The recent renewal of interest in the philosophy of Henri Bergson has increased both recognition of his influence on twentieth-century philosophy and attention to his relationship to phenomenology. Until now, the question of Martin Heidegger’s debt to Bergson has remained largely unanswered. Heidegger’s brief discussion of Bergson in Being and Time is geared toward explaining why he fails in his attempts to think more radically about time. Despite this dismissal, a close look at Heidegger’s early works dealing with temporality reveals (...) a sustained engagement with Bergson’s thought. In The Origin of Time, Heath Massey evaluates Heidegger’s critique of Bergson and examines how Bergson’s efforts to rethink time in terms of duration anticipate Heidegger’s own interpretation of temporality. Massey demonstrates how Heidegger follows Bergson in seeking to uncover “primordial time” by disentangling temporality from spatiality, how he associates Bergson with the tradition of philosophy that covers up this phenomenon, and how he overlooks Bergson’s ontological turn in Matter and Memory. Through close readings of early major works by both thinkers, Massey argues that Bergson is a much more radical thinker with respect to time than Heidegger allows. (shrink)

In this book, as feminist, Marxist, postcolonial, and queer scholars, we argue that social reproduction is foundational to comprehending urbanization and urban transformations by contributing to the feminist project of writing social reproduction and everyday life into urban theory." Social reproduction is, of course, not just an analytical framing but also an organising call for feminist scholars and our contention is that if we want an urban theory for our time, it needs to be feminist. Feminism is not simply a (...) 'discipline,' 'theory', or 'ideology', but a worldview, a lived praxis that provides a platform for engaged analysis. The book's origins lie in our belief in the necessity of feminist urban knowledge production, a belief further endorsed by our prior critical engagement with the analytical framework of planetary urbanization and our collective ruminations during and post this engagement on the nature of urban theory (Reddy 2018; Ruddick et al. 2018). Not least the considerable response to the theme issue of Society and Space (Peake et al. 2018) showed us that there was an audience desirous of troubling the hegemony of urban theory. Moreover, our approach of working as a team across hierarchies of junior and senior scholars, generations, genders, sexualities, institutions, and disciplines-a praxis we refer to as "the intergenerational social reproductive labor of knowledge production" (Peake et al. 2018, p. 377)-had been fruitful and positive and we wanted it to continue. It was as much a pedagogical experience of reading and writing together, and sharing meals, as it was an exploration of our places within the academy and an intellectual foray into urban theory. Abstract In this paper I argue that to understand the ethics of belief we need to put it in a context of what we care about. Epistemic values always arise from something we care about and they arise only from something we care about. It is caring that gives rise to the demand to be epistemically conscientious. The reason morality puts epistemic demands on us is that we care about morality. But there may be a (small) class of beliefs which (...) it is not wrong to hold unconscientiously. I also argue that epistemic values enjoy a privileged place in the panorama of what we care about because they are entailed by anything we care about. That means that when there is a conflict between caring about knowledge or true belief and caring about something else, that conflict cannot be resolved simply by following the one we care about the most because caring about knowledge in any domain is entailed by caring about that domain. Finally, I argue that whereas caring demands different degrees of conscientiousness in different contexts, contextualism about knowledge is less plausible. (shrink)

This paper summarizes various interpretations of emotional arguments, with a focus on the emotional mode of argument introduced in the multi-modal argumentation model (Gilbert, 1994). From there the author shifts from a descriptive account of emotional arguments to a discussion about a normative framework. Pointing out problems with evaluative models of the emotional mode, a paradigmatic shift captured by the Amenable Argumentation Approach is explained as a way forward for the advancement of the emotional mode and multi-modal argumentation.

