Prior to any research data collection a proposal outlining methods and protocols is required to undergo ethical scrutiny. The issues surrounding a research ethics review process within sport and exercise science departments are not dissimilar to other subject areas. In particular, the ethical review process may be unclear to the researcher and can either present a difficult and time-consuming challenge or be merely perceived as a tick-box exercise. The aim of this study was to explore and compare research ethics processes (...) and decisions within sport and exercise science departments and institutions across the UK. Participants were asked to provide decisions and justification of those decisions on ten typical sports and exercise science proposals. Results found that all respondents cited evidence of informed consent and subject information sheets, detailed methodology and data protection procedures as highly important across all scenarios. Additionally it was found that similar processes occur regarding research ethical scrutiny and similar decisions are made at the departmental level. However, confidence fluctuates for individuals when reviewing in non-specialist subject areas and qualitative data collected calls for more research ethics training. (shrink)

Kentucky and West Virginia are among the states most severely affected by opioid poisonings and deaths. The legislatures of both states have enacted a broad range of bills intended to address related issues. We present an overview of legislation enacted in 2017 and 2018, along with an approach to analysis of practitioner response to one type of legislation.

This paper uses the proxy evidence of relic inventories and labels to explore the role of relics in medieval Christianity. By means of an examination of their material nature, it argues that their primary characteristics were their fragmentary and often amorphous nature; their lack of intrinsic identification; and their easy portability. By emphasising that relic collecting was a habit that contributed to establishing religious identities and affiliations, the paper clarifies relics' role in relocating knowledge of Christian history into the homes (...) and churches of medieval Europe. Finally, having noted that their dissemination followed established networks of travel and communication, it emphasises that relics rendered the essentials of Christianity tangible and portable. Dieser Umstand kann zweifellos mit dem Ende des Kommunismus in Russland in Verbindung gebracht werden, weil gerade dort „vieles, was [Arendt] über Politik gesagt hat, durch die Ereignisse erhärtet worden ist“. Roman Jakobson, who had left Russia in 1920 and in 1941 took refuge in the USA from the Nazis, was one of the main figures in post war linguistics and structuralism. Two aspects of his work are examined in this article. Firstly, Jakobson purifies his linguistic theory of pragmatic references. Secondly, he develops his own diplomatic mission of mediating between East and West. In this article, I argue that these two aspects did not develop independently from one another. Instead (...) I claim that his theory is designed to slip through the Iron Curtain, while at the same time providing the means to analyse ways of acting politically by using language. This argument is unfolded in two steps, each consisting of two parts. First, I compare the theory of pronominal expressions as developed by Emil Benveniste to Jakobson’s theory of shifters. While Benveniste focuses on the relation of language and its subject using language, Jakobson introduces a model of communication to allow maximal formalisation of language. According to this even the category of person can be freed from its reference to a subject which would be understood as having a place in space and time. Then, Jakobson’s theory of shifters is studied in relation to his analyses of poetry. For this, two examples are chosen: Jakobson’s text on two poems by Russian poet Alexandr Blok, and his text on a poem by Bertold Brecht. In both texts, the theory of shifters—and the alleged purification from pragmatic aspects of language use ensuing from this theory—is challenged by the simple fact that they focus on the pronoun of the first person plural. According to Jakobson, the category of number does not belong to the shifters. Rather, number quantifies participants of the related event. The pronoun ‘we’ is at the same time a shifter and a non-shifter, as it refers to the speech event and the related event. Amy Olberding's book The Wrong of Rudeness is eye-opening and informative, while at the same time difficult to read, especially the first three chapters. To be clear, the difficulty does not lie in the prose or the concepts. The prose is accessible, examples relevant, and argument clear and cogent. My students recently made the comment that the women philosophers we read are clearer writers and provide more relatable examples than the male philosophers. These students would appreciate Olberding's book.Nevertheless, the book (...) is difficult for me personally because of the extreme discomfort experienced upon discovering that people in the United States actually wish death upon each other or purposely take out their... Recent neuroscientific research has caused a paradigm shift in our understanding of the meaning and scope of compassion. Derived from the Latin root compassiō, compassion used to be a religious emotion that implied suffering with the perceived sufferer, whereas now it is examined as a psychological, neuroscientific, neurobiological, and thus natural, phenomenon. The newly arisen research interest in compassion led to the development of secular compassion training programs that follow closely in the footsteps of the “mindfulness revolution.” Whereas the latter (...) has been criticized for its reductionist appropriation of Buddhist thought by the capitalist west, in this paper, I demonstrate that the secularization