The compliance-based approach and the integrity approach have been the mainstream responses to corporate scandals. This paper proposes that, despite each approach comprising necessary elements, neither offers a comprehensive solution. Compliance and integrity, far from being mutually exclusive, reinforce each other. Working together, in a correct relationship, they build a harmonized system that yields positive synergies and which also advocates prudence. It enables the generation of a culture of compliance that tends to minimize the technical and ethical errors in decision (...) making. In order to explore an applied harmonized approach, we analyze the audit committee, a specific and broadly accepted regulatory instrument. Formed by non-executive members, regulation requires these members to be dedicated, qualified, and independent as a guarantee of efficiency. We show how the compound of those elements produces positive effects in a context of solid governance. We conclude that it is the strong relationship between efficiency and prudence, in the creation of a culture of compliance, which enables the minimization of errors. (shrink)
In this paper, the structure of a southeastern Spanish population was studied for the first time with respect to its inbreeding patterns and its relationship with demographic and geographic factors. Data on consanguineous marriages from 1900 to 1969 were taken from ecclesiastic dispensations. Our results confirm that the patterns and trends of inbreeding in the study area are consistent with those previously observed in most non-Cantabrian Spanish populations. The rate of consanguineous marriages was apparently stable between 1900 and 1935 and (...) then sharply decreased since 1940, which coincides with industrialization in Spain. A marked departure from Hardy-Weinberg expectations in the ratio of first cousin to second cousin marriages in the study population was observed. The high levels of endogamy and its significant steadiness throughout the twentieth century is noteworthy. Accordingly, our results show that exogamous marriages were not only poorly represented but also that this reduced mobility suggests that the choice of a mate was preferentially local. We found higher mobility in M22 with respect to M33 cousin mating. The relationships between population size and consanguinity rates and inbreeding fit power-law distributions. A significant positive correlation was observed between inbreeding and elevation. Many Spanish populations have experienced a prolonged and considerable isolation across generations, which has led to high proportions of historical and local endogamy that is associated, in general, with high \ values. Thus, assessing genomic inbreeding using runs of homozygosity in current Spanish populations could be an additional pertinent strategy for obtaining a more refined perspective regarding the population history inferred from the extent and frequency of ROH regions. An important approach to understand how the brain gives rise to consciousness is to probe the depth of unconscious processing, thus to define the key features that cause conscious awareness. Here, we investigate the possibility for subliminal stimuli to shape the context for unconscious processing. Context effects have generally been assumed to require consciousness. In the present experiment, unconscious context processing was investigated by looking at the impact of the context on the response activation elicited by a subliminal prime. We (...) compared the effects of the same subliminal prime on target processing when the prime was embedded in different unconscious contexts. Results showed that the same prime can evoke opposite responses depending on the unconscious context in which it is presented. Research question/issue This paper aims to contribute to an improved theoretical and empirical understanding of the role that corporation has to play in anticorruption efforts. Research findings/insights Using cross-country data from three databases (Bribe Payers Index, Corruption Perceptions Index, and Doing Business) we found that pro-bribery Investment Climate conditions in host countries are not related to the payments of bribes by multinational companies when these corporations operate abroad. Theoretical/academic implications After describing the conceptual and policy framework that (...) surrounds the discussion on the role played by firms in anticorruption, we present the current debate regarding the effectiveness of international bribery control instruments, with the World Bank-GAC (2006-2008) report as a basis. Both literature and policy seem to be divided into two main, although not mutually exclusive, positions: one demands improvements in Investment Climate conditions from a joint public-private consensus led by international agencies; the other one supports the effectiveness of self-regulation by firms, independent of Investment Climate improvements. The study provides empirical support to the idea that a better Investment Climate is not enough for reducing corrup tion. Practitioner/policy implications This study offers insights to policy makers interested in promoting the involvement of corporations in the fight against corruption. (shrink)
