Analysing feminist responses to the (mainstream) media coverage of the sexual assaults of New Year’s Eve 2015 in Cologne, this article shows how a theoretical concept that is used to frame feminist arguments can influence the strength of those arguments. German-speaking media extensively reported on the large number of sexual assaults against women that happened during that night in Cologne. The dominant narrative in those media reports dwells on the circumstance that the arrested suspects all had a refugee or migrant (...) background, which assisted right-wing politics in re-creating a racist stereotype about male refugees and migrants being a threat to western women. Feminist responses to that media discourse insisted that rape culture was a cross-cultural phenomenon and that media as well as political analyses of the assaults need to take into account an understanding of intersectionality. Based on a content analysis of twenty-five feminist texts about the events of ‘Cologne’, I argue that the application of the concept of intersectionality created contradictions and argumentative voids within the – otherwise strong – feminist arguments because it conflated sexist and racist dynamics, which were both present in the context of ‘Cologne’ but not always intersecting. I further argue that these contradictions unintentionally aided the right-wing co-option of feminist demands concerning ‘Cologne’ and I suggest that the theoretical concept of femonationalism is better equipped to analyse events like ‘Cologne’. In this late modern era within which the basic values of life have been reordered (driven by globalisation, the corporate agenda and mass communication technologies), the individual has effectively been reduced to a mere abstraction. It might be argued that the rational, moral and humanistic concept of freedom has, to a great extent, been compromised by a consequent crisis within the intelligentsia. These groups, in particular the gatekeepers of a classical liberal approach to legal scholarship, are caught between the twin (...) evils of increased unreflective populism and pragmatism evident within many law schools and modern legal institutions. Although a contested term, defenders of the ‘socio-legal’ tradition, who place the humanities at the heart of legal research and education, are obliged to restate with increased determination the utility of the liberal arts and literature to the law profession and wider legal community. In a normative environment, law and narrative are inextricably linked and narrative poetry is not only invaluable to explaining the origins and location of the legal tradition, but also elicits a mode of understanding which transcends the boundaries of narrowlydefined legal hermeneutics—which often only addresses issues of an operational nature. French novelist Flaubert claimed “chaque notaire porte en soi les débris d’un poète” (Flaubert in Madame bovary (trans: Wall, G.), Penguin Classics, London, 1960: 269), paraphrased by American civil rights lawyer, Clarence Darrow, as “inside every lawyer is the wreck of a poet” (Lukas in Big trouble: a murder in a small western town sets off a struggle for the soul of America, Simon & Schuster, New York, 1997: 323). In an age of disenchantment, this paper explores the poetic form as an important medium within which to understand the nature and function of law in a society of differentiated individuals. (shrink)

This research focuses on the comparison of Hume ´s essay On Suicide and the letters XXI y XXII present in the third book of Julia or the New Heloise written by Rouseeau, that were published together by an anonymous editor in England in 1783. We will analyse the arguments present in both texts, the different reactions the audience of that time had and the possible common sources between them. On the basis of this study, the second attempt of this (...) paper is to show how the literary style used in these works and common among the 18th century thinkers is related to a particular kind of philosophical reflection upon issues that couldn’t be measured by general rules. This paper investigates the norm of presupposition, as one pervasive type of indirect speech act. It argues against the view that sees presuppositions as an indirect counterpart of the direct speech act of assertion and proposes instead that they are much more similar to the direct speech act of assumption. More concretely, it suggests that the norm that governs presuppositions is not an epistemic or doxastic attitude such as knowledge, justified belief, or mere belief; it's a practical attitude, most plausibly (...) the attitude of rational acceptance. This view has important ramifications well beyond debates in philosophy of language and linguistics. It affects not only our view of which speech act sequences are fine and which are off; it bears on whether presuppositions can function as testimony, whether they can be lies, and whether they are ontologically committal, thus addressing central topics in epistemology, ethics, and metaphysics. Epistemic permissivism is