This volume presents an extended version of the contributions presented at the workshop "Kant's Concept of Law" held at the 26th World Congress of the International Association for Philosophy of Law and Social Philosophy (IVR) in 2013. It handles issues of applied legal philosophy in Kant's Doctrine of Right such as ownership, the alleged right of necessity, the right of resistance and the right of revolution. With each of these applied issues, the focus lies, on the one hand, on the (...) relationship between the principles a priori of law and of the duties of rights, as well as their normative requirements - for instance, the duty of independence from the coercion by others - and, on the other hand, empirical situations and their pressing demands. Spheres of Global Justice analyzes six of the most important and controversial spheres of global justice, each concerning a specific global social good. These spheres are democratic participation, migrations, cultural minorities, economic justice, social justice, and intergenerational justice. Together they constitute two constellations dealt with, in this collection of essays by leading scholars, in two different volumes: Global Challenges to Liberal Democracy and Fair Distribution. These essays illustrate each of the spheres, delving into their differences, commonalities, collisions and interconnections. Unlike (...) many writings on global justice, Spheres of Global Justice does not content itself with describing the painful and advantageous effects of the globalization process as being inches per secondo facto a global injustice or a just global order. Rather, this multidisciplinary collection of essays, from a pluralist inspiration, combines empirical analysis with theoretical approaches and ethical principles, paying close attention to two aspects of the effects of the globalization process. These aspects are the causal relationships that lead to such effects and the kinds of obligations, or of normative relationships between global rights and correlative duties, that applies to each specific individual case. Seine der deutschen Philosophie von Kant bis Heidegger gewidmete Lehre hat bei seinen Studenten an der Universität Toulouse II - Le Mirail eine sehr lebendige Erinnerung hinterlassen. Dieses Buch ehrt sein Werk, indem es seine (...) außergewöhnliche Art, philosophische Texte zu lesen, und seine Schärfe in der Analyse einiger bevorzugter Lehren hervorhebt und den Geist seiner Methode mit originalen Beiträgen fortführt. The Animal Side is a manifesto on the importance of animals for human thought. It attempts to characterize the importance, for human beings, of the fact that animals exist. Adopting a philosophical and poetic approach, the book seeks to show that animals' ways of inhabiting the earth are, for human consciousness, an expansion and an exploration of what philosophers and poets have tried to name by speaking of the Open. Beginning with the story of an encounter with a deer on (...) a road at night, the book proceeds by showing that, beyond the diversity of animal life and the ways animals differ from human beings, there is a "layer of the perceptible" on which we all draw, humans and animals alike, in our own ways. At present, however, this layer itself is at risk. Thus the book can also be read as a defense and illustration of animals' modes of being, and as a plea for their survival. (shrink)

Little consensus exists about the effectiveness of transnational private governance in domains such as labor, the environment, or human rights. The paper builds on recent scholarship on labor standards to emphasize the role of labor agency in transnational private governance. It argues that the relationship between transnational private regulatory initiatives and labor agency depends on three competences: first, the ability of workers’ organizations to gain access to processes of employment regulation, implementation, and monitoring; second, their ability to insist on the (...) inclusion of employers and state agencies within such processes; and third, the ability of workers to effectively exercise leverage in pursuit of particular goals. The paper develops a framework, called hybrid production regime, for examining how workers’ capacity to act at the local level depends on how these three collective competences are addressed in the institutionalization of capital–labor relations between the transnational and national levels. In contrast to the traditional view of Kant as apure retributivist, the recent interpretations ofKant's theory of punishment (for instance Byrd's)propose a mixed theory of retributivism and generalprevention. Although both elements are literallyright, I try to show the shortcomings of each. I thenargue that Kant's theory of punishment is notconsistent with his own concept of law. Thus I proposeanother justification for punishment: specialdeterrence and rehabilitation. The complexity and the variability of parameters occurring in ecological dynamical systems imply a large number of equations.Different methods, more or less successful, have been described to reduce this number of equations. For instance, in the paper of Auger and Roussarie (1993), the authors describe how to obtain a reduction by considering different time-scales. They consider a system which can be sub-divided into sub-systems such that the strengths of the intra-sub-systems interactions are much larger than those of the inter-sub-systems interactions. (...) It is time to challenge the issue of pleasure associated with the core of medical practice. Its importance is made clear through its opposite: unhappiness—something which affects doctors in a rather worrying way. The paper aims to provide a discussion on pleasure on reliable grounds. Plato’s conception of techne is a convenient model that offers insights into the unique practice of medicine, which embraces in a single purposive action several heterogeneous dimensions. In Aristotle’s Ethics, pleasure appears to play a central (...) role for action’s assessment and intensification. Pleasure is also tightly associated with the Kantian faculty of reflective judgment, which operates at the heart of clinical reasoning. Indeed, practicing medicine means to deal with the particular and the manifold, requiring clinical judgment, but also relying on embodied habitus . With Bourdieu’s notion of habitus , pleasure is the mark of a happy practice, which presupposes a deep involvement in one’s field. Throughout our inquiry, the question of pleasure comes to offer a critical reappraisal of real medical practice and leads to consider ethics more as a component of techne than as a separate realm of concern. This paper uses multilevel modelling and Demographic and Health Survey data from five African countries to investigate the relative contributions of compositional and contextual effects of socioeconomic status and place of residence in perpetuating differences in the prevalence of malnutrition among children in Africa. It finds that community clustering of childhood malnutrition is accounted for by contextual effects over and above likely compositional effects, that urban–rural differentials are mainly explained by the socioeconomic status of communities and households, that childhood malnutrition (...) occurs more frequently among children from poorer households and/or poorer communities and that living in deprived communities has an independent effect in some instances. This study also reveals that socioeconomic inequalities in childhood malnutrition are more pronounced in urban centres than in rural areas. (shrink)

