Between the fall of the Soviet Union and the fall of Lehman Brothers, if the Anglophone academy could be said to have arrived at any consensus about the value of Marxist theory, it would be that Marxism was a quaint historical curio at best and a world-historically hubristic folly at worst. Today, however, well on our way through the first quarter of the twenty-first century, we live in a moment of greatly renewed interest in Marxist ideas. This curiosity is stoked (...) by, among other factors, the worldwide economic shocks of 2008 and, in more recent times, by impending climate catastrophe, incipient fascisticization, and the still-ongoing global COVID-19 pandemic. Any of these on its own would stand out as a rebuke to the neoliberal triumphalism of the 1990s, famously crystallized in Francis Fukayama's assertion that humanity had arrived at "the end of history," there to find permanently expanding capitalist prosperity. Taken together, they present at least strong prima facie evidence for what Karl Marx identified as the inherently and ineluctably crisis-ridden nature of capital and, therefore, good reason to encounter his writings anew. In the final pages of On What Matters, Volume II, Derek Parfit comments: ‘We live during the hinge of history... If we act wisely in the next few centuries, humanity will survive its most dangerous and decisive period... What now matters most is that we avoid ending human history.’ This passage echoes Parfit's comment, in Reasons and Persons, that ‘the next few centuries will be the most important in human history’. -/- But is the claim that we live (...) at the hinge of history true? The argument of this paper is that it is not. The paper first suggests a way of making the hinge of history claim precise and action-relevant in the context of the question of whether altruists should try to do good now, or invest their resources in order to have more of an impact later on. Given this understanding, there are two worldviews - the Time of Perils and Value Lock-in views - on which we are indeed living during, or about to enter, the hinge of history. -/- This paper then presents two arguments against the hinge of history claim: first, that it is a priori extremely unlikely to be true, and that the evidence in its favour is not strong enough to overcome this a priori unlikelihood; second, an inductive argument that our ability to influence events has been increasing over time, and we should expect that trend to continue into the future. The paper concludes by considering two additional arguments in favour of the claim, and suggests that though they have some merit, they are not sufficient for us to think that the present time is the most important time in the history of civilisation. Caring for unrepresented patients encompasses legal, ethical, and moral challenges regarding decision-making, consent, the patient’s values, wishes, best interest, and the healthcare team’s professional integrity and autonomy. In this article, I consider the impact of the aging population and the effects of the social determinants of health and suggest that without preventive intervention, the number of unrepresented patients will continue to increase. The health, social, and legal risk factors for becoming unrepresented require a multidisciplinary response. Medical-Legal Partnerships (MLPs) bring (...) healthcare and legal professionals together to address risk factors and health-harming legal needs. The article discusses the role of MLPs in identifying at-risk individuals, providing preventive interventions, and providing support. I make recommendations and conclude that proactive MLPs offer a sustainable approach to the ethical challenges in caring for unrepresented patients by providing interventions to prevent individuals from becoming unrepresented. Historically, the sociology of emotion has been relatively long on theory and short on methods. This collection of articles seeks to remedy this by introducing new ways to capture the four factors of emotion, as articulated by Thoits : meaning, expression, label, and physiology. As a group, these studies reify existing dichotomies in the literature—that is, emotional experience versus emotional expression—and seek to reconcile them. Additionally, they all champion the use of mixed methods—either simultaneously or sequentially—adopting some combination of direct (...) or indirect observation, subjective understanding/experience, and physiological change. Using examples drawn for their own research, the authors provide new ways to capture emotion that will carry emotion scholars into the next four decades of research. (shrink)

What I wish to do in this paper is to look at a part of John Stuart Mill's ‘one very simple principle’ for determining the limits of state intervention. This principle is, you will remember, that ‘the only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others. His own good, either physical or moral, is not a sufficient warrant.’.

