In contrast to the traditional view of Kant as apure retributivist, the recent interpretations ofKant's theory of punishment (for instance Byrd's)propose a mixed theory of retributivism and generalprevention. This book illustrates the specificities and interconnections of major spheres of global justice. It analyzes the diverse kinds of global ethical obligations in relation to the diversity of global causal relationships. It presents a multidisciplinary spectrum by leading scholars that combines empirical analysis with theoretical approaches.

Traditional liberalism's blindness to cultural concerns has often come under fire, while so‐called “liberal multiculturalism” has made it its business to take a good look at the place of culture within liberal law. According to them, cultural minorities should be recognized. In my opinion, however, their proposals, in fact, almost entirely preclude the possibility that cultural minorities would receive recognition within liberal society. In what follows, I explain my view of these matters and, above all, argue for a more vital (...) understanding of cultural minorities. Sie gilt zudem als die reifste und elaborierteste Darstellung des Standpunkts seiner Jenaer Wissenschaftslehre, in der die praktische Vernunft in die Rolle des hochsten Prinzips der Philosophie ruckt. Dieser kooperative Kommentar ermoglicht dem Leser, die Argumentation des Textes Schritt fur Schritt (...) nachzuvollziehen und dadurch zu einem vertieften Verstandnis dieses zentralen Textes des Deutschen Idealismus zu gelangen. Against the background of early modernism - a period that justified punishment by general deterrence - Kant is usually thought to represent a radical turn towards retributivism. For Kant, and later for Fichte and Hegel, a just punishment respects the humanity inherent in the criminal, and serves no external ends - it is instituted only because the criminal deserves it. In this original study, Jean-Christophe Merle uses close analysis of texts to show that these philosophers did not in fact hold (...) a retributivist position, or even a mixed position; instead he traces in their work the gradual emergence of views in favour of deterrence and resocialisation. He also examines Nietzsche's view that morality rests on the rejection of retribution. His final chapter offers a challenge to the retributivist position, and a defence of resocialisation, in the context of current legal theory and practice concerning the punishment of crimes against humanity. This volume presents an extended version of the contributions presented at the workshop "Kant's Concept of Law" held at the 26th World Congress of the International Association for Philosophy of Law and Social Philosophy (IVR) in 2013. It handles issues of applied legal philosophy in Kant's Doctrine of Right such as ownership, the alleged right of necessity, the right of resistance and the right of revolution. With each of these applied issues, the focus lies, on the one hand, on the (...) relationship between the principles a priori of law and of the duties of rights, as well as their normative requirements - for instance, the duty of independence from the coercion by others - and, on the other hand, empirical situations and their pressing demands. Thus, this volume illustrates how Kant concretely conceives of the doctrine of "first metaphysical of the doctrine of right" as supplying "the immutable principles for any giving of positive law". Each essay of this volume not only undertakes a careful and original interpretation of Kant's theses, but also offers a critical assessment. (shrink)

À luz da secularização da sociedade, que marcou a época moderna e a contemporânea e, sobretudo, com a larga difusão do ateísmo, trata-se de discutir a questão do mal, mostrando, por um lado, que a crença em Deus poderia atribuir uma importância cada vez maior à questão do mal, mas, por outro, poder-se-ia esperar, à luz da influência do ateísmo, que o mal assumisse uma significação inédita, ou seja, o deslocamento da questão do mal, exclusivamente, à perspectiva moral. Neste artigo, (...) fala-se não de um mundo sem religião nem sem divino nem sem divindades. Fala-se de um mundo sem Deus, no singular, limitando-se o autor a tratar de uma só das religiões monoteístas e a filosofia que ela inspirou, a saber, o Cristianismo, ainda que sem fazer distinções entre suas diferentes confissões. Partindo, pois, do pressuposto de que o mal é a única coisa que Deus não criou, o autor mostra que os filósofos, inspirados no Cristianismo, consideraram que não seria possível ser virtuoso e dizer-se ateu ao mesmo tempo, a não ser pagando o preço de uma contradição. A teoria da justiça política de Hóffe, fundamentada na justiça comutativa, sustenta que a fundamentação de normas de sociedade, na comunidade discursiva, pela Ética do Discurso de Apel e Habermas, é apenas uma fundamentação derivada, posto que a comunidade discursiva — necessariamente pressupõe direitos humanos A Ética do Discurso afirma, por sua vez, que direitos humanos podem: ser legitimados somente através de discursos. Este artigo sustenta que a pressuposição normativa para ambas - a comunidade discursiva e o princípio de justiça (...) comutativa — é que todos cos seres humanos têm o direito de partilhar o mundo. Somente sob essa premissa da justiça distributiva, pode haver parceiros que exercem reciprocidade e participantes de discurso, que também têm algo sobre o que têm de decidir conjuntamente. (shrink)

