This series provides short, accessible and lively introduction to the major schools, movements and traditions in philosophy and the history of ideas since the beginning of the Enlightenment. All books in the series are written for undergraduates meeting the subject for the first time. Hermeneutics concerns itself with the theory of understanding and the interpretation of language. The question of how to correctly interpret and understand others remains one of the most contested branches of philosophy. In Understanding Hermeneutics Lawrence (...) Schmidt provides an introduction to modern hermeneutics through a systematic examination of the ideas of its key philosophical proponents. Chapter 1 examines the ideas, of the Protestant theologian, Friedrich Schleiermacher, who argues that misunderstanding is always possible so we must always employ interpretation if we are to understnad correctly. Chapter 2 discusses the ideas of Dilthey, who maintains that understanding in the humanities is fundamentally different from explanation in the natural sciences, and who presents a methodology to judge what another person means or feels by means of their language and also their gestures, facial expressions, and manners of acting. Chapter 3 explores the ideas of Heidegger who radicalizes the concept by shifting its focus from interpreting texts to an existential interpretation of human being. In Chapter 4 the recent ideas of Gadamer are examined, which extend to examining the structures of hermeneutic experience and to question the supremacy of the natural sciences as models for truth. The final chapters consider some of the criticisms and controversies surrounding hermeneutics, including the work of Habermas, Hirsch, Ricoeur and Derrida, and the prospects for the future of hermeneutics. There are broad and narrow senses of hermeneutic application as well as of hermeneutic praxis. The broad sense of hermeneutic application means using what one has already understood in some later situation. Hermeneutic praxis in the narrow sense refers to an interpreter using a hermeneutic theory to interpret written or spoken language. The narrow sense of hermeneutic application is discussed by Hans‐Georg Gadamer in Truth and Method as the central problem of philosophical hermeneutics. Friedrich Schleiermacher had noted that the lax (...) practice of hermeneutics, which had been previously the main form of hermeneutics, assumes that understanding usually succeeds and that interpretation is only called for in difficult cases where misinterpretation might occur. Usually, after one has understood, interpreted, and applied an order to the concrete situation, one would carry out that order as it was understood. This book offers a bold challenge to modern liberal ethics by exposing its inability to confront the inexorable advance of technology. Contemporary books on technology generally fall into three categories: those that offer optimist projections of a glorious future, those that provide radical critiques of specific techniques, and those that express alarm about the dehumanizing effects of a culture dominated by technology. The End of Ethics in a Technological Society offers a deeper assessment of the modern West's commitment to technological (...) progress. It argues that modern technology, ethics, and politics are all expressions of the enlightenment view that there are no principles of truth or goodness higher than the free human will. Technological advances are, on this view, merely extensions of the range of human freedom. Modern ethics thus fails to give voice to our often inchoate moral intuition that, in the realm of techno science, some possibilities simply ought not to be pursued. The authors develop their challenge by examining typical ethical approaches to such urgent contemporary concerns as environmental degradation, nuclear energy, high tech militarism, and fetal genetic testing. André Naud was a French‐Canadian Catholic theologian who served as a peritus or advisor to Cardinal Leger, the Archbishop of Montreal at the Second Vatican Council between 1962 and 1965. Naud’s entire theological career was informed by the teachings of the Council. This was the reason why during the Papacy of John Paul II after 1978 he became alarmed at the expansion and the distortion of the authority of the magisterium. Over the last fifteen years of his life, he wrote (...) three remarkable books on this theme. In the last book (2002) entitled Les Dogmes et le Respect de l’Intelligence: Plaidoyer Inspiré par Simone Weil (The Dogmas and the Respect for Intelligence: An Argument Inspired by Simone Weil), he undertook an in‐depth analysis of Simone Weil, who had argued in the 1940s that Catholicism was in need of a philosophical cleaning up. This paper elaborates and explains the particular ways that Weil’s writings helped Naud to reformulate in the spirit of the Second Vatican Council the role of the magisterium with regard to dogmatic formulations, the manner of the reception of that teaching, the inspiration of scripture, the interpretation of miracles and the understanding of the Church itself. IF THE ENLIGHTENMENT did not exist, postmodernists would have had to invent it. It performs the same function, Daniel Gordon argues in his introduction to Postmodernism