In this book Katrin Flikschuh examines the relevance of Kant's political thought to major issues and problems in contemporary political philosophy. She advances and defends two principal claims: that Kant's philosophy of Right endorses the role of metaphysics in political thinking, in contrast to its generally hostile reception in the field today, and that his account of political obligation is cosmopolitan in its inception, assigning priority to the global rather than the domestic context. She shows how Kant's metaphysics of (...) freedom as a shared idea of practical reason underlies the cosmopolitan scope of his theory of justice, and she concludes that despite the revival of 'Kantianism' in contemporary thinking, his account of justice is in many respects very different from dominant approaches in contemporary liberal theory. In this paper an approach to the exhaustive interpretation of answers is developed. It builds on a proposal brought forward by Groenendijk and Stokhof (1984). We will use the close connection between their approach and McCarthy's (1980, 1986) predicate circumscription and describe exhaustive interpretation as an instance of interpretation in minimal models, well-known from work on counterfactuals (see for instance Lewis (1973)). It is shown that by combining this approach with independent developments in semantics/pragmatics one can overcome certain limitations of (...) Groenenedijk and Stokhof's (1984) proposal. In the last part of the paper we will provide a Gricean motivation for exhaustive interpretation building on work of Schulz (to appear) and van Rooij and Schulz (2004). (shrink)
The appropriateness, or acceptability, of a conditional does not just ‘go with’ the corresponding conditional probability. A condition of dependence is required as well. In this paper a particular notion of dependence is proposed. It is shown that under both a forward causal and a backward evidential reading of the conditional, this appropriateness condition reduces to conditional probability under some natural circumstances. Because this is in particular the case for the so-called diagnostic reading of the conditional, this analysis might help (...) to explain some of Douven and Verbrugge’s empirical observations. Research on sustainability assurance is still in its beginnings. One of the key questions in this field that also is of the highest practical relevance is concerned with the quality of the assurance process. However, a common understanding of assurance quality and how it should be measured is still missing. We try to close this gap by building on the financial audit literature. We introduce a definition of assurance quality that comprises two key aspects: the depth of the assurance process (...) and the breadth of the assurance statement. Based on prior research, we hypothesize that a firm’s sustainability performance is related to the depth of the assurance process, while the type of the assurance provider, more precisely the affiliation to the accounting profession, is related to the breadth of the assurance statement. Results for a sample of 122 European firms reveal a negative relationship between sustainability performance and assurance process depth as well as between the affiliation to the accounting profession and assurance statement breadth. Thus, we find evidence that poor sustainability performers ask for in-depth assurance services, most likely as a means to enhance their internal sustainability-related processes and systems. Assurance providers that do not belong to the accounting profession in turn are associated with broader assurance statements. (shrink)
In this paper, a pragmatic approach to the phenomenon of free choice permission is proposed. Free choice permission is explained as due to taking the speaker (i) to obey certain Gricean maxims of conversation and (ii) to be competent on the deontic options, i.e. to know the valid obligations and permissions. The approach differs from other pragmatic approaches to free choice permission in giving a formally precise description of the class of inferences that can be derived based on these two (...) assumptions. This formalization builds on work of Halpern and Moses (1984) on the concept of ‘only knowing’, generalized by Hoek et al., (1999, 2000), and Zimmermann’s (2000) approach to competence. (shrink)

More particularly, I will claim that we need a causal notion of consequence. The proposal subsequently made uses a representation of causal dependencies as proposed in Pearl (2000) to formalize a causal (...) notion of consequence. This notion inserted in premise semantics for counterfactuals in the style of Veltman (1976) and Kratzer (1979) will provide a new interpretation rule for conditionals. This contribution investigates the intimate relation and the tension between legal and literary procedures of personification and subjectivation. In order to do so, the contribution turns to Kafka’s The Trial and examines the proximity of the juridical procedure depicted in the novel, intending to establish Josef K. as a subject, to the narrative procedures of the novel itself that aims at bringing forth an accountable protagonist. The intimate relation of the legal procedures described in