Our aim is to put into consideration the topics of “semantics”, “types”, “lifeworld” and “intersubjectivity” following the social theories of Alfred Schutz and Niklas Luhmann. First of all, and inversely to Luhmann’s perspective which receives the schutzian theory comparing equal types and semantics, we will show that types are inherent to subjectivity. Secondly, and consequently, we state that the social systems theory in the analysis of the “lifeworld”, does not pay attention to the past character of its constitution. Last, but (...) not least, we will point out that all these aspects are framed in a critique of the phenomenological notion of intersubjectivity, which from the luhmannian point of view, ignores the autonomy of consciousness, as well as the emergent character of the social. L’objectif, éminemment politique, de cet ouvrage est de proposer pour 2012 une alternative aux programmes court-termistes et consensuels qui pourraient être développés par les candidats lors de la campagne officielle pour les élections présidentielles. Loin des “yaka-fokon” et des déclarations d’intention pleines de bonne volonté, cet ouvrage met en lumière des solutions qui ont fait leur preuve, à petite comme à grande échelle, dans la plupart des domaines de la société. Pour chaque thématique, une personnalité “experte”, ayant développé une vision du sujet - voire souvent conduit ou observé une expérimentation -, propose en quelques pages des voies de transition concrètes, ainsi que les moyens à disposition de tous, qu’ils soient citoyens, élus ou entrepreneurs, pour les mettre en action. Chacune de ces propositions s’appuie sur un “cas pratique” : un exemple concluant mené à l’échelle d’un territoire européen (canton, département, région...). En affirmant que "tout philosophe a deux philosophies : la sienne et celle de Spinoza", Bergson exprime avant tout que le philosophe se doit de rompre avec une pensée dogmatique qui n'a plus lieu d'être et que Spinoza incarne tout particulièrement. Le spinozisme manifeste la pente de l'intelligence lorsqu'elle suit sa logique propre sans être rectifiée par le recours à l'expérience. Or, c'est cette démarche systématique que la philosophie doit désormais abandonner. Bergson est néanmoins hanté par la pensée de Spinoza (...) et le rapport qu'il entretient avec lui, en particulier dans ses cours au Collège de France, met en évidence un lien bien plus complexe et subtil qu'un simple rapport d'opposition. Contre la tendance à la clôture et à la systématicité, Bergson va alors privilégier chez Spinoza la tendance à l'ouverture et au mysticisme. En mettant en lumière cet aspect, cet ouvrage montre la sympathie intellectuelle qui réunit ces penseurs autour des notions de joie et de liberté. According to relativist accounts of discourse about, e.g., epistemic possibility and matters of taste, the truth of propositions must be relativized to nonstandard parameters. This paper argues that the central thrust of such accounts should be understood independently of relative truth, in terms of a perspectival account of assertoric force. My point of departure is a stripped-down version of Brandom’s analysis of the normative structure of discursive practice. By generalizing that structure, I make room for an analogue of the “assessment (...) sensitivity” MacFarlane characterizes in terms of relative truth. I argue that my reformulation supplies a stronger rationale for the most distinctive feature of MacFarlane’s brand of relativism, its account of when speakers ought to retract assertions. Furthermore, I show that the view usually regarded as a “moderate” alternative to MacFarlane’s “radical” relativism requires the more radical deviation from an absolutist account of assertoric force. Experiencing a stimulus in one sensory modality is often associated with an experience in another sensory modality. For instance, seeing a lemon might produce a sensation of sourness. This might indicate some kind of cross-modal correspondence between vision and gustation. The aim of the current study was to provide explore whether such cross-modal correspondences influence cross-modal integration during perceptual learning. To that end, we conducted 2 experiments. Using a speeded classification task, Experiment 1 established a cross-modal correspondence between visual lightness (...) and the frequency of an auditory tone. Using a short-term priming procedure, Experiment 2 showed that manipulation of such cross-modal correspondences led to the creation of a crossmodal unit regardless of the nature of the correspondence (i.e., congruent, Experiment 2a or incongruent, Experiment 2b). However, a comparison of priming-effects sizes suggested that cross-modal correspondences modulate cross-modal integration during learning and thus leading to new learned