While animal rights have been a central topic within moral philosophy since the 1970s, it has remained virtually invisible within political philosophy. This article explores two key reasons for the difficulties in locating animals within political philosophy. First, even if animals are seen as having intrinsic moral status, they are often seen as ultimately distant others or strangers, beyond the bounds of human society. Insofar as political philosophy focuses on the governing of a shared social life, animals are seen as (...) falling outside its remit. Second, even if animals are recognized as members of society, they are seen as lacking the capacities or competences said to be essential for politics, and for membership in the demos. We challenge both assumptions. Many animals live and work alongside us, within an interspecies society, and all members of society should have the right to shape decisions about how that society is governed. Why do racist oppression and capitalist exploitation often seem so inescapable and intractable? To describe and explain adequately the persistence of racist ideology, to specify its role in the maintenance of racial capitalism, and to imagine the conditions of its abolition, we must understand racist ideology as a form of false consciousness. False consciousness gets things “right” at the level of appearance, but it mistakes that appearance for a “deep” or essential truth. This chapter articulates a novel, positive account of (...) first-order false consciousness, which occurs in the case of false beliefs about the world that are sustained and superficially justified by objective social arrangements, and of second-order false consciousness, which occurs in the case of false beliefs about how one has come to hold the beliefs that one does. To dismantle racist ideology requires political movements that craft theoretical interventions highlighting the inessentiality and contingency of despised racial groups’ oppressed status, as well as practical interventions aimed at directly undermining the oppressive conditions that are reflected in racist beliefs about the “naturalness” or “appropriateness” of these groups’ degraded status. An increasing number of jurisdictions allow individuals to obtain medication prescribed by their physicians for medical assistance in dying (MAID). But discussion of whether (and to what extent) individuals have the right to use the health care system to control the time and manner of their death is not limited to MAID. The right also exists in other contexts, such as directing the withdrawal of life‐sustaining treatments. Palliative (or terminal) sedation involves medications to render a patient unconscious, coupled with either (...) the withdrawal of artificial nutrition and hydration or their not being administered at all. In high‐enough doses, these medications may further suppress already‐weakened cardiopulmonary function even if there is no intent to hasten death. When teaching about these topics, I challenge students to consider whether there are meaningful differences between practices like euthanasia, MAID, aggressive use of morphine, terminal sedation, or the withdrawal of ventilator support. Whether their differences are morally, ethically, or legally meaningful can be difficult to tease out. After recently watching a loved one, whom I call “Stephan,” direct the time and manner of his death within hospice care in a state that does not allow MAID, I am less inclined than ever to believe that the differences are meaningful in a way the law should recognize. An essay about hypochondria, past and present. Beginning with the observation that for centuries hypochondria has been blamed upon various forms of reading, I attempt to take seriously this venerable relationship between hypochondria and literature. By bracketing the medical and moral concerns that encumber most treatments of hypochondria, I instead seek to understand the condition as a method of reading, a close textual engagement that is at once anxious and oddly clear-sighted about its own limits, and which bears some similarities (...) to other, more familiar hermeneutic methods such as paranoid reading and ‘too-close reading’. In the second half of the essay, I draw upon the lives and writings of Maurice Blanchot and Franz Kafka, two writers who were themselves plagued by mysterious and unexplained symptoms, and attempt to show how the imperatives of literature as understood by each writer could meaningfully be described as hypochondriacal. Above all, then, this essay looks more closely at a figure whom it is difficult to take seriously, and asks whether, viewed from a certain angle, the hypochondriac might in fact be said to be endowed with a perspicuous if discomfiting form of insight. The objective of this article is to contribute towards a fuller critical understanding of gender relations/politics in mid-19th-century Spanish America. Its aim is to provide an account of the relationship Mexican President General Antonio López de Santa Anna established with his two wives. This study is particularly concerned with the representative value of Santa Anna's case in terms of 19th-century gender relations and the macho stereotype of the caudillo. Do Santa Anna's marital and extra-marital relationships confirm or question traditional views (...) on the position of women in Spanish America following the achievement of Independence? Do they conform with the ‘rock-star’ lifestyle generally attributed to the early 19th-century caudillo? A key aim of this study is to test the extent to which the relatively recent claim that women were more independent and influential than had been previously noted is borne out by case-studies of the women who shared their lives with the promiscuous six-times president Santa Anna. Watching a dramatic musical television episode reminded me of my own meltdown and reconstruction during the collection of my dissertation research. This stir of memory led me to write down my story. Seeking meaning in the experience of the studio teacher in an early childhood school, I co-participated in events that led me through a dramatic and transformative experience that deepened my awareness and understanding of what it means to teach and learn in the wondrous space of the atelier, otherwise (...) called the early childhood studio. We engaged in the meaning making process of our studio endeavours through keeping field notes and a