The COVID-19 pandemic has led to the widespread use of online hearings in arbitral proceedings, raising questions about the impact of such proceedings on the determination of facts underlying a dispute. This article explores the extent to which online hearings may hinder arbitrators’ ability to assess witness credibility by drawing upon the cognitive psychology literature on truthfulness determination and lie detection. A survey of the literature suggests that the ability to differentiate truthful from dishonest statements through verbal and nonverbal cues (...) is limited, leading to the notion that observing behaviors like fidgeting, gaze aversion, vocal pitch, or body posture is not particularly relevant in assessing the credibility of a witness. Instead, focusing on the content of what is reported appears to be the most relevant strategy to determine credibility. Therefore, research does not support the idea that face-to-face contact with witnesses is essential to determine the facts of a dispute. Still, the use of in-person hearings may, in practice, continue to be preferred due to underlying cultural assumptions regarding the nature of hearings, the facilitation of communication between parties, counsel, and the tribunal, and a general sense of _Zoom fatigue_. Therapeutic strategies capable of inducing and enhancing prosthesis embodiment are a key point for better adaptation to and acceptance of prosthetic limbs. In this study, we developed a training protocol using an EMG-based human-machine interface that was applied in the preprosthetic rehabilitation phase of people with amputation. This is a case series with the objective of evaluating the induction and enhancement of the embodiment of a virtual prosthesis. Six men and a woman with unilateral transfemoral traumatic amputation without previous use (...) of prostheses participated in the study. Participants performed a training protocol with the EMG-based HMI, composed of six sessions held twice a week, each lasting 30 mins. This system consisted of myoelectric control of the movements of a virtual prosthesis immersed in a 3D virtual environment. Additionally, vibrotactile stimuli were provided on the participant’s back corresponding to the movements performed. Embodiment was investigated from the following set of measurements: skin conductance response, crossmodal congruency effect, ability to control the virtual prosthesis, and reports before and after the training. The increase in the skin conductance response in conditions where the virtual prosthesis was threatened, recalibration of the peripersonal space perception identified by the crossmodal congruency effect, ability to control the virtual prosthesis, and participant reports consistently showed the induction and enhancement of virtual prosthesis embodiment. Therefore, this protocol using EMG-based HMI was shown to be a viable option to achieve and enhance the embodiment of a virtual prosthetic limb. (shrink)

Este artigo pretende discutir a concepção de aparência desenvolvida por Hannah Arendt na obra A Vida do Espírito (1977), tendo em vista a centralidade da questão como elemento inicial da reflexão sobre as atividades do espírito. Inicialmente, o texto discorre sobre parte dos atravessamentos teóricos presentes na interpretação arendtiana da aparência, concentrando-se no conteúdo de referência em Martin Heidegger. Como resultado, ocorre um afastamento realizado pela autora em relação à metafísica tradicional, e tal postura crítica será compreendida a partir do (...) diálogo com Heidegger e Kant. Assim, na sua transversalidade com a faculdade do pensar e com o ser em geral, entende-se que a crítica à metafísica é consequência direta da concepção de aparência proposta pela autora. Por fim, uma breve elucidação metodológica do conteúdo de A Vida do Espírito será apresentada, com o intuito de justificar seu caráter interpretativo baseado no método fenomenológico-hermenêutico aos moldes heideggerianos, em detrimento de uma descrição fenomenológica de inspiração husserliana. The European Union Commission’s whitepaper on Artificial Intelligence proposes shaping the emerging AI market so that it better reflects common European values. It is a master plan that builds upon the EU AI High-Level Expert Group guidelines. This article reviews the masterplan, from a culture cycle perspective, to reflect on its potential clashes with current societal, technical, and methodological constraints. We identify two main obstacles in the implementation of this plan: the lack of a coherent EU vision to drive future (...) decision-making processes at state and local levels and the lack of methods to support a sustainable diffusion of AI in our society. The lack of a coherent vision stems from not considering societal differences across the EU member states. We suggest that these differences may lead to a fractured market and an AI crisis in which different members of the EU will adopt nation-centric strategies to exploit AI, thus preventing the development of a frictionless market as envisaged by the EU. Moreover, the Commission aims at changing the AI development culture proposing a human-centred and safety-first perspective that is not supported by methodological advancements, thus taking the