A student of Étienne Gilson and Joseph Owens, John P. Doyle taught medieval and Scholastic philosophy at Saint Louis University for forty years. Of continuing interest to Doyle has been the thought of Francisco Suárez, S.J. On this topic Doyle has published over a dozen articles and four English translations of portions of Suárez's key works. This research was designed to develop an inventory of vendor-related problems experienced by buyers for small retail apparel stores during the merchandise buying process, determine how frequently each difficulty occurs, and identify the experiences perceived to be unethical. Among the 22 vendor-related difficulties examined minimum order requirements, 6 month advance purchase, incomplete orders, late shipments, and shipping overcharges were identified most frequently. Analysis of results suggested that one factor, misleading vendor practices, and eight background variables (annual sales, price line, full- (...) and part-time employees, retail and buying experience, and shopping large or small markets) were associated with unethical experiences. Ethically troublesome experiences mentioned most frequently were padded orders, selling competitor same merchandise, withholding return authorization and credit, shipping overcharges, and dealing with vendor's factor. We have argued elsewhere that moral responsibility over time depends in part upon the having of psychological connections which facilitate forms of self-control. In this chapter we explore the importance of mental time travel - our ordinary ability to mentally travel to temporal locations outside the present, involving both memory of our personal past and the ability to imagine ourselves in the future - to our agential capacities for planning and control. We suggest that in many individuals with dissociative disorders, (...) forms of amnesia, or other frontal lobe damage, our capacity for mental time travel is impaired, resulting in commensurate losses to agency autonomy, and a forensic condition essential for holding persons responsible: in legal terms, the capacity for mens rea. Background: Moral distress is an important and well-studied phenomenon among nurses and other healthcare providers, yet the conceptualization of parental moral distress remains unclear. Objective: The objective of this dimensional analysis was to describe the nature of family moral distress in serious pediatric illness. Design and methods: A dimensional analysis of articles retrieved from a librarian-assisted systematic review of Scopus, CINAHL, and PsychInfo was conducted, focusing on how children, parents, other family members, and healthcare providers describe parental moral distress, both (...) explicitly through writings on parental moral experience and implicitly through writings on parental involvement in distressing aspects of the child’s serious illness. Ethical considerations: To promote child and family best interest and minimize harm, a nuanced understanding of the moral, existential, emotional, and spiritual impact of serious pediatric illness is needed. The cases used in this dimensional analysis come from the first author’s IRB approved study at the Children’s Hospital of Philadelphia and subsequent published studies; or have been adapted from the literature and the authors’ clinical experiences. Findings: Three dimensions emerged from the literature surrounding parent moral distress: an intrapersonal dimension, an interpersonal dimension, and a spiritual/existential dimension. The overarching theme is that parents experience relational solace and distress because of the impact of their child’s illness on relationships with themselves, their children, family, healthcare providers, their surrounding communities, and society. Discussion: Elucidating this concept can help nurses and other professionals understand, mitigate, or eliminate antecedents to parental moral distress. We discuss how this model can facilitate future empirical and conceptual bioethics research, as well as inform the manner in which healthcare providers engage, collaborate with, and care for families during serious pediatric illness. Conclusion: Parent moral distress is an important and complex phenomenon that requires further theoretical and empirical investigation. Barz (2018) contends that there is no specification of the phenomenon of first-person authority that avoids falsity or triviality. This paper offers one. When a subject self-ascribes a current conscious mental state in speech, there is a presumption that what she says is true. To defeat this presumption, one must be able to explain how she has been led astray.

This chapter examines an epistemological disjunctivist treatment of self-knowledge of belief. More specifically, it considers whether such a Disjunctivism is confronted by a familiar objection facing Disjunctivism about perceptual knowledge. The objection is this: given that good and bad cases are subjectively indistinguishable, one cannot take oneself to be in the good case, when one is, by reflection alone, as Disjunctivists claim. Some philosophers have argued that the objection does not apply to the case of self-knowledge; I argue they are (...) wrong. There are “ringers” for belief, and their existence may undermine our claims to self-knowledge, even in good cases. I suggest that whether the objection applies to the case of self-knowledge depends on how we conceive of conscious judgment. I end by considering an alternative conception that rules out the possibility of bad cases for self-knowledge. (shrink)

