  1. Supervenience Arguments Under Relaxed Assumptions.Johannes Schmitt & Mark Schroeder - 2011 - Philosophical Studies 155 (1):133 - 160.
When it comes to evaluating reductive hypotheses in metaphysics, supervenience arguments are the tools of the trade. Jaegwon Kim and Frank Jackson have argued, respectively, that strong and global supervenience are sufficient for reduction, and others have argued that supervenience theses stand in need of the kind of explanation that reductive hypotheses are particularly suited to provide. Simon Blackburn's arguments about what he claims are the specifically problematic features of the supervenience of the moral on the natural have also been (...)

Interrogation of Carl Schmitt by Robert Kempner (I).Carl Schmitt - 1987 - Telos: Critical Theory of the Contemporary 1987 (72):97-129.
Kempner. You do not have to testify, Professor Schmitt, if you do not want to, and if you think you are incriminating yourself. But if you do testify, then I would be grateful if you would be absolutely truthful, would neither conceal nor add anything. Is that your wish? Schmitt: Yes, of course. Kempner: And if I come to something you might find self-incriminating, you can simply say you prefer to remain silent. Schmitt: I have already been (...)

    On Grotius's Mare Liberum_ and Vitoria's _De Indis, Following Agamben and Schmitt.Johannes Thumfart - 2009 - Grotiana 30 (1):65-87.
The idea of free trade in Grotius's Mare liberum and his legal opinion De iure praedae has a strong theological basis. Grotius called the right to travel and trade freely a ius sanctissimum, a 'sacrosanct law'. He also perceived the Freedom of the Seas as being a direct result of the will of God. This theological background was strategically necessary because Grotius developed the Mare liberum and the De iure praedae to argue against Spanish-Portuguese claims to a trade monopoly that (...)

The Intrusion: Carl Schmitt's Non-Mimetic Logic of Art.Johannes Türk - 2008 - Telos: Critical Theory of the Contemporary 2008 (142):73-89.
The facts are known: The death of the queen seems imminent, while the decision on her successor has not yet been made. And while Queen Elizabeth's end, and with it the transition of power, is anticipated, political complications arise: the most apt successor of the childless heir is the Scottish prince James, whose great-grandmother was a daughter of Charles VII of England. But his mother's lover, the Earl of Bothwell, has killed James's father, Lord Darnley. And Maria Stewart has married (...)

This is the first full-length study in English of twentieth-century Germany's most influential authoritarian right-wing political theorist, Carl Schmitt, that focuses on the central place of his attack on the liberal rule of law. This is also the first book in any language to devote substantial attention to Schmitt's subterranean influence on some of the most important voices in political thought in the United States after 1945.

This paper has the aim of making Johannes von Kries’s masterpiece, Die Principien der Wahrscheinlichkeitsrechnung of 1886, a little more accessible to the modern reader in three modest ways: first, it discusses the historical background to the book ; next, it summarizes the basic elements of von Kries’s approach ; and finally, it examines the so-called “principle of cogent reason” with which von Kries’s name is often identified in the English literature.

Antagonism and Democratic Citizenship (Schmitt, Mouffe, Derrida).Matthias Fritsch - 2008 - Research in Phenomenology 38 (2):174-197.
In the context of the recent proliferation of nationalisms and enemy figures, this paper agrees with the desirability of retaining some of the explanatory and motivational potential of an agonistic account of politics, but gives reasons not to accept too much of Carl Schmitt's account of citizenship. The claim as to the necessarily antagonistic exclusion of concrete others can be supported neither on its own terms nor on Derridian grounds, as Chantal Mouffe, in particular, attempts to do. I then (...)

In the early twentieth century, ornithology underwent significant changes. So far, these changes, basically, have been studied by focussing on the elite of professional biologists working at universities or state museums. However, important developments also occurred in what Lynn Nyhart has called “the civic realm” of science – the sphere given form by private naturalist associations, nature writers, taxidermists and school teachers. This article studies the changing dynamics of civic ornithology, by looking at one particular case: the influential orinthological observatory (...)

Potentia Absoluta Et Potentia Ordinata Dei: On the Theological Origins of Carl Schmitt's Theory of Constitution. [REVIEW]Mika Ojakangas - 2012 - Continental Philosophy Review 45 (4):505-517.
In line with his theory of secularization according to which all significant concepts of the modern theory of the state are secularized theological concepts, Carl Schmitt argues in Constitutional Theory that people’s (Volk) constitution-making power in modern democracy is analogical to God’s potestas constituens in medieval theology. It is also undoubtedly possible to find a resemblance between Schmitt’s constitution-making power and God’s power as it is described in medieval theology. In the same sense as the constitution-making power is (...)