and the Enlightenment, that the Ancien Regime did for the French revolutionaries: as the "other of postmodernism," it represents "the modern that postmodernism revolts against" (P&E, p. 1). Indeed, the image of the Enlightenment that emerges from the postmodern critique does seem, in large part, to be an invention. As Keith Michael Baker and Peter Hanns Reill suggest in the introduction to their collection What's Left of Enlightenment? the various strands of thought commonly grouped under the label postmodernism "have at least one thing in common": "they all depend upon a stereotyped, even caricatural, account of the Enlightenment" which sees the Enlightenment as the point of origin for the "rationalism, instrumentalism, scientism, logocentrism, universalism, abstract rights, eurocentrism, individualism, humanism, masculinism, etc." that [End Page 432] defines the modernity which postmodernity hopes to supersede (WLE? p. 1).One consequence of the inclination to trace the origin of the various failings of modernity to the Enlightenment is that arguments about the "legacy of the Enlightenment" tend to get out of hand. In a particularly sharp-sighted contribution to the Baker and Reill collection David Hollinger notes that it is all too easy for a critic of Enlightenment to argue that "I'm hot stuff because I'm not only refuting you, my puny opponent, but... every great thinker from Descartes to Popper," and, conversely, all too enticing for those who have been criticized to counter, "watch out, you think you are arguing only against me, but the implications of your reasoning are to deny the common sense of every humane and rational mind since the seventeenth century" (WLE? p. 9). Historians of the eighteenth century have been curiously reluctant to join this battle and have, for the most part, left the field to philosophers, literary scholars, and political theorists (WLE? pp. 17-18; P&E, p. 3). The intent of the two collections reviewed here is to remedy this situation by setting a group of historians to work scrutinizing differing aspects of the postmodernist critique of the Enlightenment. More often than not, the results are quite rewarding, though the question of the relationship between postmodernism and the Enlightenment remains, in the end, somewhat ambiguous.The scope of these two volumes is quite impressive. Baker and Reill's collection opens with essays by David Hollinger and Richard Rorty (one of the two nonhistorians invited to the festivities) offering contrasting characterizations of the relationship of postmodernism and the Enlightenment. Much like Weimar, Germany, American civil society has been buffeted for a half-century by both the lunatic right, hiding behind the mask of religious freedom, and (...) the lunatic left, sporting "pomo" (postmodern) tribal colors in the garb of academic freedom. In an earlier age, both might be burned at the stake; today, they are granted tax-exempt status. Readers seeking contributions to the life of the mind find their harangues both unpleasant and unrewarding. This book is unfortunately no exception.Atwill's title is deceptive. Her work is only marginally about either Aristotle or his rhetoric. She is more concerned to "reclaim" the liberal arts held hostage by the received tradition of Athenian democratic ideals. Vide: At issue are the character of the social identities of gender, race, and class and the nature of the social ties by which we are bound.... (3) Challenges to the... humanist paradigm... became the subject of... debates over cultural diversity, political correctness, and revisionist literary canons and historical accounts. M. Cope, and rhetoric's four B's (Baldwin, Burnet, Burkhardt, and Hans Baron).Were Atwill offering a New Age update of Cope's commentary, her project might hold promise. Thus, her passing remarks on the relation of techne and theoria to Greek medicine (74-79) and to the cultural demands of what amounts to a plantation society (107-8) bear consideration. And her deconstruction of Cope's work as a managerial art grounded in associationist psychology (192-200) is especially insightful.Where the book disappoints is its clumsiness: it is simultaneously pedantic and superficial. On the first count, the author shows wide acquaintance with the standard commentaries on classical culture, but she seems often to be adrift in an ocean of secondary sources. For example, she is more likely to discuss Kennedy's treatment of Aristotle than Aristotle himself (58). And so it goes: Wright on Empedocles (90), Crane on Cicero (31), Woods on Cope (200). Indeed, it is difficult to tell from the book if the author's command of classical Greek extends much beyond Liddell and Scott.In addition to her overdependency on secondary sources, Atwill disregards historical contexts in pushing her quirky pomo readings to the fore. To cite only a few of these: For Plato, expertise is equivalent to function, and function determines one's place in the hierarchical order of the state. (30)... This is a commodification of pedantry--recycling fragments of academic publications to advocate a partisan position. The recent profusion of studies directed to uncovering the “Young Marx” has also provoked some renewed interest in his contemporary, Johann Caspar Schmidt, better known as