of compassion is the result of innovative activities by representatives of the Buddhist traditions. I argue that some of the causes for the recent secularization and sciencization can be traced back into the fourteenth century Tibet, namely to the innovative exegetical activities of the scholars of the Tibetan Lojong tradition. I argue that from the perspective of the tradition, the sciencization of compassion resembles a deliberate purposeful “translation” effort that fits into the “two-track approach” of Buddhist propagation. This essay aims to provide a philosophical analysis of the Chinese concept of cheng (sincerity) as a political virtue that could be incorporated to ground a duty of civility in liberal deliberative democracy. It is argued here that the virtue of sincerity is an essential feature of the liberal political culture taken for granted by Rawls in his theory of public reason. Ideal procedures and public discourse are not sufficient to generate civic virtues. The goal of this essay is to (...) show how, in the Chinese conception, the root of civility lies in the virtue of Cheng, which can provide the moral grounding for a duty of civility that is essential to sustaining the stability and overcoming the problem of defection from support of the common good in pluralistic states. ABSTRACT This paper is concerned with the contrast in views between traditional mainstream Chinese philosophy and Western liberal individualism on the importance of the concept of individual rights in social and political thought. The contrast is striking because, whereas individual and political rights have long featured in public discourse in the West, in China, mainstream social and political thought has developed without a notion of individual rights. In search of the significance of this major difference, the paper traces ideas (...) of the self in China through Confucian ethics, and compares the Confucian conception of the self with the deontological liberal conception of the subject as a bearer of rights in the West. Having established that the Chinese way of thinking about the self and about moral agency is in stark contrast to the image of the self as a bearer of rights in the deontological conception, the paper goes on to discuss the inadequacy of the moral individualism of a rights‐based morality and argues for an alternative view of morality which places importance on the intrinsic value of collective goods and on membership in a society. The concept of Eastern Europe was constructed during Enlightenment in order to solidify and purify the idea of Western Europe. The essay proposes that today the notion of Eastern Europe can be reclaimed: although traceable to a specific geographical region, Eastern Europe cannot be reduced to geopolitical and economic categories. It is rather a way of being that Heraclitus traces out with his aphorism “I went in search for myself.” Challenging the dichotomy between the West and the non-West, (...) Eastern Europe provides a vantage point from which we can approach philosophical and political problems in new ways. This paper discusses Eastern Europe as a way of being traceable to a specific place or topos in between the West and its Others. By virtue of fitting neither one of the terms of the usual dichotomy it could provide novel insights into Western or European identity, as well as social and political problems, such as immigration. More precisely, Eastern Europe is an instance of the process of creating the self through the encounter with an other that is not (...) radically other. Such a notion of Eastern Europe is developed from three sources: the Ancient Greek thinker Heraclitus, the Chicana theorist and writer Gloria Anzaldúa, and Merab Mamardashvili, a philosopher from Soviet Georgia. Harmony has become a major challenge for modern governance in the twenty-first century because of the multi-religious, multi-racial and multi-ethnic character of our increasingly globalized societies. Governments all over the world are facing growing pressure to integrate the many diverse elements and subcultures which make up modern pluralistic societies. This book examines the idea of harmony, and its place in politics and governance, both in theory and practice, in Asia, the West and elsewhere. It explores and analyses the meanings, (...) mechanisms, dimensions and methodologies of harmony as a normative political ideal in both Western and Asian philosophical traditions. The book argues that in Western political thought - which sees politics as primarily concerned with resolving social conflicts and protecting individual rights - the concept of harmony has often been neglected. In contrast, since earliest times harmony or ‘he’ has been a profound theme in Confucian thought, and current leaders of many East Asian governments, and the Chinese government, have explicitly declared that the realisation of a harmonious society is their aim. The book also assesses how harmony is pursued, jeopardized or deformed in the real world of politics, based upon empirical analysis of a variety of different cultural, social and political contexts, including: China, Hong Kong, Singapore, Malaysia, Singapore, Vietnam, Denmark, Latin America and the Scandinavian countries. It shows how harmony as an organizing concept can help to promote new thinking in governance, and overcome problems of modern-day governance like distrust, adversarial conflicts, hyper-individualism, coercive state intervention, and free-market alienation. It also discusses the potential problems posed by the pursuit of harmony, in particular in the grave threat of totalitarianism, and considers how these risks could best be mitigated. (shrink)