the novel and the narrative ones (...) of the novel itself is rooted in a shared historical heritage that impacts both. I argue that the fundamental configuration of advocacy in the classical rhetorical procedure: speaking for someone, against someone, in front of an other, lies at the basis of both legal and literary procedures. Against this common rhetorical background I investigate developments in legal procedures and the formation of the modern novel in the nineteenth and early twentieth century. Both developments occlude the rhetorical mechanisms of speaking-for and speaking against and turn the rhetorical procedures of personification into mechanisms of subjectivation. Kafka’s Proceß reflects these developments, yet does not affirm this transformation and ultimately does not result in a guilty subject and a ‘believable’ character. Rather, the novel embodies a gesture of resistance against certain modes of subjectivation that seem to be prevalent both in modern law and in the novel of formation. (shrink)
According to one interpretation of Leviathan, Hobbes sinks the democratic argument in favour of government by representation into his own argument in favour of absolute rule. This paper argues that Kant in turn sinks Hobbes' argument for coercive political authority into Rousseau's construction of the volonté générale . Why does Kant reject Rousseau's argument in favour of popular sovereignty; why does he revert to Hobbes' endorsement of a coercively unifying political authority? The paper examines the different responses given by Hobbes, (...) Rousseau, and Kant to the problem of political unity and unified political decision-taking. While for Hobbes and Rousseau political unity must be empirically real - there must be an actual unifying authority - in Kant the idea of the general united will is a rational criterion of just lawmaking. We investigated the impact of attention during encoding on later retrieval. During study, participants read some words aloud and named the print color of other words aloud . Then one of two memory tests was administered. The explicit test—recognition—required conscious recollection of whether a word was studied. Previously read words were recognized more accurately than were previously color named words. This contrasted sharply with performance on the implicit test—repetition priming in lexical decision. Here, words that were color named during study (...) showed priming equivalent to words that were read during study; both were responded to faster than unstudied words. Thus, an attentional manipulation during study had a strong effect on an explicit test of memory, but almost no effect on an implicit test. Focal attention during study is crucial for remembering consciously but not necessarily for remembering without awareness. (shrink)
This article asks under what conditions and on what terms current African thinkers can and should engage in the global justice debate. Following summary overviews of the Western-led global justice debate and post-independence African philosophy as two essentially separate, non-intersecting philosophical discourses, I go on to argue that the current generation of African thinkers can fruitfully intervene in the global justice debate if it succeeds in building on philosophical insights of the first-generation of African thinkers. In particular, current African thinkers (...) might fruitfully engage the notion of ‘false universals’ developed by first generation African thinkers to challenge Western philosophical conceptions in general in order to re-invigorate recently neglected critical inquiry into the status of many of this more particular debate’s unreflective universality claims. The current neurosciences contribute to the construction of gender/sex to a high degree. Moreover, the subject of gender/sex differences in cognitive abilities attracts an immense public interest. At the same time, the entanglement of gender and science has been shown in many theoretical and empirical analyses. Although the body of literature is very extensive and differentiated with regards to the dimensions of ‘neuroscience of gender’ and ‘gender in neuroscience’, the feeding back of these findings into the field of neuroscience remains (...) a desideratum. Especially, the question of how gender knowledge, i.e. insights from feminist theory on gender/sex and from gender and science studies on knowledge production, may be integrated and applied within the neurosciences has been strongly neglected. Presumably due to their epistemic culture and epistemological presuppositions, these critical engagements are conceived as externalist by critical scholars and neuroscientists alike. In this context, the question arises of how substantiated gender knowledge may be accounted for in neuroscientific research practice? The article outlines methodological considerations for a critical research agenda in the cognitive neurosciences. I present thoughts on how insights and expertise from gender and science studies can be taken into account in the neuroscientific practice of knowledge production. Starting from the assumption that changes in neuroscientific research practices are possible, my aim is to point out possibilities of integrating gender knowledge into the neurosciences. (shrink)
