More has been said about the Hart-Fuller debate than can be considered healthy or productive even within the precious world of jurisprudential scholarship – too much philosophising about how law has revelled in its own abstractness and narrowness. But the mission of this book is distinctly and determinedly different – it is not to rework these already-rehashed ideas, but to reject them entirely. Rather than add to the massive jurisprudential literature that has been generated by all and sundry, the book (...) criticises and abandons the project that Hart and Fuller set in motion. It contends that the turn that was taken in 1957 has led down a series of cul-de-sacs, blind alleys, and dead-ends to nowhere useful or illuminating. It is more than past time to leave their debate behind and strike out in an entirely new and more promising direction. We hope to show that the overall protreptic plan of Aristotle's ethical writings is based on the plan he used in his published work Protrepticus (Exhortation to Philosophy), by highlighting those passages that primarily offer hortatory or protreptic motivation rather than dialectical argumentation and analysis, and by illustrating several ways that Aristotle adapts certain arguments and examples from his Protrepticus. In this essay we confine our attention to the books definitely attributable to the Nicomachean Ethics (thus excluding the common books).

This in-depth study explores the sexual rites of sacred traditions, and shows how religion, mysticism, folklore, and mythology all contain erotic forms in which the deep potentialities of human beings are recognized.

The increasing prevalence of ecologically sustainable products in consumer markets, such as organic produce, are generally assumed to curtail anthropogenic impacts on the environment. Here I intend to present an alternative perspective on sustainable production by interpreting the relationship between recent rises in organic agriculture and greenhouse gas emissions from agricultural production. I construct two time series fixed-effects panel regressions to estimate how increases in organic farmland impact greenhouse gas emissions derived from agricultural production. My analysis finds that the rise (...) of certified organic production in the United States is not correlated with declines in greenhouse gas emissions derived specifically from agricultural production, and on the contrary is associated positively overall agricultural greenhouse gas emissions. To make sense of this finding, I embed my research within the conventionalization thesis. As a result I argue that the recent USDA certification of organic farming has generated a bifurcated organic market, where one form of organic farming works as a sustainable counterforce to conventional agriculture and the other works to increase the economic accessibility of organic farming through weakening practice standards most conducive to reducing agricultural greenhouse gas output. Additionally, I construct my own theoretical framework known as the displacement paradox to further interpret my findings. (shrink)

The Province of Jurisprudence Democratized explores the implications of taking a vigorously democratic approach to issues of traditional legal theory. Allan C. Hutchinson introduces the democratic vision and examines the complementary philosophy of a Dewey-inspired pragmatism. This is followed by an examination from a pragmatic perspective of the dominant theories of analytical jurisprudence in both their positivist and naturalist forms. He emphasizes the contested concepts of 'truth', 'facts' and 'law/morality relation' and explores what a more uncompromising democratic/pragmatic agenda for (...) law and legal theory would entail. The Author's intent is to contribute to the shift away from a technical and elite philosophical approach to jurisprudence to a more democratic engagement. It advances and follows through on the critical claim that there is no position of theoretical or political innocence. Like the law it seeks to illuminate, legal theory must recognize its own political and social setting as well as its own responsibilities. Moreover, whatever else democracy might entail or imply, it opposes elite rule whether by autocrats, functionaries or theorists, however enlightened or principled their proposals or interventions may be: authority must come from below, not above. Friedrich Brunstäd, von Haus aus Philosoph in der Tradition Hegels, galt lange als vergessener Theologe des 20. Jahrhunderts, obwohl er zu Lebzeiten über eine grosse Wirksamkeit verfügte. Die vorliegende Studie entreisst ihn dem Vergessen und verortet ihn grundlegend in der theologisch-philosophischen Landschaft seiner Zeit. Brunstäd arbeitete an einer theologischen Hegel-Rezeption, die die programmatische Weichenstellung des Hegel'schen Ansatzes, die Philosophie der Theologie überzuordnen, bewusst nicht mitvollzog. In seinen sozialethischen Grundüberzeugungen wurde er von Reinhold Seeberg geprägt, den er in der Weimarer Republik (...) als Vordenker des christlich-sozialen Protestantismus beerbte. Brunstäd übte als Mitglied im Hauptvorstand der DNVP zeitweilig auch politisch einigen Einfluss aus. Nach 1933 galt sein Interesse der Wahrung der kirchenpolitischen und theologischen Integrität des Luthertums. Die vorliegende Studie erschliesst zum einen das hohe Reflexionsniveau seiner Hegel-Rezeption, zum anderen zeigt sie anhand seiner Person zentrale Problemstellungen im politischen Weg des deutschen Protestantismus nach 1918 auf.