It has been argued by disability advocates that supported decision-making must replace surrogate, or substituted, decision-making for people with cognitive disabilities. From a moral perspective surrogate decision-making it is said to be an indefensible form of paternalism. At the heart of this argument against surrogate decision-making is the belief that such paternalistic action expresses something fundamentally disrespectful about those upon whom it is imposed: that they are inferior, deficient or child-like in some way. Contrary to this widespread belief, I will (...) argue that surrogate decision-making sometimes expresses more respect for people with life-long, ‘severe’ or ‘profound’ cognitive disabilities than does the adoption of supported decision-making.. Specifically, I argue that in some cases supported decision-making can arguably express that people with severe or profound cognitive disabilities lack equal moral value. I also argue that supported decision-making for people with profound cognitive disabilities can arguably express that they lack complex and rich inner lives. If our aim is to ensure our behaviour and practices express respect for people with life-long ‘severe’ or ‘profound’ cognitive disabilities, then sometimes surrogate rather than supportive decision-making will be a better option. Women, Art, and Power?seven landmark essays on women artists and women in art history?brings together the work of almost twenty years of scholarship and speculation.

History education holds strong potential for students to examine how racism and other intersecting forms of oppression embedded within U.S. institutions have and still impact today’s social fabric. When rooted in Martell and Stevens’ “thinking like an activist” framework, history education provides opportunities for preservice teachers (PSTs) to see, understand, and disrupt the dominant narrative. They can begin to reimagine their roles as future leaders in the classroom and beyond to ensure that all students thrive and not just survive. Thus, (...) for this qualitative study, we engaged our PST in a book study of A Different Mirror for Young People: A History for Multicultural America. Through intentional content and pedagogical choices, we investigated the question, “ How do preservice teachers make sense of history using the ‘thinking like an activist’ framework?” Findings indicated how Takaki’s different mirror, as a counternarrative centering the perspectives and experiences of historically marginalized groups, allowed PSTs 1) to unlearn oppressive structures (cultural preparation), 2) begin to develop a sociopolitical consciousness of systemic oppression, albeit through an outsider’s perspective (critical analysis), and 3) to analyze how collective action in the past enacted change–although through an already, but not yet, understanding of their role in social change in the present (collective action). Society, based on contract and voluntary exchange, is evolving, but remains only partly developed. Goods and services that meet the needs of individuals, such as food, clothing, and shelter, are amply produced and distributed through the market process. However, those that meet common or community needs, while distributed through the market, are produced politically through taxation and violence. These goods attach not to individuals but to a place; to enjoy them, individuals must go to the place where they are. Land (...) owners, all unknowingly, distribute such services contractually as they rent or sell sites. Rent or price is the market value of such services, net after disservices, as they affect each site. By distributing occupancies to those who can pay the highest price, land owners’ interests align with those of society. Without this, tenure would be precarious—by force or favor of politicians. The 18th-century separation of land from state, so little studied by historians, permitted the development of modern property in land. This change is perhaps “the greatest single step in the evolution of Society the world has ever seen.” When land owners realize that they market community services, they will organize to produce and administer them as well, and society will be made whole. Michel Foucault’s formative years included the study not only of history and philosophy but also of psychology: two years after he took license in philosophy at the Sorbonne in 1948, he took another in psychology, and then obtained, in 1952, a Diplôme de Psycho Pathologie . From his earliest years at the Ecole Normale Superieur he had taken courses on general and social psychology with one of most influential psychologists of the time, Daniel Lagache, who was attempting to integrate psychoanalysis (...) with clinical methods.(Eribon 1991, 42) Foucault’s studies included experimentation and clinical instruction in which patients were presented in an amphitheatre just as in the days of Charcot. For several years after he had received his Diplôme, Foucault continued research in psychopathology, observing practices in mental hospitals, reportedly sometimes volunteering in experiments himself. He purchased the material required to administer Roschach tests, subjecting numerous friends to the inkblots, and became, when it was founded, the honorary president of the French Rorschach organization. Foucault’s first books were on the topic of the psychological characterization of madness and the development of clinical medicine, and his last books addressed the development of psychological norms within the establishment of modern prisons as well as within an increasingly scientific approach to sex. Thus, he worked at the intersections of philosophy and psychology throughout his life. Nonetheless, Foucault reported feeling an intense aversion to psychology no less than to philosophy.(Sheridan 1980, 5) Foucault’s oeuvre is almost exclusively focused on particular knowledges in the human sciences, especially those aspects which pertained to psychological theories of human behavior, capacity, and normative functioning. His historical approach to these, and his emphasis on the role of discourse, is readily reminiscent of Thomas Kuhn’s similarly historical approach to scientific method with its emphasis on the role of paradigms and the untranslatability of paradigm dependent objects.. Cet article analyse un rapport de l’Immigrants’ Protective League à Chicago (1931) qui porte sur le paiement des pensions alimentaires dans des familles séparées par la migration. Rédigé dans le cadre d’un projet de convention internationale sur l’assistance aux étrangers indigents, ce rapport présente les différentes tactiques utilisées par les travailleuses sociales de l’organisation pour réunir les familles afin d’éviter le recours aux tribunaux. L’analyse de la mise en récit des histoires de couples et de familles montre le processus de (...) légitimation du travail social international et met en évidence les pratiques des travailleuses sociales qui s’appuient sur les émotions pour rétablir un modèle social familial fragilisé par la migration. This chapter surveys the variety of ways in which people who may appear at first to be bystanders, or mere bystanders, to wrongdoing, harm or danger might instead share responsibility with other actors. My discussion divides cases into three rough, non- exclusive categories: (a) shared responsibility for wrongs and harms; (b) shared responsibility to provide aid; and (c) shared responsibility to enforce moral norms. The third category has received the least discussion to date. My modest goal for this portion of (...) the chapter is to highlight some ways in which the responsibilities of witnesses to wrongdoing need to be more thoroughly theorized. But, furthermore, I want to suggest that these cases show that active bystanders are not always preferable to passive ones. Sometimes, it is better for witnesses to wrongdoing to remain mere bystanders. (shrink)