This article queries the cogency of human rights reasoning in the context of global justice debates, focusing on Charles Beitz's practice-based approach. By 'cogency' is meant the adequacy of human rights theorising to its intended context of application. Negatively, the author argues that Beitz's characterisation of human rights reasoning as a 'global discursive practice' lacks cogency when considered in the context of the post-colonial state system; she focuses on African decolonisation. Positively, she suggests that Beitz's gloss on international human rights (...) as an 'appurtenance' to the traditional state system offers a more promising starting point for global normative theorising, drawing attention to the requirement of sovereign competence as a necessary condition of possible human rights fulfilment. However, a concern with strengthening the sovereign competence of weak states should lead us to consider neglected public goods theorising in favour of an over-emphasis on individual human rights. William of Auvergne is one of the first Latin thinkers to discuss Avicenna’s cosmological theory of emanation and with it the famous principle «ex uno, secundum quod est unum, non est nisi unum». He accepts the validity of this principle itself, but vehemently rejects its use in the field of cosmology to explain God’s acting as the universe’s creator. Within the context of Trinitarian theology, however, William applies the ex-uno-principle to explain two core issues concerning the emanation of the second (...) Trinitarian person out of the first: the theory of the only-begotten Son and the persons’ sharing of the one divine essence. This paper offers an imminent interpretation of Kant's political teleology in the context of his response to Moses Mendelssohn in Theory and Practice III concerning prospects of humankind's moral progress. The paper assesses the nature of Kant's response against his mature political philosophy in the Doctrine of Right . In `Theory and Practice III' Kant's response to Mendelssohn remains incomplete: whilst insisting that individuals have a duty to contribute towards humankind's moral progress, Kant has no conclusive answer as to how (...) individuals might act on that duty. `Theory and Practice III' lacks a clear conception of the distinctness of political morality from the domain of virtue; Kant's resort to teleological argumentation is indicative of his lack of an account of instituting Right. The latter can be found in the Doctrine of Right —yet Kant's earlier teleological arguments contribute crucially to the development of his mature morality of Right. We provide a detailed description of an interleaved and heavily annotated copy of Florae Berolinensis Prodromus, a flora of Berlin published by the German apothecary and botanist Karl Ludwig Willdenow in 1787, which today is preserved at the Staatsbibliothek zu Berlin – Preußischer Kulturbesitz. We demonstrate that this is the copy that the author himself used and carried with him during his botanical excursions in and around Berlin to prepare a second edition of the work. By analyzing this document as (...) paper technology, we reveal that even seemingly trifling aspects of its material organization enabled far-reaching biological research agendas that were not originally intended. The hybrid form of manuscript and printed book, used in field excursions, enabled a kind of natural-historical observation that was at once detailed and bound by strict convention, a combination that inadvertently opened new research questions and suggested new objects of research. We thereby contribute to an understanding of the history of natural history that goes beyond the history of ideas and the intended uses of techniques, giving an example of how routine work on paper within a scientific tradition could generate innovation. In spite of their striking differences with real-life perception, films are perceived and understood without effort. Cognitive film theory attributes this to the system of continuity editing, a system of editing guidelines outlining the effect of different cuts and edits on spectators. A major principle in this framework is the 180° rule, a rule recommendation that, to avoid spectators’ attention to the editing, two edited shots of the same event or action should not be filmed from angles differing in a (...) way that expectations of spatial continuity are strongly violated. In the present study, we used high-density EEG to explore the neural underpinnings of this rule. In particular, our analysis shows that cuts and edits in general elicit early ERP component indicating the registration of syntactic violations as known from language, music, and action processing. However, continuity edits and cuts-across the line differ from each other regarding later components likely to be indicating the differences in spatial remapping as well as in the degree of conscious awareness of one's own perception. Interestingly, a time–frequency analysis of the occipital alpha rhythm did not support the hypothesis that such differences in processing routes are mainly linked to visual attention. On the contrary, our study found specific modulations