Following Manne (1966, Insider Trading and the Stock Market (New York, Free Press)) we introduce a distinction between insider trading and market manipulation on the one hand and corporate insiders versus misappropriators on the other hand. This gives rise to four types of alleged inside transactions. We argue that the literature on insider trading has often targeted inside transactions type II, III and IV but that these arguments do not necessarily hold for type I transactions. We look for consequentionalist as (...) well as non-consequentionalist arguments against type I transactions and demonstrate that these are hard to find. Throughout the article we refer extensively to the economic literature on insider trading in order to overcome a relative divide between the economic, legal, and philosophical discussion on insider trading. As Socially Responsible Investment (SRI) enters the mainstream of professional and institutional investment practice, some perplexities arise. Some SRI market participants are well schooled in finance but are hesitative as to how to apply non-financial criteria in the management of portfolios. Governments too are giving SRI more attention and, in some countries, are discussion whether and how to regulate the SRI market. Advocacy groups are targeting SRI projects through media campaigns using political discourse. Many of the pertinent questions that come (...) with these perplexities are of the philosophical or ethical type and concern legitimisation, demarcation of responsibilities, interpretation of norms and policy formulation. The inclusion of non-financial criteria into investment decision-making leads to a ‹puzzle in SRI’ for which this article offers a solution. The puzzle arises when the day-to-day implementation of an SRI-policy coincides with the process of administering justice. Three questions make up that puzzle: (1) what should an␣investor do when allegations arise about a corporation, (2) what should an investor do when a corporation is brought before a court, (3) what should an investor do when a corporation is found guilty by a court. This article argues, by distinguishing between the rationality of the investor and that of the judge, that allegations, court cases or court verdicts should not be reasons to disinvest from a corporation. This article offers examples from investor practice and points out in which way allegations, court cases and court verdicts make sense for investor behaviour. (shrink)

This paper demonstrates the innovative character of the approach to metaethics underlying John Dewey’s pragmatism. Dewey's theory of evaluation is contrasted with one of the most dominant contemporary metaethical theses: constructivism. I show that the insistence placed by metaethical constructivists on the actor’s practical point of view, on the rejection of the subjective preferences model, and on a specific form of ethical antirealism and naturalism echoes some of the most crucial claims made by Dewey. This argumentation leads to my main (...) hypothesis: an analysis of Dewey's conception of evaluation allows us to highlight the groundbreaking character of its metaethical approach—an approach that will be characterized as fairly constructivist. La raison pour laquelle il y a inadéquation de notre connaissance à la nature des corps extérieurs, mais aussi à celle de notre corps propre ainsi qu'à celle notre esprit, et donc à la nature de notre ego, c'est que nous sommes des êtres finis. Pour Descartes comme pour Spinoza la finitude de notre entendement rend impossible l'adéquation de la connaissance. À la connaissance adéquate, Descartes substitue la connaissance complète : certaine, mais non-absolue, vérifiée, mais seulement provisoire. La mise au (...) jour de cette première origine cartésienne de la théorie spinoziste de l'idée adéquate conduit l'auteur à l'hypothèse suivante : cette théorie accomplirait au sein de la métaphysique rationnelle développée dans l'Éthique la doctrine de la révélation et de la grâce présente dans la pensée théologique chrétienne. Dès lors il met en évidence la correspondance entre la vision béatifique suarézienne et la connaissance adéquate spinozienne, la première anticipant historiquement la seconde, à cette différence près que pour Thomas d'Aquin comme pour Suarez, « c'est la vision béatifique qui commande la connaissance », alors que c'est l'inverse pour Spinoza. Pour l'auteur, c'est le refus de toute création qui a conduit Spinoza à retrouver le modèle théologique de la vision béatifique comme moyen d'accès à la connaissance adéquates des choses et de Dieu. Le consentement et le discernement seraient-ils dans l’inceste le gage qu’il n’y a pas de violence? À lire la loi française telle qu’elle est et à entendre la défense de beaucoup de parents incestueux, la soumission du sujet incesté à leur entreprise serait la preuve d’une non-violence. Or, l’inceste est violence quelle que soit la façon dont les actes sexuels qui le réalisent sont commis parce que l’inceste ne se réduit pas à l’illégalisme