Terminally ill patients in 10 states plus Washington, D.C. have the right to take prescribed medications to end their lives (medical aid in dying). But otherwise-eligible patients with neuromuscular disabilities (ALS and other illnesses) are excluded if they are physically unable to “self-administer” the medications without assistance. This exclusion is incompatible with disability rights laws that mandate assistance to provide equal access to health care. This contradiction between aid-in-dying laws and disability rights laws can force patients and clinicians into violating (...) one or the other, potentially creating an underclass of patients denied medical care that is available to those with other (less physically disabling) terminal illnesses. The immediacy of this issue is demonstrated by a lawsuit in Federal court filed in August 2021, requesting assistance in self-administration for terminally ill patients with neuromuscular diseases. This paper discusses the background of this conflict, the ethical issues at the heart of the dilemma, and recommends potential remedies. (shrink)

George Herbert Mead argues that human society is comprised of six basic institutions—language, family, economics, religion, polity, and science. I do not believe that he can be criticized for making institutions the cornerstones of a society, but he can definitely be criticized for his explanation of how our basic institutions originate, how these institutions operate in society after their inception, and how they later change, modifying society in the process. The problem with Mead's explanation of these three critical matters is (...) that he based them on his principle of “sociality” rather than on the principle of “domination.” If Mead's principle of sociality is replaced by the principle of domination and his notion of the “generalized other” is replaced by the notion of the “phantom community,” then most of these problems can be largely solved. Thus, in this paper, I will not only point out the key problems in Mead's theory of society, but I will also offer solutions to them based on the notions of domination and the “phantom community.” The end product is a “radical interactionism” that surpasses Mead's original interactionism in identifying the part that both domination and the composite “other” play in every known human society—big and small, and past and present. The eight primary chapters cover Jainism, Buddhism, Confucianism and Daoism, Hinduism, indigenous traditions, Islam, Judaism, and Christianity. There is a summary epilogue and each chapter has a bibliography. Subverting Hatred [End Page 292] ought to be read in religious study groups as well as in academic settings for the study of religion.Editor Daniel Smith-Christopher teaches theological studies and directs the Peace Studies program at Loyola Marymount University in Los Angeles; he is also the author of The Religion of the Landless. In the introduction, Smith-Christopher sets out the intent of this collection. First, in the face of clear evidence that religious traditions "can be manipulated and used to justify all kinds of violence," it is vital to argue that religions are not inevitably "divisive and destructive" (p. 9). Second, the book presents the positive claim that it is "precisely the call to nonviolence that embodies one of the noblest values and sacred obligations of religion" (p. 10). Here, nonviolence means active peacemaking rather than merely refusal to engage in violence.It was exciting to see a chapter devoted to Jainism, and have it be the first of the book. The author, Christopher Chapple, is professor of theological studies and director of Asian and Pacific Studies at Loyola Marymount University; among his publications is Nonviolence to Animals, Earth, and Self in Asian Traditions. Rooted in the deep strand of nonviolence it shares with Hinduism and Buddhism, Jainism powerfully advocates nonviolence. The earliest records of the religious impulse in the Indus Valley are also the earliest images most associated with nonviolence in these religious traditions. These cylinder seal impressions of figures seated in the yoga position surrounded by plants and animals can still evoke a sense of a calm and peace. Thus, in Indian traditions the connection of nonviolence to meditative practices is inseparable.Jainism has arguably made nonviolence a central teaching for all adherents to a greater extent than other traditions. The earliest text of the Jain tradition, the Acaranga Sutra (fourth or fifth century B.C.E.) makes this clear: "'All breathing, existing, living, sentient creatures should not be slain, nor treated with violence, nor abused, nor tormented, nor driven away. This is the pure, unchangeable, eternal law." Further, the reason for this prohibition is also presented: the desire to harm arises from a false sense of self-interest, and violence ultimately comes back to harm us. Chapple then presents some striking historical examples of Jain scholarship and nonviolent action. In conclusion, though Jainism has focused upon individual spiritual liberation, Jains do not "disengage from worldly life" (p. 19), but act to promote violence reduction in society.The author of the next chapter, Christopher Queen, is at Harvard and is co-editor of Engaged Buddhism: Buddhist Liberation Movements in Asia; his interest in the social dimensions of Buddhist nonviolence is reflected in this essay. He shows how the "Peace Wheel" of Buddhist nonviolence transforms the image of the wheel of the war chariot. As the Vedic tradition developed, it produced contrasts to the tradition of yogic nonviolence shared with Jainism. The sun-disk of Vishnu and chariot of Indra were associated with war, and their symbol was the chariot wheel. In contrast, Buddha turns the wheel "by peaceful means."Queen suggests that while much of the attention in the West has focused upon the "inner peace" offered by Buddhist meditation, it is vital that we see the social [End Page 293] setting of Buddhist practice. The meaning of niche and competitive ability have long been surrounded by controversy. The reason for this stems from the obscure relationship that exists between these terms. This extends from the views of Darwin through Eltonian tradition to current views in which the meaning of competitive ability is implicitly infused into the paradigm of niche. Distinct operational definitions for niche and competitive ability are therefore established with special reference to plants. It is proposed that potential niche refer explicitly to a (...) theoretical hyperspace of places where a species would leave descendents if all biotic interactions were precluded, and that competitive ability refer to the relative capacity to leave descendents in a particular place in the face of restrictions imposed by competitive interaction. This leads to a qualitative comprehensive theory for coexistence which may be extended to any type of biotic interaction. Niche and competitive ability are both determined by the biological attributes of a species and may be independently adjusted in a population by natural selection in contexts of competition. Species coexistence in nature may therefore be a consequence of alternative evolutionary mechanisms which may operate to various degrees in concert: (1) natural selection leading to niche differentiation; (2) an ongoing process of reciprocal selection (coevolution) which maintains an approximate balance in relative competitive abilities for contested resources. A plea has been made for replacing the perspective of “symbolic interactionism” with a new interactionist's perspective—“radical interactionism.” Unlike in symbolic interactionism, where Mead's and Blumer's ideas play the most prominent roles, in radical interactionism's, Park's ideas play a more prominent role than either Mead's or Blumer's ideas. On the one hand, according to Mead, the general principle behind the organization of human group life was once dominance, but it is now “sociality.” On the other hand, according to Park, this (...) general principle is now and has always been dominance. Blumer takes a position much closer to Mead's than Park's arguing that the general principle underlying the organization of human group life is sociality. Under certain special conditions, however, it can become dominance. Although like radical interactionism, symbolic interactionism is rooted in pragmatism, unlike in radical interactionism, symbolic interactionism is still plagued with strains of utopian thought, among which the notion of sociality is the most virulent. Sociality may be the principle on which human group life is organized in heaven, but, down here on earth, it remains organized on the basis of domination. Thus, radical interactionism provides a much-needed antidote to the idealistic overtones still found in symbolic interactionism. (shrink)