This chapter reviews and evaluates the most common strategies for defending the view that, whatever other reasons might support forgiving in a particular case, forgiveness is defective when the person purporting to forgive lacks standing. Various arguments in favor of limiting standing are used in order to clarify what standing might be. In the end, I endorse an interpretation of standing as the possession of a normative power, which allows for the possibility of third-party forgiveness in some circumstances.

Habermas has argued that many of the endemic socio- economic problems of Western society are either symptoms or prod ucts of a 'lopsided' process of cultural rationalization, one that has emphasized instrumental forms of rationality over communicative. But other than presenting a rather general typology of lifeworld pathologies, Habermas has not done much to specify what these problems might be, nor has he provided any 'middle-range' analysis of the mechanisms through which they might be generated. This paper discusses some of (...) the ways in which, consistent with Haber mas's general framework, rational choice theory can be used for pre cisely this task. In this analysis, rational choice theory is not presented as a comprehensive theory of action, but is employed as a critical- diagnostic tool that allows the theorist to identify undesirable social interaction patterns that arise from a broader instrumentalization of the lifeworld. Moriarty argues that the Market Failures Approach to business ethics is inapplicable to “real world” problems, because it treats “market failure” as a failure to achieve Pareto efficiency. Depending upon how it is applied, Pareto efficiency is either trivially easy to satisfy or else so demanding that no real-world market could ever satisfy it. In this Commentary, I argue that Moriarty overstates these difficulties. The regulatory structure governing markets is best understood as an attempt to maximize the number of Pareto-improving (...) exchanges that occur. There is no reason to think business self-regulation cannot be guided by the same normative-conceptual framework. (shrink)