de l’acte sexuel. Les cas cliniques et (...) judiciaires dans lesquels l’allégation d’inceste consenti a été énoncée montrent que l’inceste n’est en fait jamais consenti pour ce qu’il est concrètement : un acte sexuel entre deux personnes interdites de mariage, mais qu’il est toujours une violence absolue dont la mentalisation ne vient que longtemps après. Ce que les victimes ont pu croire, même après révélation des actes, c’est que leur place d’enfant et la relation à celui qui les agresse passent par la confusion entre désir sexuel et désir de lien, la notion d’inceste étant indicible. This chapter ventures into a deeper interpretation of the concept of cogito, ergo sum. The chapter begins with a presentation of the newly-reborn challenge and contact of Descartes' thoughts to contemporary philosophy. One such contact was Henry's use of “material phenomenology” to interpret Descartes' hermeneutic. The chapter emphasizes that this particular line gives access to an original and powerful understanding of the cogito, ergo sum, and not only that its phenomenological repetition pulls the Cartesian ego out of the aporias for (...) which the greatest interpreters—Kant, Nietzsche, Husserl, Heidegger—had opposed it, but above all that this line opens absolutely new perspectives on the whole of Descartes' work. In particular, the chapter argues that it would in this way seem possible to reestablish, in the “I think, therefore I am” which generosity finally effects, the unity long missing between the love of wisdom and the search for truth. La question de la peinture n'appartient ni d'abord, ni uniquement aux peintres ou aux esthéticiens. Elle appartient à la visibilité elle-même, donc à tous. A dire vrai ou plus exactement à tous ceux pour qui voir ne va pas de soi. Et c'est sans doute pourquoi la philosophie ne peut que se trouver, quand il y va de la peinture, à demeure. En effet, la philosophie a pris aujourd'hui une figure essentielle, la phénoménologie ; or la phénoménologie ne prétend revenir (...) aux choses mêmes que parce qu'elle entreprend d'abord de voir ce qui se donne - ce que cela donne. La visibilité exceptionnelle du tableau devient alors un cas privilégié du phénomène, éventuellement une voie vers la phénoménalité en général. Mais la phénoménologie suffit-elle à cerner la visibilité et donc tous les tableaux possibles? Le tableau n'admet-il lui-même qu'un seul statut, ou ne ménage-t-il pas d'autres ressources? En passant de l'idole à l'icône, nous poursuivons certes des recherches antérieures, mais nous suivons surtout la nécessité de la chose même : le tableau, donc le visible par excellence, s'offre au dilemme de deux figures d'apparition, inverses, adverses et pourtant indispensables, inséparables. La théologie devient, dans cette situation, une instance irrécusable de toute théorie du tableau. Pour l'avoir parfois dénié, puis simplement oublié, la pensée esthétique s'est parfois empêtrée dans de longues apories. Among the many difficulties, or even paradoxes, that phenomenology has imposed upon us by positing itself as a doctrine, or at least as a radical foundation for philosophy, one must first and foremost consider the operation typically referred to as the reduction. The reasons for detecting difficulties therein are many, but they take on even greater significance since Husserl proclaimed the reduction to be fundamental to any philosophy that wished to establish itself as a phenomenology. The history of phenomenology, then, (...) would appear not only as the history of all the difficulties encountered in the reduction, but principally as the history of Husserl’s own self-elucidation of his entire project. This brings us to the point of reformulating Ricoeur’s claim—that phenomenology is the sum of misinterpretations of Husserl’s doctrine—with this new contention: that phenomenology consists in the sum of discussions and disagreements about the doctrine and practice of the reduction. The four talks collected here transcribe lectures delivered to an audience of children between the ages of ten and fourteen, under the auspices of the little dialogues series at the Montreuil's center for the dramatic arts. Modeled on Walter Benjamin's Aufklrung for Kinderradio talks, this series aims to awaken its young audience to pressing philosophical concerns. Each talk in God, Justice, Love, Beauty explores what is at stake in these topics as essential moments in human experience. (Indeed, the book argues (...) that they are constitutive of human experience.) Following each, Nancy's audience is given a chance to engage with him in a process of philosophical questioning; the texts of these touching and probing exchanges are included in the volume. Despite the fact that these lectures were delivered to an audience of children, the intellectual level they achieve-while remaining easily comprehensible-is astounding. No attempt is made to simplify Nancy's positions or to resolve the complexities that arise in the course of the talks or the question periods that