It is becoming increasingly apparent that Elizabeth Anscombe, long known as a student, friend and translator of Wittgenstein, was herself one of the most important philosophers of the twentieth century. No Morality, No Self examines her two best-known papers, in which she advanced her most amazing theses. In 'Modern Moral Philosophy', she claimed that the term moral, understood as picking out a special, sui generis category, is literally senseless and should therefore be abandoned. In 'The First Person', she maintained that (...) the word 'I' is not a referring expression: in other words, its function in the language is not to pick out the speaker, or 'the self' - or any entity whatsoever. Both papers are considered influential, and are frequently cited; but their main claims, and many of their arguments, have been widely misunderstood. In this book James Doyle shows that once various errors of interpretation have been cleared away, the claims can be seen to be far more plausible, and the arguments far more compelling, than even her defenders have realized. Philosophers often seek attention by making startling claims which are subsequently revealed as little more than commonplaces wrapped in hyperbole. Doyle's book makes it clear that here, in her greatest papers, Anscombe achieves something vanishingly rare in philosophy: a persuasive case for genuinely unsettling and profound conclusions. The two lines of argument, seemingly so disparate, are also shown to be connected by Anscombe's deep opposition to the Cartesian picture of the mind.--. (shrink)

This paper argues that Nietzsche shares the aim of contemporary Sellarsian efforts to reconcile the natural and the normative. However, as Joseph Rouse notes, the Sellarsian strategy collapses into dualism by virtue of its treatment of natural causality and normativity as different in kind and of the normative as operating parallel to the causal (Rouse 2002). The paper argues that Nietzsche avoids this dualism by offering a constitutively causal account of the normative. He does this by identifying the normative with (...) dominant drives of the self. It is argued that these dominant drives, like natural causes in the world, are modally dispositional and differ from natural causes in degree rather than dualistically in kind. However, the identification of the normative status of our values with dominant drives has been subject to strenuous criticism. Specifically, it is argued that the normative cannot be identified with dominant drives for fear of eliminating the normative. The paper responds to these criticisms in detail and argues that the constitutively causal account of normativity that stems from Nietzsche’s identification of the normative with dominant drives can be defended. Psychopaths have long been of interest to moral philosophers, since a careful examination of their peculiar deficiencies may reveal what features are normally critical to the development of moral agency. What underlies the psychopath's amoralism? A common and plausible answer to this question is that the psychopath lacks empathy. Lack of empathy is also claimed to be a critical impairment in autism, yet it is not at all clear that autistic individuals share the psychopath's amoralism. How is empathy characterized in (...) the literature, and how crucial is empathy, so described, to moral understanding and agency? I argue that an examination of moral thinking in high-functioning autistic people supports a Kantian rather than a Humean account of moral agency. (shrink)

Is it possible that the most famous critic of quantum mechanics actually invented most of its fundamentally important concepts? -/- In his 1905 Brownian motion paper, Einstein quantized matter, proving the existence of atoms. His light quantum hypothesis showed that energy itself comes in particles (photons). He showed energy and matter are interchangeable, E = mc2. In 1905 Einstein was first to see nonlocality and instantaneous action-at-a-distance. In 1907 he saw quantum “jumps” between energy levels in matter, six years before (...) Bohr postulated them in his atomic model. Einstein saw wave-particle duality and the “collapse” of the wave in 1909. And in 1916 his transition probabilities for emission and absorption processes introduced ontological chance when matter and radiation interact, making quantum mechanics statistical. He discovered the indistinguishability and odd quantum statistics of elementary particles in 1925 and in 1935 speculated about the nonseparability of interacting identical particles. -/- It took physicists over twenty years to accept Einstein’s light-quantum. He explained the relation of particles to waves fifteen years before Heisenberg matrices and Schrödinger wave functions. He saw indeterminism ten years before the uncertainty principle. And he saw nonlocality as early as 1905, presenting it formally in 1927, but was ignored. In the 1935 Einstein-Podolsky-Rosen paper, he explored nonseparability, which was dubbed “entanglement” by Schrödinger. The EPR paper has gone from being irrelevant to Einstein’s most cited work and the basis for today’s “second revolution in quantum mechanics.” -/- In a radical revision of the history of quantum physics, Bob Doyle develops Einstein’s idea of objective reality to resolve several of today’s most puzzling quantum mysteries, including the two-slit experiment, quantum entanglement, and microscopic irreversibility. T he Question of punishment and its justification has been a major preoccupation in recent philosophy of law. The reasons for this growing concern are not difficult to discover. Both philosophers and jurists have become increasingly sceptical of traditional theories of legal punishment. Each of these inherited theories was designed to establish criteria for the recognition and appraisal of punishment as a legal institution. However, alternative theories emphasised different and often conflicting criteria. Some theories emphasised moral desert and retribution, while (...) others appealed to the social utilities of punishment. Undercover marketing targets potential customers by concealing the commercial nature of an apparently social transaction. In a typical case an individual approaches a marketing target apparently to provide some information or advice about a product in a way that makes it seem like they are a fellow consumer. In another kind of case, a friend displays a product to you, and encourages its purchase, but fails to disclose their association with the marketing firm. We focus on this second type of (...) case and argue that the constitutive dispositions of friendship that provide for the development and maintenance of intimacy also render friends especially vulnerable to undercover marketing techniques and so to the exploitation of friendship for commercial ends. We show how this is corrupting both of the friendship and the commercial agent. (shrink)