Recent prescriptions for rescuing civilization from collapse involve extending our human capacity for empathy to a global scale. This is a worthy goal, but several indications leave grounds for cautious optimism at best. Evolutionary biology interprets non-kin helping behaviors as products of natural selection that rewarded only the transmission success of resident genes within ancestors, not their prospects for building a sustainable civilization for descendants. These descendants however are now us, threatened with ruin on a warming, overcrowded planet—and our evolutionary (...) bequeathal, in giving us empathy, may have also given us potential for resolve in guiding cultural evolution for the best interests of humanity. But can the latter trump the best interests of our genes? And if so, now that the liberal copying success of our genes is in conflict with the best interests of a sustainable civilization for our descendants, do the latter risk losing the empathic instinct presently called upon to save them? What are some of the key historical trends in hours of work per worker in US? What economic, social-psychological, organizational and institutional forces determine the length of individuals' working hours? How much of the trend toward longer working hours among so many workers may be attributable to workers' preferences, workplace incentives or employers' constraints? When can work become overwork or workaholism – an unforced addiction to incessant work activity which risk harm to workers, families or even economies? The first part (...) of this article traces the history of the length of working hours and its recent polarization. The second part develops a multi-disciplinary model to identify motivations behind working longer hours. Individuals' desired work hours will stem from the weighted contribution of five sources: (1) current real wage rates; (2) forward-looking, wage trajectories; (3) relative status associated with hours of labor; (4) intrinsic rewards, process benefits or amenities acquired through work; (5) hours demanded by the employer and other structural constraints, to which workers may adapt. Employers and their established conditions of work have influenced the course of long run trends labor supply and in work time structures. The final section suggests policies that might address the persistence of long hours. (shrink)

