The First World Congress on Evidential Legal Reasoning, organised by the Legal Culture Chair of the University of Girona, was held between June 6 and 8, 2018. The Congress was attended by 350 participants and featured 18 speakers from four continents. The three days of formal and informal presentations and discussions yielded excellent results, strengthening the interrelation between the legal communities and specialists of different traditions. The 18 papers from the Congress, reviewed by their authors based on the discussions and (...) the suggestions made at the Congress, have been compiled in this book. (shrink)

El artículo revisa las aportaciones más trascendentes que Jordi Ferrer ha hecho a la tradición racionalista de la prueba jurídica y evalúa críticamente el limitado papel que, desde su óptica, le corresponde desempeñar a la epistemología en la discusión general sobre los estándares de prueba apropiados para las distintas ramas del derecho. Más específicamente, se analiza la irrelevancia que Ferrer parece atribuir a dicha disciplina –o el silencio que debe guardar–, respecto del establecimiento del estándar de prueba (...) deseable en materia penal. Se concede que, en efecto, le corresponde al pueblo tomar la decisión de qué estándar implementar. No obstante, se sostiene, ello no impide que la epistemología incida en el proceso de formación de dicha decisión mediante la realización de observaciones, el ofrecimiento de argumentos y la propuesta de metodologías adecuadas, con miras a que aquella se tome en un contexto mejor informado y sea lo más racional posible. In procedural-law scholarship as well as in the theoretical analysis of the notion of proof as a result of the joint assessment of all items of evidence introduced in a trial, reference is frequently made to notions such as the conviction, belief, or certainty of a judge or a jury member about what happened. All these notions underscore the mental states involved in the process of determining the facts on the part of a judge or a jury. In this analysis, (...) In jurisprudential literature, the adjective ‘defeasible’ appears as a predicate of many terms: concepts, laws, rules, reasoning, justification, proof, and so on. In this paper, we analyze the effects of some versions of the thesis of the defeasibility of legal norms on the reconstruction of the notion of legal validity. We analyze some possible justifications of this thesis considered as a claim concerning validity, and enquire into two possible sets of problems related to the defeasibility of the criteria of identification (...) of a legal system. We also provide a formalization of some options regarding defeasible criteria of identification, which can be used as a tool for meta-jurisprudential analysis. Finally, the thesis according to which defeasibility is better conceived of as a feature of legal application is examined and questioned. (shrink)

This paper first uncovers the subtle spiritual narcissism that has characterized historical approaches to religious diversity and discusses the shortcomings of the main forms of religious pluralism that have been proposed as its antidote: ecumenical, soteriological, postmodern, and metaphysical. It then argues that a participatory pluralism paves the way for an appreciation of religious diversity that eschews the dogmatism and competitiveness involved in privileging any particular tradition over the rest without falling into cultural-linguistic or naturalistic reductionisms. Discussion includes the question (...) of the validity of spiritual truths and the development of a participatory critical theory of religion. The essay concludes with an exploration of different scenarios for the future of religion– global religion, mutual transformation, interspiritual wisdom, and spirituality without religion–and proposes that such a future may be shaped by spiritually individuated persons engaged in processes of cosmological hybridization in the context of a common spiritual family. A participatory approach to spirituality turns the problem of religious plurality into a celebration of the critical spirit of pluralism. (shrink)

This paper critically examines Ken Wilber's transpersonal evolutionary theory in the context of the philosophical discourse of postmodernity. The critique focuses on Wilber's refutation of non?absolutist and non?universalist approaches to rationality, truth, and morality?such as cultural relativism, pluralism, constructivism or perspectivism?under the charges of being epistemologically self?refuting and morally pernicious. First, it is suggested that Wilber offers a faulty dichotomy between his absolutist?universalist metanarrative and a self?contradictory and pernicious vulgar relativism. Second, it is shown that Wilber's arguments for the self?refuting (...) and pernicious nature of other non?absolutist approaches are both fallacious and distorting. Finally, the problematic consequences of absolutist discourse for academic and cross?cultural dialogue are pinpointed. Taking Wilber's treatment of Nagarjuna's thinking as a paradigmatic example, it is suggested that absolutist thinking both usually leads to ?bad? hermeneutics, and potentially hinders genuine dialogue among people and traditions holding different world views. Esta investigación pretende aportar datos para determinar en qué medida el feedback influye en el rendimiento académico.Se ha realizado una experimentación con estudiantes universitarios de los grados de marketing y de educación física. Se ha dividido la muestra en tres grupos en función del tipo de información -feedback- que se les proporcionaba.Los resultados muestran que hay correlación entre la información facilitada y los resultados obtenidos. El rendimiento mejora en función de la información cuando ésta es correcta. Does the law contain implicit exceptions to its own rules? If so, what consequence does that have for understanding the relationship between law and morality? This collection gathers leading legal philosophers to analyse the logical structure of legal norms, advancing the understanding of the general philosophy of law.

