This article deals with the problem of justification of war in the light of Leibnizian natural right and deontic definitions. From an analysis of the principles of rationality on which, according to Leibniz, the justification of an act is based, it proposes “deontic types of war” - namely: justifiable wars (whether just or facultative), just wars (defensive war, war of cooperation), facultative wars (preventive war, humanitarian intervention), unjust wars (war of aggression, war of extermination, terrorism) -, which express (...) the modality according to which their agents are constrained to act, namely: authorized, necessarily justified, contingently justified or unjustified to the military action. This modalisation is illustrated by a “war casuistry”, mostly taken from Leibniz’s reflections on the wars of his time. As it will be seen, our hypothesis states that the sufficient reason for a war is at bottom identified with the principle of the best, whose application requires an examination of the consequences of action in different possible scenarios. The right to justification is the central tenet of Rainer Forst's theory of justice: every person has the moral right to receive justification for morally relevant actions. This approach is instructive also from a jurisprudential perspective. One important purpose of the law is to force state authorities to provide justifications for their actions. Therefore, based on the right to legal equality, justification must be provided for any unequal treatment. Likewise, restrictions of fundamental rights in a constitutional state (...) are subject to accountability as well. Binding decisions and judgements must also be justified. Currently, the obligation of argument remains poorly developed on a transnational level. It is therefore important to implement obligations for justification in this context as well. (shrink)

Die Regeln, Institutionen oder Gesetze sind rechtfertigbar, wenn alle betroffenen Personen vor dem Hintergrund ihrer je verschiedenen evaluativen Standards einen hinreichenden Grund haben, sie zu akzeptieren. Das Universalisierbarkeitsprinzip dagegen ist kein normatives Prinzip der politischen Philosophie, (...) sondern ein metaethisches Prinzip. Es besagt (in einer auf moralische Gründe bezogenen Variante), dass wenn es für Person A einen moralischen Grund gibt, x zu tun, es auch für Person B in relevant ähnlichen Umständen einen moralischen Grund gibt, x zu tun. Steven Wall nun hat zu zeigen versucht, dass beide Prinzipien inkompatibel sind. Da das Universalisierbarkeitsprinzip sehr plausibel erscheint, das Prinzip öffentlicher Rechtfertigung dagegen sehr umstritten ist, ist die Unvereinbarkeit der beiden Prinzipien für Wall ein Argument, das Prinzip öffentlicher Rechtfertigung abzulehnen. For the last 30 years there have been debates in philosophy about the concept of rationality. In anglo-american circles they have been primary characterized as discussions about “justified beliefs.” By contrast, the debate in Germany among discourse-theorists (Habermas, Apel) has been linked to the problem of justification of communicative speech-acts (within the concept of the entire communicative situation). Herbert Schnädelbach has modified the discours-theoretical account. His concept can be regarded along a number of dimensions. He has developed a linguistic (...) analysis of the validity claims made in various speech-act situations (following Paul Taylor). In Schnädelbach’s view, normative characterizations of speech acts can be used descriptively, too. Furthermore, the hierarchy of justifications ends on the level of rational choice.My starting point here is: there is a fundamental distinction between justifications in everyday-life and a theoretical level of justification (discoursive justifications). Thus, I discuss the hierarchy of justifications developed by Schnädelbach.Furthermore, I evaluate Schnädelbach’s concept in a semantic perspective. I will show that Schnädelbach’s pragmatical account requires a semantic analysis. Without recourse to such analysis, we cannot understand the universe of normative language. (shrink)

I would like to assume that Reichenbach's distinction of Justification and Discovery lives on, and to seek arguments in his texts that would justify their relevance in this field. The persuasive force of these arguments transcends the contingent circumstances apart from which their genesis and local transmission cannot be made understandable. I shall begin by characterizing the context distinction as employed by Reichenbach in "Experience and Prediction" to differentiate between epistemology and science (1). Following Thomas Nickles and Kevin T. (...) Kelly, one can distinguish two meanings of the context distinction in Reichenbach's work. One meaning, which is primarily to be found in the earlier writings, conceives of scientific discoveries as potential objects of epistemological justification. The other meaning, typical for the later writings, removes scientific discoveries from the possible domain of epistemology. The genesis of both meanings, which demonstrates the complexity of the relationships obtaining between epistemology and science, can be made understandable by appealing to the historical context (2). Both meanings present Reichenbach with the task of establishing the autonomy of epistemology through the justification of induction. Finally, I shall expound this justification and address some of its elements of rationality characterizing philosophy of science(3). (shrink)

Zugleich muss sie den Anspruch des Christentums, dass seine Gehalte von allgemeiner Bedeutung für den Menschen sind, gedanklich entfalten. The historical development of the associated theory of stochastic fairness is described using concepts embodied in the structuralist meta‐theory. The justification of the theory is discussed using an approach derived from J. Rawls.