Although precision medicine cuts across a large spectrum of professions, interdisciplinary and cross-sectorial moral deliberation has yet to be widely enacted, let alone formalized in this field. In a recent research project on precision medicine, we designed a dialogical forum (i.e. ‘the Ethics Laboratory’) giving interdisciplinary and cross-sectorial stakeholders an opportunity to discuss their moral conundrums in concert. We organized and carried out four Ethics Laboratories. In this article, we use Simone de Beauvoir’s concept of moral ambiguity as a lens (...) to frame the participants’ experience with fluid moral boundaries. By framing our approach through this concept we are able to elucidate irremediable moral issues that are collectively underexplored in the practice of precision medicine. Moral ambiguity accentuates an open and free space where different types of perspectives converge and can inform each other. Based on our study, we identified two dilemmas, or thematic interfaces, in the interdisciplinary moral deliberations which unfolded in the Ethics Laboratories: (1) the dilemma between the individual and the collective good; and (2) the dilemma between care and choice. Through our investigation of these dilemmas, we show how Beauvoir’s concept of moral ambiquity not only serves as a fertile catalyst for greater moral awareness but, furthermore, how the concept can become an indispensable part of the practices of and the discourse about precision medicine. All non-nuclear-weapon states are morally and legally obliged by the Nuclear Nonproliferation Treaty (NPT) to refrain from acquiring nuclear weapons. These obligations cannot be overridden for reasons of mere prudence. Only (i) material breaches of the treaty and/or a corresponding; (ii) ‘fundamental change in circumstances’ (rebus sic stantibus) that undermines the integrity of the NPT may override states parties’ legal nonproliferation duties. More than the violations of the NPT by ‘rogue’ states like North Korea or Iran, I argue that the (...) failure of the de jure nuclear-weapon powers since 2001 to uphold their informal and some formal NPT commitments suggests the possibility of material breach and/or institutional subversion. If NPT subversion were to occur, the non-nuclear-weapon states’ collective responsibility to avoid complicity in that subversion leads them to choose between (a) individually seeking nuclear weapons capability for state security; or, more preferably, (b) a publicly announced and collective withdrawal from the NPT that simultaneously refuses to pursue the nuclear weapons option. “Oversinging” is singing that is excessive in one or more dimensions: too loud, too ornamented, too melismatic, too expressive, or employing too much vibrato. I begin with a characterization of oversinging and establish a context for discussion (Section I). Next I consider performances by Christina Aguilera and Michael Bolton as examples (Section II). In light of these examples, I consider how oversinging might be both aesthetically and morally problematic (Section III). Along the way I raise concerns about authenticity and sincerity (...) (Section IV). Finally (Section V), I consider a “paradox” of oversinging involving the role of skill in artistic performance. The recent, influential Social Intuitionist Model of moral judgment (Haidt, Psychological Review 108, 814–834, 2001) proposes a primary role for fast, automatic and affectively charged moral intuitions in the formation of moral judgments. Haidt’s research challenges our normative conception of ourselves as agents capable of grasping and responding to reasons. We argue that there can be no ‘real’ moral judgments in the absence of a capacity for reflective shaping and endorsement of moral judgments. However, we suggest that the empirical literature (...) indicates a complex interplay between automatic and deliberative mental processes in moral judgment formation, with the latter constraining the expression and influence of moral intuitions. Is it ever possible for people to act freely and intentionally against their better judgement? Is it ever possible to act in opposition to one's strongest desire? If either of these questions are answered in the negative, the common-sense distinctions between recklessness, weakness of will and compulsion collapse. This would threaten our ordinary notion of self-control and undermine our practice of holding each other responsible for moral failure. So a clear and plausible account of how weakness of will and self-control (...) are possible is of great practical significance. Taking the problem of weakness of will as her starting point, Jeanette Kennett builds an admirably comprehensive and integrated account of moral agency which gives a central place to the capacity for self-control. Her account of the exercise and limits of self-control vindicates the common-sense distinction between weakness of will and compulsion and so underwrites our ordinary allocations of moral responsibility. In epistemology and philosophy of science, there has been substantial debate about truth’s relation to understanding. “Non-factivists” hold that radical departures from the truth are not always barriers to understanding; “quasi-factivists” demur. The most discussed example concerns scientists’ use of idealizations in certain derivations of the ideal gas law from statistical mechanics. Yet, these discussions have suffered from confusions about the relevant science, as well as conceptual confusions. Addressing this example, we shall argue that the ideal gas law is best (...) interpreted as favoring non-factivism about understanding, but only after delving a bit deeper into the statistical mechanics that has informed these arguments and stating more precisely what non-factivism entails. Along the way, we indicate where earlier discussions have gone astray, and highlight how a naturalistic approach furnishes more nuanced normative theses about the interaction of rationality, understanding, and epistemic value. A diagnosis of schizophrenia is often taken to denote a state of global irrationality within the psychiatric paradigm, wherein psychotic phenomena are seen to equate with a lack of mental capacity. However, the little research that has been undertaken on mental capacity in psychiatric patients shows that people with schizophrenia are more likely to experience isolated, rather than constitutive, irrationality and are therefore not necessarily globally incapacitated. Rational suicide has not been accepted as a valid choice for people with schizophrenia (...) due in part to a belief that characteristic irrationality prevents autonomous decision-making. Since people with schizophrenia are often seen to lack insight into the nature of their disorder, both psychiatric and ethical perspectives generally presume that suicidal acts result directly from mental illness itself and not from second-order desires. In this article, I challenge notions of global irrationality conferred by a diagnosis of schizophrenia and argue that, where delusional beliefs are unifocal, schizophrenia does not necessarily lead to a state of mental incapacity. I then attempt to show that people with schizophrenia can sometimes be rational with regard to suicide, where this decision stems from a realistic appraisal of psychological suffering. (shrink)