"The Cage of Nature" focuses on the concept of nature as a way to rethink Japanese and European versions of modernity and the historical tropes that distance "East" from "West." This essay begins by comparing Japanese political philosopher Maruyama Masao and his contemporaries, Max Horkheimer and Theodor Adorno. Both sets of authors define modernity as the moment when humanity overcomes nature, but Maruyama longs for this triumph while Horkheimer and Adorno deplore its consequences. Maruyama insists that Japan has failed (...) to attain the freedom promised by modernity because it remains in the thrall of nature defined in three ways: as Japan's deformed past, as the mark of Japan's tragic difference from "the West," and as Japan's accursed sensuality, shackling it to uncritical bodily pleasures. In short, Maruyama sees Japan as trapped in the cage of nature.My argument is that Maruyama's frustration arises from the trap set by modern historiography, which simultaneously traces the trajectory of modernity from servile Nature to freedom of Spirit and at the same time bases the identity of the non-Western world on its closeness to nature. In other words, nature represents both the past and the East, an impossible dilemma for an Asian nationalist desirous of liberty. By revising our historical narratives to take into account the ways in which Western modernity continued to engage versions of nature, it becomes possible to reposition Japan and "the East" within modernity's history rather than treating them as the Other. Why does a wine glass break when you drop it, whereas a steel goblet does not? The answer may seem obvious: glass, unlike steel, is fragile. This is an explanation in terms of a power or disposition: the glass breaks because it possesses a particular power, namely fragility. Seemingly simple, such intrinsic dispositions or powers have fascinated philosophers for centuries. A power's central task is explaining why a thing changes in the ways that it does, rather than in other ways: (...) powers should explain why an acorn turns into an oak tree, not a sunflower, or why fire burns wood, and wood can catch fire. -/- This volume examines the twists and turns of the fascinating history of a difficult philosophical concept, focusing on the metaphysical sense of "powers"--that is, the powers that are invoked in the explanation of natural changes and activities. Scholars probe the views of thinkers from antiquity to the present day: Anaxagoras, Plato, the Stoics, Abelard, Anselm, Henry of Ghent, Gottfried Wilhelm Leibniz, Margaret Cavendish, Mary Shepherd, Immanuel Kant, Georg Wilhelm Friedrich Hegel, and numerous others. In addition, the volume contains four short reflection essays that examine the concept of powers from the perspective of disciplines other than philosophy, namely history of music, West African religions, history of chemistry, and history of art. -/- The history of philosophy brims with controversies surrounding the concept of power, and these controversies have not diminished--particularly as potentialities or powers see a revival in contemporary analytic metaphysics. Some may doubt whether the question of equality of opportunity applies to women anymore. In most Western countries every career is now, in theory, open to women. Firstly, while this may be true in Western countries, it is not true in others; there are still many careers barred to women outside the West. However, affirmative action is not a remedy where women are barred from given careers, for in such cases the principle of equality of opportunity has been rejected. (...) This article examines Grotius’ lifelong support for Dutch expansion overseas. As noted in other publications of mine, Grotius cooperated closely with the directors of the Dutch East India Company (VOC) in the years 1604–1615. Right up to his arrest for high treason in August 1618, he contributed towards Dutch government discussions about the establishment of a West India Company (WIC). Three years of imprisonment at Loevestein Castle and, following his escape, long years of exile could not weaken his dedication (...) to the cause. His relatives in Holland, in particular his brother Willem de Groot and his brother-in-law Nicolaas van Reigersberch, kept him up-to-date on the fortunes of the VOC and WIC. His expertise on maritime affairs was in high demand. For example, Cardinal Richelieu invited him in November 1626 to become actively involved in the establishment of a French East India Company. As itinerant ideologue of empire, Grotius sought to further his own career and those of his nearest family members, without damaging the interests of the United Provinces. Through Willem de Groot and Nicolaas van Reigersberch, he provided informal advice on Dutch imperial policy to the VOC directors and government officials in The Hague. He was rewarded with the appointment of his brother and his second son, Pieter de Groot, as VOC lawyers (ordinaris advocaten) in 1639 and 1644, respectively. They served as his proxies in diplomatic disputes involving the VOC, the States General and the Portuguese ambassador in autumn 1644, when Pieter and Willem de Groot wrote a defense of VOC claims to the cinnamon-producing areas of Ceylon (modern-day Sri Lanka), liberally citing De Jure Belli ac Pacis. Grotius’ vision of empire hardly changed in the course of 40 years. In his view, the Dutch had gone to the Indies as merchants, not conquerors, and should regulate themselves according to natural law and the law of nations. Thus he contributed to the creation of two political orders, one for Europe and one for the Indies. European diplomatic relations counted for little beyond the Line. VOC and WIC officials could act as judges and executioners in their own cause, without reference to indigenous rulers, other colonial powers, or even the political authorities back home. (shrink)