Mein Beitrag untersucht die folgende Fragestellung: „Kann S gerechtfertigt sein, X zu tun, wobei es erlaubt ist, X zu tun, wenn die Bedingungen B vorliegen, wenn S fälschlich, aber vernünftigerweise glaubt, dass die Bedingungen B vorliegen?“ Ich plädiere für eine Bejahung dieser Frage, und zwar im Gegensatz zu der von Joachim Hruschka in seinem Aufsatz „Justifications and Excuses: A Sy-stematic Approach“ vertretenen Posi-tion. Ich bin der Auffassung, daß eine Rechtfertigung eine vernünftige Annahme voraussetzt; es ist nicht notwendig, daß diese (...) Annahme auch zutrifft. Dass S vernünftigerweise glaubt, daß p, während in Wirklichkeit p nicht vorliegt, scheint jedenfalls kein entschuldigender Umstand zu sein. Diese Situation ist vielmehr wesentlich unterschieden von krankheitsbedingter Zurechnungsunfähigkeit oder sonst verminderter geistiger Fähigkeit. Es ist daher wichtig, zwischen zwei Arten von Gründen zu unterscheiden, die dazu führen, daß eine Person nicht verantwortlich gemacht wird für X, obwohl sie X getan hat; und zwar sind dies einerseits Gründe, die im Hinblick auf Probleme der handelnden Person selbst entschuldigend wirken, und andererseits solche Gründe, die weder einen Mangel noch Verwirrung der handelnden Person selbst reflektieren, noch einen Fehler in dem Entscheidungsprozeß, der zu der Handlung geführt hat. My essay addresses the following question: "Can S be justified in doing X, where it is permissible to do X when conditions C obtain, if S mistakenly but reasonably believes that conditions C do obtain?" I defend an affirmative reply, contrary to the position taken by Prof. Hruschka in his "Justifications and Excuses: A Systematic Approach" . I understand justification as requiring reasonable belief; it is not necessary that the belief be true. That S believes on reasonable grounds that p when in fact p is false seems not to be an excusing condition. It is importantly different from insanity, or diminished capacity. I stress the importance of differentiating between two very different kinds of reasons for holding someone not to be culpable for X despite having done X, viz, reasons that exculpate due to problems with the agent himself and those that do not reflect any deficiency or disorder in the agent, or any flaw in the process by which she chose as she did. With his distinction between the "context of discovery" and the "context of justification", Hans Reichenbach gave the traditional difference between genesis and validity a modern standard formulation. Reichenbach's distinction is one of the well-known ways in which the expression "context" is used in the theory of science. My argument is that Reichenbach's concept is unsuitable and leads to contradictions in the semantic fields of genesis and validity. I would like to demonstrate this by examining the different meanings of Reichenbach's (...) context distinction. My investigation also shows how the difference between genesis and validity precedes Reichenbach's context distinction and indicates approaches for meaningful applications of the concept of context to the phenomena designated by Reichenbach. I will begin by reconstructing the way in which Reichenbach introduces the distinction between discovery and justification as a difference of contexts (I). Drawing on the numerous meanings of the term "context", I will then emphasize some chief characteristics and review, through exemplification, the usage of this term. First of all, I turn to the context of discovery as the nonrational part of all scientific knowledge and show that this meaning cannot be defined consistently (la). For the context of justification, one can distinguish two main cases: the context of justification is either contrasted with the context of discovery, or it forms a unit there with. In the first case, the use of the context term becomes paradoxical, insofar as justification separated from scientific practice does not represent a field of reference which could be specifically contrasted with another field of reference (I b). In the second case, the unifying definitions contradict the contextual meaning of discovery and justification (1 c). In the last section, I point to a useful application of the concept of context which can be found in Reichenbach's argumentation and which refers to the practical conditions of justification(2). In this brilliantly argued book, Sophie Loidolt advances the compelling thesis that these structures of right and justification, broadly construed, not only shape lived experience, but are, as “fundamentale Weisen der Welterschließung,” constitutive of subjectivity itself (p. 1).Loidolt takes as her point of departure the phenomenology of Edmund Husserl and offers a detailed reconstruction of Husserl’s (...) genetic analyses of theoretical evidence and justification found in his later writings, above all Experience and Judgment, as well as a thorough presentation of the main trends in the development of his ethical writings from 1908 to the end of his career. This paper extends my prior analysis of Hegel’s solution to the Pyrrhonian Dilemma of the Criterion to moral philosophy. So doing provides a uniform account of rational