This paper discusses the semiotic dimension of patent interpretation. Patent documents are at the same time disclosure of information and a granting of rights. The claim section expresses the granted rights. In this paper, we view the claims as signs that express the granted rights. The semantics to interpret the signs is given by the all-elements rule, as pragmatics. The description and drawings sections of the patent document provide metapragmatics in the form of lexicon and syntax to help the understanding (...) the claims as signs that express the granted rights. This semiotic approach for patent interpretation has important practical consequences to the correct structuring of a patent document. We highlight this contribution through an instance of a patent application in which a claim includes examples of use. Examples are not allowed in the claim text, as examples do not describe the invention, but consist of metapragmatics to better understand the invention. In this way, examples consist of metapragmatics and belong to the description section of the patent, which has the goal to facilitate the understanding of claims. In the patent application used to highlight our semiotics approach for patent interpretation, the examples initially presented in the claims were rephrased in the final granted patent, significantly reducing the scope of the claim. On souhaiterait aborder dans ce livre la question souvent oubliée des effets que l'oeuvre de Jean-Marie Guyau a continué à produire après sa mort prématurée, en 1888. Certains penseurs se sont présentés eux-mêmes comme des continuateurs de son oeuvre, mais, la plupart du temps, l'influence de Guyau s'est exercée dans de telles conditions que ceux qui l'ont reçue n'ont pas assumé le statut de disciples.

Il n'est pas fruit du hasard cette rencontre qui a précédé l'édition de ce livre. Les rapports entre philosophes français et catalans viennent de loin. Le XIXe était modèle des "voyages philosophiques". Est parmi les plus connus celui de Cousin en Allemagne. Moins connus, mais également fructifères étaient ceux des philosophes exilés qui partirent sous les régimes de persécutions pour trouver en France non seulement un lieu d'accueil, mais également l'opportunité de confrontation de leurs idées avec celles des philosophes français. (...) De la même manière, certains exilés de la commune avaient trouvé un lieu d'accueil dans la Barcelone révolutionnaire des années républicaines. "Das Buch der Ursachen" und seine Rezeption fin Mittelalter. Mainz, Dieterich'sche Verlagsbuchhandlung, 2001, donde se ofrece una nueva edición del texto latino presentado en su día por Adriaan Pattin revisándolo teniendo en cuenta las importantes sugerencias del arabista Richard Taylor . Éstas, a su vez, resultan, en su mayoría. del cotejo del (...) importante manuscrito latino de Aosta, Seminario Maggiore. Ai° D 20.Como las dos recientes traducciones castellanas del Liber de cau sis tan sólo tienen en cuenta el texto de Pattin, y parecen desconocer las propuestas de Taylon hemos creído conveniente publicar esta tercera traducción, señalando los cambios más importantes respecto a la edición de Pattin siempre y cuando éstos afecten a la traducción. Además, hay que advertir que ambas traducciones dividen el texto del Liber en 219 sentencias; sin embargo. esta división es una ficción editora introducida por Celsao Pera en su edición de la Sancti Thomae de Aquino In Librum de causis expositio, Roma. 1955, que no tiene ningún fundamento en los manuscritos. A pesar de que esta división pueda parecer "pedagógica", como afirma Cruz Cruz en su traducción citada, p. 26, n. 29, prescindimos de ella, ya que sugiere que el texto sigue una lógica puramente axiomática. mientras que su argumentación es harto más compleja. Con todo, ambas traducciones siguen siendo muy útiles y de alta calidad. y también han sido consultadas con gran provecho para esta versión.El texto latino conduce a una aparente paradoja, ya que constata que la causa sigue su efecto . Se trata aquí de un problema de la traducción latina de Gerardo de Cremona quien vierte el término árabe waliya por sequitur, en vez de "estar junto" o "cerca de". Lo que el texto original quiere expresar, por consiguiente, es que la causa acompaña su efecto, no que ésta le siga. No hace falta, pues, cambiar el pronombre ipsum por ipsam? como ha hecho Pattin, refiriéndolo así a la primera causa. (shrink)

