This paper will examine the recent Human Fertilisation and Embryology Authority public consultation on sex selection. It will review the current regulation on sex selection in the United Kingdom and critically examine the outcomes of the HFEA consultation. The paper will argue that the current ban on embryo sex selection for social reasons and a proposed ban on sperm selection are not justified. There is no evidence for sex selection causing an increase in sex discrimination; creating a slippery slope towards (...) selection for other non-disease characteristics; or promoting a consumerist attitude towards children. The HFEA recommendations to prohibit social sex selection techniques rely upon an unwarranted concern about the risk of the procedures used. Reproductive technologies should be made available to people unless a substantial risk of harm—to the child, the parents or to society—can be identified. There is no such evidence of harm in this case. (shrink)

To advance a successful reading of Kant's theory of motivation, his interpreter must have a carefully developed position on the relation between our rational and sensible capacities of mind. Unfortunately, many of Kant's commentators hold an untenably dualistic conception, understanding reason and sensibility to be necessarily conflicting aspects of human nature that saddle Kant with a rigoristic and fundamentally divided moral psychology. Against these interpreters, I argue for a reading that maintains a unified conception, claiming that we must think of (...) reason and sensibility as interdependent capacities, which stand to one another as form to matter. Our sensible nature thus does not stand opposed to reason; its fundamental character is determined by reason's activity. I take Kant's account of moral motivation and the feeling of respect to represent the lynchpin of this unified account. Against interpreters who would emphasize either the intellectual or affective nature of respect, I claim that it should be understood as the formal element of moral sensibility, the result of practical reason determining the capacity to feel and fundamentally transforming its character. To make this argument, I draw on Kant's account of sensibility in the Critique of Pure Reason, claiming that space, time, and respect for the moral law are analogous formal elements of sensibility. Immanuel Kant’s notion of weakness or frailty warrants more attention, for it reveals much about his theory of motivation and general metaphysics of mind. As the first and least severe of the three grades of evil, frailty captures those cases where an agent fails to act on their avowed recognition that the moral law is the only legitimate determining ground of the will. The possibility of such cases raises many important questions that have yet to be settled by interpreters. Most (...) importantly, should we account for the failures of weakness by appealing to the activity of reason or sensibility? I will discuss this question in light of a tendency to adopt an overly dualistic reading of Kant’s moral psychology. Focusing on Kant’s remarks on weakness from the Religion and the Metaphysics of Morals, I argue that we should understand weakness as arising from the unique difficulties of sense-dependent judgment, rather than from self-deception, flagging commitment, or overwhelming desire. The resulting account offers a unified moral psychology capable of accommodating the many features of weakness that are difficult to reconcile on other readings. (shrink)

Making sense of Kant’s claim that it is morally necessary for us to believe in the immortal soul is a historically fraught issue. Commentators typically reject it, or take one of two paths: they either restrict belief in the immortal soul to our subjective psychology, draining it of any substantive rational grounding; or make it out to be a rational necessity that morally interested beings must accept on pain of contradiction. Against these interpreters, I argue that on Kant’s view, belief (...) in our immortality is necessary because it further determines and enriches the cognitive content contained in the concept of the highest good. Through this sharpened conceptual content, we acquire the resources to withstand theoretical skepticism about our moral vocation. (shrink)

This essay seeks to understand the complex response to the current Black Lives Matter protests against police violence, which pose deeper questions about the forms of politics that black citizens—who are experiencing a defining moment of racial terror in the United States in the twenty-first century—can and should pursue. When other citizens and state institutions betray a lack of care and concern for black suffering, which in turn makes it impossible for those wrongs to be redressed, is it fair to (...) ask blacks to enact “appropriate” democratic politics? These questions are explored via a reading of Danielle Allen and Ralph Ellison’s meditations on the problem of democratic loss and Hannah Arendt’s critique of school desegregation battles in the 1960s. I suggest that there is a conceptual trap in romantic historical narratives of black activism (especially the civil rights movement) that recast peaceful acquiescence to loss as a form of democratic exemplarity. The two vegetative cell types of the acellular slime mould Physarum polycephalum ‐ amoebae and plasmodia ‐ differ greatly in cellular organisation and behaviour as a result of differences in gene expression. The development of uninucleate amoebae into multinucleate, syncytial plasmodia is under the control of the mating‐type locus matA, which is a complex, multi‐functional locus. A key period during plasmodium development is the extended cell cycle, which occurs in the developing uninucleate cell. During this long cell cycle, many of (...) the changes in cellular organisation that accompany development into the multinucleate stage are initiated including, for example, alterations in microtubule organisation. Genes have been identified that show cell‐type specific expression in either amoebae or plasmodia and many of these genes alter their pattern of expression during the extended cell cycle. With the introduction of a DNA transformation system for P. polycephalum, it is now possible to investigate the functions of genes in the vegetative cell types and their roles in the cellular reorganisations accompanying development. If human societies are understood as identity groups, then our psychology should include design for the production and detection of credible identity signals. We argue that vocalizations are ideal identity signals because the human auditory system is sensitive to subtle acoustic features; vocal signals are efficient; and speech and song are highly complex, enabling the embedding therein of identity signals.