follow. The work of opening performed here is fully in keeping with the strategy of Nancy's philosophy as a whole. Thus, for readers unfamiliar with his work, God, Justice, Love, Beauty will function as an excellent introduction to Nancy's larger corpus. As varied as the individual talks are, they share the motif of incalculability or the immeasurable. Broadly speaking, one could say that the various ways in which Nancy approaches this motif exemplify his deconstructive approach to think of human existence. As well, those treatments exemplify his conviction that the task of thinking is to develop original ways of communicating the incalculable.God, Justice, Love, Beauty is thus a skillful reminder that philosophy is important to all of us. The book is also a model of intellectual generosity and openness. Seamlessly moving from Schwarzenegger to Plato, from Kant, Roland Barthes, and Caravaggio to Caillou, Harry Potter, and the pages of Gala magazine, Nancy's wide-ranging references bear witness to his commitment to think of culturein its broadest sense. La question des relations entre expertise scientifique, société et politique est fondamentalement communicationnelle. Souvent présenté comme univoque et incontestable, l’avis des experts ne fait pas taire les controverses. Il est élaboré dans le cadre de relations toujours incertaines, mobilisant les multiples parties prenantes de l’objet de l’expertise dans une situation sociale. Les connaissances qui en résultent constituent, quelque part, des récits qui relèvent de multiples interprétations et recadrages traduisant des logiques d’action hétérogènes, des intérêts économiques et politiques contradictoires, des tensions (...) et des conflits. Ce mouvement s’opère en lien étroit avec les médias et réseaux, au travers desquels les résultats de l’expertise sont diffusés, et de plus en plus souvent discutés.The question of relationships between scientific expertise, society and politics fundamentally revolves around communication. Though often presented as unequivocal and indisputable, expert scientific opinions do not put an end to controversy. They are developed in the context of relationships that are always uncertain, involve many different stakeholders with an interest in the object of the controversy and exist in a social situation. The resulting knowledge shapes narratives that can be interpreted and framed in many different ways, each reflecting different reasons for action, conflicting economic and political interests, tensions or disputes. This process takes place in close conjunction with the activities of the media and networks, through which expert conclusions are broadcast and increasingly debated. (shrink)

La présente contribution propose un panorama des représentations géographiques des lettres à Timothée et Tite, aussi appelées les Pastorales. À l’aide du concept de « carte mentale », elle montre comment les trois lettres remanient la perception spatiale du champ d’action paulinien d’est vers l’ouest, au tournant du ier et du IIe siècle. Le déplacement spatial identifié correspond à la majorité des études historiques qui situent les trois lettres parmi les premières réceptions de Paul. Il met également en évidence les (...) soubassements géographiques de la reconfiguration de la notion d’oikos dans ces premières réceptions, souvent occultés dans les études sur l’univers domestique des Pastorales. Cet article pave ainsi la voie à l’étude de la maison romaine dans les trois lettres proposée dans ce numéro par Michael Theobald. (shrink)

Of the thousands of HMs that have arisen over the ages, only a small number survive today, drawing their power and longevity mostly from their superior ability to act as a placebo within the context of modern-day culture, rather than through any other mode of action.When it comes to HMs, Western scientific culture has not yet evolved beyond a pre-scientific stage (Fancher 1995). A scientific analysis of the part played (...) by practitioner/subject empathy and other emotional influences within the healing situation is needed. Passer de l’un à l’autre impose sans doute à notre vision l’une des plus radicales transformations, métamorphoses, bref modifi cation de la fi gure qui se puisse concevoir, ou justement qui ne se peut pas concevoir. The Common that is Least Common. It is not a mere accident if the notion of The Common designates both what is shared by several and something which is banal or trivial. Nothing is more shared than that which is most ordinary. The consequence is that the representations of a « Communism » -even if we leave aside the reference to the various regimes which appropriated the idea of « communism »- are so easily charged with the mistrust which is (...) addressed to the idea of levelling, and with the accusation of seeking to liquidate distinction and superiority. What is collective is accused of stifling originality. « Real » communisms did nothing to try to project a different image. However the communist idea need involve nothing that is « common ».