units that have different stability over time. We discuss the implications of our results for the relation between cross-modal correspondence and perceptual learning in the context of a Bayesian explanation of cross-modal correspondences. Locke's claims about the "inadequacy" of substance-ideas can only be understood once it is recognized that the "sort" represented by such an idea is not wholly determined by the idea's descriptive content. The key to his compromise between classificatory conventionalism and essentialism is his injunction to "perfect" the abstract ideas that serve as "nominal essences." This injunction promotes the pursuit of collections of perceptible qualities that approach ever closer to singling out things that possess some shared explanatory-level constitution. It is (...) in view of this norm regulating natural-historical inquiry that a substance-idea represents a sort for which some such constitution serves as the "real essence," i.e. as that on which all the sort's characteristic "properties" depend. Teaching research methods is especially challenging because we not only wish to convey formal knowledge and encourage critical thinking, as with any course, but also to enable our students dream up meaningful research projects, translate them into logical steps, conduct the research in a professional manner, analyze the data, and write up the project in APA style. We also wish to spark interest in the topics of research papers, and in the intellectual challenge of creating a research report, but we (...) have learned just how difficult these goals can be from teaching undergraduates and from serving as journal reviewers: many submissions contain flaws such as elementary errors of logic (e.g., using a null control condition instead of a placebo or dummy treatment), tangled statistics, a lack of graphs, and ungrammatical, unclear writing that violates APA rules. Yet these manuscripts are written by university faculty, often with doctorates and years of experience. Even published papers may contain egregious faults (Standing & McKelvie, 1986). And although we have both published widely, we still hone our skills. It requires optimism to expect that a typical undergraduate will do better, on the basis of just a year or two of studies in psychology. El acceso a la justicia es un derecho inherente de cada una de las personas dentro de los procesos penales a través de los diferentes mecanismos, uno de ellos es la prueba anticipada, materia de estudio del presente artículo; cuyo objetivo general es analizar el uso de la prueba anticipada en el proceso penal y su impacto en la protección de víctimas vulnerables y en los derechos fundamentales del imputado, para el mejoramiento de los mecanismos que permitan un equilibrio adecuado (...) entre ambas garantías. Este estudio se realizó a través de una investigación no experimental, puesto que se basa en bibliografía existente, con un enfoque cualitativo y alcance descriptivo, además se utilizó los métodos, exegético-jurídico e inductivo-deductivo y comparado. De acuerdo a los estudios realizados por diversos autores, la aplicación de la prueba anticipada de manera formal, efectiviza la garantía de los derechos de las víctimas vulnerables y de los procesados; sin embargo, existen algunas deficiencias en cuanto a la práctica de la misma, pues en el caso de las víctimas vulnerables aunque se pretende garantizar el derecho a la no revictimización en muchos casos no sucede al no ser aplicada como entrevista única; y en cuanto a los procesados, las audiencias de prueba anticipada se instalan sin la presencia de ellos, vulnerando los derechos al debido proceso y la igualdad de las partes procesales; así también existen casos donde la aplicación de la prueba anticipada no se efectúa de acuerdo a su condición de urgencia y necesidad. En conclusión, para garantizar la protección de los derechos de las víctimas vulnerables y de los procesados, se debe plantear reformas a la normativa penal ecuatoriana, con el fin de establecer las reglas para la práctica de la prueba anticipada. El Foro Global de Bioética en Investigación (GFBR por sus siglas en inglés) se reunió el 3 y 4 de noviembre en Buenos Aires, Argentina, con el objetivo de discutir la ética de la investigación con mujeres embarazadas. El GFBR es una plataforma mundial que congrega a actores clave con el objetivo de promover la investigación realizada de manera ética, fortalecer la ética de la investigación en salud, particularmente en países de ingresos bajos y medios, y promover colaboración entre países (...) del norte y del sur.a Los participantes en el GFBR provenientes de Latinoamérica incluyeron a eticistas, investigadores, miembros de comités de ética y representantes de autoridades sanitarias provenientes de