Cet article explicite une distinction entre deux sens du lien social : un sens de lien fonctionnel, qui ne s’applique qu’à ses aspects physiques ou biologiques, et un sens de lien civil, qui s’applique à la capacité des sujets sociaux de concevoir et évaluer leur propre vie matérielle et biologique du point de vue sémantique et moral. Partant du problème du lien et de la coopération sociale tel qu’il est posé dans l’ouvrage de Durkheim, La division (...) du travail social, l’article présente ensuite les principaux éléments d’une « théorie du lien civil » et sa contribution éventuelle à l’explication de la coopération sociale, en situant cette approche par rapport au paradigme bio-anthropologique contemporain.This paper makes explicit a distinction between two meanings of social link : a functional meaning which concerns only the physical or biological components ; and a civil meaning which concerns the ability of social agents to conceive and evaluate their own physical and biological life from a semantic and moral point of view. The paper stems from the problem of social cooperation in Durkheim’s book : La division du travail social, and then presents the main elements of a « theory of civil link » and its contribution to the explanation of social cooperation. Cet article rend compte du lien mère-enfant et des effets des confinements sur les fantasmes œdipiens. Nous partirons de notre pratique de psychologue dans un centre médico-psychologique et plus particulièrement de l’analyse d’un cas clinique d’un jeune garçon et de sa mère que nous avons pu suivre avant et après la période des confinements. Nous nous appuierons sur la parole de l’enfant qui évoque, au sortir du confinement, une certaine « nostalgie » de ce moment où la place du (...) tiers (social et familial), comme possible agent séparateur, a été mise de côté. Ceci nous permettra de faire des hypothèses quant aux effets de ce huis clos familial et de mettre en avant le vécu de menace d’une réalisation du fantasme œdipien qui a pu faire violence à l’enfant. Cet ouvrage interroge le sens de la relation entre lien magique et métamorphose en essayant de dégager des perspectives philosophiques et politiques spécifiques à la Renaissance et à l'âge classique. La pensée de Giordano Bruno demeure dans cette optique une référence essentielle. Le philosophe nolain n'a de cesse de réfléchir sur le sens de cette relation, puisque c'est à travers elle qu'il construit aussi bien l'art de la mémoire que la pratique magique comme art du lien. Des thèmes (...) comme celui de la fureur héroïque, de la différence entre l'homme et l'animal, de l'action magique ne sont compréhensibles qu'à partir de la relation constitutive entre le lien et la métamorphose. C'est par conséquent en étudiant les "liens de la métamorphose" que l'on peut faire apparaître la constitution d'un spectre de savoirs (magie, philosophie, politique) traversant l'histoire européenne de la Renaissance et de l'âge classique. Cela permet également d'insister sur le rapport que ces savoirs entretiennent avec les pratiques sociales. La philosophie et la magie, loin d'apparaître comme des savoirs abstraits et purement nominaux, s'affirment en réalité comme des discours performatifs légitimant la constitution des liens civils et sociaux. Il s'agit en définitive ici de reconstituer à nouveaux frais des séquences historiques et philosophiques qui tracent les relations entre une sphère des savoirs et une pratique de l'institution du social, dans une perspective comprenant aussi bien des auteurs de la Renaissance (Machiavel, Giordano Bruno) que de l'âge classique et baroque (Hobbes, Graciân)."--Page 4 of cover. This study is an attempt to construct a quantitative link for international regimes with global leadership. The country's willingness to lead in solving global issues as the first mover in the formation of an international regime is measured and characterized by analyzing their ratification behavior in multilateral conventions deposited to the United Nations which shape of the global community. For this purpose, a set of quantitative indicators, the Index of Global Leadership Willingness and the Global Support Index, was defined and (...) calculated for each country based on its actual ratification year data for 120 multilateral conventions covering global issues such as peace and security, environment, commerce, communication, intellectual property protection, human rights, and labor. By proposing a framework of global leadership analysis, the study seeks to provide an empirical testing of the transformation of global governance towards cooperation without hegemony paradigm. The paper analyses changes in the leadership willingness indices of selected country groups, such as the G3, G7/8, and G20, over the century and finds that the will to drive the international agenda of these groups of leaders is in decline. Moreover, our study provides evidence to argue that our current world is actually without consistent global leadership across domains of the world affairs. Although several countries still show visible leadership in specific policy domains, such as environment and intellectual property, neither the G7/8 nor the G20 was playing a comparable role to those performed by the G3 a hundred years ago. In der umfassenden Darstellung der Monadenlehre -des Unendlichen, Unbegrenzten, das in jedem Endlichen, Begrenzten bereits impliziert ist -verändern sich der physische Punkt, welche das kleinste sichtbare Lebewesen bildet, und der mathematische Punkt, welcher die Mitte ist. Einerseits enthält jedes winzige Teilchen, jedes winzige Staubkorn eine Welt von unendlich vielen Lebewesen, „und die Mikroskope haben unseren Augen mehr als eine Million lebender Tierchen in einem Wassertröpfchen sichtbar (...) gemachtײ. Dies ist die Theorie der Korpuskeln, wie sie sich im späteren Denken des Philosophen immer stärker abzeichnet und bestätigt: die Materie ist überall organisch. This article tries to provide a dynamic interest group theory. Using the economic method of the 'homo economicus' demand for and supply of policy catering to the needs of pressure groups are analysed. Central are the notions of information and organisation costs that face latent groups treatened by already existing groups. These notions permit to integrate the existing theories on pressure group into one global dynamic theory. The economists' rent seeking theory and the political scientists' pluralism and neo-corporatism can thus (...) be understood as stages in a continuing process. (shrink)

Following an introduction to international law regarding the use of force, the author examines the impact of post-9/11 practice, focusing on the right of self-defence. After critically reviewing operation Enduring Freedom, the U.S. National Security Strategy, the ‘Yemen strike’ and the war in Iraq, including the justifications offered for these actions and the international responses to them, as well as developments in NATO and the EU, he concludes that there is a tendency towards a broader interpretation of the right of (...) self-defence, in that this right may be extended to attacks by non-state actors and such attacks may be more easily attributed to states that support such actors. However, the author submits that this interpretation has not yet been sufficiently affirmed to have changed the law, that the rules of the UN Charter still accurately reflect the law and that there is insufficient support for a right of anticipatory or pre-emptive self-defence. Finally, he recommends strengthening the effectiveness of the Security Council and regional organizations such as the EU and NATO to avoid the risk of a true deregulation of the use of force.