It is often claimed that the existence of psychopaths undermines moral rationalism. I examine a recent empirically based argument for this claim and conclude that rationalist accounts of moral judgement and moral reasoning are perfectly compatible with the evidence cited.

A person suffering a mental illness or disorder may differ dramatically from his or her previous well self. Family and close friends who knew the person before the onset of illness tend to regard the illness as obscuring their loved one's true self and see the goal of treatment as the restoration of that self. ‘He is not really like this,’ they will say with increasing desperation. Treatment teams and others, who have no acquaintance with the person when well, respond (...) to what they see in front of them and do sometimes make harmful judgments of character based on the person's presentation when ill. An adequate account of musical understanding must be sufficiently detailed and nuanced so as to be able to make sense of the experience of listeners with diverse musical and cultural backgrounds. It should also help us begin to understand the wide variety of responses to music, including the responses of those who hear music as having semantic content. I approach these issues in the more general philosophical context of aesthetic understanding. As an approach to my own position, I examine the (...) accounts of aesthetic understanding offered by Nelson Goodman, Roger Scruton, and Peter Kivy. Because each can be seen as broadly within the Kantian tradition, I also undertake an examination of Kant's aesthetics. ;My account of what it is to understand music and of how this understanding is achieved draws upon a phenomenological analysis of listening. I argue that a continuum of two levels of understanding music can be distinguished. At the lowest level, "recognitional understanding," the listener can hear a series of tones as a rhythmic and melodic gestalt, and understand a minimum of expressive and gestural characteristics. The second level, "enhanced understanding," requires greater sensitivity to the music's expressive character, being able to place the music in an appropriate historical context, and some awareness of musical form. Beyond these two levels but presupposing them is a third, which I call "interpretive understanding." Listening to music, we sometimes get the sense that the music is "profound" or has something to say, if only we could grasp it. ;For musical understanding of any sort, involvement with the music is crucial. I develop an account of involvement with music which stresses the similarities between following a musical performance and following or constructing a narrative. I conclude by suggesting the ways in which my account of musical understanding captures some of the strengths of the accounts already discussed , and consider some objections which might be made against it.