Argentina, Brasil, Chile, Colombia, Ecuador, El Salvador, Guatemala, Honduras, Panamá, Perú, Nicaragua y la República Dominicana. Una legítima preocupación por la protección de las mujeres embarazadas y sus embriones o fetos ha llevado a la mayoría de los países de la Región de las Américas a limitar la realización de estudios con mujeres embarazadas exclusivamente a aquellos estudios específicos sobre el embarazo, y a requerir la exclusión sistemática de las mujeres embarazadas o de las mujeres que quedan embarazadas en el curso del estudio. Ciertamente, a lo largo de la historia de la ética de la investigación, se ha creído erróneamente que proteger a una población es sinónimo de excluirla de los estudios. Se sabe ahora que proceder así implica exponer a riesgos mucho mayores a la población que se busca proteger. El embarazo implica cambios fisiológicos sustantivos e impacta profundamente la manera como el cuerpo metaboliza los medicamentos. Sin embargo, por evitar hacer investigación con mujeres embarazadas, no se ha producido la evidencia científica necesaria para tomar decisiones sobre tratamientos e intervenciones preventivas con dosis eficaces y seguras para ellas y sus embriones o fetos. A manera de ilustración, en el 2001 había en los Estados Unidos apenas más de una docena de medicamentos aprobados para uso en el embarazo (1) y en el 2011 la Food and Drug Administration (FDA) aprobó por primera vez en 15 años un medicamento para su uso en el embarazo (2). Como consecuencia de no haber producido la evidencia necesaria, se pone en riesgo la salud de las mujeres embarazadas cada vez que se les da atención médica. Las mujeres embarazadas se enferman y las mujeres enfermas se embarazan, y no se sabe si los medicamentos que se les da son eficaces o siquiera seguros para ellas y sus embriones o fetos. (shrink)

Lionel Penrose (1898–1972) was an important leader during the mid-20th century decline of eugenics and the development of modern medical genetics. However, historians have paid little attention to his radical theoretical challenges to mainline eugenic concepts of mental disease. Working from a classification system developed with his colleague, E. O. Lewis, Penrose developed a statistically sophisticated and clinically grounded refutation of the popular position that low intelligence is inherently a disease state. In the early 1930s, Penrose advocated dividing “mental (...) defect” (low intelligence) into two categories: “pathological mental defect,” which is a disease state that can be traced to a distinct genetic or environmental cause, and “subcultural mental defect,” which is not an inherent disease state, but rather a statistically necessary manifestation of human variation in intelligence. I explore the historical context and theoretical import of this contribution, discussing its rejection of typological thinking and noting that it preceded Theodosius Dobzhansky’s better-known defense of human diversity. I illustrate the importance of Penrose’s contribution with a discussion of an analogous situation in contemporary medicine, the controversial practice of using human growth hormone injections to treat “idiopathic short stature” (mere diminutive height, with no distinct cause). I show how Penrose’s contributions to understanding human variation make such treatments appear quite misguided. (shrink)

A presente pesquisa propõe apresentar, pela primeira vez na área de conhecimento das Ciências da Religião, a análise do pensamento jusnaturalista de John Finnis acerca do aspecto humano da religião. Nas obras de sua autoria, Finnis apresenta uma reconstrução inovadora da teoria do direito natural de Aristóteles e Tomás de Aquino. Tal inovação foi publicada em 1980, sob a orientação de Herbert Lionel Adolphus Hart, que foi seu mentor quando na conclusão de seu doutorado, sendo que este último lhe (...) propôs o título da obra Natural Law and Natural Rights - Lei Natural e Direitos Naturais, o qual foi acolhido. A primeira publicação desta obra no Brasil ocorreu somente em 2007, pela editora Unisinos. Finnis enfatiza em suas obras a possibilidade de, por meio da razão prática, ser possível a identificação de sete bens humanos que ele mesmo os caracteriza como fundamentais básicos, dentre eles a Religião. Tais bens, segundo a sua compreensão acerca da teoria da lei natural de Aristóteles e Tomás de Aquino, consistem em valores inerentes ao ser humano, e, por assim o serem, são essenciais para o florescimento humano de cada indivíduo. Dessa forma, essa dissertação propõe-se a analisar como a teoria do direito natural de John Finnis colabora para pensar o lugar da religião no espaço público, no que condiz a sua ressignificação como fundamento ético para a formação dos direitos humanos. The British journalist Christopher Hitchens has recently noted that the