Max Stirner. With a few exceptions, the most important being William Brazill’s The Young Hegelians, Stirner has been retained in his traditional role as Marx’s first critic, the harried “Sankt Max” of The German Ideology. This perspective, established firmly by Sidney Hook and continued by David McLellen, does cast light upon Marx’s development, but (...) it cannot be expected to do justice to Stirner, who is more than a mere anti-Marxist. Somatic cell gene therapy has yielded promising results. If germ cell gene therapy can be developed, the promise is even greater: hundreds of genetic diseases might be virtually eliminated. But some claim the procedure is morally unacceptable. We thoroughly and sympathetically examine several possible reasons for this claim but find them inadequate. There is no moral reason, then, not to develop and employ germ-line gene therapy. Taking the offensive, we argue next that medicine has a prima facie moral obligation to (...) do so. (shrink)

Ethics advisory groups, in various forms, have existed for at least 50 years in the United States and other countries. In science and biomedicine, four principal types of committees can be distinguished: policy-making and/or advisory committees, health professional association committees, health care ethics committees, and research ethics committees. Overall, these bodies have been of use to governments, policy makers, health care professionals, and the public in considering ‘what is ethical’ and ‘what is unethical’ in areas such as research involving humans (...) or animals or environmental questions such as whether to use genetically modified crops. : The Siminoff, Burant, and Youngner study in Ohio is strikingly consistent with data from a national study. Both suggest that there might be significant public acceptance of future policies that violate the dead donor rule, or that further extend the boundary between life and death to include brain-damaged patients short of "brain death." Experience with donation suggests that many individuals would donate their loved ones' organs when they have concluded that the brain injury is not survivable, even if all (...) the criteria for "brain death" are not met. It would be very helpful to have research on those who have gone through a real-life clinical situation. Based on the findings of this study and the increasing demand for organs, it may be appropriate for public policy to allow for ways to increase organ procurement from individuals who are not fully "brain dead" beyond the current method of procurement after cardiac death, but any change in this area should go slowly and with significant public input. The paper provides a critical commentary on the article by Baker and McCullough on Medical Ethic's Appropriation of Moral Philosophy. The author argues that Baker and McCullough offer a more "pragmatic" approach to the history of medical ethics that has the potential to enrich the bioethics field with a greater historical grounding and sound methodology. Their approach can help us to come to a more nuanced understanding about the way in which medical ethics has connected, disconnected, and reconnected with philosophical (...) ideas throughout the centuries. The author points out that Baker and McCullough's model can run the danger of overemphasizing the role of medical ethicists whilst marginalizing the influence of philosophers and of other historical actors and forces. He critically reviews the two case studies on which Baker and McCullough focus and concludes that scholars need to bear in mind the levels of uncertainty and ambivalence that accompany the process of transformation and dissemination of moral values in medicine and medical practice. By "ethical imperative" we mean a health care organization's duty to fulfill value-based obligations that transcend compliance requirements in order to be consistent with its basic sense of purpose. We consider three points here: the existence of a distinctively ethical imperative for board oversight, the fact that the imperative is organizational in nature, and practical ways to fulfill its obligations. The term applied ethics can be controversial if it is taken to imply that ethical theory from philosophy or religious ethics has to be the starting point for ethical analysis of some practical field such as medicine or law or politics. The term can be understood as requiring some premises from an ethical (...) theory that are then "applied" to some problem area, as a "top down" way of doing the work of moral reflection in a way that axioms in geometry are applied to present proofs of mathematical claim.The publication of an important work in the history of medical ethics, A History of Medical Ethics, provides an opportunity to reflect more carefully on what applied ethics means. That massive multi-authored volume edited by Robert Baker and Laurence McCullough (2007) is scheduled for publication this fall. With the permission of the Press, we have asked Baker and McCullough to prepare an article-length version of one of the central essays in that work. Their paper challenges the idea that ethical theory should be "applied" to medicine or other fields, putting forth an alternative of the "appropriation" of an ethical theory by the formulation of concepts, principles, moral