the view that it is possible for two people to rationally hold incompatible attitudes toward some proposition on the basis of one body of evidence. In this paper, I defend a particular version of permissivism – unacknowledged permissivism (UP) – which says that permissivism is true, but that no one can ever rationally believe that she is in a permissive case. I show that counter to what virtually all authors who have discussed UP claim, UP is an (...) attractive view: it is compatible with the intuitive motivations for permissivism and avoids a significant challenge to permissivism: the arbitrariness objection. Bayesian epistemology provides a popular and powerful framework for modeling rational norms on credences, including how rational agents should respond to evidence. The framework is built on the assumption that ideally rational agents have credences, or degrees of belief, that are representable by numbers that obey the axioms of probability. From there, further constraints are proposed regarding which credence assignments are rationally permissible, and how rational agents’ credences should change upon learning new evidence. While the details are hotly disputed, all (...) flavors of Bayesianism purport to give us norms of ideal rationality. This raises the question of how exactly these norms apply to you and me, since perfect compliance with those ideal norms is out of reach for human thinkers. A common response is that Bayesian norms are ideals that human reasoners are supposed to approximate – the closer they come to being ideally rational, the better. To make this claim plausible, we need to make it more precise. In what sense is it better to be closer to ideally rational, and what is an appropriate measure of such closeness? This book reconstructs key aspects of the early career of Descartes from 1618 to 1633; that is, up through the point of his composing his first system of natural philosophy, Le Monde, in 1629-33. It focuses upon the overlapping and intertwined development of Descartes’ projects in physico-mathematics, analytical mathematics, universal method, and, finally, systematic corpuscular-mechanical natural philosophy. The concern is not simply with the conceptual and technical aspects of these projects; but, with Descartes’ agendas within them and his construction and (...) presentation of his intellectual identity in relation to them. Descartes’ technical projects, agendas and senses of identity shifted over time, entangled and displayed great successes and deep failures, as he morphed from a mathematically competent, Jesuit trained graduate in neo-Scholastic Aristotelianism to aspiring prophet of a systematised corpuscular-mechanism, passing through stages of being a committed physico-mathematicus, advocate of a putative ‘universal mathematics’, and projector of a grand methodological dream. In all three dimensions—projects, agendas and identity concerns—the young Descartes struggled and contended, with himself and with real or virtual peers and competitors, hence the title ‘Descartes-Agonistes’. This paper argues that the vitalist monisms of Anne Conway and Margaret Cavendish. Even though Conway is often cited as a proponent of a thoroughgoing ‘spiritualist’ ontology and Cavendish as the advocate of a similarly thoroughgoing materialism, their views turn out to be much closer than they may initially seem. Apart from highlighting the more radical nature of Conway’s position, such a reframing also has the added advantage of bringing the similarities between her own ‘spiritual’ monism and the vitalist ‘materialisms’ (...) of her time into sharper relief. As F. Wunderlich emphasizes, the notion of subtle matter pervaded the natural sciences of the seventeenth and the eighteenth centuries. The chapter provides a brief sketch of Cavendish’s ‘materialism’ and compares it to Conway’s view of created substance, drawing out a number of relevant similarities. It asks what may have motivated Conway and Cavendish to move beyond the materialism-immaterialism divide by ‘spiritualizing’ matter in this way. (shrink)

On Moral Certainty, Justification and Practice presents a view of morality that is inspired by the later Wittgenstein. Hermann explores the ethical implications of Wittgenstein's remarks on doubt, justification, rule-following, certainty and training, offering an alternative to interpretations of Wittgenstein's work that view it as being intrinsically ethical. The book scrutinises cases in which doubt and justification do not make sense, and contrasts certain justificatory demands made by philosophers with the role of moral justification in concrete situations. It offers an (...) account of moral certainty, which is linked to a view of moral competence. Contrary to the views propounded by philosophers who emphasise the importance of moral principles, it is argued that moral agency is first and foremost a matter of having certain capacities. ABSTRACT A new phenomenon in the philosophical discipline, philosophical practice—or counselling—is introduced to the reader through the description