My focus is the possibility of a unitary account of freedom that respects the major insights of both Kant and Hegel. I use Hegel’s remark from §22 in the Introduction to the Rechtsphilosophie as my central text. The argument unfolds over three parts: first, I use the passage to unpack key aspects of Hegel’s view of freedom, including its self-generating nature; second, I show how the passage can be read as a criticism of Kant; and third, I reposition Kant’s view (...) to elude this criticism. I conclude by suggesting that Hegel’s remark from §22 is better read as a criticism of empiricism that Kant would also endorse. Any significant differences between their respective accounts of freedom will thus lie further downstream from this broader unity. (shrink)

Solidarity-the reciprocal relations of trust and obligation between citizens that are essential for a thriving polity-is a basic goal of all political communities. Yet it is extremely difficult to achieve, especially in multiracial societies. In an era of increasing global migration and democratization, that issue is more pressing than perhaps ever before. In the past few decades, racial diversity and the problems of justice that often accompany it have risen dramatically throughout the world. It features prominently nearly everywhere: from the (...) United States, where it has been a perennial social and political problem, to Europe, which has experienced an unprecedented influx of Muslim and African immigrants, to Latin America, where the rise of vocal black and indigenous movements has brought the question to the fore. Political theorists have long wrestled with the topic of political solidarity, but they have not had much to say about the impact of race on such solidarity, except to claim that what is necessary is to move beyond race. The prevailing approach has been: How can a multicultural and multiracial polity, with all of the different allegiances inherent in it, be transformed into a unified, liberal one? Juliet Hooker flips this question around. In multiracial and multicultural societies, she argues, the practice of political solidarity has been indelibly shaped by the social fact of race. The starting point should thus be the existence of racialized solidarity itself: How can we create political solidarity when racial and cultural diversity are more or less permanent? Unlike the tendency to claim that the best way to deal with the problem of racism is to abandon the concept of race altogether, Hooker stresses the importance of coming to terms with racial injustice, and explores the role that it plays in both the United States and Latin America. Coming to terms with the lasting power of racial identity, she contends, is the starting point for any political project attempting to achieve solidarity. (shrink)

The rapid growth of Uber and analogous platform companies has led to considerable scholarly interest in the phenomenon of platform labor. Scholars have taken two main approaches to explaining outcomes for platform work—precarity, which focuses on employment classification and insecure labor, and technological control via algorithms. Both predict that workers will have relatively common experiences. On the basis of 112 in-depth interviews with workers on seven platforms (Airbnb, TaskRabbit, Turo, Uber, Lyft, Postmates, and Favor) we find heterogeneity of experiences across (...) and within platforms. We argue that because platform labor is weakly institutionalized, worker satisfaction, autonomy, and earnings vary significantly across and within platforms, suggesting dominant interpretations are insufficient. We find that the extent to which workers are dependent on platform income to pay basic expenses rather than working for supplemental income explains the variation in outcomes, with supplemental earners being more satisfied and higher-earning. This suggests platforms are free-riding on conventional employers. We also find that platforms are hierarchically ordered, in terms of what providers can earn, conditions of work, and their ability to produce satisfied workers. Our findings suggest the need for a new analytic approach to platforms, which emphasizes labor force diversity, connections to conventional labor markets, and worker dependence. (shrink)