of the central mu rhythm ERD as an indicator of sensorimotor activity, suggesting that sensorimotor networks might play an important role. We think that these findings shed new light on current discussions about the role of attention and embodied perception in film perception and should be considered when explaining spectators’ different experience of different kinds of cuts. Kant and Confucius maintain that the art of becoming human is synonymous with the unending process of becoming moral. According to Kant, I must imagine a world in which the universality of my maxims were possible, while realizing that if such a world existed, then morality would disappear. Morality is an impossible possibility because it always meets resistance in our encounter with nature. According to Confucius, human beings become moral by integrating themselves into the already meaningful natural order that is (...) tian 天. Like Kant, he upholds the dignity of human beings. For Kant this dignity rests on the autonomy of each human being’s reason, while for Confucius it is dependent upon our interconnection with each other, demanding ongoing self-extension. Despite these differences, the two thinkers would concur that our efforts at humanization are unceasing and that we may never fully live up to our human potential. (shrink)
In terms of Groenendijk and Stokhofs (1984) formalization of exhaustive interpretation, many conversational implicatures can be accounted for. In this paper we justify and generalize this approach. Our justification proceeds by relating their account via Halpern and Moses (1984) non-monotonic theory of only knowing to the Gricean maxims of Quality and the first sub-maxim of Quantity. The approach of Groenendijk and Stokhof (1984) is generalized such that it can also account for implicatures that are triggered in subclauses not entailed by (...) the whole complex sentence. In this collection of essays Onora O'Neill explores and argues for an account of justice that is fundamentally cosmopolitan rather than civic, yet takes serious account of institutions and boundaries, and of human diversity and vulnerability. Starting from conceptions that are central to any account of justice - those of reason, action, judgement, coercion, obligations and rights - she discusses whether and how culturally or politically specific concepts and views, which limit the claims and scope of justice, can be avoided. She then examines the demands and scope of just institutions, arguing that there are good reasons for taking the claims of distant strangers seriously, but that doing so points not to a world without boundaries but to one of porous boundaries and dispersed power. There is a tendency within the literature to decry Kant as either a proto-imperialist or as a proto-democrat in relation to his views on distant strangers. I here take an alternative view, arguing that Kant’s cosmopolitan morality is considerably more context-sensitive than is often assumed. More specifically, I argue that Kant’s encounter with American nomads on the final pages of his Doctrine of Right reflects a nuanced reading of European settlers’ requisite comportment towards them: Kant neither endorses a universal duty (...) of state entrance nor does he place nomads beyond all possible moral engagement with European settlers. Several disciplines share an interest in the evolutionary selection pressures that shaped human physical functioning and appearance, psyche, and behavior. The methodologies invoked from the disciplines studying these domains are often based on different rhetorics, and hence may conflict. Progress in one field is thereby hampered from effective transfer to others. Topics at the intersection of anthropometry and psychometry, such as the impact of sexual selection on the hominin face, are a typical example. Since the underlying theory explicitly places facial (...) form in the middle of a causal chain as the mediating variable between biological causes and psychological effects, a particularly convenient conceptual and analytic scenario arises as follows. Modern morphometrics allows analysis of shape both “backwards” and “forwards” . The two computations are commensurate, hence the two kinds of effects can be compared and evaluated as directions in the same morphospace. We suggest translating the morphometric methodology of “Darwinian aesthetics” into this space, where psychological and other processes of interest can be coded commensurately. Such a translation permits researchers to relate the effects of biological processes on form to the perceptions of the same processes in one unified “psychomorphospace.”. (shrink)