justification in non-formal, substantive domains, i.e. empirical knowledge and morals. It argues that the Pyrrhonian Dilemma refutes both foundationalist and coherentist models of justification, and raises serious issues about the justificatory adequacy of contemporary forms of moral constructivism. It explicates and defends Kant’s account of the autonomy of reason as the self-critical (...) regulation of one’s own thought and judgment in view of relevant principles, standards, evidence and alternative analyses. It argues that Kant’s account of autonomy is defensible independently of transcendental idealism and of natural causality. Due to our fallibility and incomplete knowledge and understanding, our individual critical self-assessment requires the constructive mutual criticism of others. Hence maximally rational justification in non-formal, substantive domains is in part, ineliminably, a social and historical phenomenon. These aspects of rational justification are consistent with, and ultimately support, realism about the objects of empirical knowledge and strict objectivity about basic moral principles. One’s own maximally rational justification of non-formal, substantive claims or views accordingly requires recognition of one’s justificatory dependence upon the constructive criticism of others. This requires recognizing their capacities for critical assessment and rational justification. This is the most fundamental form of mutual recognition in Hegel’s analysis. It provides direct and powerful justification for Kant’s thesis that we ought and must respect all others as autonomous rational agents, as agents who can think and act on the basis of justifying reasons. This justification is independent of Kant’s account of ‘dignity’ or the incommensurable value of rational agency. (shrink)

Epistemic warrant for Husserl is closely tied to his phenomenological method and his main philosophical theme: intentionality. By investigating the lived experience of intentional givenness he elaborates what being a justificatory reason amounts to and thereby develops his specific conception of epistemic justification: intuitive fulfillment of a signitive intention which achieves evidence as the experienced, subjectively accessible presence of the “thing itself.” Terminologically, Husserl calls this Ausweisung. The intuitively fulfilled givenness of the intended, its self-givenness, is the ultimate reason (...) for its epistemic justification. For Husserl a “space of reasons” is thus is tied to and made possible only by means of the fundamental accomplishment of intentionality: the conscious presence of the world itself which surpasses the classical epistemological division between inner and outer realm, mind and world. By following Husserl’s development from the Logical Investigations up to his phenomenological version of transcendental idealism, the role of epistemic justification qua demonstration of intuitive fulfillment will be spelled out according to the theses above. In the last part of the paper I will examine Husserl’s position with respect to discussions on justification in the Philosophy of Mind and analytic epistemology. (shrink)

The work of Rainer Forst constitutes the third generation of the Habermasian School. In Das Recht auf Rechtfertigung [The right to justification] (2007) Forst develops a constructivist approach to justice in a serious effort to find a systematic basis for ‘critical theory’. In this article the relevant arguments of this approach are critically analysed. The position developed in the work of Forst appears to be characterized by a fundamental ambiguity because it oscillates between two irreconcilable points. On the (...) one hand Forst seems to admit the necessity of something like the ‘unconditionality of moral law’ presupposing a kind of Kantian transcendentalism beyond constructivism. But on the other hand, he turns back to a more Habermasian constructivist or proceduralist theory. The ambiguity implicit in Forst’s philosophy is that it does not find a compromise between these two approaches to discursive theory so it fluctuates between them, needing the logical support of both poles. The pre-discoursive agreement. Theory of scientific truth and procedural justification. — On basis of the constructive philosophy of science, the attention is focussed to the pre-discoursive elements of discoursive theories of truth. By using a pragmatic approach it is shown that foundation of those pre-discoursive elements, like discourse rules or the basic terminology, is possible though the discourse rules are not available at this level. Propositions which can be shown in the presented theory to be true, always describe a (...) know-how instead of a knowledge about the world. As a result, the relevance of the presented analysis for prototheories of scientific disciplines is investigated. (shrink)