Paul Goodman, 1960’larda modern Amerikan toplumunun organize sistemi içerisinde dönemin gençliğinin sorunlarını ön plana çıkaran ‘Growing Up Absurd: Problems of Youth in the Organized System’ (Saçmayı Büyütmek: Organize Sistemde Gençliğin Problemleri, 1960) eseri ile sosyal bir eleştirmen olarak ön plana çıkmıştır. Amerikalı bir düşünür olan Paul Goodman’ın kısa öyküler, romanlar, şiirler ve makalelerden oluşan çalışmaları, siyaset, sosyal teori, eğitim, kentsel tasarım, edebi eleştiri, hatta psikoterapi gibi geniş bir yelpazeye dağılmıştır. Onun temel argümanı (1960: 9-10) tek bir merkez etrafında örgütlenen teknoloji (...) toplumunun başarısızlıklarını eleştirerek, mevcut düzenin insanın doğasına uygun bir biçimde yeniden inşasını vurgulamaktadır. Goodman’ın yeniden inşa süreci içerisinde insan doğasına önem veren faaliyete dayalı anarşist ideolojisi, sorumluluk duygusunun homojen bir şekilde bireyler arasında paylaşılması gerektiğini vurgular. Goodman merkeziyetçi olmayan siyaset anlayışı ile kendisini Amerikan siyasetinin ve kültürünün karşısında yer alan bir pozisyonda konumlandırmaktadır (Honeywell, 2011: 1). Diğer bir deyişle Goodman (1960: 36), anarşist geleneği formüle etmek amacıyla yirminci yüzyıl Amerikası’nın içinde bulunmuş olduğu mevcut durumdan yola çıkarak eleştirilerini ademi merkeziyetçilik, katılımcı demokrasi, özerk toplum temaları üzerine temellendirmiştir. -/- Goodman’a göre, sosyal, kültürel, ahlâk ve eğitim gibi alanlarda uygulanan kurallar günümüz devletlerini etkisi altına alan kapitalist düzen tarafından belirlenmektedir (Bakır, 2016: 110). Bu durum Goodman’ın da içerisinde bulunduğu anarşist düşünürler tarafından kabul edilebilecek bir husus değildir, çünkü anarşistler mevcut düzenin ve sosyal yaşamın otorite ve itaat yapılarıyla güçlendirilen belirli yaklaşımlar ile kontrol altına alınmasını, insanların fikirlerini özgürce ifade edemeyeceği, bir nevi entelektüel bir hapishane içerisinde yaşaması anlamına geleceğinden dolayı karşı çıkmaktadırlar (Sheean, 2003: 122). Aynı nedenlerden dolayı Goodman, modern liberalizm ve Marksizm gibi alternatif radikal ideolojileri yerinden yönetim düşüncesi ve sosyal mühendislik konusundaki eğilimleri dolayısıyla reddetmektedir. Goodman için anarşizm, özgürlük ve toplumsal değişime yeterli düzeyde arka çıkabilecek tek ideolojik çerçeve olarak görülmektedir. Ona göre (2010: 143), “anarşizm ya da daha iyisi, anarko-pasifizm (toplumsal değişim hareketleri içerisinde örgütlü şiddete ve kurumlara karşı çıkan anarşist anlayış) günümüzün gelişmiş toplumlarının bürokrasilerini, karar verme konusunda aşırı merkezîleşmelerini ve sosyal mühendislik gibi problematik durumlarını ve tehlikelerini tutarlı bir şekilde öngörmüştür”. -/- Siyaset, sosyoloji ve felsefe gibi çeşitli alanlar içerisinde etkili olan anarşist kuramlar, radikal bir söylem olarak eğitimcileri ve araştırmacıları yeni öğretilere ve uygulamalara teşvik etme konusunda itici bir güç oluşturabilmektedirler. Anarşist yaklaşımlardan eğitim kuramı ve araştırmalara yönelik daha belirleyici bir rol alması beklenmektedir, ancak bu yaklaşımlar mevcut radikal akademik görüşü büyük ölçüde etkisi altına alan Marksizm’in eğitim alanında göstermiş olduğu aynı etkiyi gösterememiştir. Anarşist düşünceleri eğitim alanı içerisinde daha etkili ve görünür kılabilmek amacıyla Paul Goodman, Francisco Ferrer ve Alexander Neill’ın ileri sürmüş olduğu çeşitli düşünceler, girişimler ve uygulamalar ortaya çıkmıştır. Bu doğrultuda Goodman’ın anarşizme ilişkin düşünceleri ile bu çalışma sıkı bir anarşizm tahlili, eleştirisi ve felsefesinden öte anarşist anlayışın eğitimdeki uygulanabilirliğine yönelik bir soruşturma içerisine girmekte ve anarşist yaklaşımın mevcut eğitim sistemlerinden hangi yönleriyle farklılaştığını, sonucunda etkili bir eğitim anlayışı ortaya koyup koyamadığını tartışmaktadır. Las directrices anticipadas aún no se encuentran legisladas en todos los estados de la República mexicana. En algunos de los estados en los que sí se encuentran legisladas, se prohíbe expresamente su validez durante el periodo de gestación. Lo anterior representa dilemas bioéticos y jurídicos importantes, los cuales revisamos para esclarecer las diversas interrogantes que surgen en materia de la protección tanto del bebé como de la madre gestante. Concluimos que existe una necesidad de desarrollar una ley federal que homologue (...) las directrices anticipadas, garantizando una muerte digna a todos los mexicanos, y que establezca que en caso de encontrarse en periodo de gestación, se busque asesoría por un comité de bioética que apoye a determinar en cada caso particular, las condiciones que favorezcan el desarrollo y supervivencia del bebé, siempre que sea posible, sin recurrir a tratamientos y/o medidas extraordinarias que pongan el riesgo la muerte digna y libre de sufrimiento de la madre.