Cimpian et al. observed that we accept generic statements of the form ‘Gs are f’ on relatively weak evidence, but that if we are unfamiliar with group G and we learn a generic statement about it, we still treat it inferentially in a much stronger way: all Gs are f. This paper makes use of notions like ‘representativeness’, ‘contingency’ and ‘relative difference’ from psychology to provide a uniform semantics of generics that explains why people accept generics based on weak evidence. (...) The spirit of the approach has much in common with Leslie’s cognition-based ideas about generics, but the semantics will be grounded on a strengthening of Cohen’s relative readings of generic sentences. In contrast to Leslie and Cohen, we propose a uniform semantic analysis of generics. The basic intuition is that a generic of the form ‘Gs are f’ is true because f is typical for G, which means that f is valuably associated with G. We will make use of Kahneman and Tversky’s Heuristics and Biases approach, according to which people tend to confuse questions about probability with questions about representativeness, to explain pragmatically why people treat many generic statements inferentially in a much stronger way. This article aims to propagate Logic Programming as a formal tool to deal with non-monotonic reasoning. In philosophy and linguistics non-monotonic reasoning is modelled using Minimal Models as standard, i.e., by imposing an order (or selection function) on the class of all models and then by defining entailment as only caring about the minimal models of the premises with respect to the order. In this article we investigate the question whether instead of minimal models we should use logic programming to (...) model non-monotonic reasoning. Logic programming is an attractive alternative to a minimal models approach in that it makes concrete predictions in an efficient and transparent way. We study this question by focusing on one particular phenomenon that gives rise to non-monotonic inferences: conditional sentences. (shrink)
This study explores the attitude of German psychiatrists in leading positions towards joint crisis plans and psychiatric advance directives. This topic was examined by contacting 473 medical directors of German psychiatric hospitals and departments. They were asked to complete a questionnaire developed by us. That form contained questions about the incidence and acceptance of joint crisis plans and psychiatric advance directives and previous experiences with them. 108 medical directors of psychiatric hospitals and departments responded . Their answers demonstrate that in (...) their hospitals these documents are rarely used. Among the respondents, joint crisis plans are more accepted than psychiatric advance directives. There is a certain uncertainty when dealing with these instruments. Our main conclusion is that German psychiatry needs an intensified discussion on the use of instruments for patients to constitute procedures for future critical psychiatric events. For this purpose it will be helpful to collect more empirical data. Furthermore, the proposal of joint crisis plans in psychiatric hospitals and departments should be discussed as well as the possibility of consulting an expert during the preparation of a psychiatric advance directive. Recently, priming effects of unconscious stimuli that were never presented as targets have been taken as evidence for the processing of the stimuli’s semantic categories. The present study explored the necessary conditions for a transfer of priming to novel primes. Stimuli were digits and letters which were presented in various viewer-related orientations . The transfer of priming to novel stimulus orientations and identities was remarkably limited: in Experiment 1, in which all conscious targets stood upright, no transfer to unconscious primes (...) in a non-target orientation was found. Experiment 2, in which primes were presented without masks, ruled out the possibility that primes were presented too short to allow congruency effects. In Experiments 3 and 4, in which all targets were presented upside down, priming transferred to upright stimuli with target identities but neither to horizontal stimuli nor to stimuli with novel identities. We suggest that whether a transfer of priming to unpracticed stimuli occurs or not depends on observers’ expectations of specific stimulus exemplars. (shrink)
The essay critically reviews two recent contributions to the debate on global justice made by Darrel Moellendorf and Thomas Pogge respectively. Given both authors’ acknowledgement of the substantial contributions which liberal economic practice currently makes to ever-increasing levels of global deprivation and injustice, can we continue to assume with confidence that liberal morality is capable of providing the solution? It is a central claim of the essay that both authors are able to sustain this optimistic assumption only because of their (...) abstraction of liberal morality from its statist political and competitive economic settings. Were these settings to be taken into account, some liberal values might be shown to be less universalisable than they are routinely assumed to be. In that case, we should not argue, implausibly, for the extension of these values to the global context, but should focus on their critical revision in the context of mature liberal societies’ domestic politics. Humour in the Zhuangzi is used to question the priority that human beings bestow upon language and thought, revealing both its limitations and its possibilities. Hierarchies and conventions are overturned and both the sense and senselessness of language are celebrated. Humour also opens up a world in which a plethora of perspectives is acknowledged and the purpose of purposelessness is underscored.