Cult Criminals is a set of early Victorian novels 'sensationally' popular with readers and of immense influence in the development of the novel form. All six novels, commonly labelled 'Newgate' novels, scandalized the Victorians by glamorizing criminals and led to a bitter literary controversy between Dickens and Thackeray, who damned the former's Oliver Twist as a 'Newgate' novel. At the heart of the 'Newgate' debate lay questions concerning the moral and social function of the novel, the relationship between romance and (...) realism in fiction, and whether crime should be portrayed in fiction at all. The Newgate novels function as a bridge between the eighteenth- century tradition of crime fiction and the detective and crime novels of the nineteenth and twentieth centuries, as well as encapsulating many of the social and cultural shifts that took place in the early Victorian period. To resume, then, the need for a written Law specifically prohibiting Genocide. (1) It should by now be evident that “the pleasure principle” needs its ethical mandate, beyond the “reality principle” of a social field that can no longer be considered homeostatic and nonconflictual. The fantasmatic character of human pleasure must not only be accounted for in any ethic today, it must take primacy. Fantasy formations grow ever central in our lives; fantasy is the support of our “reality.” (2) The (...) writing of such a Law would permit the enunciation of positively negative content, thereby reframing the Other as lacking; and it would also provide a way for the increasingly stateless “citizens” of the postmodern, “global” community, to be asked to decide on the necessarily paired alternatives (Good and Evil, to kill or to love) which have once again become the starkest of possibilities for them. Only this kind of decision — which is not that of the vel — suffers resistance to the will of the people when it is a malignant will-to- jouissance. (shrink)

In recent years much has been said about how new democracies are backsliding or have regressed since the turn of the century when hope and optimism about the future spread of democracy was widespread. However, ideas that democracy would spread were based on institutional and governance indicators rather than from the perspective of everyday citizens. When we look at public attitudes towards democracy during this period, we can see that such optimism was perhaps misplaced or premature. Drawing on findings from (...) the AsiaBarometer and the World Values Survey, this research finds that public attitudes during this time were not overly convinced by democracy and certainly not yet satisfied with their government's performance in terms of providing basic democratic freedoms and independence. We are witnessing a Europe in turmoil, tormented by the violence of ethnic and nationalist struggles which legitimate themselves in the name of identity. This anthology explores the assumptions of identity by disassembling old myths and fictions of unity in relation to the subject, politics and art. Other than identity offers the possibility of rethinking the concept and introducing instead notions of self and other, identity politics and aesthetics. Through theoretical and concrete examples, this study exemplifies the best of current (...) thinking concerning identity. It marks a new venture in multi-disciplinarity, bringing together writers identified with different discursive fields and visual artists to produce work specifically for this publication. Not only will each chapter be a contribution to particular specialist genres but the collection as a whole will offer new possibilities for rethinking identity. The multifarious approach will appeal to a wide spectrum of disciplines and discourses and to anyone with an interest in what is traditionally identified as culture. (shrink)