In this timely book, a Pulitzer Prize-winning reporter trains an autobiographical lens on a moment of remarkable transition in American journalism. Just a few years ago, the mainstream press was wrestling with whether labeling waterboarding as torture violated important norms of neutrality and objectivity. Now, major American newspapers regularly call the president of the United States a liar. Clearly, something has changed as the old rules of "balance" and "two sides to every story" have lost their grip. Is the change (...) for the better? Will it last? In Just a Journalist, Linda Greenhouse--who for decades covered the U.S. Supreme Court for The New York Times--tackles these questions from the perspective of her own experience. A decade ago, she faced criticism from her own newspaper and much of journalism's leadership for a speech to a college alumnae group in which she criticized the Bush administration for, among other things, seeking to create a legal black hole at Guantánamo Bay--two years after the Supreme Court itself had ruled that the detainees could not be hidden away from the reach of federal judges who might hear their appeals. One famous newspaper editor expressed his belief that it was unethical for a journalist to vote, because the act of choosing one candidate over another could compromise objectivity. Linda Greenhouse disagrees. The clinical literature on moral injury sometimes mentions the making of amends as part of a possible treatment plan. However, it is typically unclear how clinicians are conceiving of the making of amends or “atonement,” particularly in the context of the debilitating cluster of symptoms known as moral injury. This chapter reviews some culturally prominent conceptions of atonement. It then raises a number of objections to these and recommends an alternative model – a “reconciliation theory” of atonement – that can (...) avoid these objections. This theory conceives of wrongdoing as damaging relationships among victims, wrongdoers, and communities, and of atonement as repairing this damage. Atonement for serious wrongdoing isn't easy, but it isn't impossible either. Atonement comes in degrees. When pursued well, it offers benefits to victims and communities as well as to wrongdoers themselves. (shrink)

This chapter reflects on public apologies as means of moral repair by considering the various roles the public might play in these moral dramas. Audiences to public apologies include people who are related to the transgression in different ways. This chapter focuses on those parties in front of whom public apologies are intentionally performed but who are neither victims nor wrongdoers. Do such third parties add something of value to the apology? If so, how? How might they play their role (...) well? Under what circumstances might they forgive? How might things go poorly? Loss of the Y‐chromosome is a common feature of species with chromosomal sex determination. However, our understanding of why some lineages frequently lose Y‐chromosomes while others do not is limited. The fragile Y hypothesis proposes that in species with chiasmatic meiosis the rate of Y‐chromosome aneuploidy and the size of the recombining region have a negative correlation. The fragile Y hypothesis provides a number of novel insights not possible under traditional models. Specifically, increased rates of Y aneuploidy may impose positive (...) selection for (i) gene movement off the Y; (ii) translocations and fusions which expand the recombining region; and (iii) alternative meiotic segregation mechanisms (achiasmatic or asynaptic). These insights as well as existing evidence for the frequency of Y‐chromosome aneuploidy raise doubt about the prospects for long‐term retention of the human Y‐chromosome despite recent evidence for stable gene content in older non‐recombining regions. Abstract:This field survey focused on two constructs that have been developed to represent the ethical context in organizations: ethical climate and ethical culture. We first examined issues of convergence and divergence between these constructs through factor analysis and correlational analysis. Results suggested that the two constructs are measuring somewhat different, but strongly related dimensions of the ethical context. We then investigated the relationships between the emergent ethical context factors and an ethics-related attitude (organizational commitment) and behavior (observed unethical conduct) for (...) respondents who work in organizations with and without ethics codes. Regression results indicated that an ethical culture-based dimension was more strongly associated with observed unethical conduct in code organizations while climate-based dimensions were more strongly associated with observed unethical conduct in non-code organizations. Ethical culture and ethical climate-based factors influenced organizational commitment similarly in both types of organizations. Normative implications of the study are discussed, as are implications for future theorizing, research and management practice. (shrink)

This work analyzes the centrality of law in nineteenth-century historical and institutional economics and is a prehistory to the new institutional economics of the late twentieth century. In the 1830s the 'new science of law' aimed to explain the working rules of human society by using the methodologically individualist terms of economic discourse, stressing determinism and evolutionism. Practitioners stood readier than contemporary institutionalists to admit the possibilities of altruistic values, bounded rationality, and institutional inertia into their research program. Professor Pearson (...) shows that the positive analysis of law tended to push normative discussions up from the level of specific laws to that of society's political organization. The analysis suggests that the professionalization of the social sciences - and the new science's own imprecision - condemned the program to oblivion around 1930. Nonetheless, institutional economics is currently developing greater resemblances to the now-forgotten new science. (shrink)