risks of unforeseen social and societal impacts of AI. We discuss potential societal, technical, and methodological gaps that should be filled to avoid the risks of developing AI systems at the expense of society. Our analysis results in the recommendation that the EU regulators and policymakers consider how to complement the EC programme with rules and compensatory mechanisms to avoid market fragmentation due to local and global ambitions. Moreover, regulators should go beyond the human-centred approach establishing a research agenda seeking answers to the technical and methodological open questions regarding the development and assessment of human-AI co-action aiming for a sustainable AI diffusion in the society. One of the initial triggers for the development of the book was the perceived ambiguity of the binomials Design vs. Design Thinking and Innovation vs. Invention. Frequently, designers and innovation consultants are questioned by their clients about the relationships between these kind of concepts. Has the second emerged through the first, or vice-verse? Is one part of the other? Where are the similarities and which are (...) the differences? This conceptual incomprehension makes itself noticeable between many ambiguous concepts in the world of innovation and creativity. What is the difference between Radical and Disruptive Innovation? O trabalho é um exercício de pensamento referente ao lugar da filosofia no currículo do ensino médio. A investigação considera a recente presença da filosofia como disciplina obrigatória em todas as séries da escola média brasileira. Assim, a condição curricular, e o próprio lugar do docente são ainda uma lacuna a ser preenchida. Para essa “atividade” as provocações de Hannah Arendt e de Gilles Deleuze figuram como o solo conceitual da reflexão.O exercício intelectual de Arendt sobre o “vazio de pensamento” (...) e sua rigorosa análise sobre a faculdade de pensar articuladas com as provocações de Deleuze quanto a compreensão da filosofia como uma “produtora” e articuladora de conceitos, ditaram o caminho que sugere ser a filosofia, enquanto “disciplina”, um parar para pensar como forma de contrapor o pensar ao fluxo laboral de consumo de conteúdos da escola média. Aqui a filosofia enquanto disciplina é uma contemplação tão ativa quanto a ação. (shrink)

Brain–machine interfaces combining visual, auditory, and tactile feedback have been previously used to generate embodiment experiences during spinal cord injury rehabilitation. It is not known if adding temperature to these modalities can result in discomfort with embodiment experiences. Here, comfort levels with the embodiment experiences were investigated in an intervention that required a chronic pain SCI patient to generate lower limb motor imagery commands in an immersive environment combining visual, auditory, tactile, and thermal feedback. Assessments were made pre-/ post-, throughout (...) the intervention, and at 7 weeks follow up. Overall, high levels of embodiment in the adapted three-domain scale of embodiment were found throughout the sessions. No significant adverse effects of VR were reported. Although sessions induced only a modest reduction in pain levels, an overall reduction occurred in all pain scales at follow up. A high degree of comfort in the comfort scale for the thermal-tactile sleeve, in both the thermal and tactile feedback components of the sleeve was reported. This study supports the feasibility of combining multimodal stimulation involving visual, auditory, tactile, and thermal feedback to generate embodiment experiences in neurorehabilitation programs. Há duzentos anos (1823) triunfou a contrarrevolução da _Vila-Francada_, pondo fim à primeira experiência constitucional moderna em Portugal. De imediato, D. João VI determinou a revogação da Constituição de 1822, assim como das reformas adotadas para apagar a memória do regime constitucional anterior. Em simultâneo, a partir de uma iniciativa espontânea da Câmara da vila de Sernancelhe, formou-se um movimento municipal para anulação das próprias eleições às Cortes vintistas e revogação das procurações outorgadas aos deputados. Este artigo versa sobre (...) ambas as iniciativas, régia e municipal, considerando sobretudo que a anulação municipal das eleições vintistas é muito pouco conhecida e está praticamente por estudar na historiografia sobre a contrarrevolução. Neste ensaio apresentamos o conceito de vida para o filósofo e médico francês Georges Canguilhem (1904-1995) e, posteriormente, desenvolvemos uma reflexão deste conceito, estabelecendo um paralelo entre a emergência da tecnociência e o transumanismo. Na primeira parte do ensaio, foram selecionados trechos das obras de Canguilhem, O normal e o patológico, O conhecimento da vida e o verbete “vida” escrito para a Encyclopédie Universalis. Sobre o verbete daremos atenção para a quarta interpretação sobre a vida proposta pelo filósofo. Além dos (...) textos escolhidos, utilizaremos artigos de especialistas que aprofundem a filosofia de Georges Canguilhem. Na segunda parte, apresentaremos, de modo geral, o surgimento e as implicações éticas da tecnociência na sociedade contemporânea. Na terceira parte, apresentaremos uma possível origem do transumanismo e o instigante