    Reconciling Constitutionalism with Power: Towards a Constitutional Nomos of Political Ordering.K. U. O. Ming-Sung - 2010 - Ratio Juris 23 (3):390-410.
Drawing upon Hannah Arendt's and Carl Schmitt's theories on the relationship between nomos and boundary, this paper revisits how constitutionalism and political power are reconciled as constitutional ordering. It first analyzes constitutionalism in the light of political modernity. Indicating that political power grounded by constitutions is omnipotent, complementing and completing constitutionalism, the paper contends that an omnipotent constitutional ordering is anything but an unleashed Leviathan. It is argued that constitutional omnipotence is framed and thus constrained by a constitutional nomos, the (...)

In the article of Oleh Shepetyak «Dramatic Theology of K. Barth, H.U. von Balthasar and R. Schwager» the analysis of one of the theological concepts of XX - the beginning of XXI century was performed which was developed by Karl Barth, Gustav Aulén, Gans Urs von Balthasar and got the name «dramatic theology». This way of theological reflection appeared as antithesis to liberal theology developed in the dialogue with the Enlightment philosophy. The contribution of main creators of dramatic theology into (...)

The aim of this cross-sectional study was to investigate beliefs, attitudes and reproductive behaviours in relation to consanguinity in a population living in the backlands of north-eastern Brazil. Data were collected by face-to-face interview from 147 high school students aged 13–20 years and from 532 elderly individuals aged 60 years and over from Brejo dos Santos in the state of Paraíba in 2017. The frequency of consanguineous marriage was found to have increased over the generations, being 15.9% in the parents (...)

The Power Struggle Between Accountants and Marketers and its Consequences for Business Ethics in the U.K.Barbara O'Leary - 2001 - Business Ethics 10 (2):140–144.
The dominant managerial discipline in U.K. companies is finance. Accountants are often viewed as being concerned with what is measurable, definite and controllable. The emphasis is on professional conduct, independence, objectivity, technical competence and confidentiality. This paper explores the concept that the growth of professionalism has created an environment in which functional specialists have different ethical perspectives. The pre‐eminence of accountants is now being challenged by the marketers, a profession that takes a much wider view of business ethics. This development (...)

Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.

Mercado religioso e mercado como religião (Religious Market and Market as Religion) - DOI: 10.5752/P.2175-5841.2014v12n34p290. [REVIEW]Jung Mo Sung - 2014 - Horizonte 12 (34):290-315.

Despite governmental and private antismoking initiatives, tobacco smoking remains a significant public health and economic challenge. The Centers for Disease Control and Prevention estimates that for each year between 1997 and 2001, cigarette smoking and exposure to secondhand smoke caused approximately 438,000 U.S. residents to die prematurely, resulting in 5.5 million years of potential life lost, and in $92 billion dollars of lost productivity. Also, despite convincing scientific data that laws against indoor smoking protect people from the negative health effects (...)

Authenticity:The Ultimate Challenge in the Quest for Lasting Constitutional Legitimacy†.Ming-Sung Kuo - forthcoming - Oxford Journal of Legal Studies.
The recent upsurge of populism has prompted a wave of theoretical reflections on constitutional democracy. Echoing Max Weber’s sociology of legitimate authority, Bruce Ackerman’s Revolutionary Constitutions: Charismatic Leadership and the Rule of Law stands out from the crowd by providing an ambitious trichotomy of constitutional legitimacy—revolutionary, establishmentarian and elitist—with a focus on the revolutionary pathway. Engaging with Ackerman’s theoretical modelling of the relationship between constitutionalism and legitimate authority, I argue that the resurgence of popular sovereignty, as embodied in We the (...)

From Myth to Fiction: Why a Legalist-Constructivist Rescue of European Constitutional Ordering Fails.Ming-Sung Kuo - 2009 - Oxford Journal of Legal Studies 29 (3):579-602.
The defeat of the Constitutional Treaty by French and Dutch voters in 2005 and the following stalemate of the Lisbon Treaty have sparked a soul-searching process for European constitutional scholarship. Among the numerous academic efforts devoted to contemplating the future of European constitution, Michelle Everson and Julia Eisner's The Making of a European Constitution: Judges and Law Beyond Constitutive Power deserves a close look. Everson and Eisner argue for a postconstituent view of European constitutionalization, which they call ‘Rechtsverfassungsrecht’. Departing from (...)

In the Shadow of Judicial Supremacy: Putting the Idea of Judicial Dialogue in Its Place.MingSung Kuo - 2016 - Ratio Juris 29 (1):83-104.
I aim to shed theoretical light on the meaning of judicial dialogue by comparing its practice in different jurisdictions. I first examine the practice of dialogic judicial review in Westminster democracies and constitutional departmentalism in American constitutional theory, showing the tendency toward judicial supremacy in both cases. Turning finally to continental Europe, I argue that the practice of constitutional dialogue there is reconciled with its postwar tradition of judicial supremacy through the deployment of proportionality analysis-framed judicial admonition. I conclude that (...)

In ethical relativism characteristical for Freud, moral and (...)

Many lesbians and gay men apply for asylum in the U.K. each year on the basis that they fear persecution in their home country because of their sexual orientation. The legal basis for claiming asylum on the ground of sexual identity is now well established. Nevertheless, making these claims remains very difficult for applicants. Western cultural expectations around sexual identity often mix with homophobic assumptions about sexual behaviour to present applicants as “not sufficiently gay”. Furthermore, applicants may not initially disclose (...)

Overestimation of one’s ability to argue their position on socio-political issues may partially underlie the current climate of political extremism in the U.S. Yet very little is known about what factors influence overestimation in argumentation of socio-political issues. Across three experiments, emotional investment substantially increased participants’ overestimation. Potential confounding factors like topic complexity and familiarity were ruled out as alternative explanations. Belief-based cues were established as a mechanism underlying the relationship between emotional investment and overestimation in a measurement-of-mediation and manipulation-of-mediator (...)

The formulae advanced by Popper to calculate the degree of corroboration C of a scientific hypothesis are unsatisfactory in that the probability values required in the computation are often not available. An attempt is made to define a quantitative measure B* in the place of C in which only countable empirical values would be used. This condition is fulfilled in two basic formulae and eq. ), which could be applied to calculate the degree of corroboration. When m successful falsifications of (...)

Alegorický výklad patří v dějinách evropského myšlení k nejstarším a nejvlivnějším interpretačním metodám. Jeho počátky sahají do 6. stol. př. Kr. a velkého rozkvětu dosáhl zejména v rukou stoiků a středoplatoniků i novoplatoniků, jejichž prostřednictvím posléze hluboce pronikl i do křes_anské a židovské filosofie.

This article considers the differential absorption and integration of refugee physicists into various countries during the 1930s, and the social and intellectual factors responsible for this, focusing particularly on the social functions of the British and American university at that period, as well as continuing ideological struggles in the Soviet Union. More generally, the issue of the relative absorption of refugee physicists is used to examine the nature of the physics communities and other institutions of the host societies.

Using covariant derivatives and the operator definitions of quantum mechanics, gauge invariant Proca and Lehnert equations are derived and the Lorenz condition is eliminated in U(1) invariant electrodynamics. It is shown that the structure of the gauge invariant Lehnert equation is the same in an O(3) invariant theory of electrodynamics.