journal, informally interviewing and engaging in collaboration sessions with the studio teachers, and reviewing the dissertation manuscript for authenticity. Through active listening and engagement, I collided with predicament. I learnt that the only way to move through the crisis-point is to ‘keep on living’. In the end, I came to a new sense of how to live and work in an early childhood studio and I also came to understand that life eats entropy. My experience in the studio became about the beauty of courage, time, and deep listening, as examined through the experiences of fear of the new and of my reconstruction into something more. This essay accounts for the adolescent popularity of The Fountainhead and Atlas Shrugged by arguing that both novels indirectly appropriate the mid-twentieth-century figure of the rebel. By denying their “prime movers” much of a childhood, however, both novels heroize rebels who never suffer the dilemma that defines the adolescent according to Erik H. Erikson: the struggle between identity and role confusion. Following Erikson and Julia Kristeva, this essay reads Rand's prime movers as figures of a post-Oedipal fantasy of self-reconciliation and (...) career-oriented drive—figures who invite their reader into the fantasy of a life lived without adolescence's defining identity crisis. "Since at least 1980 Godard’s cinema has been explicitly looking for (its) music, as if for its outside. In Sauve qui peut (la vie) Paul Godard hears, and asks about it, coming through the hotel room wall, and it follows him down to the lobby, but remains “off,” like Marguerite Duras’s voice, in spite of his questions, until the final sequence. At that moment, at the end of the section entitled “Music,” the protagonist is at the same time struck by (...) a car and struck by the entrance of the music into the diegetic present of the film, as the camera pans past an orchestra playing on the sidewalk while Paul fades off under the quizzical gaze of his daughter. By 2004, with Notre musique , it would seem to have taken over the whole text, for the film was announced as being about the collaboration between Godard and German record label ECM. In the context of that film it is difficult to determine both what that music is and who we are, although this discussion will try to advance a hypothesis in that regard. In fact, my main contention will be that music in Godard’s films functions as something like the absent image ( s ), not those it has lost but rather its cinema to come, what remains to be discovered and live within it, the survival of it. Not a cinema that cannot be seen, rather the image that can perhaps only be heard; and not the romantic or psychedelic dream of a synaesthetic apotheosis either, rather the technological coincidence of sonimage that has also been the precise direction of Godard’s cinematic research for more than thirty years. For the argument I will be making here is inscribed within my own investigation of what I call “technological life,” the means by which, in “prosthetic” symbiosis, or “dorsal” umbrality, a form lives beyond the simplistic opposition of animate and inanimate, or against the reductive presuppositions of autokinetic ipseity...". Other leaders are accessible there—Lincoln brooding in square-toed rectitude at his monument, a Mathew Brady image frozen in white, throned yet approachable; Jefferson democratically exposed in John Pope’s aristocratic birdcage. Majestic, each, but graspable.Washington’s faceless monument tapers off from us however we come at it—visible everywhere, and perfect; but impersonal, uncompelling. Yet we should remember that this monument, unlike the other two, was launched by private efforts. When government energies were (...) stalled, in the 1830s, subscriptions kept the project alive. Even when Congress took over the project, stones were added by the citizenry, those memorial blocks one can study while descending the long inner stairway. The classical control of the exterior hides a varied and spontaneous interior—an image of the puzzle that faces us, the early popularity of someone lifted so high above the populace. The man we can hardly find was the icon our ancestors turned to most easily and often. We are distanced from him by their generosity, their willingness to see in him something more than human.The larger they made Washington, the less they left us to admire—until, in Horatio Greenough’s George Washington, he becomes invisible by sheer vastness. Greenough took for his model what the neoclassical period believed was the greatest statue ever created, by the greatest sculptor who ever lived—the Elean Zeus of Phidias. Since that chryselephantine wonder was no longer extant, artists had to rely on the description given by Pausanias in the Description of Greece, and on coins of Elis that celebrated the work. In his discussions of justice and of friendship in the Nicomachean Ethics, Aristotle appeals frequently—without much explanation—to temporal considerations. I take these indications as a key for sorting out the systematic significance of Aristotle’s claim that “when people are friends, there is no need for justice” (NE VIII.1.1155a26). Mainstream educational theory and practice tend to favour what Freire, in Pedagogy of the Oppressed, has called ‘banking education’, in which students are seen as depositories of knowledge. But seeing pedagogy as a matter of simply communicating knowledge misses the epistemological complexities of our relationship with the world. By means of a reading of the Dao De Jing and the Zhuangzi, in this paper I intend to explore how the communication of not-knowing may be of central value in teaching and (...) learning. Arguing that our lives are characterised by an ‘epistemological chaos’ in which the distinctions between knowing and not-knowing can never be firmly established, I suggest that the Daoist texts may allow teachers and students to rethink the purpose of education as a matter of yang sheng, or ‘nourishing life, by means of developing skill in dealing with the epistemological chaos in which we are immersed. This essay illustrates senses in which linear time can be proven to be non existent. Yet, as the essay agrees, the practical use of linear time, as an organizational principle in life, is unquestionable. Do we live a lie by relying on the non existent to undergird our lives? Or is lie a misleading, and naïve, word for our solution to this state of affairs?