There is a sentence in the Philosophical Investigations where Elizabeth Anscombe has missed an opportunity to distill a whole cloud of philosophy into the choice of one mot juste. Wittgenstein writes: ‘Ein Wort ohne Rechtfertigung gebrauchen, heisst nicht, es zu Unrecht gebrauchen’. Anscombe translates: ‘To use a word without justification does not mean to use it without right.’ The missing of the philosophical opportunity is at the same time a literary lapse. There is nothing in Anscombe’s version to (...) mark the echoing of the ‘Recht’ in ‘Rechtfertigung’ by the ‘recht’ in ‘zu Unrecht.’ My preferred alternative would be: ‘To use a word without justification does not mean to be unjustified in using it’, or: ‘To use a word without a justification does not mean to be unjustified in using it.’. Dieses Verständnis der creatio ex nihilo ermöglicht es, Schöpfung als Rechtfertigung und Rechtfertigung als Schöpfung wahrzunehmen. Nicht nur das Sein des Menschen besteht darin, allein aus Glauben gerechtfertigt zu sein . Vielmehr gilt nicht nur anthropologisch, sondern schöpfungstheologisch und ontologisch umfasssend und durchdringend: mundum iustificari fide.In seiner Identitätssuche verfängt und verkrümmt der Mensch sich jedoch in sich selbst: Er will selbst sein. Diese Ontologie des Selbstseins ist eine Ontologie der Selbstrechtfertigung. Zwischen dieser und der kategorischen Gabe kommt es zum Streit der Rechtfertigungen – in der Dimension der eigenen Lebensgeschichte, der Dimension der Weltgeschichte und der Dimension der Naturgeschichte. I briefly characterize globalization as the new context of contemporary theology in the first part, and go on in the second part to defend its relevance as a radical and total critique of life today in its nihilistic pursuit of creaturely arrogance, greed, and pleasure, and argue for the particular urgency of promoting the love and solidarity of Others beyond (...) the conventional boundaries of identity in a world increasingly suffering from unreconciled pluralism of all sorts, ethnic, religious, cultural, and economic. In the third, longest part I offer a new perspective on the soterioriological significance of „good works“ on the basis of a new relationship between creator and creature, a concrete anthropology of action as mediation between subjectivity and objectivity, and the irreducible involvement of the free and responsible subject in the very believing relationship to God. I try to reinstate „good works“ as the human way, as a free and responsible being, of „participating“ in God’s own redemptive work, not as „cooperating with“ divine grace or as „contributing to“ God’s redeeming work, or as „causing“ one’s own redemption. Ein Ansatz, der auf diesem Gebiet in jüngerer Zeit viel von sich Reden gemacht hat, ist die von Philosophen wie William Alston, Nicholas Wolterstorff, allen voran jedoch von Alvin Plantinga entwickelte sogenannte "Reformierte Erkenntnistheorie". Christian theology conceives of ‘sacrificium intellectus’ to account for the message of Saint Paul that he will “take every thought captive to obey Christ”. Human insight gives way to the revealed truths of religion. In modern western cultures to explain the natural world has become the domain of science, and the imposition of collective rules of how we should live was shifted to democratically elected parliaments. In Germany legislation of bioethical issues is often justified with reasons that violate standards of (...) cognitive rationality. Is this another case of sacrificium intellectus? The Federal Constitutional Court refrains from the control of legislative arguments by conceding a broad margin of appreciation for the legislator. People have, however, a right to justification; they must not be subjected to arbitrary legal power. While the practice of democratic rule may seldom comply with the expectations of ‘government by discussion’, it is neither likely to gain acceptance as ‘government without discussion’. To impose legal force on the basis of false arguments and unsound reasoning is not a legitimate sacrificium intellectus, it is an intellectual scandal. (shrink)

Zunächst wird gezeigt, dass die Befolgung einer Odysseus-Anweisung eine Form des paternalistischen Handelns darstellt und die Frage nach der Verbindlichkeit von Odysseus-Anweisungen daher in diejenige nach der (...) Rechtfertigung paternalistischen Handelns zu überführen ist . Im Folgenden wird als Rechtfertigungsmodell für paternalistisches Handeln ein Zustimmungsmodell verteidigt , dem zufolge eine paternalisierende Maßnahme durch die antizipierte spätere Zustimmung des Patienten zu dieser Maßnahme gerechtfertigt wird . Nach einer Erörterung des Einwandes, dass damit die besonderen normativen Probleme von Odysseus-Anweisungen aus dem Blick geraten , werden abschließend Fälle untersucht, in denen aufgrund eines irreversiblen Kompetenzverlustes keine spätere Zustimmung zur paternalisierenden Maßnahme mehr möglich ist. In diesen Fällen, so die These, ist ein paternalistisches Handeln gegen den aktualen Patientenwillen nicht gerechtfertigt; kommt es hier also zu einem Konflikt zwischen dem in der Vorausverfügung dokumentierten und dem aktualen Patientenwillen, ist letzterer zu respektieren .In the context of medical ethics, the term „Ulysses contract“ denotes an advance directive by means of which a patient binds himself for the future by instructing a doctor to act against his foreseen future preferences. There is some