Yet the conventional dating fails to consider the materiality of Ms. BPL 917 in Leiden University Library. By analyzing paper supplies, this article throws new light on the date and manner of the manuscript's composition. The watermarks in the paper, the quire divisions and foliation are considered in combination with relevant textual evidence, such as (...) manuscript references to historical events and any allusions to Ms. BPL 917 in Grotius’ letters and other archival sources. This approach has yielded unforeseen results. Yes, Grotius wrote out the original text in 1604/05, as a fair copy of a previously existing work. Yet he did not stop there. Entire folio-pages were crossed out in Ms. BPL 917 and new ones inserted in the following sequence:- in, or shortly before, January 1607, Grotius deleted f. 63v and 67r and inserted f. 64–66- between January 1607 and Nov–Dec. 1608, he deleted f. 7v, 19r, 38v, and 43r-v and inserted f. 8–9, 18, and 39–42- in November–December 1608, he deleted f. 119r–122r and inserted f. 117–118.These revisions were a direct response to the challenges faced by the Dutch East India Company in this period. Its growing empire in Southeast Asia was under threat from the peace and truce negotiations between the States General and Philip III of Spain and Portugal. Grotius’ revisions of Ms. BPL 917, along with chapter twelve's appearance as Mare Liberum in April 1609, justified the continuation of Dutch empire-building in the East Indies, the Twelve Years’ Truce notwithstanding. Grotius’ rights and contract theories made it perfectly acceptable to conclude a peace or truce in Europe, yet persist in colonial warfare beyond the Line . It is questionable whether counterfeiting in many areas of life contributes to unethical behavior to a wider extent. If the notion is supported by data, then the moral damage in a society could be prevented by reducing the counterfeit self and behavior to a bare minimum. This study aimed at empirically testing the measurement model of counterfeit self of Wood et al. (2008) among Indonesians as well as theoretically reviewing counterfeit self roles in unethical behavior. The participants of this study (...) were 1,655 high school students (764 males, 891 females; Mage = 15.76 years old; SDage = 1.08 years) recruited through a purposive sampling technique in North Sumatera and West Kalimantan, Indonesia. The data analysis technique used was Confirmatory Factor Analysis. The results showed that the counterfeit self model--comprised of counterfeit self dimensions, namely Self-alienation (ALIEN), Inauthentic Living (LIVE), and Accepting External Influence (EXT)--was supported by the empirical data. However, the dimension of EXT could not be represented by its indicators. The study contributed to the psychological body of knowledge that the EXT dimension might need to be excluded from the measurement of counterfeit self on teenagers, especially in Indonesia and other Eastern countries. This paper investigates the norm of presupposition, as one pervasive type of indirect speech act. It argues against the view that sees presuppositions as an indirect counterpart of the direct speech act of assertion and proposes instead that they are much more similar to the direct speech act of assumption. More concretely, it suggests that the norm that governs presuppositions is not an epistemic or doxastic attitude such as knowledge, justified belief, or mere belief; it's a practical attitude, most plausibly (...) the attitude of rational acceptance. This view has important ramifications well beyond debates in philosophy of language and linguistics. It affects not only our view of which speech act sequences are fine and which are off; it bears on whether presuppositions can function as testimony, whether they can be lies, and whether they are ontologically committal, thus addressing central topics in epistemology, ethics, and metaphysics. Epistemic permissivism is the view that it is possible for two people to rationally hold incompatible attitudes toward some proposition on the basis of one body of evidence. In this paper, I defend a particular version of permissivism – unacknowledged permissivism (UP) – which says that permissivism is true, but that no one can ever rationally believe that she is in a permissive case. I show that counter to what virtually all authors who have discussed UP claim, UP is an (...) attractive view: it is compatible with the intuitive motivations for permissivism and avoids a significant challenge to permissivism: the arbitrariness objection. Bayesian epistemology provides a popular and powerful framework for modeling rational norms on credences, including how rational agents should respond to evidence. The framework is built on the assumption that ideally rational agents have credences, or degrees of belief, that are representable by numbers that obey the axioms of probability. From there, further constraints are proposed regarding which credence assignments are rationally permissible, and how rational agents’ credences should change upon learning new evidence. While the details are hotly disputed, all (...) flavors of Bayesianism purport to give us norms of ideal rationality. This raises the question of how exactly these norms apply to you and me, since perfect compliance with those ideal norms is out of reach for human thinkers. A common response is that Bayesian norms are ideals that human reasoners are supposed to approximate – the closer they come to being ideally rational, the better. To make this claim plausible, we need to make it more precise. In what sense is it better to be closer to ideally rational, and what is an appropriate measure of such closeness? On Moral Certainty, Justification and Practice presents a view of morality that is inspired by the later Wittgenstein. Hermann explores the ethical implications of Wittgenstein's remarks on doubt, justification, rule-following, certainty and training, offering an alternative to interpretations of Wittgenstein's work that view it as being intrinsically ethical. The book scrutinises cases in which doubt and justification do not make sense, and contrasts certain justificatory demands made by philosophers with the role of moral justification in concrete situations.