of three different approaches to philosophical practice. What is common to these approaches is that an academically trained philosopher philosophises together with a ‘sane’person—the visitor—on questions and problems relevant to the visitor. The essential difference between this and psychological counselling is that philosophers do not use therapeutic methods or make diagnoses. The philosophical practitioner triggers in his dialogue partner a didactic philosophical process, (...) which enables the visitor to become an authentic thinker and eventually to arrive at philosophical answers by her/himself. The effectiveness of the language used in philosophical practice is not so much in applying philosophical ideas or theories as in the philosophical knowledge, skills and attitudes attained by the visitor. This article develops the argument that non-cosmopolitan considerations of justice justify relief of sovereign debt for highly indebted poor states. In particular, the article claims that considerations of national determination warrant some debt-forgiveness in the backdrop of unfair terms of global interaction. In a context of inequality, poor countries cannot generally afford to disregard the costs of ignoring the interests of the wealthiest states. Patterns of unbalanced interaction undermine national self-determination by limiting the poor countries' effective capacity to choose between (...) different policies to achieve development and other worthy goals. In concrete, this article suggests that unequal terms of interaction constrain national self-determination by making of sovereign debt an 'escape mechanism' in the absence of rival alternatives to palliate the effects of underdevelopment and related afflictions, despite the causes of sovereign debt being partly domestic, possibly. Thus, this paper views national self-determination as dependent on the availability of acceptable (non-unbearably burdensome) policy options on the part of states. (shrink)

John Stuart Mill, whose relevance for Nietzsche’s late work has been documented by recent research, is not directly mentioned in On the Genealogy or Morality (1887). This article argues that Mill’s On Liberty (1859) nevertheless played a crucial role in the development of the Genealogy. Following a source-based methodology, three major references demonstrate how Nietzsche used On Liberty as a resource as he initiated and developed his own exploration into the origin of morality. After tracing Nietzsche’s reading of Mill through (...) pencil marks in his copy of On Liberty, I discuss the reappearance of Mill’s motives and terminology as well as the explanatory power of Mill as a source for the respective sections in the Genealogy. It becomes clear to what extent Nietzsche adapts Mill and how he turns Mill’s own weapons against him through skillful transformations. The article concludes that instead of delivering the “better” Mill, Nietzsche builds up a fruitful tension between a then-common take on morality and its transgression. (shrink)

We survive a period of relentless stress, perhaps because we are in a war zone and witness or commit atrocities. Raised by parents who are alcoholic or mentally ill, we endure traumatic experiences on a daily basis. Or, we are ignored, neglected, or treated as playthings by narcissistic parents, who themselves were ignored and neglected, and on and on through generations. To survive these experiences, perhaps we (...) dissociate. This can take various forms. Elinor Mason has provided an account of blame and blameworthiness that is pluralistic. There are, broadly speaking, three ways in which we aptly blame -- and ordinary sense, directed at those with poor quality of the will, and then a detached sense and an extended sense, in which blame is aptly directed towards those without poor quality of the will as it is normally understood. In this essay I explore and critically discuss Mason's account. While I argue that she has (...) identified interesting aspects of the way in which we hold people morally responsible, I disagree with certain features of the account, in particular, that ordinary blame issues in demands and that there is any deep sense in which we can simply decide to take on responsibility. This commentary on Elinor Mason’s _Ways to be Blameworthy_ considers Mason’s proposed reflexivity constraint on ordinary blame- and praiseworthy action. I argue that the reflexivity constraint leaves too many intuitively apt targets of praise and blame out of the reach of those attitudes, and the availability of their detached counterparts does not make up for this. I also suggest that Mason’s case for the constraint is open to question. This gives us reasons to prefer a moral concern account of ordinary (...) or communicative praise- and blameworthiness, an account that does not include a reflexivity constraint. Finally, I argue that the moral concern view has more resources to explain some of the nuances and complexities of our practice of moral judgment than Mason allows—nuances Mason turned to pluralism to capture.