controversy, however, about whether a person’s prior decisions should be regarded as mandatory for the doctor even when they conflict with her present desires. In this contribution, I address the questions whether and under what circumstances Ulysses instructions should be regarded as binding. In Part , I attempt to show that observing a Ulysses instruction means acting paternalistically and that therefore the question whether Ulysses contracts ought to be respected should be transformed into the question how paternalistic action can be justified. Parts and are concerned with the justification of paternalistic action. On the basis of a conception of welfare as being tied to the person’s interests and preferences, I defend a consent-based model of justification . More specifically, I suggest that the patient’s anticipated later consent to a precedent paternalistic action should count as its justification . In what follows, I attempt to rebut the objection that this account does not do justice to the specific normative problems of Ulysses contracts . Finally, I examine cases in which, due to an irreversible loss of competence, a paternalistic action cannot be assented to by the patient. I argue that in these cases, acting against the patient’s present wishes cannot be justified. If in such a case a patient’s present request runs contrary to the past request expressed in the advance directive, the former should be respected. (shrink)

Dennoch gründet Alvin Plantinga sowohl die Parität alltäglicher und wissenschaftlicher gegenüber religiösen Überzeugungen als auch seine gesamte religiöse Epistemologie auf ein Konditional, so dass es an der Zeit zu sein scheint, die Bedeutung von Konditionalen in Argumentationen erneut herauszustellen.Plantinga propagiert eine Parität religiöser und säkularer Überzeugungen auf Grundlage seiner Warrant-Theorie, nach der die Erkenntnisvermögen für die Entstehung wahrer Überzeugungen angemessen operieren müssen. However, Alvin Plantinga establishes the parity between religious and common propositions as well as his whole religious epistemology on a conditional. Therefore, it seems to be about time to reassess the significance of conditionals and reconsider their constraints in argumentation.Based on his warrant theory, Plantinga propagates parity between common scientific and religious propositions: By virtue of properly functioning cognitive faculties true propositions will be produced. Highlighting the fact, that cognitive faculties constitute the functional centre for the production and justification of both religious and common propositions, this paper will establish to what extent the parity can be maintained if the argumentation theory is applied to the status of the cognitive faculties in Plantinga's warrant theory. The assertion of the existence of cognitive faculties for the production of religious propositions is founded by a conditional expression and hypothesis. By way of a perspective from argumentation theory about conditionals, the paper concludes that on one hand in Plantinga's general warrant theory the parity between common and religious propositions cannot be sustained and on the other hand that the part of the warrant theory which deals with philosophy of religion can be considered as unusable for real knowledge. ZusammenfassungDieser Beitrag konzentriert sich auf eine starke und auf eine schwache Seite von Bayers Zugang zu Luthers Theologie. So wird als Stärke angesehen, dass das Thema der Rechtfertigung in Luthers Theologie als allumfassend angesetzt wird. Dagegen besteht eine Schwäche in der Art und Weise, wie Bayer durch Luthers Dialektik der zwei Arten, in denen Gott sich verbirgt – also verborgen »unter dem Gegenteil« und absolut verborgen – hindurch bricht, indem er die beiden trennt und diese Aufteilung als Kriterium verwendet, (...) um zwischen einer Periode, in der Luther die reformatorische Einsicht vollständig ausarbeitet, und einem vor-reformatorischen Luther zu unterscheiden. Diese Luther-Interpretation sollte nochmals überdacht werden, denn sie verneint die Entsprechung und die kontrapunktisch zu verstehende Beziehung zwischen dieser doppelten Verborgenheit im Lichte des »offenbaren Gottes«. Ein ähnliches Problem taucht dann auf, wenn Bayer die Rede vom dreieinigen Gott, die ausschließlich am Evangelium orientiert ist, unterscheidet von einer allgemeinen Art und Weise, von Gott zu reden, die allein auf dem Gesetz basiert. Luthers Vorstellung, dass die Unterscheidung zwischen Gesetz und Evangelium vollständig in Gottes Offenbarung des Evangeliums integriert ist, widerspricht einer solchen Unterscheidung. It finds a strength in the universally implemented theme of justification in Luther's theological thought. A weakness is however found in the way Bayer breaks through Luther's dialectics concerning the dual way God hides himself – i. e. hidden ‘under the opposite’ and absolutely hidden – by separating them and using this division as a criterion to distinguish between the period where Luther had fully worked out the insight of the Reformation and the pre-Reformation Luther. Such an interpretation of Luther needs to be reconsidered because it