rules, or other specifications that may turn out to be unique or at least modified for the particular field in question.In this issue of the Kennedy Institute of Ethics Journal, we publish the Baker-McCullough article together with five critical commentaries. We include two medical historians who have a sustained commitment to studying the history of ethics in medicine, two systematic ethicists who have an unusual level of commitment to studying ethics historically, and a physician with unusual sensitivity to the history of medical ethics. Each comments on the Baker-McCullough thesis and offers an alternative view of the link between ethical theory and the field of biomedical ethics.Daniel Fox triggered some of the initial reflection on the history of medical ethics in the 1970s. McCullough and Warren Thomas ReichThe past three decades have witnessed the emergence and remarkable success of the fields of bioethics and medical humanities. The intellectual landscape of medicine and that of the humanities have been remarkably altered in the process. Twenty-five to 30 years ago in the United States there existed but a few courses in what came (...) to be called “bioethics” in departments of philosophy, religious studies, and theology in colleges and universities, a handful of programs of teaching in medical schools such as the University of Texas Medical Branch at Galveston and Pennsylvania State University School of Medicine at Hershey, and but one independent research center (the Hastings Center) and one university-based research center (the Kennedy Institute of Ethics at Georgetown University). Articles on bioethics began to appear in the peer-reviewed medical, nursing, and humanities literature and some books were published. There was only one journal in bioethics, The Hastings Center Report (which consolidated two previously separate journals from the Hastings Center). Graduate programs in bioethics and medical humanities in colleges and universities and fellowship training in bioethics and medical humanities in medical schools did not exist. Very little existed in colleges, universities, and medical schools in other countries. Now, of course, everything is different.Teachers, scholars, and students of bioethics and medical humanities should not take these remarkable changes for granted, for they represent a sustained and innovative interaction between medicine and the humanities. We have chosen the metaphor of “laying medicine open” to characterize the history of bioethics and medical humanities of the past three decades. This surgical metaphor was used in eighteenth-century Britain by a number of writers who wanted to make medical science and practice more accessible to the sick and to the lay public more generally (Lawrence 1975). We use the metaphor to characterize the efforts of teachers and [End Page 1] scholars over the past three decades and more to make the value-laden dimensions of biomedical science and practice and of health care policy more accessible to patients and to the lay public more generally. The result of this laying open of medicine has gone a long way toward bringing closer together the two cultures of science and the humanities that had, as C. P. Snow famously described, become significantly isolated from each otherAlbert Jonsen (1998) has recently contributed the first book-length history of what he calls the “birth” of bioethics, adding to the work of other scholars such as Warren Reich (1994; 1995) and Robert Baker (1993) and, before them, Corrado Viafora (1990) and David Rothman (1991). The articles in this issue of the Kennedy Institute of Ethics Journal make additional contributions to the developing understanding of the history of the past thirty years of interaction between medicine and the humanities.Laurence McCullough provides an historical context for the three accounts of the recent laying open of medicine that follow. McCullough examines two times in the history of medicine when it has been laid open to accountability (in addition to its being laid open to and by bioethics and medical humanities). The first laying open occurred in the work of the eighteenth-century Scottish physician and philosopher John Gregory, who set out to create a profession of medicine in a true moral sense of a fiduciary profession by making medicine accountable for its scientific and moral quality. The second occurred in the late twentieth century in which the managed practice of medicine in general, and managed care in particular, have begun to lay medicine open to accountability for its scientific and moral quality, as well as its cost and, at least in the public sector, its accessibility. McCullough argues that, just as Gregory responded to the ethical challenges of medicine laid open more than two centuries ago, bioethics should respond to the ethical challenges in the current laying open of medicine.Warren Reich provides an account of André Hellegers, whose premature death left an enormous gap in the field that will never be filled. Much of the philosophical discussion of punishment has focused on its justification. Consequentialists argue that punishment must be justified by its future consequences. Retributivists argue that punishment must be justified by the ill-desert of the one punished.