extraordinary excitement created by l’affaire Pound, an excitement sustained for now some forty years, is partly the result of having no fewer than three debates going on whenever the poet’s legal situation and his consequent hospitalization are discussed. As Hitchens says, those questions are: “First, was Pound guilty of treason? If not, or even if so, was he mad? Third, was he given privileged treatment for either condition?”1 I propose to (...) discuss all three issues in a way that fairly reflects the fact that I am neither a physician nor a lawyer. What I know of the state of medical expertise, both today and in the period of time from 1943 to 1958 , leads me, as a layman, to believe that there is an enormous latitude of understanding among medical professionals as to the precise meaning of “insanity.” At one extreme, for some distinguished physicians, the term means almost nothing. They see it as a legal term and as therefore irrelevant to them; some of them follow the line of reasoning developed by Thomas Szasz over his long writing career, namely that “mental illness” if not illness in any ordinary sense of the term.2 For other medical practitioners, it does mean something, but only when it is redefined into much smaller subcategories and enriched with much more precise terminology, and when the given patient and his full range of circumstances are considered.What I know of the legal understanding of insanity is that there has been and is now little firm agreement about “insanity” or “madness.” Equally competent juries and courts have been able to set down findings that are more or less plausible on their face but do not seem to comport at all with each other. I tentatively conclude that whatever “insanity” now is in the United States, and whatever it was when Pound was found unfit to stand trial in 1945, the standard is not the lucid simplicity of the M’Naghten test, namely, the ability of the accused to understand the difference between “right” and “wrong.” Human mind, self-awareness, and motivations are vastly more complicated than such a test would imply. 1. Context: The idea for this article sprang from a desire to revive a conversation with the late Ernst von Glasersfeld on the heuristic function - and epistemological status - of forms of ideations that resist linguistic or empirical scrutiny. A close look into the uses of humor seemed a thread worth pursuing, albeit tenuous, to further explore some of the controversies surrounding the evocative power of the imaginal and other oblique forms of knowing characteristic of creative individuals. Problem: People generally (...) respond to humor, i.e., they are inclined to smile at things they find funny. People like to crack jokes, make puns, and, starting at age two, human infants engage in pretense or fantasy play. Research on creativity, on the other hand, has mostly scorned the trickster within. Cognitivists in particular are quick to relegate wit, whimsy, and even playfulness to the ranks of artful or poetic frivolities. Method: We use the emblems of the craftsman, the trickster, and the poet to highlight some of the oblique ways of knowing by which creative thinkers bring forth new insights. Each epitomizes dimensions intrinsic to the art of “possibilizing.” Taken together, they help us better understand what it means to be playful beyond curious, rigorous beyond reasonable, and why this should matter, even to constructivists! Results: The musings characteristic of creative individuals speak to intelligent beings’ ability to use glitches intentionally or serendipitously as a means to open up possibilities; to hold on to a thought before spelling it out; and to resist treating words or images as conventional and arbitrary signs regardless of their evocative power. To fall into nominalism, Bachelard insisted, is a poet’s nightmare! Implications: Psyche is image, said Jung, and when we feel alive we rely on the imaginal to guide our reason. Note that image is not here to be understood as a picture in the head or a photographic snapshot of the world. The imaginal does not represent, it brings forth what we understand beyond words. It does not lock us into a single mode. Instead, it is a call to be mindful, in Ellen Langer’s sense: in the present, mentally alert, and on the outlook for our psyche’s own surprising wisdom (sagacity. Constructivist content: Debates on the heuristic function and epistemological status of oblique ways of knowing have long occupied constructivist scholars. I can only guess whether my uses of Jung’s imaginal or Bachelard’s anti-nominalism would have amused or exasperated Ernst! I do know that, on occasion, Ernst the connoisseur, bricoleur, and translator allowed the rationalist-within to include the poet’s power to evoke as a legitimate form of rationality.