e complexo debate em torno deste movimento. Neste tópico apresentaremos as contribuições de filósofos alinhados ao pensamento de Canguilhem e filósofos que refletem sobre o movimento transhumanista, tais como João de Fernandes Teixeira, Natasha Vita-More e Nick Bostrom. Na conclusão, apresentaremos a relevância do diálogo entre as áreas do conhecimento como a filosofia, ciências da vida e tecnologia para compreendermos os meandros da sociedade contemporânea.Palavras chave: Georges Canguilhem; vida; tecnociência; transhumanismo. The personal is not political, even if politics marks it and, in many cases, determines it. Infrapolitics seeks to understand conditions of existence that are not reducible to political life and that exceed any definition of world bound to political determinations. It seeks to mobilize an exteriority without which politics could only be business or administration, that is, oppression. It demands a change in seeing and an everyday practice that subtracts from political totalization in the name of a new production (...) of desire, of a new emancipation, and of a conception of experience that can breach the general captivation of life. In this book, Alberto Moreiras describes a form of thought aiming to provide content for a form of life and to offer a new theoretical practice for concrete existence. The book provides a genealogy of the notion of infrapolitics and places it within contemporary philosophical reflection, examining its deployment in the wake of postphenomenology and deconstruction, Lacanian analysis, the principle of anarchy, and an egalitarian symbolization of social life. Nietzsche's metaphor of the spider that spins its cobweb expresses his critique of the metaphysical use of language - but it also suggests that ‟we, spiders‟, are able to spin different, life-affirming, healthier, non-metaphysical cobwebs. This book is a collection of 12 essays that focus not only on Nietzsche's critique of the metaphysical assumptions of language, but also on his effort to use language in a different way, i.e., to create a ‟new language‟. It is from this viewpoint that the (...) book considers such themes as consciousness, the self, metaphor, instinct, affectivity, style, morality, truth, and knowledge. O presente artigo abordará a construção do conhecimento em Giambattista Vico embasando-se no discurso De Nostri Temporis Studiorum. Com a troca da “imaginação” pela “racionalidade”, colocou-se de lado a engenhosidade humana, anulando assim a verossimilhança que fora negada por não apresentar verdades factuais levando à atrofia do engenho. O intuito aqui é analisar o desenvolvimento imaginativo proposto por Vico, gerando uma nova crítica. Conclui-se sobre uma possível epistemologia das humanidades, na qual cada sujeito possa, com seus próprios instrumentos, desenvolver um (...) conhecimento menos “dogmático” e mais humano, partindo de um solo estável, qual seja, a história. In this paper, we intend to discuss how, according to Peirce’s semiotics, gestures can be conceptualized and described as diagrams. We are not concerned with answering when, why or how gestures emerged as semiotic motor activities. As a prerequisite for the very formulation of these problems, we are rather interested in discussing the theoretical conditions which should be fulflled for gestures to be characterized as iconic processes - and more specifcally as diagrammatic processes. The frst step is to summarize a (...) systematic analysis of the variety of iconic signs, elaborated by Peirce, followed by his typology of hypoicons in order to describe the hypoiconic class of diagrams. After that, we present some tentative answers to the question of how to describe gestures as diagrammatic signs. (shrink)

This Open Access book addresses the epistemological and ontological significance as well as the scope of new mechanism. In particular, this book addresses the issues of what is "new" about new mechanism, the epistemological and ontological reasons underlying the adoption of mechanistic instead of other modelling strategies as well as the possibility of mechanistic explanation to accommodate a non-trivial notion of emergence. Arguably, new mechanism has been particularly successful in making sense of scientific practice in the molecular life sciences. But (...) what about other sciences? O trabalho analisa, por meio da cobertura do diário A Tarde, de Salvador, a convivência entre a delegação alemã de futebol e a população local de Santa Cruz Cabrália, no sul da Bahia, que serviu de base para a seleção que conquistou a Copa do Mundo de futebol em 2014. A partir dos critérios de identidade cultural, globalização e seleção jornalística, mostra que a estratégia de aproximação com os moradores marcou a cobertura de A Tarde e criou um clima simpático (...) à seleção alemã. O objetivo deste trabalho é a analisar a utilização e impacto das fake news nos últimos anos da vida política brasileira enquanto propulsão ao esvaziamento do pensamento e uma zona de anomia entre democracia e totalitarismo que captura e sacraliza a vida biológica humana ao mesmo tempo que a abandona, reconhecida como estado de exceção permanente. Para tanto, abordamos as obras de Hannah Arendt e Giorgio Agamben, bem como analisamos