced students in the field. (shrink)

It is sometimes alleged that the study of emotion and the study of value are currently pursued as relatively autonomous disciplines. As Kevin Mulligan notes, “the philosophy and psychology of emotions pays little attention to the philosophy of value and the latter pays only a little more attention to the former.” (2010b, 475). Arguably, the last decade has seen more of a rapprochement between these two domains than used to be the norm (cf. e.g. Roeser & Todd 2014). But there (...) still seems to be considerable potential for exchange and dialogue if the situation is compared with their intimate relationship in central strands of early realist phenomenology. The philosopher perhaps most representative of this ecumenical approach is Husserl’s early student Dietrich von Hildebrand (1889-1977). From the very early stages of his philosophical career, Hildebrand has developed one of the most original, comprehensive and nuanced accounts of emotions at whose core is a detailed examination of their connection to value. While his central concern with the ethical significance of our affective life is in many ways continuous with Scheler’s work and draws crucially on Reinach’s philosophy of mind, Hildebrand’s own reflections considerably expand on and substantially modify the picture of the ontology and normative role of emotions defended by these authors. In this article, I reconstruct Hildebrand’s view of emotions with a particular focus on those aspects which represent his most distinctive contribution to this subject. (shrink)

Rechercher et dire la vérité peut-il nous altérer et, avec nous, le monde auquel nous appartenons? Pour répondre à ces questions, Foucault se déplace de l'époque moderne à l'Antiquité et privilégie tour à tour les rapports de pouvoir disséminés dans toute la société, les stratégies politiques qui les organisent et le travail éthique qui permet l'" inservitude " volontaire. Au terme de ce voyage que la mort a interrompu, la volonté de vérité devient le courage de se transformer et de transformer le monde, le principe d'une expérience spirituelle dont la politique est la pierre de touche. Ensuite, la reconnaissance du donné comme instance (...) première et dernière de la phénoménalité peut-elle encore faire droit à l'herméneutique (en discussion avec Hans-Georg Gadamer)? Dans ce cas, comment se déplie le pli de la donation avec la manifestation? Et encore, le monde peut-il se manifester comme l'un des phénomènes donnés, et même comme la totalité du donné? Ou ne faut-il pas lui reconnaître une donation par exception, celle de la possibilité de toute donation (sur la ligne de Jan Patocka)? Contrary to what many interpretations claim, according to Bayle faith does not completely eliminate reason. It intervenes to reveal factual truths that can only be known through revelation (for example, that God allowed Adam and Eve to sin). To these factual truths can be applied a rational principle (an axiomatic and evident one, according to Bayle, which he calls a "common notion"), namely, that "what God does is well done." In Vodou Cosmology and the Haitian Revolution in the Enlightenment Ideals of Kant and Hegel, Vivaldi Jean-Marie begins with an interpretation of the rise of Vodou practices in Saint-Domingue which is sensitive to the social, spiritual and cultural challenges of the slaves communities in Saint-Domingue, later Haiti. He shows effectively that Vodou cosmology emerged as a spiritual, social and cultural technology for the enslaved to overcome the dissonance and brutality of slavery in Saint-Domingue. Vodou Cosmology thus assumes the tripartite (...) role of spiritual, social and cultural compass for slaves who, concurrently with the development of Vodou, managed to establish a common ethos. Furthermore, to situate the rise of Vodou cosmology within the larger discourse of the Enlightenment and argue that it heralded a radical Enlightenment in the African diaspora, Jean-Marie compares and contrasts some aspects of the philosophies of Kant and Hegel with the social, spiritual and cultural experience of the enslaved communities of Saint-Domingue. This comparison shows that Kant and Hegel's depiction of African Negroes' mores and their religious practices in the colonies fails to capture that Vodou cosmology was both a mechanism of resistance and the medium to restore their social, spiritual, and cultural identity against the backdrop of the Atlantic slave trade. Also, he elaborates the Enlightenment's conception of African Negroes as commercial currency and specifically Hegel's view of slavery in the colonies as the manifestation of divine providence. He concludes that the significance of the Haitian Revolution lies in the fact that it ascribed freedom to people of African descent in the diaspora and is thus implicit in later themes of black freedom. The Haitian Revolution ties blackness with freedom and mapped out a radical enlightenment in the European colonies. (shrink)

Selon le philosophe, la personne de Jésus n'est qu'un mythe sans consistance historique et la religion chrétienne se trouve à l'origine des violences et de l'intolérance qui obscurcissent, jusqu'à nos jours, le devenir de l'Occident, à travers son lien étroit au pouvoir politique. Il revient ici à Jean-Marie Salamito de répondre point par point à ces affirmations aussi définitives que contestables : non, (...) le christianisme n'est pas un obscurantisme bon à jeter aux poubelles de l'histoire. L'existence et le message de Jésus sont bel et bien attestés. Saint Paul n'est pas l'inventeur d'une religion obscurantiste qui manie le glaive. Et l'on ne peut réduire la relation Eglise/politique au seul épisode de Constantin. Et si le christianisme décrit par Michel Onfray n'était, au fond, qu'un mythe, une vision réinventée et caricaturée, sans plus de réalité que les personnages fantasques de Lewis Carroll? (shrink)