This empirical study explores the characteristics and degree of implementation of so-called ethics hotlines in transnational companies (TNCs), which allow employees to present allegations of wrongdoing and ethical dilemmas, as well as to report concerns. Ethics hotlines have not received much attention in literature; therefore, this paper aims to fill that gap. Through the analysis of conduct/ethics codes and the compliance programs of the top 150 transnational companies ranked by the United Nations Conference on Trade and Development (UNCTAD) ( 2007 (...) ), we carry out a descriptive and taxonomic study of these companies’ ethics hotlines. We analyze: (1) the basic characteristics of the mechanism, (2) the degree of exigency and the provision of safeguards, (3) the matters reported and the systems for reporting, and (4) the relationships between hotlines and economic characteristics of the firm. Our study compares financial and nonfinancial TNCs as well as North American and European TNCs. Our results show that many firms (especially from North America) have established these procedures. We also find some disparities between European and North American ethics hotlines that suggest differences in the orientation of the procedures. (shrink)
Der Mittelmeerraum stellt den Geburtsort der europäischen Philosophie dar. Die Philosophie wurde dort immer wieder marginalisiert, zuletzt nach dem Ende der Renaissance. In diesem Aufsatz werden die möglichen Ursachen dieser Marginalisierung hinterfragt. Diese war das Resultat des fortschreitenden christlichen und moslemischen Dogmatismus und der rigiden Kontrolle über die Philosophie. Doch die Geburt der neuzeitlichen Philosophie zeitigt auch eine Ablösung des dominanten Paradigmas durch die Priorität der Quantifizierung, was sowohl die neuzeitliche Wissenschaft als auch die Hauptlinie der neuzeitlichen und modernen Philosophie (...) charakterisiert. Die Tatsache, dass N. Abbagnano auch in Italien eine sekundäre Rolle gegenüber M. Heidegger spielt, provoziert weitere Fragen über das Schicksal der Philosophie im Mittelmeerraum. (shrink)
The aim of this paper is to explore the ethical dimension of hawala, an ancient informal financial practice rooted in Islamic moral traditions. Widely used in countries with an Islamic background and their diasporas, hawala is considered an important vehicle for the financial and economic development of some less developed countries. Nevertheless, in Western countries, hawala is regarded with suspicion due its controversial ethical nature. Unlike other Islamic financial institutions, the controversial questions are not the legitimacy of profit sources or (...) the interest charged, but rather the lack of transparency that surrounds hawala transactions. Yet, the literature on hawala has neglected its ethical perspective. Our study delves into this dimension with a critical approach, using the Triple Font Theory, grounded on virtue ethics. We conclude that if hawala transactions are carried out with honesty, and fairness, this practice deserves a positive ethical appraisal. However, it is necessary to implement efficient regulatory measures to guarantee that the system is not abused by money launders and criminals. In practice, it becomes imperative to bring over a change in the regulatory approach to hawala toward a more ethically, culturally, and economically sensitive strategy. Thus, future research should focus on how “hyper-norms” or fundamental principles inherent to humanity, which are common to both “formal” and “informal,” “Western” and “non-Western” financial practices, could run the new AML/CTF regulation agenda. Industrial (“white”) biotechnology promises to contribute to a more sustainable future. Compared to current production processes, cases have been identified where industrial biotechnology can decrease the amount of energy and raw materials used to make products and also reduce the amount of emissions and waste produced during production. However, switching from products based on chemical production processes and fossil fuels towards “biobased” products is at present not necessarily economically viable. This is especially true for bulk products, for example ethanol production (...) from biomass. Therefore, scientists are also turning to genetic modification as a means to develop organisms that can produce at lower costs. These include not only micro-organisms, but also organisms used in agriculture for food and feed.The use of genetic modification for “deliberate release” purposes, in particular, has met great opposition in Europe. Many industrial biotechnology applications may, due to their scale, entail deliberate releases of GM organisms. Thus, the biobased economy brings back a familiar question; is it ethically justifiable, and acceptable to citizens, to expose the environment and society to the risks associated with GM, in order to protect that same environment and to sustain our affluent way of life? For a successful innovation towards a biobased economy, its proponents, especially producers, need to take into account (take responsibility for) such issues when developing new products and processes. These issues, and how scientists can interact with citizens about them in a timely way, are further explored in projects at Delft University and Leiden University, also in collaboration with Utrecht University. Se replantea con ello la capacidad primordial del lenguaje metafórico y el valor propio del filosofar ingenioso frente al saber racional y deductivo, interpretando el ingenio en su justa apreciación humanista de función originaria