Advance directives are propagated as instruments to maintain patients’ autonomy in case they can no longer decide for themselves. It has been never been examined whether patients’ and healthy persons themselves are inclined to adhere to these documents. Patients’ and healthy persons’ views on whether instructions laid down in advance directives should be followed because that is (or is not) “the right thing to do”, not because one is legally obliged to do so, were studied and compared with that of (...) medical staff. Method: Vignette study presenting five cases. Cancer patients, healthy persons, nursing staff and physicians (n = 100 in each group) were interviewed. An adherence score was calculated (maximum value 5). The adherence score is found to be low in all groups, yet lowest in patients (1.55; standard deviation 1.13) and healthy controls (1.60; 1.37). The scores are significantly different between nursing staff on the one hand and patients and healthy controls on the other (p < 0.005 and p < 0.05, respectively), and between doctors and patients (p < 0.05). Interviewees who want these documents to be followed tend to live alone and to have already written an advance directive. Conclusions: Cancer patients and healthy persons widely disregard instructions laid down in advance directives and consider them less binding than physicians and nursing staff do. Only a minority tends to adhere more to advance directives. To improve decision-making at the end of life when patients are no longer able to decide for themselves alternative concepts, such as advanced care planning, should be considered. (shrink)

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement (...) constituted a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. Views of fire in the contemporary physical sciences arguably accord with Heraclitus’ proposal that ‘all things are an exchange for fire, and fire for all things, as goods for gold and gold for goods.’ Fire is a media, as John Durham Peters has stated, a species of transformative biochemical reactions between the flammable gases found in air, such as oxygen, and those found in fuels, such as plants. Inspired by an ignition source, these materials react and transform themselves and their (...) surrounds into light and heat energy, carbon dioxide, water vapour, char and much else besides. Fire is conjunctural, durational and transformative. Fire is a dialectician, at once consuming living and dead organic matter and providing both the space and ingredients for new and renewed organic life. In this article, we draw upon our experience of combustible contexts—Australia, Canada and the Philippines—to consider the diverse ways in which fire is today framed as a social problem, an ecological process, an ancient tool, a natural disaster, a source of economic wealth and much more. In this way, we seek to explore the value and limits of ‘elemental thinking’ in relation to the planetary predicaments described by ‘the Anthropocene’. (shrink)

In the literature three mechanisms are commonly distinguished to make decisions about the care of incompetent patients: A living will, a substituted judgment by a surrogate (who may or may not hold the power of attorney ), and a best interest judgment. Almost universally, the third mechanism is deemed the worst possible of the three, to be invoked only when the former two are unavailable. In this article, I argue in favor of best interest judgments. The evermore common (...) aversion of best interest judgments entails a risk that health care providers withdraw from the decision-making process, abandoning patients (or their family members) to these most difficult of decisions about life and death. My approach in this article is primarily negative, that is, I criticize the alleged superiority of the living will and substituted judgment. The latter two mechanisms gain their alleged superiority because they are supposedly morally neutral, whereas the best interest judgment entails a value judgment on behalf of the patient. I argue that on closer inspection living wills and substituted judgments are not morally neutral; indeed, they generally rely on best interest judgments, even if those are not made explicit. abstract Many people assume that invasive research on animals is justified because of its supposed benefits and because of the supposed mental inferiority of animals. However probably most people would be unwilling to sign a living will which consigns themselves to live biomed‐ical experimentation if they ever, through misfortune, end up with a mental capacity equivalent to a laboratory animal. The benefits would be greater by far for medical science if living will signatories were to be (...) used, and also the mental superiority boast would no longer apply. Ultimately, it is argued that invasive biomedical experiments would be unacceptable in a democratic society whose members are philosophically self‐consistent. (shrink)

Advance directives such as living wills are attractive in that they give us a sense of control over our futures. But they also tend to obscure conflicts between a patient's competent wishes and later, incompetent interests. They allow caregivers to avoid evaluating quality of life in assessing the best interests of incompetent patients.