The implications of this paradox are explored here, including the question of where then does the Darwinist find meaning in life? The main source, it is proposed, is from cognitive domains for meaning inherited from sentient ancestors—domains that reveal our evolved (...) human nature as the fool that it is: given to distractions and delusions of many kinds, designed by natural selection primarily for one essential purpose—to allay our instinctual fear of failed legacy, rooted in our uniquely human awareness that we are not immortal. Darwinism, however, also teaches that genuine legacy is a fate enjoyed only by individual genes. Accordingly, as argued here, those genes with the grandest legacy—and hence rampant within us—are of two types: “legacy-drive” genes delude us into thinking that the legacy can be individually and personally ours; and “leisure-drive” genes distract us from the agonizing truth that it can never be. The most rudimental delusion of legacy is the perception of offspring as vehicles for memetic legacy—the transmission of resident memes from one’s mind to the minds and behaviors of offspring— thus also ensuring genetic legacy: the transmission of resident genes, including importantly, genes inherited from ancestors that influence both legacy and leisure drives. Today, legacyand leisure-drive genes reveal their phenotypes across a wide range of human affairs, and together with the phenotypes of survival- and sex-drive genes, they provide a foundation for a novel view of the Darwinian roots of cultural evolution. The study of infant social cognition is the study of how human infants acquire information about people. By examining infants’ sensory abilities and the stimulus characteristics of people, research can determine what information is available to infants from their social world. We can then consider what social environments are appropriate for infants of different ages. This paper examines the sociocognitive competencies of human infants during the first 6 months of their lives and asks how these competencies are functional in the (...) daily social ecology of the human infant. Select examples of research with other species are used to illustrate how the adaptive significance of sociocognitive abilities could be more fruitfully explored in studies of human infancy. In this study, undergraduate business students indicated the degree to which three activities were ethical or unethical, how likely they would be to commit each action, and how likely they thought the average student would be to commit each action. Significant declines in ethicality were found between comparisons of the ethical appropriateness of each scenario and the students’ personal intentions to commit the action, and between personal intention and the students’perceptions of other students’ actions. The comparison between self and others (...) was attenuated by academic classification with seniors perceiving their peers’ behavior as similar to their own. This demonstrates that business students do have an ethical blind spot both in acting contrary to their own stated ethical beliefs and in believing that their peers will commit unethical actions while they would not. We encourage faculty to develop reflective curricula that require students to actively engage in ethical decision-making. In addition, ethical training should, when possible, address the entire ethical decision-making process, from awareness, to intention, to actual behavior. Finally, students should be made aware of the unfounded disparities between their perceptions of their own actionsand their perceptions of their peers’ actions. (shrink)

I sin udmærkede kommentar til vores artikel «En etisk diskussion af screening for kræftsygdomme» beskriver Geir Hoff den udtalte mangel på evidens vedrørende nytteværdien af screeningsprogrammer for kræftsygdomme baseret på randomiserede studier. Ydermere fremhæver Geir Hoff misforholdet mellem den manglende evidens ved screening og de strenge krav, der er til evidensen i den farmaceutiske industri. Dette er en velkommen kritik, pga. en udtalt ukritisk og uvidenskabelig tilgang til anvendelse af screening for denne eller hin sygdom eller risikofaktor.

I 2007 gennemførte forbundskansler Angela Merkel en sundhedsreform der blandt andet indebærer, at tyske borgere ikke frit kan afgøre, om de vil deltage i forebyggende programmer, da et fravalg kan medføre økonomiske konsekvenser. Hermed udvider den tyske stat sin ret til at gribe ind i borgernes liv, når det handler om sekundær forebyggelse, fx i form af screening for kræftsygdomme. Dette kan være problematisk da den bedst tilgængelige evidens viser at tre igangværende kræftscreeningsprogrammer ikke kun har gavnlige virkninger, men også (...) betydelige skadelige virkninger. Formålet med denne undersøgelse var at undersøge, hvilke holdninger eksperter, politikere og sundhedsmyndigheder i Danmark har til tvang og/eller belønning i forbindelse med screening for kræftsygdomme, og om de ville støtte eller fraråde en tysk model i det danske sundhedsvæsen.Der blev foretaget enkeltinterviews med strategisk udvalgte eksperter. Interviewene blev transskriberet og analyseret med en fænomenologisk analysemetode, og derefter analyseret og diskuteret i forhold til utilitaristisk og deontologisk etik, samt evidensen vedrørende de tre eksisterende kræftscreeningsprogrammer i Danmark.Alle informanterne var kritiske over for det tyske forslag. Til gengæld blev forholdet mellem de gavnlige og skadelige virkninger af kræftscreening vurderet meget forskelligt. Manglen på enighed, uklare udtalelser og ikke-stringent terminologi bestyrkede vor konklusion; at det danske sundhedsvæsen for det første ikke bør følge den tyske kurs og, for det andet, at man bør være kritisk over for implementering af screeningsprogrammer for kræftsygdomme. Hvis forebyggende initiativer kan være mere til skade end gavn, bør de altid overvejes nøje i lyset af sundhedsvæsnets oprindelige intention om at hjælpe og beskytte det enkelte menneske. (shrink)

This book offers productive new readings of Merleau-Ponty’s political philosophy and of other facets of his thought.