neglects the correspondence and the contrapuntal relation between this double hiddeness in the light of the ‘revealed God’.A similar problem arises when Bayer divides speaking about the triune God, which is exclusively orientated towards the Gospel, from a general way of speaking about God, which is only based on the Law. Luther's idea that the distinction between Law and Gospel is fully integrated into God's revelation of the Gospel contradicts such a division.This contribution considers not only a distinction between an immature and a mature Luther who has worked out all the implications of the reformation insight unnecessary, but appreciates the young Luther as a theologian who is capable of holding together what the later Luther is in danger of letting fall apart. Fortunately, in Bayer's study there are also openings for a Luther interpretation that includes the positive as well as the negative aspect of both kinds of hiddeness and of Law and Gospel in a single continuous process. This article provides an explication of the concept "imputation". On the one hand, this explication takes account of the common meaning of the concept and its generally intended range of application. On the other hand, it also provides a definition of the meaning of "y is to be imputed to x", which is precise and fruitful . The adequacy of this definition of "imputation" is justified in detail, in the light of the standards for explications. Since the concept "imputation" is (...) a highly complex notion, its explication in turn involves an explication, an analysis, or at least a clarification of each of the many concepts that constitute it: event, event causality, agent , realization, action, agent causality, personhood, knowledge of what one is doing, etc. Competing interpretations of some of these concepts are considered and they are evaluated in comparison to the interpretation here preferred. To the extent possible, a justification is given for the use of the two concepts most central to imputation - causal necessity and realization - since they clearly cannot be understood as "empirical" concepts. The role freedom and volition play for imputation is also explained. Differentiations are drawn between imputation in a general and legal sense, between purely causal imputation and imputation in its full sense, between participatory and non-participatory imputation, and between simple imputation and imputation to a certain extent or degree. If Kant's account of rights had continued the "early modern Natural Law tradition", basing rights on some notion of human flourishing, there would be no difficulty about including socio-economic rights for the needy in his theory. However, his division of moral philosophy into Rechtslehre and Tugendlehre limits Rechtspflichten to duties that a moral agent can be coerced to fulfill. If a state is to give the needy statutory rights, the justification for using coercion on its citizens cannot be that (...) they have a duty of virtue to assist the needy. In order to determine whether such a justification can be found, the one innate socio-economic right Kant admits, a child's right to be cared for and educated, is examined and found to be a right against its parents, not against the state. Kant does, however, hold that a state should establish institutions to provide for abandoned children and for the poor in general. His justification for a state's use of coercion with regard to such statutory rights is considered and a criterion is suggested for the possible consent of its non-virtuous citizens to proposed measures for assistance to the needy. It is suggested that if advocates of aid to the needy cannot justify their proposals by such a criterion they will have to provide a very different account of rights than Kant gives in his Rechtslehre , which is concerned with the moral permissibility of using coercion. Deshalb kann, wenn ein Staat den Bedürftigen durch ein positives Gesetz irgendwelche Rechte auf Hilfe gewährt, die Rechtfertigung der Anwendung von staatlichem Zwang nicht darin gesucht werden, daß die dadurch in Anspruch genommenen Personen die Tugendpflicht haben, die Bedürftigen zu unterstützen. Um festzustellen, ob sich staatlicher Zwang in bezug auf solche Hilfspflichten überhaupt rechtfertigen läßt, erörtert der Beitrag das Recht des Kindes auf Fürsorge und Ausbildung als das eine und einzige angeborene sozio-ökonomische Recht, das Kant akzeptiert. Freilich ist das Recht des Kindes ein Recht gegen seine Eltern und nicht gegen den Staat. Gleichwohl nimmt Kant an, daß der Staat Einrichtungen schaffen sollte, die für verlassene Kinder und für die Armen im allgemeinen zu sorgen haben. Der Beitrag untersucht die Rechtfertigung, die Kant für die Anwendung von staatlichem Zwang zur Durchsetzung solcher positiv-gesetzlicher Rechte gibt, und arbeitet die Gründe dafür heraus, warum der nicht tugendhafte Staatsbürger in die vorgesehenen Hilfsmaßnahmen für die Bedürftigen einwilligen könnte. Wenn sich die Verfechter von Hilfsmaßnahmen für die Bedürftigen außerstande sehen, ihre Vorschläge auf Gründe dieser Art zu stützen, dann werden sie mit einem Konzept von subjektivem Recht aufwarten