Die Berechtigung und Angemessenheit von Strafen ist ein Zentralproblem jeder Staats- und Gesellschaftsphilosophie. Die vorliegende Abhandlung befasst sich mit den Vergeltungstheorien (Retributivismus) und den Theorien der Generalprävention und erarbeitet in einer Kombination von Spezialprävention und Resozialisierung einen eigenen Standpunkt, aus dem sich ein Plädoyer für einen die Würde des Menschen respektierenden Umgang mit Verbrechern herleitet.

Contrariamente à visão tradicional de Kant como um puro retributivista, as interpretações recentes da teoria kantiana da pena propõem uma teoria mista da retribuição e prevenção geral. Embora ambos elementos sejam literalmente corretos, tentarei mostrar os limites de cada um deles. Sustentarei que a teoria kantiana da pena não é consistente com seu próprio conceito de lei. Proponho, então, uma outra justificação para a pena: especial e reabilitação. A crítica kantiana do utilitarismo não afeta essa alternativa, que tem, outrossim, apoio (...) em Kant e é totalmente consistente com sua própria concepção de lei. (shrink)

Kant nimmt in der Einleitung zur Metaphysik der Sitten eine Einteilung in innere und äußere Gesetzgebung vor. Beide leitet er aus demselben in der Grundlegung zur Metaphysik der Sitten formulierten kategorischen Imperativ ab, und fügt Letzterem weitere Elemente einer Grundanthropologie hinzu, die das Material für die einzelnen Teile der Rechts- und Tugendlehre darstellen. Die Zusammenhänge zwischen Rechts- und Tugendlehre sind aber komplexer als die Einteilung in äußere und innere Gesetzgebung es nahelegt. Sie teilen etwa dieselben Anwendungsmethoden und Metaphern, und bei (...) einer näheren Untersuchung der einzelnen Teile erweist sich diese Einteilung als entweder problematisch oder unscharf. In der Textinterpretation der einzelnen Beiträge kommen die genannten Zusammenhänge und Beziehungen zum Vorschein – insbesondere weil ein Teil der Autoren dieses Bandes zum Kommentar beider Werken beiträgt. Ein weiterer Schwerpunkt dieser Textinterpretationen liegt bei der kritischen Untersuchung des Ertrags dieser Werke für die entsprechenden heutigen Debatten und die Auseinandersetzung mit heutigen im weiten Sinne „Kantischen“ Positionen. Spheres of Global Justice analyzes six of the most important and controversial spheres of global justice, each concerning a specific global social good. These spheres are democratic participation, migrations, cultural minorities, economic justice, social justice, and intergenerational justice. Together they constitute two constellations dealt with, in this collection of essays by leading scholars, in two different volumes: Global Challenges to Liberal Democracy and Fair Distribution. These essays illustrate each of the spheres, delving into their differences, commonalities, collisions and interconnections. Unlike (...) many writings on global justice, Spheres of Global Justice does not content itself with describing the painful and advantageous effects of the globalization process as being inches per secondo facto a global injustice or a just global order. Rather, this multidisciplinary collection of essays, from a pluralist inspiration, combines empirical analysis with theoretical approaches and ethical principles, paying close attention to two aspects of the effects of the globalization process. These aspects are the causal relationships that lead to such effects and the kinds of obligations, or of normative relationships between global rights and correlative duties, that applies to each specific individual case. This volume illustrates how diverse global obligations are, and how they can be, grounded in diverse relationships (identity, ability to provide help, causal responsibility, past injustices, protection of agency and promotion of independence, et cetera). These essays also demonstrate that an ethical global approach has not only international or transnational, but also domestic, local and interpersonal dimensions. (shrink)