This article addresses, from a Frankfurt School perspective on law identified with Franz Neumann and more recently Habermas, the attack upon the principles of war criminality formulated at the Nuremberg trials by the increasingly influential legal and political theory of Carl Schmitt. It also considers the contradictions within certain of the defence arguments that Schmitt himself resorted to when interrogated as a possible war crimes defendant at Nuremberg. The overall argument is that a distinctly internal, or “immanent”, form (...)

    Johannes Volkelt a problem metafizyki.Tomasz Kubalica - 2012 - Estetyka I Krytyka 26:27-50.
The aim of the paper is a historical analysis and evaluate of the metaphysic of Neo-Kantian philosopher Johannes Volkelt and of Postneo-Kantian Martin Heidegger. Heidegger's approach to Kant's critique of pure reason (transcendental philosophy) as the foundation of metaphysics is not new and it had a major precursor in the metaphysical Neo-Kantianism. In the Neo-Kantianism was taken inside the question of the possibility of metaphysics, not only as metaphysica specialis, but also as the ontology (metaphysica generalis).

Johannes Daubert he was an acknowledged leader, and in some respects the founder, of the early phenomenological movement, and was considered – as much by its members as by Husserl himself – the most brilliant member of the group. In Daubert’s unpublished writings we find a series of reflections on Lask, and on Neo-Kantianism, which form the subject-matter of this paper. They range over topics such as the ontology of the ‘Sachverhalt’ or state of affairs, truthvalues (Wahrheitswerte) and the (...)

Secularization, History, and Political Theology: The Hans Blumenberg and Carl Schmitt Debate.Celina Maria Bragagnolo - 2011 - Journal of the Philosophy of History 5 (1):84-104.
Considering the enormous outpouring of scholarly work on Schmitt over the last two decades, the absence of an adequate treatment in English of Schmitt's concept of history and the problem of secularization is quite surprising. After all, it is Schmitt himself who claims that “all human beings who plan and attempt to unite the masses behind their plans engage in some form of philosophy of history,” such that the attempt to make sense of Schmitt's program remains (...)

Carl Schmitt, an increasingly influential German law professor, developed a provocative and historically oriented model of “political theology” with specific relevance to legal scholarship and the authorship of constitutional texts. His “political theology” is best understood neither as an expressly theological discourse within constitutional law, nor as a uniquely legal discourse shaped by a hidden theological agenda. Instead, it addresses the possibility of the continual resurfacing of theological ideas and beliefs within legal discourses of, for instance, sovereignty, the force (...)

    Reoccupying Secularization: Schmitt and Koselleck on Blumenberg's Challenge.Timo Pankakoski - 2013 - History and Theory 52 (2):214-245.
This article analyzes the compound of the categories of secularization and reoccupation in its variations from Hans Blumenberg's philosophy to Carl Schmitt's political theory and, ultimately, to Reinhart Koselleck's conceptual history. By revisiting the debate between Blumenberg and Schmitt on secularization and political theology with regard to the political-theoretical aspects of secularization and the methodological aspects of reoccupation, I will provide conceptual tools that illuminate the partly tension-ridden elements at play in Koselleck's theorizing of modernity, history, and concepts. Carl Schmitt is usually perceived as the theorist of total state, total war and total hostility. In the article, the author however tries to show that from 1937 to 1944, Schmitt was arguing that total war and total hostility were dangerous for Germany and warned against perpetuation of all efforts to totalize enemy that started in 1914.

This article questions the status of Vattel's Law of Nations as an exemplary illustration of eighteenth-century developments in the history of international law. Recent discussions of the relation between eighteenth-century thinking about the law of nations and the French Revolution have revived Carl Schmitt's contention about the nexus between just war theory and the emergence of total war. This evaluative framework has been used to identify Vattel as a moral critic of absolutism who helped undermine the barriers against total (...)

Focusing on their adaptation of a German tradition of state-legal theory, the book offers a scholarly, contextualized account of the interrelationship between their political thought and practical political criticism. Dr Kelly criticizes the typical separation of these writers, and offers a substantial reinterpretation of modern German political thought in a period of profound transition, in particular the relationship between political (...)

This book argues that a radical political gesture can be found in Søren Kierkegaard’s writings. The chapters navigate an interdisciplinary landscape by placing Kierkegaard’s passionate thought in conversation with the writings of Georg Lukács, Carl Schmitt, Walter Benjamin and Theodor Adorno. At the heart of the book’s argument is the concept of “indirect politics,” which names a negative space between methods, concepts, and intellectual acts in the work of Kierkegaard, as well as marking the dynamic relations between Kierkegaard and (...)