Time is a fundamental dimension of consciousness. Many studies of the “sense of agency” have investigated whether we attribute actions to ourselves based on a conscious experience of intention occurring prior to action, or based on a reconstruction after the action itself has occurred. Here, we ask the same question about a lower level aspect of action experience, namely awareness of the detailed spatial form of a simple movement. Subjects reached for a target, which unpredictably jumped to the side on (...) some trials. Participants expressed their expectancy of a target shift during the upcoming movement, pointed at the target as quickly and accurately as possible before returning to the start posiment to the target shift if required and reproduced the spatial path of the movement they had just made, as accurately as possible, to give an indication of their awareness of the pointing movement. We analysed the spatial disparity between the initial and the reproduced movements on those with a target shift. A negative disparity value, or undershoot, suggests that motor awareness merely reflects a sluggish record of coordinated motor performance, while a positive value, or overshoot, suggests that participants’ intention to point to the shifting target contributes more to their awareness of action than their actual pointing movement. Undershoot and overshoot thus measure the reconstructive and the preconstuctive aspects of action awareness, respectively. We found that trials on which subjects strongly expected a target shift showed greater overshoot and less undershoot than trials with lower expectancy. Conscious expectancy therefore strongly influences the experience of the detailed motor parameters of our actions. Further, a delay inserted either between the expectancy judgement and the pointing movement, or between the pointing movement and the reproduction of the movement, had no effect on visuomotor adjustment but strongly influenced action awareness. Delays during either interval boosted undershoots, suggesting increased reliance on a time-limited sensory memory for action. The experience of action is thus strongly influenced by prior thoughts and expectations, but only over a short time period. Thus, awareness of our actions is a dynamic and relatively flexible mixture of what we intend to do, and what our motor system actually does. (shrink)

Notre analyse prend comme point de départ le discord entre l’expérience vécue du malade et le statut de patient inauguré par la rencontre médicale, pour suggérer l’existence d’un motif de basse continue à une dysharmonie qui n’est pas la seule conséquence du contexte actuel, mais qui tient à un hiatus irréductible. Les mouvements tendanciels destinés à « corriger le tir » (...) risquent de manquer leur but, faute d’avoir pris en considération le caractère inévitablement bancal de la pratique médicale. Faisant retour sur ce qui « a lieu » dans la consultation, la question initiale en vient à être déplacée : conviendrait-il, tout bien considéré, de ne pas trop (chercher à) comprendre le malade? Poly(ADP‐ribosyl)ation is an immediate DNA‐damage‐dependent post‐translational modification of histones and other nuclear proteins that contributes to the survival of injured proliferating cells. Poly(ADP‐ribose) polymerases (PARPs) now constitute a large family of 18 proteins, encoded by different genes and displaying a conserved catalytic domain in which PARP‐1 (113 kDa), the founding member, and PARP‐2 (62 kDa) are so far the sole enzymes whose catalytic activity has been shown to be immediately stimulated by DNA strand breaks. A large repertoire of sequences encoding (...) novel PARPs now extends considerably the field of poly(ADP‐ribosyl)ation reactions to various aspects of the cell biology including cell proliferation and cell death. Some of these new members interact with each other, share common partners and common subcellular localizations suggesting possible fine tuning in the regulation of this post‐translational modification of proteins. This review summarizes our present knowledge of this emerging superfamily, which might ultimately improve pharmacological strategies to enhance both antitumor efficacy and the treatment of a number of inflammatory and neurodegenerative disorders. Mentionné à plusieurs reprises bien qu’aucun de ses écrits ne soit cité, Bakounine occupe une place particulière dans quelques-uns des principaux textes de Carl Schmitt (Théologie politique, La dictature, Le concept de politique). Les thèmes que Schmitt choisit de repérer chez Bakounine (satanisme, naturalisme, nature religieuse de l’autorité, refus de la médiation), s’ils sont l’indice d’une connaissance précise de l’œuvre du révolutionnaire russe, permettent également de l’inscrire dans une opposition terme à terme avec les théoriciens de la contre-révolution. La lecture (...) attentive que Schmitt semble avoir faite des textes de Bakounine ne doit donc pas masquer que dans l’œuvre du théoricien allemand, Bakounine est avant tout une figure : celle de l’anarchiste russe, ennemi par excellence qui prétend en finir avec le politique. Apparemment adventice, la convocation de cette figure partiellement mythique touche dès lors à un thème central chez Schmitt, celui de la conception de la politique. (shrink)

The Marx-Bakunin Conflict in the First International : A Confrontation of Political Practices. The conflict between Marx and Bakunin within the First International was more than a merely political opposition. It was in fact a conflict about the very status of the political. Accused of being apolitical, Bakunin replied by declaring his anti-statist stance, while at the same time misinterpreting the Marxian political project. The position he defended within the International prefigured the anarcho-syndicalist subsumption of the political within syndicalism. In (...) return, the opposition helped to clarify the Marxian conception of worker organisations. Finally, the conflict would enable Bakunin to identify the dangers of bureaucratisation to which such organisations are prone, while Marx, for his part, sought to conceive of a type of political action which was specific to the proletariat. The conflict thus enables us to characterise Marx and Bakunin as two types of militant engagement. (shrink)