fenomenologicamente algumas das fake news mais divulgadas entre a população brasileira (...) no período das eleições presidenciais de 2018. Por fim, entendemos que a verdade factual, resguardada pelas humanidades e transmitida pela mídia é capaz de levar a população novamente à percepção da realidade e ao resgate do sentido da política pela ação. Tradicionalmente, ‘fatalismo’ é compreendido como uma doutrina que ensina a rigidez de um fado que anula o poder das ações humanas. Essa acepção de fatalismo não é, contudo, corroborada por Nietzsche. O autor, entretanto, não abandona o termo e passa a compreendê-lo num sentido subvertido. Levando isso em conta, os objetivos de nosso trabalho consistem em: 1) examinar de que forma Nietzsche compreende o termo ‘fatalismo’ em alguns momentos de sua obra; 2) tentar mostrar que as acepções de fatalismo nesses (...) momentos possuem correspondência conceitual; 3) tentar entender a noção de fatalismo à luz da cosmologia nietzschiana. Cause-related marketing has risen to become a popular strategy to increase business value through profit-motivated giving. Despite the growing number of articles published in the last decade, no comprehensive analysis of the most discussed constructs of cause-related marketing is available. This paper uses an advanced Text Mining methodology to conduct a comprehensive analysis of 246 articles published in 40 different journals between 1988 and 2013 on the subject of cause-related marketing. Text Mining also allows quantitative analyses to be performed on (...) the literature. For instance, it is shown that the most prominent long-term topics discussed since 1988 on the subject are “brand-cause fit”, “law and Ethics”, and “corporate and social identification”, while the most actively discussed topic presently is “sectors raising social taboos and moral debates”. The paper has two goals: first, it introduces the technique of CTM to the Marketing area, illustrating how Text Mining may guide, simplify, and enhance review processes while providing objective building blocks to be used in a review; second, it applies CTM to the C-RM field, uncovering and summarizing the most discussed topics. Mining text, however, is not aimed at replacing all subjective decisions that must be taken as part of literature review methodologies. (shrink)

This paper tries to disclose the abstract manner in which orthodox theories of ‘welfare’ conceive of social values and the consequences of such subjective treatment of values for theory itself and for praxis. The interest here resides particularly in the demonstration that the abstract articulation of social values stems from the admission of determinate ontological tenets, which characterise a profoundly conservative worldview. As the realisation of some of the values considered by orthodox theories of ‘welfare’ demands a truly transformative praxis, (...) it is obstructed a priori. To overcome this continued frustration and finally realise social values, economists reclaim the idea of state intervention. The question then is whether the state has the capacity to radically modify social reality. (shrink)

O jornal Tribuna Criciumense foi o único impresso publicado na cidade de Criciúma no período deste escrito. Fundado em 1955, ele passou por três fases. Na primeira, produziu um discurso anticomunista, mas de maneira um pouco tímida. Na segunda fase, com curta duração, o impresso passou a valorizar a ideologia comunista e, ao mesmo tempo, a defesa do presidente João Goulart. A última fase foi marcada por ataques violentos contra o comunismo, em defesa do golpe civil-militar e da ditadura (...) implantada. Analisar essas fases e como os discursos anticomunista e pró-comunismo reverberaram no jornal se configura no objetivo deste escrito. (shrink)

Latin America has often been represented by images of pre-Columbian artifacts and artwork on book covers and in other printed materials produced by Latin American studies. This article tries to show that there are strong connections between this type of representation and the semantics of Latin America both in everyday English language and in the discourses of the social sciences. First, the author reviews the history of the concept of Latin America in everyday English language, showing how it has been (...) defined as the opposite of a glorified collective self-image of America, in cultural, temporal, and racial terms. Next, chief approaches of Latin American studies (modernization theory, studies of corporatism, and the present-day textbook literature) are examined, focusing on how social scientific discourses have defined Latin America. Before returning to the topic of pre-Columbian representation, the covers of the best-selling present-day textbooks are surveyed to show how these pictorial representations reproduce the cultural and temporal perceptions of otherness already present in the texts, plus a racial perception that is mostly absent in them. The author argues that the pre-Columbian representation reproduces the three aspects of Latin America’s othering in a powerful and synthetic way. Last, the results of the present analysis are evaluated in the light of some contributions to postcolonial theory, visual culture studies and picture theory. (shrink)