Este libro va dirigido esencialmente a los estudios de Postgrado de las Facultades de Filosofía de la UNED y de la UAM, en primer lugar, y de las universidades españolas e iberoamericanas en general. Pero sin duda interesará a cualquier persona que quiera estar al tanto del pensamiento filosófico actual. Es decir, de las Ideas propias de nuestro tiempo-espacio del pensar y de su diferencia histórica y mediática. La cuestión de la Filosofía de la Historia y la Historia Universal puesta (...) en cuestión, están en el centro de las investigaciones que se van hilvanando cronológicamente en estos dos libros dedicados al pensamiento y la intervención de Los hijos y las hijas de Nietzsche. Ya que estos dos libros: Materiales de Ontología Estética y Hermenéutica (Los hijos de Nietzsche I) y El retorno teológico-político de la inocencia (Los Hijos de Nietzsche II) tratan precisamente de eso: de dar cuenta de cómo y por qué se ha producido ese giro transhistórico: el que va, por así decirlo (y lo significativo es que se pueda decir así) desde la Dialéctica de La Historia Universal –Y la lógica de la Emancipación y Superación que la preside – hasta la Hermenéutica de la Historicidad Plural –y la lógica de la comprensión e interpretación dialogal que la constituye –, en busca de nexos o de acuerdos posibles entre las diferencias enlazadas. La percepción sincrónica y sus regímenes de enlace y sentido, como sobredeterminación condicional de los universos diacrónicos y cinéticos está en el centro operacional y corazón noético de todos estos escritos. Pues no otro sino el predominio condicionante de la sincronía sobre la diacronía expresa el giro esencial de nuestra época, en medio de las sociedades telemáticas de la comunicación. Estos trabajos que se entregan al lector, ya de escritura, ya de recreación audiovisual de la palabra, son solamente eso: materiales para una ontología estética y hermenéutica, del espacio y el tiempo, del acontecer del lenguaje del ser, en el que todos nosotros nos jugamos la vida–muerte que se construye entre todos; que cada cual puede construir a su manera para que podamos jugar juntos, con tal de respetar una sola regla: la ley del límite limitante que es condición del juego ontológico mismo y de su hermosa, inagotable, intensa, creatividad. Comprender que este desafío nos reclama hacia un nuevo pensar, viniendo desde la apelación de la propia voz del ser del tiempo, tal y como se vierte en las obras y en la experiencia del lenguaje de las acciones participativas extáticas, proporciona a la ontología estética (del espacio y el tiempo) y la ontología política (de la ley común) un complejo e inaplazable enclave: el de la ontología de nuestro propio presente, hoy todavía por emerger, y sometida a brutales fuerzas ilimitadas. Tant par son œuvre politique importante que par le potentiel créateur de son travail sur la perception, l'expression et l'ontologie, Maurice Merleau-Ponty a exercé une influence peu remarquée sur la pensée politique française. Aux lectures des Aron, Sartre et Lefort qui ont déterminé la compréhension et le sens politiques de l'œuvre de Merleau-Ponty s'ajoute une postérité immédiate chez ses contemporains. Colette Audry, Tran Duc Thao, Jean-Toussaint Desanti, et Frantz Fanon furent marqués par leur proximité à Merleau-Ponty tout autant que par (...) ses écrits, reprenant chacun à son propre compte son attitude. Une postérité silencieuse, quelque peu différée, se remarque chez Cornelius Castoriadis, Françoise Collin et Jean-François Lyotard, qui construisirent leurs pensées dans une rupture créative avec celle de Merleau-Ponty. Enfin, une postérité politique se fait sentir dans le moment qui nous est contemporain): Vincent Peillon, Marc Crépon et Luce Irigaray reviennent ici sur leur relation à sa philosophie et sur ce qu'elle permet de penser.