en la constitución del mundo humano y la historia, del lenguaje y el saber retórico-filosófico.Considering Vico's definition of ingenium, the relationship (...) between necessity, ingenium, metaphor, and religious poetry is analyzed in the ingenious Spanish rhetoric of before Vico. The primordial capacity of metaphor is raised again, along with the real value of the ingenious philosophizing in the face of rational and deductive knowledge, interpreting ingenium through the humanist appreciation of original function in the make-up of the human world and history, of language and rhetorical-philosophical knowledge. SummaryPedigree structures of 161 uncle/niece-aunt/nephew and 4420 first cousin consanguineous marriages registered during the 19th and 20th centuries in two large and very different Spanish regions have been analysed and their genetic consequences evaluated. The frequencies of the different pedigree subtypes within each degree of relationship were quite similar in both populations despite significant heterogeneity in inbreeding patterns. The mean X-linked inbreeding coefficient for each type of cousin mating was calculated and compared to that expected for autosomal genes. The effect (...) of genealogical structure on theFx/Fradio was compared to different cultural populations worldwide. Preferentiality and avoidance of close consanguinity along with specific types of pedigrees are discussed on the basis of premarital migration and sociocultural rules still deeply rooted in certain human groups. The present study contributes elements to the literature for the understanding of those institutional factors of organizations that promote the creation of spin-offs in universities. Institutional barriers to spin-off creation within universities are addressed from a qualitative perspective. The study was carried out in Colombia, a country with low levels of innovation and entrepreneurship. Purposive and snowball sampling were employed to identify experts. Participants were selected in accordance with their extensive experience in entrepreneurship, innovation, or technology transfer. The sample size (...) was decided by saturation criteria, and 15 interviews were selected with this method. The semi-structured interview was chosen for information collection, and a thematic analysis was employed for data interpretation. Several aspects which permit suggestions for the future spin-off research agenda were identified: perceptions of the university, teaching focus, academic cultures that reward publication as a means of knowledge transfer, restrictions for public university spin-offs in developing countries, few economic and non-economic incentives for entrepreneurship, trust as a determining cultural characteristic, and limitations to the understanding of the spin-off concept that affect their creation. These results may be extrapolated to Latin America and other developing regions with similar entrepreneurial ecosystems. (shrink)
En este trabajo presentaré una forma de evitar los problemas más recurrentes en cierta versión del pluralismo lógico, aquella que defiende que incluso considerando un lenguaje fijo existen múltiples sistemas lógicos legítimos. Para ello, será necesario considerar los puntos de partida del programa pluralista y explicitar los problemas que de ellos surgen, principalmente el Desafío de Quine y el Problema del Colapso. Luego, propondré una modificación respecto de lo que se entiende por consecuencia lógica, para poder considerar una familia de (...) sistemas lógicos, las lógicas mixtas, que abarcan tanto a las lógicas puras como a las impuras. Finalmente, mostraré que con una interpretación razonable del formalismo se puede eludir aquellos problemas a la vez que se respeta el espíritu del programa pluralista. (shrink)
Albert Einstein je svojom specijalnom teorijom relativnosti definitivno opovrgao svaku mogućnost znanstvenog legitimiranja mehanicističkog pogleda na svijet, što implicira i opovrgnuće one metafizike materijalističkog predznaka koja se temelji na koncepciji razdvojenosti prostora i vremena. On je u specijalnoj teoriji relativnosti zasnovao pojam vremena i prostora kao jedinstvenog zbivanja, a taj je pojam oslobođen i od ravne metrike kakva obilježuje još i koncepciju Hermanna Minkowskog. Mnoštvenost jedinstvena vremena-prostora ukida i Galilejeve i Newtonove pojmove kao što su: apsolutni prostor, apsolutno vrijeme, apsolutno (...) mirovanje, te nepromjenjivost mase, a jednako tako i apsolutnost činjenice koja sadrži istodobnost dva prostorno udaljena zbivanja. Time su uspostavljene pretpostavke za razvoj tzv. postmoderne kozmologije. Autor postavlja pitanje otvara li postmodernizam ukozmologiji put za obnovu raznovrsnih onto-teokozmo-antropologija kojima je zajedničko htijenje da se ukine ideja povijesnosti, ili pak, naprotiv, Einsteinovo ukidanje pravocrtnosti otvara prostor afirmacije autentične povijesnosti. A upravo se u toj antitezi između metafizike i povijesnog mišljenja sastoji temeljni prijepor današnje filozofije,suočene i s lažnom alternativom iracionalizma i hiperracionalizma.Albert Einstein hat durch seine Spezielle Relativitätstheorie jegliche Möglichkeit der wissenschaftlichenLegitimierung einer mechanizistischen Weltanschauungdefinitiv widergelegt.Diesimpliziert ebenfalls die Widerlegungeiner Metaphysik materialistischer Art,die auf derKonzeptionder getrenntenExistenz von Zeit und Raum begründet ist.