My dissertation covers a number of different topics in Kant scholarship, but is driven by one central question: how do our sense-based capacities to perceive, desire, and feel relate to our capacity to reason? I take the answer to this question to be key to understanding much about Kant’s philosophical system. For topics as diverse as the role that sensation plays in practical knowledge, the character of moral motivation, the nature of evil, or Kant’s theory that we are morally required (...) to believe in our immortality and God’s existence, I claim that the correct reading turns on a novel approach to the relation between our rational and sensitive capacities. To properly understand this relation, we must overcome the deeply entrenched thought that Kant inherits his conception of reason from the rationalists, and his conception of sense experience from the empiricists. This would be to adopt a fundamentally dualistic philosophy, on which reason and the senses are independently intelligible and sometimes even diametrically opposed. On Kant’s actual view, our capacities to perceive, feel, and desire are metaphysically interdependent with and thus not intelligible in isolation from our capacity to reason. Developing the details of this more unified position leads to satisfying philosophical accounts of a number of controversial issues in Kant scholarship that have suffered under a dualistic framework. Wittgenstein's treatment of number words and arithmetic in the Tractatus reflects central features of his early conception of philosophy. In rejecting Frege's and Russell's analyses of number, Wittgenstein rejects their respective conceptions of function, object, logical form, generality, sentence, and thought. He, thereby, surrenders their shared ideal of the clarity a Begriffsschrift could bring to philosophy. The development of early analytic philosophy thus evinces far less continuity than some readers of Wittgenstein, from Russell and the Vienna positivists to many contemporary (...) readers of the Tractatus, have supposed. This article provides a novel inroad to the field of process philosophy and its application. It does this by elucidating the relationship between two modes of thought—static and process thinking—as a key to cocreating ecological civilization. Static and process modes of thought are conceptualized in terms of five “basic orientations”: abstract and context, closed and open, isolating and relational, passive and generative, one-dimensional and multidimensional. Inspired by the work of Alfred North Whitehead, Arran Gare, and Julie Nelson, these dynamic dualisms (...) are resolved by nesting static perspectives within process-relational contexts. This article argues that “hegemonic static thinking” is guiding decision-making at root of global crises. While also avoiding “dualistic process thinking,” “encompassing process thinking” that includes and transcends static thinking is posited as a mode of thought conducive to more ecological and community-oriented decision-making across multiple scales. This article establishes the philosophical consistency of this nested “static-process framework,” using it to show how process metaphysics underpins interlinking shifts in worldviews, politics, and economics for moving from industrial to ecological civilization. Kant has little to say about moral frailty or weakness. But for his readers, the topic is a fruitful site of interpretive projection that deserves focus. How we approach it reveals much about Kant’s theory of motivation and his general metaphysics of mind as it relates to the practical philosophy. Prominent views on the subject range from affectivism, which holds that sensible incentives motivate weak action independently of reason’s activity, to intellectualism, which holds that weak actions are ultimately grounded in (...) reason, reflecting the subject’s true maxims. After briefly unpacking two well-known versions of each position, I will argue that neither can succeed. For in both cases, reason and sensibility are too dualistically opposed and insulated from one another to capture Kant’s view. I propose, instead, that we must completely reconsider the relationship between these capacities, and the role that sensible desire plays in light of our ability to reason. The result is a more desirable account of weakness that can both invoke the role that reason plays in determining human action, and appeal to strong sensible desires and their ability to disrupt our practical lives. This collection of previously unpublished essays presents a new approach to the history of analytic philosophy--one that does not assume at the outset a general characterization of the distinguishing elements of the analytic tradition. Drawing together a venerable group of contributors, including John Rawls and Hilary Putnam, this volume explores the historical contexts in which analytic philosophers have worked, revealing multiple discontinuities and misunderstandings as well as a complex interaction between science and philosophical reflection.

I defend Putnam’s modal structuralist view of mathematics but reject his claims that Wittgenstein’s remarks on Dedekind, Cantor, and set theory are verificationist. Putnam’s “realistic realism” showcases the plasticity of our “fitting” words to the world. The applications of this—in philosophy of language, mind, logic, and philosophy of computation—are robust. I defend Wittgenstein’s nonextensionalist understanding of the real numbers, showing how it fits Putnam’s view. Nonextensionalism and extensionalism about the real numbers are mathematically, philosophically, and logically robust, but the two (...) perspectives are often confused with one another. It is now well recognized that the United States is a consumer-driven society. Private consumption comprises a rising fraction of GDP, advertising is proliferating, and consumerism, as an ideology and set of values, is widespread. Not surprisingly, those developments are not confined to adults; they also characterize what some have called “the commercialization of childhood.” Children are more involved than ever in media, celebrity, shopping, brand names, and other consumer practices. At the core of this change is children's growing role (...) as independent consumers. In recent years, children's access to income has risen markedly, and they have gone from being purchasers of cheap plastic goods and a few select food items to being a major market for a diverse set of goods and services, including foodstuffs. Unofficial estimates suggest that children aged four to twelve spent a reported $6.1 billion in purchases from their own money in 1989, $23.4 billion in 1997, and $30 billion in 2002, for a total increase of four hundred percent. eJudicial cooperation is a goal of EU policy. It appears to offer procedural and technical ICT solutions to enhancing EU security. This paper outlines particular dilemmas posed by operationalising ejudicial cooperation within the EU and its member states, and assesses how political weakness is reconfigured as a problem of technical ethics. The application of biometrics and ICT based ejustice potentially bring the EU closer to the citizen without closing the confidence and trust deficit. The paper first outlines three political dilemmas (...) of ejudicial cooperation: political competence, public accountability, and globalisation imperatives. It examines the rationale for introducing biometric IDs, highlighting a general problem of ejudicial cooperation and egovernance which aggravate the trust deficit. Then, it assesses the technical and managerial procedures to ethical practices for quality justice and security to combat the trust deficits which elude open public accountability and compromise trust.