müssen, das sich von dem Konzept Kants von Recht und Rechtslehre , bei dem es allein um die moralische Erlaubtheit von Zwangsmaßnahmen geht, ganz erheblich unterscheidet. Die wissenschaftlichen Unzulänglichkeiten der Soziologie Paretos sind oft erörtert worden. Ebensooft hat man die politische Bedeutung dieser Soziologie hervorgehoben. In seinem Aufsatz versucht A., wissenschaftliche Unzulänglichkeit und politische Bedeutung wechselseitig zu erklären.Im ersten Teil werden die Hauptthesen der Paretoschen Soziologie zusammengefasst. Der zweite Teil bringt eine Kritik der Paretoschen Soziologie. Die Methode Paretos wird mit der Psychoanalyse und mit der marxistischen Interpretation der Ideologien kurz verglichen und dabei klargelegt, dass Pareto weder die historische Bedeutung noch den psychologischen Ursprung der „dérivations“ (...) zu zeigen vermag. Die Paretosche Theorie des sozialen Ganzen ist durch den Psychologismus und die Verkennung der Geschichte verfälscht. Mit formellen und abstrakten Begriffen wie „hétérogénéité sociale, élite, force, consentement“ vermag man weder die Struktur einer besonderen Gesellschaft noch die verschiedenen Funktionen der Autorität zu kennzeichnen.Im dritten Teil wird Pareto als typischer „polemischer Denker“ gedeutet. Ohne den Rationalismus zu überwinden, kommt er zur Negation aller rationalistischen Behauptungen. Er kennt keinen Fortschritt, die menschliche und die gesellschaftliche Natur bleiben ewig dieselben, der Klassenkampf beruht auf unabänderlichen Gegebenheiten der individuellen und gruppenmässigen Psychologie.Im vierten Teil wird kurz die Soziologie Paretos in ihren Beziehungen zum faschistischen Denken interpretiert. Zynismus, Notwendigkeit einer Religion für das Volk und einer Propaganda, die die irrationalen Kräfte der Massen ausnützt, Machiavellismus der Führer, Rechtfertigung der Elite durch den Erfolg, hoffnungsloser Pessimismus, der die Unmöglichkeit jeder menschlichen Gesellschaft beweist und den Privilegierten ein gutes Gewissen sichert, bilden die Hauptpunkte dieser antiliberalistischen und antimarxistischen Ideologie, die typisch ist für die Periode des Übergangs von der Demokratie zum autoritären Staat. Nach dem Sieg des letzteren wird der metaphysische Schleier nützlicher als der offene Zynismus.The scientific shortcomings of Pareto's sociology have often been discussed, and its political significance noted. In this article, A. attempts to analyze the interrelations between the two.The article begins with a statement of the main theses of Pareto's sociology. In part two, Pareto's method is compared briefly with psychoanalysis and with the Marxist interpretation of ideology, and this comparison reveals that Pareto could show neither the historical significance nor the psychological roots of „derivations“. His theory of the social whole is erroneous because of his psychologism and his misunderstanding of the historical process. Formal, abstract concepts like social heterogeneity, élite, force, and consent, do not permit adequate analysis of the structure of a specific society or of the various functions of authority.Part three studies Pareto as a typical „polemical thinker“. He arrives at a negation of all rationalistic contentions without, however, overcoming rationalism. He does not recognize progress ; the nature of man and society are eternally the same ; the class struggle, for him, rests on unalterable facts of individual and social psychology.The last section is devoted to a brief discussion of the relationship of Pareto’s sociology to Fascist thought. Cynicism, the necessity for religion and for propaganda which will utilize the irrational forces of the masses, Machiavellianism of the leader, justification of the elite through success, a pessimism which insists on the hopelessness of every form of society and salves the conscience of privileged groups — these are the main elements of this anti-liberal, anti-Marxist ideology, typical of the period of transition from democracy to the authoritarian state. After the victory of the latter, the metaphysical veil becomes more useful than open cynicism. (shrink)

Kant is often regarded as an extreme retributivist, but recently commentators emphasize the importance of deterrence in Kant's basic justification of punishment. Kant's combination of deterrence and retributive elements, however, must be distinguished from others that are less plausible. To interpret Kant as merely adding retributive side-constraints to a basic deterrence aim fails to capture fully the retributive strain in Kant's thought. The basic questions are: who should be punished, how much, in what manner, and why? Kant held that (...) all and only the legally guilty ought to be punished, the legally guilty being also morally guilty, except when the legal requirement was to do something "immoral in itself." This case aside, violations of law also transgress an ethical duty to obey the law. Criminal punishments should be designed to match victims' empirically discernable losses in degree and kind, except when this would be impossible or degrading; courts cannot measure the ultimate moral desert of criminals, which depends on their inner "will." "Punishment" is not a mere disincentive in a "price" system of social control; it has an inherent expressive function, conveying a public message of moral disapproval of the criminal conduct in question. Understanding this together with Kant's basic theory of justice may help to explain his acceptance of ius talionis and condemnation of making exceptions for pragmatic reasons. It also accounts for the retributive "tone" of Kant's remarks, despite his insistence that public courts deal only with "external actions," not overall moral worth and character assessment. Kant wird oft als Vertreter einer extremen Vergeltungstheorie gesehen. Auf der anderen Seite betonen verschiedene Autoren in der letzten Zeit die Abschreckung als grundlegendes Element in Kants Rechtfertigung der Strafe. Ihnen gegenüber muß Kants Verknüpfung von Vergeltung und Abschreckung von anderen ähnlichen Verknüpfungen unterschieden werden, die weniger plausibel sind. Kant so zu interpretieren, als füge er zum Hauptziel der Abschreckung nur einige nebensächliche Elemente der Vergeltung hinzu, verfehlt den Vergeltungsaspekt in Kants Straftheorie. Die grundlegenden Fragen sind: Wer soll bestraft werden, wie schwer, in welcher Weise und warum? Kant war der Ansicht, daß alle, aber auch nur diejenigen bestraft werden sollen, die sich vor dem juridischen Gesetz schuldig gemacht haben. Wer sich vor dem juridischen Gesetz schuldig gemacht hat, hat sich auch moralisch schuldig gemacht, es sei denn, das vom Recht Geforderte sei etwas "an sich selbst Unmoralisches". Sieht man von diesem letzteren Fall einmal ab, dann enthält jede Übertretung des juridischen Gesetzes immer auch eine Verletzung der ethischen Pflicht, dem juridischen Gesetz zu gehorchen. Strafe sollte darauf angelegt sein, den empirisch erkennbaren Verlusten des Opfers nach Art und Ausmaß zu entsprechen, außer, wenn dies unmöglich oder erniedrigend wäre; Gerichte können die tatsächliche moralische Schuld von Verbrechern, die von ihrem inneren "Willen" abhängt, nicht messen. "Strafe" ist kein bloßes Abschreckungsmittel in einem "Preis"-System sozialer Kontrolle. Statt dessen hat sie die ganz wesentliche und ausdrückliche Funktion, die moralische Mißbilligung des jeweiligen verbrecherischen Verhaltens öffentlich zum Ausdruck zu bringen. Diese Interpretation, zusammen mit Kants grundlegender Theorie der Gerechtigkeit, kann helfen zu verstehen, warum Kant das ius talionis akzeptiert hat und warum er Ausnahmen, die aus pragmatischen Gründen gemacht werden, mißbilligt. Sie erklärt auch den "Tonfall" in Kants Äußerungen, der mir seiner Vergeltungstheorie zusammenhängt, auch wenn Kant darauf beharrt, daß staatliche Gerichte sich immer nur mit "äußeren" Handlungen befassen, nicht mit dem moralischen Wert insgesamt oder mit einer Beurteilung des Charakters einer Person. Im Zentrum der Ästhetik und Kulturtheorie des nahezu vergessenen jüdischen Aufklärers Lazarus Bendavid (1762-1832) steht das Verhältnis von moralischem und ästhetischem Fortschritt. Dieser Aufsatz stellt drei komplementäre Theorien Bendavids vor, denen zufolge ästhetische Phänomene Moralität befördern: Erstens behauptet Bendavid, dass die ästhetische Selbsterfahrung auch die Einfühlung in andere Menschen ermögliche und deshalb zu deren Anerkennung einen entscheidenden Beitrag leiste. Zweitens geht er davon aus, dass der Ästhetiker sich nicht nur theoretisch erkennt, sondern auch praktisch-autopoietisch bestimmt. Zugleich Künstler und Kunstwerk, verwirklicht (...) er durch kulturelle Artefakte seine Autonomie. Drittens verbindet sich mit der Ästhetik eine Rechtfertigung des Menschen: Trotz aller menschlichen Unzulänglichkeiten sieht die ästhetische Einstellung die Gleichheit und Zusammengehörigkeit aller Menschen und verheißt damit einen moralisch besseren Zustand in der Zukunft. The works of Jewish enlightenment thinker Lazarus Bendavid (1762-1832) are virtually forgotten today. His aesthetic and cultural theory focused on the relationship between moral and aesthetic progress. The present essay discusses Bendavid’s three complementary theories on how aesthetic phenomena promote morality: Firstly, he claims that aesthetic self-experience leads to empathy and therefore to social recognition. Secondly, he suggests that aesthetics do not only facilitate theoretical self-knowledge, but also practical, autopoietic self-determination. At once artist and artwork, the human subject realizes autonomy through cultural artefacts. English summary: The freedom potential of modern societies, above all the justification of political authority, is today linked to a democratically constituted order. What is meant by the idea of being democratic seems, however, to be anything but clear. Is it only a question of representing the people through elections, ballots, and political parties, or does it include institutional culture, the division of powers, and the legal regime within a community? A "philosophy of the republic," as developed in this (...) volume's contributions, shows that the current "dominance of the democratic" falls short of accounting for the independent significance to the republican self-organisation of state and society.
